Approval of the Previous Minutes –November 1, 2018

The Chair asked if there were any corrections to the minutes of the November 1, 2018 meeting. There being no amendments, upon a motion by Ms. Daub, seconded by Ms. Boyer, it was voted on and unanimously carried to approve the minutes of the November 1, 2018 meeting as circulated.

Education Committee Report – November 1, 2018 Meeting Ms. Daub reported on the recommendations of the Education Committee’s

November 1, 2018 meeting (see attached report) and motioned to approve/accept the report and recommendations, it was seconded by Ms. Boyer and voted on and unanimously carried to approve/accept the report and recommendations of the November 1, 2018 Education Committee.

Executive Officer’s Conferences/Seminars/Meetings Report:

The EO announced that she would like all the Board members to attend at least one NCSBN meeting or seminar. The next scheduled meeting is the mid-year and the Chair or Vice Chair can attend with another Board member since the NCSBN can sponsor up to 2 individuals. The mid-year meeting will be held March 26-28, 2019 in San Antonio, Texas, so if anyone is interested and available, to let her know and she will discuss with the Chair/Vice Chair.

Nursys – Status Report

The EO reported that we were not able to “go-live” on November 5, 2018 as was previously reported. There were some “glitches” and Hawaii went “live” with Nursys on November 13, 2018.

Remedial Course Approval ReMar Online Academy

The EO reported that exam applicants are now calling about which remedial course to take and that she did receive a request for approval from Remar Online Academy. According to the email request, the RN and LPN NCLEX Review Course is 6-weeks long and consist of NCLEX lectures, homework, timed-quizzes and NCLEX practice exams.

The Board members who tried to find this online course said it did not include a

practical or clinical component and does not meet the definition of “Remedial course” in HAR §16-89-2.

Consequently, it was the consensus of the Board to not accept this online course

as meeting the remedial course requirement for exam applicants because it appears to be an NCLEX review course as opposed to a remedial course that includes both the didactic and clinical components to ensure the individual’s competency to practice as a nurse.

Discussion of Definition of “Remedial course” in HAR 16-89-2 The Board deferred to the previous discussion on this definition. 2019 Legislative Session

Proposed Legislation to Amend HRS Chapter 321 to include APRNs to Act as a “Medical Director”

The EO reported she received an email from Laura Reichhardt, Director, Hawaii State Center for Nursing (“HSCFN”) regarding legislation to draft a bill to amend the definition of medical director in HRS Chapter 321, Relating to Health under the authority of the Department of Health, but is unclear as to which section is being amended and that Ms. Stacy Kracher is here to provide more clarification.

The Board decided that until they can see the actual bill/legislation, they could not

take a definitive position but would consider the proposed amendment at a later date when the bill becomes available.

At this point the EO called on Ms. Kemp and Ms. Walch, both from the American

Nurses Association in Hawaii to do a brief report on any legislative proposals.

Ms. Kemp stated that they are here to represent the ANA in Hawaii and to offer their support for the Board. She reported that currently they have 256 members and will be disseminating a survey in which they hope to receive at least a 50% positive response.

Continuing Competency: Updates to Continuing Competency Booklet No change in status from the last report.

Hawaii Nursing Continuing Competency Preceptor Activity for Nursing Employees Form Created by the HSCFN

Ms. Muraoka from the HSCFN asked if the Board had any questions on the

preceptor form for nursing employers and students.

The Board asked for more time to review for further discussion at the January meeting.

The EO asked the Board members to provide her with recommendations by the

end of the year so that she could forward to Ms. Muraoka for discussion at the January 2019 meeting.

Research Nurse – Certified Tumor Registrar The Chair led the discussion on the following email inquiry: “I’m concerned about the new Nursing License Requirement for June 2019. I am

a Research Nurse for Kaiser Permanente. I have carefully reviewed the list on the nursing website. This list does not offer what I need to maintain my position here at Kaiser Permanente as a Research Nurse.

Kaiser hired me because I am also a Certified Tumor Registrar (CTR) through the

National Cancer Registrars Association (NCRA). NCRA requires me to maintain my CTR status with CEU’s that are offered thru the North American Association of Central Cancer Registries (NAACCR). They are partners with the Center for Disease Control (CDC), National Cancer Institute (NCI), National Program of Cancer Registries (NPCR), and Surveillance, Epidemiology, and End Results Program (SEER).

My question: Am I able to renew my RN license in June 2019 by submitting the

CEU’s that I earn for my CTR status. The courses are live or recorded webinars/training sessions (3 hrs) that cover specific cancer areas (Breast, Colon, Brain, Lung, Leukemias, Lymphomas, etc). It includes a test at the end that must be passed to get credit for the 3 hr webinar/training session. They require 20 CEU’s/2years. I usually do more than 20 & can do 30 hrs if needed for my RN license renewal.”

After some discussion, it was the consensus of the Board that CEUs that are

provided by an organization approved by the Board, as indicated on page(s) 19-20 in the Continuing Competency booklet would be acceptable towards the CE learning activity option.

Request for Approval of Education Activity from Maui Memorial Medical Center

Prior to the discussion, Ms. Kodama recused herself from this agenda item. The Chair led the discussion on the following email inquiry:

“I have talked to my team and we have decided to submit to the board (for continuing education credit) the attached activity. We recently identified a gap and education need regarding key concepts in the nursing care of our stroke patients. As one of The Joint Commission’s measures, we decided that it is imperative that we provide our nurses this continuing education and training.

The attached form documents the identified need for such training and our

proposed educational activities.

It is our hope that this proposal will be approved. Please let me know if there is anything else we can provide your office to assist with the deliberation or for any questions you may have. Thank you for your consideration.”

The Board members reviewed the information contained in the “Application for CE

Certification of an Educational Activity” that was attached to the email inquiry. It was the consensus of the Board to approve the May 2019 and October 2019

offering of this course as meeting part of the continuing education learning activity option. However, any substantive changes to the information provided shall require Board review/approval.

Post Graduate Nursing Course in Ed from University of Tasmania The Chair led the discussion on the following email inquiry:

“I am Liza Kaneda. I am a Registered nurse currently practicing in Australia. I have been working as a clinical nurse in emergency department for the past 3years. I did get my Australian nursing license through the Hawaiian Nursing license. My original nursing license is Hawaiian nursing license i graduated my BSN degree from Hawaii. I am currently taking a post-graduate nursing course in ED from University of Tasmania, would this count as my continuing education for license renewal? It is not accredited by the list of boards mentioned at the website. Please let me know what i should do. I do need my Hawaiian nursing license. I can provide with the certificate of completion of the graduate certificate degree. Thank you for your time.”

After some discussion, it was the consensus of the Board to inform Ms. Kaneda

that HRS §457-9.3(a)(4) refers to an “accredited nursing program” related to nursing practice and that an “accredited” nursing program means accredited by an organization recognized by the U.S. Department of Education. Also, the Board noted that in the email, Ms. Kaneda was taking a post-graduate nursing course in ED which will require further clarification in order to meet the definition.

Dr. Napoleon noted that in Ohio, a bill was introduced on Ancillary Professions that proposes to change the professional title of registered veterinary technician to registered veterinary “nurse”.

Clarification on HRS §457-7(b)(2) and 457-8(b)(2) – “Employment with a

Hawaii Employer” The EO asked the Board for clarification the following sections, specifically when it

refers to a “Hawaii employer”:

§457-7 Registered nurses; qualifications; licenses; fees; title; existing licensed nurses; verification of licenses; eligibility. "(a) An applicant for a license to practice nursing as a registered nurse shall submit:

(b) Licenses shall be granted either by:

(2) Endorsement: The board may issue a license to practice nursing as a registered nurse by endorsement to an applicant who has been licensed as a registered nurse under the laws of another state, territory, or foreign country if the applicant has an unencumbered license and, in the opinion of the board, the applicant meets the qualifications required of registered nurses in this State at the time of graduation. Pending verification of a valid, unencumbered license from another state, a temporary permit may be issued for employment with a Hawaii employer.

§457-8 Licensed practical nurse; qualifications; license; fees; title;

existing licensed nurses; verification of licenses; eligibility. (a) An applicant for a license to practice nursing as a licensed practical nurse shall submit:

of a valid, unencumbered license from another state, a temporary permit may be issued for employment with a Hawaii employer.

The EO explained that a local health care staffing organization that employs

nurses in facilities and home health care settings ran into issues when their employees tried to apply for a Hawaii temporary nurse license. She further explained that the Licensing Branch was “instructed” to issue only if the temporary permit application was signed by a Hawaii “facility”, i.e. hospital, etc.

She stated that when she double checked the statutes, it only referred to “Hawaii

employer” and not specifically a practice setting.

Consequently, it was the consensus of the Board that a temporary permit may be issued to a qualified applicant for a “Hawaii employer” and not necessarily a practice setting. The Board further clarified that out-of-state staffing agencies would not meet the “Hawaii employer” since they are not located in Hawaii and therefore we can continue to issue the temporary permit to qualified applicants if the temporary permit is signed by an authorized person for a local practice setting.

Scope of Practice Can LPNs Take Verbal Orders? The Chair asked the Vice Chair to lead the discussion on the following email

inquiry:

“Can you please tell me if Licensed Practical Nurses (LPNs) can take verbal orders?”

The Vice Chair stated that although not specifically addressed in the nurse practice act, specifically under the definition of “The practice of nursing as a licensed practical nurse” under HRS §457-2, under this definition, it does require an LPN to be under the direction of a dentist, physician, osteopathic physician, registered nurse, osteopath, or podiatrist or physician assistant. She also noted that the LPN should follow the policies and procedures of the practice setting/employer, however, ultimately, the LPN is accountable and responsible for the quality of nursing care rendered.

Ms. Boyer pointed out that the practice setting policies and procedures may differ depending according to what kind of facility it is, i.e. acute care vs. long term care.

Ms. Kodama had concerns with patient safety.

After further discussion, it was the consensus of the Board to concur with the Vice Chair’s response.

Exclusionary Formulary - APRNs Prescribing Testosterone Medications to Treat Medical Issues Such as Hypogonadism or Chronic Fatigue Secondary to Low Testosterone Level

The Chair asked Dr. Napoleon to lead the discussion on the following email

inquiry:

“My name is Jae Hwan Kim, and I am a APRN with prescription authority (Hawaii Lic #: APRN-1886). I have questions regarding the exclusionary formulary for APRN-Rx published in August 2016

Background: In the exclusionary formulary for APRN-Rx published in August 2016, it was mentioned that "an APRN with prescriptive authority shall NOT prescribe, administer or dispense, shall consist of: ... Human Growth hormones, anabolic steroids, or hormones for performance enhancement or decreasing the impact of aging".

My questions are the following: 1. Can an APRN prescribe testosterone medications to treat medical issues such as hypogonadism or chronic fatigue secondary to low testosterone level? 2. What does "performance enhancement" mean in the article? Does it mean a sports performance specifically? “

Dr. Napoleon stated that the Exclusionary Formulary specifically lists “Human Growth hormones, anabolic steroids, or hormones for performance enhancement or decreasing the impact of aging”. She stated that it is not prohibited in the nurse practice act and that he should refer to the Decision-Making Framework on the Board’s web page. The Board discussed that “performance enhancement” was not defined and that perhaps the Board should re-review the exclusionary formulary. After further discussion, it was the consensus of the Board to refer Mr. Kim to the Decision-Making Framework on the Board’s web page.

RNs “suggesting” OTC Medication

The Board discussed the following email inquiry: “I am contacting you regarding Hawaii Nursing State Board’s view on RNs

suggesting OTC medication. I was an Occupational Health Nurse-Telephonic Triage and quit my nursing

position as the nursing practice at that company was in conflict with some of the Nursing State Boards (including Hawaii) and included RNs suggesting OTC medication which was placing my RN license in jeopardy.

Can you please provide a brief statement in a letter regarding Hawaii Nursing State Board’s view on RNs suggesting OTC medication with the information?”

Ms. Kodama stated that there should be protocols or standing order(s).

The Vice Chair referred to the definition of “Scope of practice as a registered nurse” under HRS §457-2 that states: "The practice of nursing as a registered nurse" means the performance of professional services commensurate with the educational preparation and demonstrated competency of the individual having specialized knowledge, judgment, and skill based on the principles of the biological, physical, behavioral, and sociological sciences and nursing theory, whereby the individual shall be accountable and responsible to the consumer for the quality of nursing care rendered. The foregoing may include but shall not be limited to observation, assessment, development, implementation, and evaluation of a plan of care, health counseling, supervision and teaching of other personnel, and teaching of individuals, families, and groups in any stage of health or illness; administration, supervision, coordination, delegation, and evaluation of nursing practice; provision of health care to the patient in collaboration with other members of the health care team as autonomous health care professionals providing the nursing component of health care; or use of reasonable judgment in carrying out prescribed medical orders of a licensed dentist, physician, osteopathic physician, or podiatrist licensed in accordance with chapter 448, 453, 460, or 463E; orders of an advanced practice registered nurse licensed in accordance with this chapter; or the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician. This definition allows the RN to perform an assessment but not necessarily to provide a diagnosis for which may be required in order to “suggest” any medication, including OTC drugs. Consequently, it was the consensus of the Board that an RN may not “suggest” an OTC drug/medication. In accordance with HAR § 16-201-90, the above interpretation is for informational and explanatory purposes only and based solely on the information provided. It is not an official opinion or decision and therefore not binding on the Board.

voted on and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1), “To consult with the board’s attorney on questions and issues pertaining to the board’s powers, duties, privileges, immunities, and liabilities”.

At 11:48 a.m. upon a motion by the Vice Chair, seconded by Dr. Napoleon, it was voted on and unanimously carried to move out of executive session.
