Sub : Rate Contract for Tit Bit Maintenance of Distribution Transformer Rating 10 KVA to 100 KVA.

Rates, Terms & Conditions of the Rate Contract Order for Tit Bit Maintenance of Distribution

Transformer are mentioned below:

TERMS AND CONDITIONS :

A. TECHNICAL

1. This rate contract will be in force w.e.f. from 2nd May’2013 and will remain valid up to 30th

April’2015.

2. On the basis of Health Check Up report of the Distribution Transformers, Divisional Manager

will identify the DTRs which will be taken up for the Tit Bit maintenance work at site.

3. Detail schedule of works is to be prepared and approved by the Divisional Manager and place

necessary LOI / Order.

4. The Enlisted Erection Contractors shall have sufficient experience on working in HT line &

Distribution Sub-Stn. with adequate know how for carrying the job. They shall have a team of

i) Licensed Electrical Supervisor possessing Supervisory Competency Certificate

for section 12 & from Licensing Board.

ii) Skilled Labour possessing Workmen Permit for section VI(a) from Licensing

Board / Distribution Level Licensing Board.

5. The Tit Bit maintenance work of DTRs to be executed with supply of all spares as necessary.

6. Spares (e.g. gaskets (National grade RC70C or equivalent), studs, breathers, oil seals etc.) should

be of good quality and to be approved by the Controlling Officer.

7. Job involving exposure of core coil assembly in open air to be avoided for Tit Bit maintenance

work.

8. During replacement of gaskets/ studs etc. every precaution to be taken to prevent any ingress of

moisture / dust / foreign particles. Work to be taken up mainly in dry weather to avoid

possibility of moisture ingress.

9. Agency should have the required tools / tackles, instruments (Megger (500 Volt – 1000 Volt),

clip on Ammeter / Multi meter / Earth megger, Earth discharge rod) etc. for carrying out the

work.

10. No sub contracting will be allowed for the job.

11. Replaced stud / damaged stud will be retained by the Agency for which cost will be deducted

from the bill of the agency as scrap value of the material issued from time to time.

B. GUARANTEE AFTER MAINTENANCE WORK:

Work to be completed with entire satisfaction of the Controlling Officer/Supervising Officer.

Work to be guaranteed for 60 days from the date of completion of work. In case of defect developed

due to bad workmanship, use of bad quality of materials the same is to be rectified free of cost.

C. TIME SCHEDULE OF WORK:

The maintenance work of each Transformer shall have to be completed on the same day

within a definite time frame as the same is related to the supply of power to the consumer.

D. CONTROLLING OFFICER :

Divisional Manager concerned will be the Controlling Officer of the work. Station Manager

of the supply/ Assistant Engineer authorized by the Divisional Manager will be the overall supervising

officer for the job. He will guide and supervise the job and ascertain the quality of the job and report

from time to time to the Divisional Manager.

E. WORK SCHEDULE:

Programme for Tit Bit Maintenance work shall be pre-scheduled in consultation with the

enlisted contractor by Station Manager/ Assistant Engineer attached to the respective Division and day

to day completion report for maintenance of DTR shall be intimated in writing to the respective SM/

AE by the contractor.

F. TERMS OF PAYMENT:

All arrangement for payments will be made by the Controlling Officer in accordance with

the following terms:

90% payment bill along with 100% taxes and duties will be made within 45(forty five) days

from the date of submission of bill in triplicate copies to the Controlling Officer duly certified by the

Supervising officer and Balance 10% payment will be made after expiry of 60 days from the date of

completion of work.

Statutory taxes and duties will be payable as and when applicable on submission of

necessary documents.

G. PAYING AUTHORITY:

Head of Accounts of the office of the controlling officer will be the paying authority.

H. METHOD OF SHUT DOWN:

Shutdown will be arranged by the Supervising Officer. Before taking up the job, necessary

precaution to be ensured as per safety norms.

I. LIQUIDATED DAMAGE:

Company reserves the right to repudiate the contract, if the contractor failed to perform

the job within stipulated period and as per terms and conditions of this rate contract. But Controlling

Officer may at his discretion waive this condition with imposition of liquidated damage @ ½% of the

value of the particular L.O.I. beyond the schedule period for each week of delay or part there of up to a

maximum limit of 5% of the value of the particular L.O.I. beyond the stipulated period. Liquidated

damage, if any, shall be recovered from the outstanding bills if required.

J. LEGAL JURISDICITION:

If any dispute or difference arises with respect to quality/quantity of the

equipment/materials pertaining to this order or any other terms and conditions of the order including

its execution, such dispute/difference shall be subject to settlement under the jurisdiction of Courts in

Kolkata only.

K. FORCE MAJEURE:

The Contractor’s shall be under no liability if he is prevented from carrying out any of his

obligations by reason of war, invasion, act of foreign country, hostilities (whether war declared or not),

riots, civil commotion, mutiny, insurrection, rebellion, revolution, accident, earthquake, fires, floods

Govt. orders. However, such force majeure circumstances are to be intimated immediately o the

Controlling officer.

L. CANCELLATION/TERMINATION OF ORDER:

In case of failure to take up the job/complete the scheduled completion time, Controlling

Officer have the right to cancel the order and the job may be done by engaging separate agency

/departmentally and the additional cost may be realized from his pending bills.

M. TECHNICAL SPECIFICIATION & SCHEDULE OF RATE: enclosed in Annexure-A

N. AREA OF OPERATION:

Area of operation will be anywhere within the State of West Bengal and placement of

order will be decided by the Controlling Officers.

O. SUBMISSION OF REPORT:

Completion Report needs to be submitted after completion of work to the Controlling Officer /

the Supervising Officer.

P. COMPLIANCE OF STATUTORY OBLIGATIONS:

The Contractor has to comply all statutory obligations as per existing rules and regulations.

Distribution of Work amongst the Contractors engaged with the Division should be made on rotational

basis subject to satisfactory performance of the Contractor as well as having necessary registration /

certificate of the Provident fund, Labour license, E.S.I, Service tax etc.

Contractors shall ensure that their employees should get wages as fixed at par with the

minimum wages as published by the Govt. of West Bengal from time to time and comply with

statutory provisions of E.P.F. and miscellaneous provisions Act, 1952, E.S.I.Act, 1923, Contract Labour

(Regulation & ABOLITION) Act, 1971 and other relevant Labour Laws as applicable.

Q. COMPLIANCE OF SAFETY PROVISIONS:

Shut down to be taken maintaining safety norms on submission of safety induction form to

supervising officer.

It shall be the personal responsibility of the Contractor to provide adequate personal protective

equipments to his worker and no labour would be allowed to undertake any job without informing the

concerned Officer and without observing the safety standards of the Company. In case of accident

while working on the system of WBSEDCL, if it is observed that the Contract labours had no personal

protective equipments and other safety standards were not observed and due to which accident

occurred, the Order on the concerned Contractor shall be cancelled immediately, in addition to other

actions including prosecution under Indian Penal Code that the Contractor is legally liable for.
