Bill to Give Priority to Reman PartsH.R.4056 Introduced into the House of Representatives

H.R. 4056, the Federal Vehicle Repair Cost Savings Act of 2014, was introduced by Rep. Gary Peters (D-MI) on February 11th. This bill is designed to increase awareness of cost benefits, and encourage the use of remanufactured parts within the federal gov-ernment. Though agency fleet managers still have final discretion of their use, remanu-factured parts are to be given priority as long as they reduce costs, do not lower vehicle performance, and do not delay the vehicles return to service.

In a report issued by the Government Accountability Office (GAO) in 2011 they confirmed that:

• 588,000 civilian Federal fleet vehicles were serviced at a cost of nine hundred seventy five million dollars ($975,000,000).

• Remanufacturered vehicle components tend to be less expensive.• The US Postal service relies on remanufacturing to reduce their vehicle repair

costs.

According to Mark Kothe, COO of APRA, “H. R. 4056 is a definite win for remanu-factured products. Everyone reading this article should write to their Congressmen and request that they support H.R. 4056 today!” r

Well, the year end financials are out for all of the OEM’s. The Big 3 had a good year as well as all the truck companies except for Navistar who still showed a loss.

This is great news for Remanufactur-ing. Why? Because this is somewhat our “crystal ball” or the next best thing to having one. Whatever vehicles and trucks that were built last year will be remanu-facturing candidates in 3-5 years from now. With the Big 3 building more than 15 million vehicles in the USA last year, that will be good news for remanufactur-ers when that model year hits maturity.

So lets go back in time to 2009 when the automotive manufacturers built only 11 million vehicles. Our “crystal ball” tells us we will have fewer vehicles in the market beginning about now, depending on the warranty purchased and the age of the ve-hicle. So if I was to guess, I would say the market for remanufacturing would be flat this year, or at least I would be conserva-tive on my projections, that is unless you are adding new products to your portfolio to compensate for the reduced vehicle park in the market. The good news is that we are heading in the right direction as new vehicle production increases.

I was reading the The Rhein Report the other day, which is where I got my financial information regarding the truck market, and they had a joke within the report that I thought it was pretty funny so I wanted to share it with you. A little hu-mor never hurts and hopefully will bring a smile to your face.

A shepherd was herding his flocks in a remote pasture when suddenly a brand new BMW advanced out of a dust cloud towards him. The driver, a young man in an Armani suit, Feragamo shoes, Ray Ban sunglasses and an ESL tie leaned out of the window and asked our shepherd:

“If I can tell you exactly how many sheep you have in your flock, will you give me one?”

The shepherd looks at the guy, then at his peacefully grazing flock and calmly answers, “Sure!”

The young man parks the car, whips out his cell enabled tablet, takes several photos with the tablet, then calls up im-age recognition software, and after some screen tapping, he says “You have here 156 sheep!”

“This is correct. As agreed, you can take one of the sheep," says the shepherd. He watches the young man make a selection and bundle it into his BMW. Then he says: “If I can tell you exactly what your busi-ness is, will you give me my sheep back?”

“Okay, why not,” answers the young man.

“You are a consultant," says the shep-herd.”

“That's correct," says the young man. “How did you guess that?”

“Easy!,” answers the shepherd. “You showed up here even though nobody called you; you want to get paid for an answer I already knew, to a question I never asked, and you don't know anything about my business, because you took my dog.”

APRA Speaks at the RLA Conference in Las Vegasby George Davis, APRA Technical Director

APRA attended the Reverse Logistics Association Conference and Exhibition in Las Vegas, Nevada. The exposition was held on February 10-13 at the Rio Hotel. The Rio is the same hotel that will host the 2014 Big R/ReMaTecUSA Show.

Reverse logistics is the movement of material from the consumer back to the supplier. In most industries this is the opposite of most business plans.

Parts may be returned for many reasons. This is especially true since most sell-ers these days have very liberal return policies. Parts may be returned because they are out-of-date or because they have exceeded their contract lives (i.e. cell phones), or simply the customer may no longer want them. In many cases these parts are reworked, repacked and sold at a discount. Warranties vary from product line to product line. Almost everything that is sold has a reverse logistics compo-nent—cell phones, cameras, tablet PCs, clothing, etc.

The RLA Conference and Expo is some-what different from the Big R Show. At

this Expo the speakers are the dominant factor with relatively few exhibit booths. APRA's President, Joe Kripli, spoke about the remanufacturing industry’s history and future, placing a strong emphasis on the increased electronics and control modules found on newer passenger car applica-tions.

There are some possible synergies between automotive remanufacturing and reverse logistics. The business model itself is similar to our industry, except for the fact that in remanufacturing the core return portion of our business provides our raw materials, and is not a burden.

There were businesses at the show spe-cializing in software to control reverse logistics. This software is built with a component to track cores through several different transactions and may be of inter-est to APRA members who are looking for a stronger core management program. Additionally, there are commonalities with scrap metal companies. At the RLA Expo there were companies specialized in buy-ing electronic boards that have outlived their usefulness.

We have invited a number of attendees to exhibit at the 2014 Big R/ReMaTecUSA. We believe this will provide opportunities for APRA members to grow. r

Regardless of the unbear-able cold and lots of snow this winter, the months of February, March and April are the tech train-ing season in my area, the Midwest and

the Great Lakes region. As a person who has been involve with a lot of training venues, these months are busy times for traveling and teaching various classes.

Starting with Auto-Value/Bumper-to-Bumper annual Expos in Grand Rapids, Michigan, and Chicago, Illinois, to the amazing Vision Hi-Tech Training and Expo in Overland Park, Kansas (just outside of Kansas City), to 2014 ERA’s Trade Show in Atlanta, and back to Chicago for the 2014 Auto TECH Expo (formerly ShowPower) in early April. It all requires a lot of preparation and traveling and given this year’s weather, I hope it will go without a serious hitch.

During these sessions, especially when

my audiences are technicians, I try my best to explain our side of the rebuilding business as it relates to proper diagnosis to reduce bogus warranty returns. Working with a newer generation of technicians, I realize a good number of them are not familiar with the concept of rebuilding or have a very low opinion of it, given re-building rotating electrical has practically been dropped from most technical college curriculums and instead the information the students get is simply at the replace-ment level.

Now getting back to my column, since any shortcomings in the charging system and any effects of excessive parasitic drain are intensified by the extreme cold we have been encountering this winter, I will point out a couple of such cases— one easy to find and the other, not.

Hard Starting PT CruiserA 2003 PT Cruiser showed up for an ap-pointment where the owner’s concern was a persistent overnight battery run down, sometimes to the point that even a jump start wouldn't get it going. I was told the battery had already been replaced by an auto part store counterperson.

The day the car was brought in, the

temperature was hovering around 0°F. Consequently, our first look into the bat-tery found it to be solid ice. Charging it was delayed for a day so the battery could thaw out!

The battery did not make it. After nearly three full days of slow charging with our CTEK charger the electrolyte concentra-tion didn't change — our hydrometer showed the make-up to basically be water. Obviously this rather new battery was wasted by repeated run-downs and freeze ups.

A detailed testing of the vehicle showed that it was fine, all the modules would power down, and eventually the drain would subside to a comfortable 22mA that should not cause a battery drain.

We found the actual cause of the battery drain quite by accident. After multiple times of taking the key out of the igni-tion, closing the doors and allowing the modules to time out so we could measure the battery drain, once we observed that the clock on the face of the radio was still on and the digits brightly visible. This unusual case was caused by a worn ignition switch that allowed the key to be pulled out when the switch was actually in accessory position. The owner could have simply made the same mistake we did by pulling out the key from the igni-tion switch while in “ACC” position, and causing a 500mA drain that would then discharge the battery.

Another battery was supplied by the auto part store, and the car owner, a young graduate student from a warm Mexico City was taught how to pull the key out properly. I am sure the experience of the frozen battery in the January tundra of Illinois is something this young man will

never forget for rest of his life!

2006 Acura Battery Run-downWe had scheduled a 2006 Acura TL with a common complaint — the battery was go-ing down after a day or two of sitting idle, and would not start unless jumped.

A preliminary check of the charging and starting systems, and the battery showed they were all in order. The battery was ac-cepting a charge and overall it showed to be fine, albeit a little discharged.

While keeping the system alive using an external power source, the ammeter was inserted into the system to show a whopping 350mA drain that occasionally peaked to 600mA. Removing fuses one at a time (while keeping the door switches closed) did not affect the drain, until the fuse #6 was pulled, which eliminated the drain.

Whatever circuit was causing the drain was related to this fuse. Since we had nar-rowed it down, we thought a simple check of the wiring schematics would guide us directly to the offender. Well, it did, but not that directly.

As the schematic shows (Figure 1), the circuit protected by a mere 7.5 amp fuse fed 12 items. Eight of them were a variety of illumination lights, such as the vanity mirrors and trunk light, and the other four were four different control modules. Due to the small size of the fuse, we assumed this would be mostly a sensing or keep-alive-memory kind of thing, and not the actual power feed to these modules.

Each module (power seat, keyless entry, power mirror control) was located and disconnected, which is a challenge by itself, with no effect on the battery drain.

The fourth module, which is hidden behind the center overhead headliner (behind sunglass holder and courtesy lights), is a HFL (Hands-Free Link) control unit, that allows a hands-free Blue-Tooth connection for the cell phone! Once the unit was disconnected, the drain went away and all was fine. (Figure 2)

This characteristic somehow narrows the usage of this alternator. If you have a vehicle that usually runs on higher RPM, then there would be no problem, but if this alternator is used to provide its additional power to a hi-power audio system which is usually blaring at low speed, then the problem becomes quite serious. In the idle speed range, the output will surge from almost nothing to plenty, and I am sure it will have profound effect on a sound system!

I might add that stators available for 160 or even 200 amp CS-130 D alternators intensify the problem and cause an even worse effect on the low speed performance. Using a smaller pulley might help a little, but going too small on pulley size not only reduces the belt-to-pulley contact area, but also may require a shorter belt to keep proper belt tension and prevent slippage.

Quality IssuesWhen a 13341 alternator core (98 Jeep Grand Cherokee) was sent back from a good customer of ours we noticed that it was in such clean and pristine shape that the hous-ing didn't needed cleaning and blasting. It was supplied by a big name supplier with clean and intact ID tags, and had been sold through a large auto part store chain.

An immediate inspection showed it had no field current, so obviously the rotor coil had come open. Upon the tear-down, it became obvious that the reason for not having field current was that the brushes were com-pletely worn out; which is surprising for such a clean

alternator and in such a short time. (Figure 4)

While rebuilding this alternator for our own stock, we ran the rotor on the lathe to true-up the slip rings, and that is when we noticed that the slip rings were way off on concentricity. By the time it was machined and cor-rected the slip rings were so below my minimum spec (0.530”) that they was not usable. The slip rings had to be replaced and new rings installed.

Whether due to financial pressures or the unskilled labor used, what we often see in factory reman units are prod-ucts that are good enough to pass a final test but may not have the same quality or have the longevity that a custom remanfacurted product would.

The final judgment is upon the end-user of the product, the car owner, who considers all rebuilts to be the same, and this is a problem that affects all of us.

The customer didn’t want to have a new control unit in-stalled and was not even aware there was one on her car, so we left it disconnected and rest of the car was put back together, and we called it fixed.

As simple or complicated as the cases might be, this type of work is coming in more often, and by the advances in automotive electronics, I think they continue to be a niche for our business.

High-output ModificationIncreasing an alternator output is something that is often requested and the availability of high output stators al-lows this modification to be possible. Of course any time we use a higher amp stator, there are some changes in the output curve and turn-on speed of the alternator. When more power is extracted from a standard alternator by changing the stator there is usually an immediate turn-on speed increase. In addition to that, the curve usually takes a more gradual climb, then it eventually stabilizes at a higher level RPM around 6000 and beyond.

What we have noticed recently is a strange power output curve, unusually seen in 150-amp modified stators for the CS-130D alternator. (Figure 3)

As you see on the above print-out taken from our D&V JBT-5P test bench, the curve does not start until 2250 RPM (way too late, as compared to 1200 RPM of an OE unit), and from there up to about 2600 RPM, it rises to a mere 35 amps. Suddenly, just above 2650 RPM, it starts generating power abruptly and by 2750 RPM it produces a healthy 120 amps or so. This mean in a very narrow band of RPM which is very close to the idle speed of the engine, this alternator may have no significant output, but a little further up, it may have all the power that you need.

A friend sent me a link to a video. He captioned it: “There are three very strict rules to hand grenade fishing!”

1. Pull the pin.2. Throw the grenade.3. Collect stunned fish.

Then, he wrote, “THESE GUYS FOR-GOT STEP NUMBER TWO!” If you look up “grenade fishing goes wrong” on any search engine it will show you the video.

First a disclaimer. I am a long-time member of Trout Unlimited. Conserva-tion is very important to me. Fishing with explosives is illegal almost everywhere, and with good reason. In no way do I condone the actions shown in the grenade fishing video. Nevertheless, I have no reservations about using it as an example of what not to do.

In the video two men are in a boat. They are holding a hand grenade while some-one shouts instructions from the shore. They then drop the hand grenade directly alongside the boat. When it explodes there is predictable mayhem. Both men are knocked over. Buckets are blown off the bow of the boat. Unfortunately one of the men appears to be injured, since he does not get back up.

How could they have prevented this? With any procedure where there is high risk or opportunity for error, we can provide in-structions and training beforehand. In this example, there appears to have been no prior instruction. Additionally, simulation is a very useful tool for reducing errors. The two men could have practiced with a potato or some other non-explosive object, before using a live grenade.

You may think that your business does not have hand grenades lying around for peo-ple to abuse. On the contrary, you would be amazed at the simple things that can be made to explode when lack of training, recklessness, and foolishness combine.

A long time ago, in a shop far away… We had a natural gas stator removing tool. This device used a gas burner to heat alternator drive end housings so that they would expand, then the press fit stator could be easily removed. The lighting procedure was actually quite simple:

1. Strike the match.2. Hold the match to the burner.3. Open the gas valve.4. Get to work.

So simple, in fact, that the procedure was not documented and there was no formal training given before operating the tool.

The tool was in place for quite some time, causing no trouble. As so often happens, the “new guy” was asked to light it one morning with no instructions. Somehow the process got turned around and became:

1. Open the gas valve.2. Fumble around looking for a

match.3. Find match.4. Strike it5. Be thankful that the new guy’s eye-

brows were the only casualty from the resulting enormous blue flame. They grew back.

One of the key benefits of having a formal safety program, or quality program for that matter, is that these require you to document your procedures and provide training. Thinking about your operations beforehand can prevent mistakes that can become very costly. Had we taken the time to insist only trained operators could light the burner, we would have avoided a large disruption to the work day. A better approach would be to engineer the tool so

that the main gas would not flow without a pilot lamp.

Be sure to take a look at the risks that are hidden in your shop. To those of us who cook outdoors, the stator removing tool behaved identically to a gas grill, so its danger was hidden. As the example shows, not everyone has had the same life experiences. So, as you look through your operations, take the time to consider the experience level of the new worker. And ask yourself, “What could possibly go wrong?” r

8th Annual Heavy Duty Remanufacturing Summit by E. Mark Kothe, APRA COOThe 8th annual HDRG Remanufacturing Summit was held on January 27, 2014 at the Mirage Hotel in Las Vegas.

As Chairman of the HDRG, Sandra Stand-ley of Power Brake Sales kept the group on track in her usual lively manner. Unfor-tunately, this was Sandra’s last meeting as Chairman — we will miss her.

Seven speakers presented a variety of top-ics covering managerial issues as well as technical topics.

In the managerial section, Jeff Susbauer, presented “Tuning Up Your Reman Busi-ness,” followed by “How Fragile is Our Industry,” by Bill Wade, Wade & Partners.

On the technical side we offered, “How to Handle all the Electrical Loads in Your Truck” by Bruce Purkey, Purkey's Fleet Electric, “Electronic Turbo Actuator Remanufacturing” by Russ Schinzing, ERC, and “Getting to the Core of Reman-ufacturing,” by Matt Pagni, Level Seven Group.

During the lunch break, WABCO was pre-sented with the “Mike S. Hill Heavy Duty Remanufacturer of the Year Award.” The award is given to a company or individual who has demonstrated innovative ways

The transaction closed on Friday, Jan. 24. Broad Ocean Motor has acquired Presto-lite Electric’s China operations, and OCM has acquired Prestolite Electric’s rest-of-the-world operations, consisting mainly of the U.S.-based parent company and Prestolite Electric’s European subsidiary. Broad Ocean Motor, OCM and Prestolite Electric have formed a global alliance of

The same global management team will continue coordinating Prestolite Electric’s global business as before. Advanced Powertrains to Drive Remanufactured Replacement Component MarketSource: HDT Truckinginfo, Feb. 13, 2014The entry of advanced class 6-8 pow-ertrain systems that comply with new emission regulations will drive revenue for the North American remanufactured replacement components market over the next five to seven years.

New analysis from Frost & Sullivan says while this will intensify competition from suppliers of new replacement parts it will affect unit shipments for some products, the environmentally friendly image of remanufactured engines, transmissions, clutches and turbochargers will support ongoing demand among major truck fleet operators.

The business consulting firm’s report, Strategic Analysis of the North American Class 6-8 Remanufactured Powertrain Components Aftermarket, finds that the market earned revenue of $3.19 billion in 2013 and estimates this to reach $3.52 billion in 2019.

“Increased sophistication in the function-ality of heavy duty engines and variable geometry turbochargers will raise the unit prices of remanufactured components,” said Frost and Sullivan automotive and transportation research analyst Anuj Monga. “The enhanced reliability and availability of remanufactured

Of the remanufacturing industry, Funck said for all three partners it has been a lifelong pursuit. “Once it gets into your blood it’s hard to get away from,” he related. Funck has over 35 years of experience in the remanufac-turing industry, with 25 years of experience each for both Zuck and Neugebohr. Plus, the fathers of both Zuck and Neugebohr were in the remanufacturing business. Starting ZOR Industries was somewhat of a renais-sance for Funck and his partners of getting back “into something where you get your hands dirty, where you’re tearing down units and being involved in that type of business. “It’s something all three of us enjoy,” explained Funck. “With our backgrounds and the areas we’ve worked in during our careers, we thought we would blend well together to create a strong business environment.” Funck says all three partners have been “hands on” with experience in engineering, quality and sales, both inter-nationally and domestically with all levels of customers from the smallest repair shop to the largest OEs. About creating and growing ZOR Industries, Funck says, “We are all enjoying ourselves.”

Charging AheadZOR Industries is located at the northern end of Virgin-ia’s Shenandoah Valley in the town of Winchester. Being just two hours east of Washington, D.C., Funck says Winchester is a strategic location for the company. Due to their location, they have access to customers in Virginia, West Virginia, Washington, D.C., Maryland and Pennsylvania. “In the future we see increased potential to expand outside of our local area,” said Funck of the company’s desire to evolve into a nationwide and international sup-plier. In addition to selling remanufactured turbochargers, ZOR sells new OE, new aftermarket and service kits for those who want to do their own repairs. Funck says the company has tapped into the market for remanufactured turbochargers, but he says like rotating electric, every customer has different needs.“You have some customers who want to retain the origi-nal unit. While another customer wants to upgrade his original unit. And you’ve got another customer that wants

to stay exclusively OE new,” explained Funck. “Different customers want different things and you have to be ready to supply their need.” When asked about the company’s business philosophy, Funck told me it is to “provide service, value and to meet the needs of what are customers are looking for at a value the customer can afford.” Like most APRA members, ZOR’s remanufactured units are completely disassembled into individual components, inspected, cleaned and revamped through the company’s multiple processes. “Components are inspected and gauged for any non-conformance to specifications,” says the company in a customer flyer. “Great care is taken in the reassembly processes to ensure fit, form and function of all compo-nents. All fasteners are torque checked.” In what is a capstone of the company’s commitment to customer service, the company touts it workmanship, products and processes. “Our dedication to perfection is so evident in our finished products that many of our customers think our remanufactured units are new.”

Turbo ChallengesWhile Funck and his partners at ZOR Industries have learned very quickly that the challenges are varied and somewhat different than rotating electrical, the ride into the turbocharger market has not been without bumps in the road. “One of the challenges in the turbocharger market is application information,” explained Funck. “It is not as sophisticated as other remanufactured components, such as rotating electrical.” He says getting application and unit information is dif-ficult due to the lack of catalog data. “Other challenges are in component sourcing,” said Funck. “Finding good quality parts at reasonable prices can be a problem, as well cores prices for turbochargers are at a much different value than electrical.” Funck says that causes greater investment in the raw core material. “You find you get more labor dollars into a unit than electrical. As with electrical, the turbo works within a system. Many times the other system components cause failure to the turbo or place blame on it. This results in unjustified warranty returns and customer dissatisfaction. These are only some of the significant challenges we have faced, but we like challenges and finding ways to overcome them.”

While the company is relatively small and has few em-ployees, Funck says the company is in a growth mode. Like a lot of participants in the remanufacturing industry, Funck enjoys the remanufacturing business and says with a laugh, “There’s never a dull moment! “There’s always a challenge. You’ve got to keep yourself sharp in order to be profitable,” he says. When I asked him what he liked least about the remanu-facturing business, Funck said that like any business it’s hard to make a decent margin particularly in rotating electrical. “We’ve already seen price reductions in the turbocharger business,” Funck commented. “It’s like any commodity in the U.S., unless you have an exclusive, you’re always going to have to work with closer margins.” When asked about lessons learned and keys to success in the remanufacturing business, Funck emphatically pointed to the need of staying ahead of your competition. “You often have to think out of the box,” he said. “You have to go after your customers in different ways than your competition does. You have to add a different value than your competitors. That cannot always be in pricing, you must consider quality, availability, service, attitude and technical assistance.”

World TravelsWhen I asked Funck about any funny or weird experi-ences during his career, he laughed and said: “We could be here all day!”

Many of Funck’s interesting or funny experiences have been made during trips around the world. He’s logged

trips to over 30 countries during his career.

Among the highlights:• Being stuck in China with no one around and be-

ing unsure about where he was going because no one picked him up at the airport. And to top it off the airport shut down for the day.

• Riding through the deserts of Tunisia in a van at night with the driver falling asleep and no one able to speak French.

• Staying at a hotel one block from Yasser Arafat’s headquarters in Tunis.

• Going through the middle of riots in Jakarta about 12 years ago during protests in Indonesia.

Funck says the variety of experiences has given him a better understanding of people and cultures and an ability to accept and understand cultural differences. “The most interesting thing I learned was that generally most people just want it a little bit better for their kids than they had it,” he explained. “Your general population is not trying to seize the world or gain control over the masses, they just want it better for their kids.” With that cultural understanding embedded in Funck’s DNA, he and his partners are dedicated to making ZOR Industries the best it can be for their employees and customers. components means that these products will continue to thrive in the face of stiff competition from new, non-original replacement parts.”

However, the group notes, the addition of newer and refined components to the powertrain system could still pose a challenge, as the lack of cores will lead to the use of newer parts in component assemblies, thereby escalat-ing final costs. The scarcity of skilled labor is another restraint that will be prominent in the case of independent remanufacturers, who are otherwise not involved in the design and development process.

“Unlike many independent remanufacturers that find it tough to gain momentum due to core availability issues, original equipment manufacturers can leverage their installed base and stand a better chance in the remanufac-turing market,” said Frost & Sullivan in a release.

It believes partnerships with OEMs will be vital for re-manufacturers of enhanced powertrain components to not only access key proprietary information, but also capital-ize on the installed base of different OEMs.

“Truck manufacturers are also interested in widening their participation in the remanufacturing industry, hence providing added opportunities for remanufacturers to partner with OEMs, keep pace with technological change, and offer differentiated products,” observed Monga. “The remanufactured powertrain components market will particularly see higher activity from truck manufacturers looking to vertically integrate into component remanufac-turing.”

MAHLE Service Solutions Becomes Official Name for MAHLE Aftermarket Tool & Equipment Division MAHLE Aftermarket Inc. announced that MAHLE Ser-vice Solutions is now the official name for the company’s division specializing in the tool and equipment segment. The new division was announced on November 6, 2013 at AAPEX in Las Vegas. The employer mandate has been considered a keystone of the Affordable Care Act (ACA). In the legislation passed by Congress, the employer mandate, also referred to as the employer shared responsibility, required “large employers” to provide affordable health insurance for their full-time employees or be subject to certain financial penalties. ACA required employers with 50 or more full time equivalent employees to comply with this require-ment beginning January 1, 2014. However, the Obama administration delayed the employer mandate until Janu-ary 1, 2015.

Now, another change in the implementation of the ACA has occurred. On February 10, 2014 the Treasury Depart-ment and the Internal Revenue Service (IRS) announced that employers with 50 to 99 full-time equivalent employ-ees will not be subject to the employee mandate assess-ments until January 1, 2016. The “pay or play” mandate for employers with 100 or more full-time equivalent employees is still effective January 1, 2015.

Companies with 50 to 99 employees will report on their workers and coverage in 2015, but have until 2016 before any employer responsibility payments could apply. These employers must certify that they meet the following conditions:

• Limited workforce size – employs on average at least 50 full-time equivalent employees but fewer than 100 full-time equivalent employees during 2014.

• Maintenance of workforce and hours of service – during the period Feb. 9, 2014 until Dec. 31, 2014, the employer may not reduce the size of its work-force or the overall hours of service of its employ-ees in order to qualify for the transition relief.

• Maintenance of previously offered health cover-age – during the period Feb. 9, 2014 until Dec. 31, 2015, the employer does not eliminate or materially reduce the health coverage it offered as of Feb. 9, 2014.

Companies with 100 or more full-time equivalent em-ployees were also provided some relief in the announce-ment. To avoid payment for failing to provide health coverage, these employers need to offer coverage to at least 70 percent of their full-time employees (as defined by ACA) in 2015 and 95 percent in 2016 and beyond. This helps employers who may offer coverage to employ-ees with 35 or more hours, but not yet to that portion of their workforce who work 30 to 34 hours.

It should be noted that the Treasury Department an-nouncement stated the following: “As these limited transition rules take effect, we will consider whether it is necessary to further extend any of them beyond 2015.”

SESCO will continue to monitor developments in health care reform to include compliance as well as recommen-dations for employers on best practices for their firms.
