CHAPTER 7LOBBYISTS

28-7-101. Registration; reports. (a) As used in W.S. 28-7-101 through 28-7-104 “lobby” or “as a lobbyist” means to attempt to influence legislation. (b) Any person, who, on behalf of any association, corporation, labor union, public, nonprofit or private special interest group or any interest other than personal, is receiving or has a reasonable expecta-tion of receiving expense, reimbursement or compensation in excess of five hundred dollars($500.00) in a reporting period defined under W.S. 28-7-201(c), as a lobbyist shall, before, or within forty-eight (48) hours of, commencing lobbying activities during a reporting period as defined under W.S. 28-7-201(c), register with the secretary of state. The secretary of state shall collect a registration fee of twenty-five dollars ($25.00) at time of registration, which shall be deposited with the state treasurer to be placed in the general fund. Any person who is not receiving or has no reasonable expectation of receiving expense reimbursement or compensation in excess of five hundred dollars ($500.00), or who shall receive no compensation beyond travel and per diem expenses for lobbying activities under this chapter shall pay a registration fee of five dollars ($5.00) to the secretary of state at the time of registration. Registration shall state: (i) The name and business address of the individual registering; (ii) The name and business address of the association, corpora-tion, labor union, public, nonprofit or private special interest group which the person represents. (c) Not later than March 1 of each year the secretary of state shall make available a report of the registrations to all duly elected members of the house of representatives, the senate, state elected officials and any other person requesting a copy of the report.

28-7-102. Penalties. (a) Any person or individual failing to register as a lobbyist with the secretary of state shall be guilty of a misdemeanor subject to a fine of not more than two hundred dollars ($200.00). (b) Any person or organization failing to file a lobbyist activ-ity report required under this section or who files a lobbyist activity report containing information which the lobbyist knows to be false is guilty of a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00). Upon a second or subsequent con-viction under this section, any person or organization shall have his right to be a registered lobbyist revoked by the secretary of state for a period of up to two (2) years in addition to any fine.

28-7-103. No infringement of right to petition or communi- cate with legislature. Nothing in the provisions of this act [§28-7-101 through 28-7-104] shall be construed to prohibit or infringe upon the right of a citizen as an individual to petition or to address written or oral com-munications to members of the legislature.

28-7-104. Chapter inapplicable to public official. This act [§28-7-101 through 28-7-104] shall not apply to any public official acting in his official capacity.

28-7-201. Lobbyist activity reports; contents, form and fil-ing requirements; penalties. (a) As used in this section “lobby” or “as a lobbyist” means to attempt to influence legislation. (b) Except as provided in subsection (f) of this section, any per-son or organization who is registered under W.S. 28-7-101 as a lobby-ist shall file a lobbyist activity report with the secretary of state which complies with this subsection. Any organization which employs a lobbyist shall report the information required by subsections (d) and (e) of this section unless this information is reported by the lobbyist. The organization and the lobbyist may make a joint report and the lobbyist may report on behalf of the organization. (c) Lobbyist activity reports required under this section shall be filed electronically or otherwise annually no later than June 30 for activities during the preceding year May 1 through April 30. (d) Each lobbyist activity report shall contain a listing of the lob-byist’s sources of funding, each loan, gift, gratuity, special discount or hospitality paid or given, as defined by rules and regulations, to or on behalf of any legislator, state elected official or state employee acting in his official capacity which exceeds fifty dollars ($50.00) in value identified by date, amount and the name of the legislator, state elected official or state employee. (e) Special events, including receptions, meals, entertainment, attendance at athletic events and other functions, to which members of the legislature, of either house of the legislature, of any committee of the legislature or any regional legislative delegation have been invited shall be included in the report required under this section. The total expenses of activities reported pursuant to this subsection shall be reported by event or function not by individual legislator. The report shall specify the group of legislators invited but is not required to specify the names of individual legislators. Informational publications and other printed materials used for legislative purposes are not reportable under this act. (f) If the amount of expenses reportable under subsections (d) and (e) of this section is less than five hundred dollars ($500.00), no lobbyist activity report is required.

(g) Funding provided by any person or on behalf of the employer of the person to defray the cost of a meeting of any national or regional legislative organization shall not be reported. Any loan, gift, gratuity, special discount or hospitality paid or given to a bona fide charity or to defray the cost of a bona fide charitable event shall not be reported. (h) Lobbyist activity reports shall be made in the manner and form prescribed by the secretary of state and shall be open to public inspection. If a named legislator, state elected official or state employee disagrees with the report, the legislator, state elected official or state employee may file a written objection to the report with the secretary of state which objection shall be attached as an addendum to the report filed with the secretary of state. The secretary of state shall promulgate rules and regulations to implement this act. The rules, regulations and forms shall be designed to ensure maximum compliance. (j) Amendments to a lobbyist activity report may be filed with the secretary of state at any time. If inaccuracies are found in the report filed or additional amounts required to be reported occur or become known after the report is filed, amendments to the original report or additional reports shall be filed within a reasonable time not to exceed ninety (90) days from the time the inaccuracies or additional receipts or expenditures became known. If the total amount required to be reported is less than five hundred dollars ($500.00), including the original reported amount, an amendment need not be filed. (k) Notwithstanding W.S. 22-24-201(d) and in addition to the lobbyist activity report that may be required under this section, any group of persons which, through a private or public association, raises, collects or spends money for paid advertising in any communi-cation medium or for printed literature to support, oppose or otherwise influence state legislation in the state of Wyoming shall file with the secretary of state a statement of applicable receipts and expenditures.

Wyoming Secretary of State Lobbyist Rules CHAPTER 1

Section 1. Authority. These rules are promulgated pursuant to the authority granted the Secretary of State in W.S. 28-7-201 (h) to adopt such rules and regulations.

Section 2. Definitions. (a) Sources of Funding - Means the person or organization, who provided the funds required to be itemized under W.S. 28-7-201(d), for each loan, gift, gratuity, special discount, hospitality, special event or function, paid or given to or on behalf of a legislator, state elected official or state employee.

(i) A lobbyist may be his or its own source of funding. (ii) Membership dues and donations to nonprofit corporations are not sources of funding. (b) Loan - Means money lent for temporary use to be repaid with or without interest. (c) Gift - Means anything of value to the extent that consideration of equal or greater value is not received. (d) Gratuity - Means something given voluntarily in return for or in anticipation of some service. (e) Special Discount - Means anything of value given or received at a price or consideration that ordinarily would not be available to a member of the public or as a promotional group rate. (f) Hospitality - Means a reception or social event in connection with a business meeting, convention or lobbyist activities.

Section 3. Filing Information. (a) Registration Requirements - Lobbyists who are required to pay a registration fee shall register with the Secretary of State within forty-eight (48) hours of commencing lobbying activities. (b) Filing Date - All lobbyist activity reports and any statements of receipt and expenditure reports required by W.S. 28-7-201 (k) shall be filed no later than June 30 for activities during the preceding year May 1 through April 30. (c) Filing Methods - All reports required under the Lobbyist Disclosure Act may be filed by facsimile transmission during regular business hours within the time limit specified in the act provided an original statement is sent by mail on the same day the facsimile is sent. The original report shall be stamped by the United States Postal Service, United Parcel Service, Federal Express or other such licenced carrier who delivers to the Secretary of States Office. When the Secretary of State has the means to accept electronic filing, electronic filings will be permitted under directives from the Secretary. (d) Reporting of expenditures - A lobbyist who has incurred total lobbyist expenses equal to or greater than five hundred dollars ($500.00) shall file an expense report. If the total amount of lobby-ist expenditures for reportable expenditures under Wyoming Statute 28-7-201(d) and (e) is equal to or greater than five hundred dollars ($500.00), itemization of such expenses is required.

Section 4. Enforcement. (a) Referral to law enforcement - Any person or individual having evidence of a violation of the registration or filing requirements for lobbyists may file a report with the appropriate local law enforcement agency or with the Attorney Generals Office.

Wyoming Capitol Club, Inc.Bylaws

Article I. PurposesThe Capitol Club is organized for the purposes of undertaking action on behalf of its members or any matter or project of common interest. For the purposes of these bylaws, “common interest” is to be determined by the procedures herein set forth.

The Capitol Club shall:

1. Maintain and support the highest level of professional responsibility.

2. Maintain the integrity of the Capitol Club and provide, on behalf of its members, continuing liaison with the members of the Wyoming Legislature and appropriate state agencies.

3. Support and maintain the Legislative Message Center.

Article II. Members and Membership1. Eligibility for membership: Regular membership shall be open to all

lobbyists who are registered with the Wyoming Legislative Service Office.

2. Dues: The membership dues shall be established by the Board of Directors. Special assessments may be required at any time, subject to the approval of a majority of those members present and voting at a membership meeting. Dues shall be due and payable by December 1 of each year.

3. Discipline: The Board of Directors may, by a 2/3 vote of its mem-bers, expel, suspend or reprimand any member for any conduct that is likely to endanger the welfare, interest or harmony of the Club.

Any expelled or suspended member may be reinstated with such conditions as set by the Board of Directors upon a 2/3 vote of its members.

Article III. Meetings of Members1. Annual meeting. The annual meeting of the members shall be at the

call of the President and notice shall be provided to all members. Notice of the annual meeting, on even numbered years, shall include a list of nominees for office.

2. Special meetings. Special meetings of the members may be called by the President, or upon written request by at least 10 members, and it shall thereupon be the duty of the Secretary to give notice of such meeting.

3. Quorum. The presence of a majority of those members present and voting at a membership meeting shall constitute a quorum for the transaction of business at all meetings of the members.

4. All meetings shall be subject to Robert’s Rules of Order, unless oth-erwise provided in the bylaws.

Article IV. Officers1. Election and term of office. The officers shall be elected from the

membership at the annual meeting of the members on even numbered years. Term of office shall be two years to include the regular 40 day and the 20 day Budget Session of the Wyoming Legislature.

2. Removal. Any elected officer may be removed by two-thirds vote of the membership present at any regular or special meeting when-ever, in its judgement, the best interest of the Capitol Club would be served thereby.

3. Vacancies. Except as otherwise provided in these bylaws, a vacancy in any office may be filled by the Board of Directors of the unexpired portion of the term.

4. President. The President shall:

a. Be the principal executive officer of the organization and shall preside at all meetings of the members.

b. In general, perform all duties incident to the Office of President and such other duties as may be prescribed by the members from time to time.

5. Vice President. In the absence of the President, or in the event of the President’s inability to act, the Vice President shall perform all duties of the President and, when so acting, shall have all the powers of and be subject to all the restrictions upon the President and shall perform such other duties as from time to time may be assigned by the mem-bers.

6. The Secretary-Treasurer. The Secretary-Treasurer shall:

a. Keep the minutes of the meetings of the members.

b. See that all notices are duly given in accordance with these bylaws.

c. Be custodian of the corporate records of the Capitol Club and keep a register of the address of each member which shall be fur-nished to the Secretary by such member.

d. Keep on file, at all times, a complete copy of the bylaws of the Capitol Club, containing all amendments thereto, which copy shall always be open to the inspection of any member, at the expense of the Capitol Club, forward a copy of the bylaws and all amendments thereto to each member.

e. In general, perform all duties incident to the office of Secretary-Treasurer, and such other duties as from time to time may be assigned by the President.

f. Have charge and custody of, and be responsible for, all funds and securities of the organization.

g. Receive and give receipts for monies due and payable to the orga-nization from any source whatsoever, and deposit all such monies in the name of the organization in such bank or banks as shall be selected by the officers of the organization.

h. Pay promptly all obligations which have been duly authorized by the President or a membership meeting or as otherwise provided for.

i. Be responsible for seeing that current budgets are maintained; that budgeted expense limitations are not exceeded without authoriza-tion by the Board of Directors.

Article V. Board of Directors and Committees1. Election and term of office. The Board of Directors shall consist of

the President, Vice President, and Secretary-Treasurer and four mem-bers elected from the membership at the annual meeting of the mem-bers on even numbered years, one of whom shall be a past president of the Capitol Club. Each director shall hold office for a term of two years. The President shall act as Chairman of the Board and shall cast the President’s vote only when necessary to break the vote.

2. Duties of the Board of Directors. The business and affairs of the Capitol Club shall be managed by the Board of Directors. The pres-ence of four Directors shall constitute a quorum for the transaction of business.

3. The organization shall have a Nominating Committee which will meet on call of the Chairperson. The Nominating Committee of three members, including the Chairperson, shall meet every two years. Members are appointed by the President.

4. The President may appoint such ad hoc committees as is found nec-essary. In each such case, the President will state the purpose of the committee, period of service, number of members and recommended budget which must be approved by the Board of Directors.

Article VI. Contracts and Checks1. Contracts. Except as otherwise provided in these bylaws, the

President may authorize any officer, officers, or members to enter into any contracts to execute and deliver any instrument in the name of, and on behalf of, the Capitol Club and such authority may be gen-eral or confined to specific instances.

2. Checks, drafts, etc. All checks, drafts or other orders for payment of money and all notes or other evidence of indebtedness issued in the name of the organization shall be signed by either of two officers of the Capitol Club.

Article VII. AmendmentsThe bylaws may be amended, altered or repealed by the affirmative vote of more than one half of the regular members at any regular or special meeting of the members, provided that each regular member is mailed a copy of said proposed action not less than 10 days before such meeting.
