  • What is an auction property?An auction property is a property, be it residential or commercial, that goes up for sale through an open and competitive process whereby interested buyers will place bids on it. The buyer who makes the highest bid during the auction process will get to buy the property as long as the bid price meets or exceeds the reserve price.

    Once the hammer falls, the legal binding contract is set between the seller and purchaser, a deposit is paid and a set completion date is confirmed. The auctions are the most effective way to recognize, create and channel demand.

    Identify your desired property according to your preferred location and budget. Take note of all relevant information of the property.

    Conduct an external inspection of the property to ascertain the condition of the property.

    What are secondary sale properties?Secondary sale properties are properties that have been foreclosed and acquired by the Bank or its subsidiaries as bidder of last resort during auctions. It also refers to properties that are acquired by the Bank or its subsidiaries, arising from compromised settlements with borrowers. The ownership of these properties lies with the Bank or its subsidiaries. CIMB Property Mart sells these properties through negotiated sales with interested buyers.

    Additionally, secondary sale properties also consist of properties owned by third parties or the Banks customers who have enlisted CIMB Property Marts assistance to market these properties. Interested buyers or Real Estate Agents (REA) will then negotiate directly with the owners or the Banks customers for the sale.

    Get further details on the selected property from CIMB Property Mart.

    Interested buyers/REAs are required to fill up the Offer to Purchase Form and submit to CIMB Property Mart, together with a 2% earnest deposit or RM1,000, whichever is higher, in the form of a bank draft payable to CIMB Bank Berhad. If represented by a panel REA, the interested buyer should ensure that the REA signs the Offer to Purchase Form.

    Take note of the auction time, date and venue. Prepare a bank draft or cashiers order for the deposit amount equivalent to either 5% or 10% to the Reserve Price before the auction date.

    On the auction day, please ensure that you reach the auction venue earlier and register at the auctioneer registration counter.

    The auctioneer will announce the commencement of the auction, and then provide a briefing on the bidding process. He/she will then read out the important clauses in the COS and property information.

    The bidder is to raise his/her bidding card to indicate the bidding price. The bidding process will stop when the highest price is called out 3 times by the auctioneer and no further bids are made. At the fall of the hammer, the property is sold.

    The successful bidder is required to sign Contract of Sale and pay the difference on the deposit sum between the successful bidding price and the reserve price, if there is an increment in bidding price. The balance of the purchase price must be paid within the time frame given.

    If you are not the successful bidder, you may redeem your bank draft or cashiers order at the registration counter immediately after the auction.

    CIMB Property Mart will revert within 30 days. If offer is accepted, the interested buyer will receive a Letter of Award (LOA). From the date of LOA issuance, the successful buyer is required to sign the Sale and Purchase Agreement (SPA) and pay a 10% deposit within 30 days thereof. This includes a 2% retention sum for Real Property Gains Tax purposes. If the offer is rejected, CIMB Property Mart will refund the 2% earnest deposit submitted earlier, free of interest.

    Balance 88% of the purchase price (less retention sum) is payable within 3 months from the SPA date or 1 month after the SPA becomes unconditional, whichever is later.

    The property is sold on an as is where is basis, with no warranty or representation on title, description, fitness for purpose, quality, condition or vacant possession of the property either expressed or implied.

    Interested buyers are advised to inspect the property and conduct the necessary searches or enquiries with the relevant authorities, prior to submitting their offers.

    End-financing is available from CIMB Bank for eligible buyers.

    Stamp duty and registration fees, in respect of the transfer of property, will be borne by the buyer. The buyer should appoint their own solicitors to represent them in the sale transaction. The SPA will be prepared by the banks solicitors and legal fee, in respect of the SPA, is borne by the bank. The buyer will be responsible for legal fees charged by their own solicitors.

    The outstanding quit rent and assessment prior to the SPA date will be absorbed by the bank. Buyers will be responsible for payment of quit rent and assessment after the SPA date. All other outstanding outgoings e.g. maintenance charges and utilities will be borne by the buyer.

    A: The outstanding quit rent & assessment will be borne by the bank, up to the date of auction. However, the payment of the outstanding maintenance and utilities charges will be subject to the terms and conditions stated in COS. Interested bidders are advised to read the relevant clauses of the COS.

    8. Q: What if the Successful Bidding Price is higher than the Reserve Price?

    A: Be prepared to top-up the difference on the deposit sum between the Final Successful Bidding Price and the Reserve Price by cash immediately after the auction. Please ensure that the final price or the purchase price is within your budget. If you have a limited budget, you can always find out from any CIMB Bank loan officer whether you are eligible for a financing of the balance of the purchase price, prior to the auction.

    9. Q: Do I need to appoint my own lawyer to handle the transfer of property ownership?

    A: Yes, you need to appoint your own lawyer to act on your behalf to execute the transfer of the property ownership. The lawyer attending the auction will act on behalf of CIMB Bank Berhad only.

    A: The duration is either 90 days or 120 days from the auction date, depending on the Conditions of Sale. Thus, should you wish to obtain financing, it is advisable to apply the same as soon as possible after the auction.

Pembeli yang menawarkan bidaan tertinggi semasa proses lelongan akan dapat membeli hartanah tersebut asalkan harga bidaan mencapai atau melebihi harga rizab. Selepas ketukan tukul terakhir, kontrak yang sah telahpun ditetapkan antara penjual dengan pembeli, deposit dibayar dan tarikh penyempurnaan akan ditentukan.     Hartanah Jualan Sekunder

    Apakah itu hartanah jualan sekunder?Hartanah jualan sekunder (secondary sale properties) ialah hartanah lelongan yang diambilalih oleh pihak Bank atau subsidiarinya sebagai pembida dalam lelongan terakhir. Ianya juga merujuk kepada hartanah yang diperolehi oleh pihak Bank atau subsidiarinya daripada peminjam dengan cara penyelesaian berkompromi. Hak milik hartanah-hartanah ini dimiliki oleh pihak Bank atau subsidiarinya. CIMB Property Mart berunding dengan pembeli yang berminat untuk menjual hartanah tersebut. Selain itu, hartanah ini juga terdiri daripada hartanah yang dimiliki oleh pihak ketiga atau pelanggan bank yang telah mendapatkan khidmat CIMB Property Mart untuk menjual hartanah tersebut. Pembeli yang berminat / REA akan berunding secara langsung dengan pemilik atau pelanggan bank tersebut untuk urusan jualan.

    Pembeli yang berminat dinasihatkan untuk memeriksa keadaan hartanah tersebut dan membuat carian / pertanyaan yang sewajarnya dengan pihak berkuasa berkaitan sebelum menghantar tawaran mereka.

    Pembiayaan disediakan oleh CIMB Bank untuk pembeli yang layak.

    Duti setem dan bayaran pendaftaran berkaitan pemindahan hartanah akan ditanggung oleh pembeli. Pembeli perlu melantik peguam mereka sendiri untuk mewakili mereka dalam transaksi jualan. SPA akan disediakan oleh peguam bank dan bayaran guaman berkenaan SPA akan ditanggung oleh bank.     5. S: Siapakah yang akan menanggung cukai tanah, cukai taksiran, kos penyelenggaraan dan bil-bil utiliti yang tertunggak?

    J: Bayaran cukai tanah dan taksiran yang tertunggak setakat tarikh lelongan akan ditanggung oleh pihak bank. Namun tunggakan kos penyelenggaraan dan bil-bil utiliti akan bergantung kepada terma dan syarat seperti yang termaktub dalam Syarat-syarat Jualan (COS). Pembida yang berminat dinasihatkan supaya membaca klausa yang releven dalam COS.

    6. S: Apakah kelebihan membeli hartanah lelongan?J: a) Ia merupakan satu pelaburan yang bijak kerana hartanah

    lelongan dijual pada harga pasaran yang adil tanpa perlu melalui proses tawar menawar yang berpanjangan.

    b) Risiko projek perumahan terbengkalai dapat dielakkan.c) Membeli hartanah lelongan melalui proses jual beli yang

    pendek.d) Dilelongan CIMB Property Mart terdapat pelbagai jenis

    J: Jika anda tidak dapat hadir pada hari lelongan, anda boleh membenarkan sesiapa yang berusia 18 tahun dan keatas untuk membida bagi pihak anda. Walaubagaimanaupun, wakil pembida mesti membawa bersama surat kebenaran yang asli bersama dengan salinan fotostat kad pengenalan anda dan Bank Draf ke lelongan tersebut.
