Advances/Withdrawals from the General Provident Fund Account (GPF) areadmissible to the members of the Fund from the amount standing to their creditat the discretion of the sanctioning authority subject to the conditions laid downunder the Trust Rules.

Now, in order to facilitate hassle-free advances/withdrawals and to keep themembers more conversant with the rules and regulations governing suchadvances and withdrawals, relevant portion of the WBSETCL GPF Trust Rules isattached herewith for information .or the all concerned.

All the controlling officers are requested to give wide circulation of thoserules for the benefit of the members in the interest of the Company.

Rule 12 Advances from the Fund:

12(1) A temporary advance may be granted to a subscriber from the amount standingto his / her credit in the Fund at the discretion of the sanctioning authoritysubject to the following conditions:

(a) No advance shall be granted unless the sanctionlng-authorltv is satisfied that theapplicant's pecuniary circumstances justify it, and that it will be expended 011 thefollowing objects and not otherwise:-

i) to pay expenses incurred in connection with the treatment forprolonged illness of the applicant or any person actually dependenton him / her.

ii) to pay for the overseas passagefor reasons of health or education ofthe applicant or any person actually dependent on him / her.

iii) to-pay obligatory expenses on a scale appropriate to the applicant'sstatus which by customary usage the applicant has to incur inconnection with marriages, funerals or other ceremonies of personsactually dependent on him / her.

Provided that the condition of actual dependency shall not apply inthe case of son or daughter of the subscriber.

.•...Note: Advances under sub-clause (iii) are also permissible for meeting

expenditure. in connection with marriage and other ceremoniesof the subscriber himself / herself.

(b) To meet cost of higher education, including where necessary, 'the travelingexpenses of the subscriber and members of his family or any person actuallydependent on him in the following cases namely,

i) for education outside India for academic, technical, professional orvocational course beyond the High School stage, and --'for any medical, engineering or other technical or specialized course --in India beyond the High School stage, provided that the course ofstudy is for not less than three years;

ii)

(c) The sanctioning authority shall record in writing its reason for granting theadvances.

(d) An advance shall not-

i) exceed three month's pay, or half the amount at the credit ofthesubscriber in the Fund, whichever is less

ii) except for special reasons, to be recorded in writing, be granted toany subscriber in excess of the limit laiddown in sub-clause (i) ofclause (d) or until repayment of the last installment of any previousadvance:

...Provided that if the reason is of a confidential nature, it may becommunicated .to the Accounts officer personally and / orconfidentially. ..--

~--Note: The amount of advance under special reasons shall not exceed 75% of

the amount standing at the credit of the subscriber in the Fund atthe time of making application for such advance.

12.2 In fixing the amount of an advance the sanctioning authority shall pay due regardto the amount at the credit of the subscriber in the Fund.

Recovery of Advances :

An advance shall be recovered from the subscriber in such number of equalmonthly installments as the sanctioning authority may direct, but such numbershall not be less than twelve unless the subscriber so elects, or in any case morethan twenty four. A subscriber may at his / her option, repay the total un-recovered amount in one installment in a-month. Each installment shall be anumber of whole rupee, the amount of the advance being raised or reduced, ifnecessary, to admit of the fixatio.n of such installments in whole rupee.

Recovery shall be made in the manner prescribed in Rule 10 for the realization ofsubscriptions, and shall commence with the issue of pay for the month followingthe one in which the advance was drawn. Recovery shall not be made, exceptwith the subscriber's consent while he is in receipt of subsistence grant or is onleave for ten days or more in a calendar month which either does not carry anyleave salary or carries leave salary equal to or less than half payor half averagepay, as the case may be. The recovery may be postponed, on the subscriber'swritten request, by the sanctioning authority during recovery of an advance ofPaygranted to the subscriber.

Note: The expression advance of pay in this sub-rule includes ordinaryadvance of pay granted under the relevant rules, but does notinclude. advances for the building or repairs of a house, for thepurchase of conveyance or for the payment of passagesoverseas,which are of a different nature. ..~

If an advance has been granted to a subscriber and drawn by him and theadvance is subsequently disallowed before repayment is completed, the wholeor balance ofthe amount withdrawn shall forthwith be repaid by the subscriberto the Fund, or in default, be 'ordered by the Accounts Officer to be recovered bydeduction from the emoluments of the subscriber in a lump sum or in monthlyinstallments not exceeding twelve as may be directed by the authoritycompetent to sanction an advance for the grant of which; special reasons arerequired-under sub-rule (2) of Rule 10. ..••

Provided that •.b-efore such advance is disallowed, the subscriber shall be g[Ven anopportunity to explain to the sanctioning authority lnwrttlng and' within flfteen-;days of the receipt of the communication why the repayment' shall not beenforced and lfarr explanation is submitted by the subscriber, within the saidperiod of fifteen days, it shall be referred to the Trustees for-decision; and if noexplanation within the said period is submitted by him, the repayment of theadvance shall be enforced in the manner prescribed in this sub-rule.

Recoveries made under this rule shall be credited as they are made to thesubscriber's account in the Fund. ~

Wrongful use of Advance

Notwithstanding anything contained in these rules, if the sanctioning authorityhas reason to doubt that money drawn as an advance from the Fund under Rule12 has been utilized for a purpose other than that for which sanction was givento the drawer ofthe money, he shall communicate to the subscriber the reasonsfor his doubt and require him to explain in writing' and within fifteen days of thereceipt of such communication whether the advance has been utillzed for thepurpose for which sanction was given to the draw.er of the money. If thesanctioning authority is not satisfied with the ~~Ianation furnished by thesubscriber within the said period of fifteen days, the salioetoning authority shalldirect the subscriber to-repay the amount in question t.6 the' Fund forthwith or indefault, order the amount .to be recovered by deduction in one sum from theemoluments of the subscriber even if he be on leave. If, however, the totalamount to be repaid be more than half the subscriber's monthly salary, therecovery be made in monthly Installments of monies till the entire amount Isrepaid by him.

Rule 1S WithdrawaHrom the Fund :

Subject to the conditions specified therein, withdrawals may be sanctioned bythe authorities competent to sanction an advance for special reasons under Rule12.1, at any time

(i) After the completion of fifteen years of s~rvice (including broken periods ofservice, if any) of a subscriber or within ten years before the date of hisretirement on superannuation, whichever is earlier, from the amount standing tohis credit in the Fund, for one or more of the following purposes, namely, -

a) meeting the cost of higher education, including where necessary, thetravelling expenses of the subscriber or any child of the subscriber in thefollowing cases, namely,

i) for education outside India for academic, technical, professionalor vocational course beyond the High School stage, and

ii) for any medical, engineering or other technical or specializedcourse in India beyond the High School stage;

b) meeting the expenditure in connection with the betrothal/marriage ofthe subscriber or his sons or his daughters, and any other female relationactually dependent on him;

c) meeting the expenses in connection with the illness, including ~nere·necessary, the travelling expenses, of the subscriber and members of hisfamily or any person actually dependent on him;

d) building or acquiring a suitable house or ready-built flat for his residenceincluding the cost of the site or repaying an outstanding amount onaccount of-loan expressly taken for building or acquiring a slJitable houseor ready-built flat for his residence;

.,.•.•e) purchasing~ house-site for building a house thereon for his residence, or

repaying any outstanding amount on account of loan expressly taken 6rthis purpose;

f) constructing a house on a site purchased under sub-rule (e)

(ii) Within twelve months before the date of retirement on Superannuation of asubscriber a one lime withdrawal of an amount not exceeding 90% of theamount standing toathls / her credit in the Fund.wlthout asslgnlng any' reasonfor such withdrawal by him/ her. The facility shall be admissible {lnly once,

Note 1 A subscriber who has availed himself / herself of an advance from the Boardunder the scheme for the-grant of advances for house building purpose, or hasbeen allowed any-assistance in this regard from any other Government source,shall be eligible for the grant of final withdrawal under clauses (d), (e), s (f) forthe purposes specified therein and also for the purpose of repayment of any loantaken under the -aforesald Scheme subject to the limit .speclfied in the provisionto Rule 16.

Note 2 Withdrawal under clause (d), (e) or (f) shall be sa~ioned only after a subscriberhas submitted a plan of the house to be constructed or of the additions oralterations to be made, duly approved by the local mt"';;icipal body of the areawhere the site or house is situated and only in cases where the plan is actuallygot to be approved.

Note 3 Withdrawal under sub-rule (d), (e) or (f) shall also be allowed where the houseslte or house is in the name of wife or husband provided she or he is t,he firstnominee to receive Provident Fund money in the nomination made bysubscriber.

Note 4 Only one withdrawal shall be allowed for the same purpose under this rule. Butmarriage or education of different children dr illness on different occasions or afurther addition or alternation to a house or flat covered by a fresh plan dulyapproved by the local municipal body of the area where the house or flat issituated shall not be treated as the same purpose.

Note 5 A withdrawal under this rule shall not be sanctioned if an advance under Rule 12is being sanctioned for the same purpose and at the same time.

Rule 16 Condition for Withdrawal :

16.1 Any sum withdrawn by a subscriber at anyone time for one or more of thepurposes specified in Rule 15 from the amount standing to his credit in the Fundshall not ordinarily exceed one-half of such amount or six months' pay,whichever is less. The sanctioning authority may, however, sanction thewithdrawal of an amount in excess of this limit up to ~ th of the balance at hiscredit in the Fund having due regard to

i) The object for which the withdrawal is being made,

ii) The status of the subscriber, and

iii) The amount to his credit in the Fund,

Provided that in no case the maximum amount 'of withdrawal for purposesspecified ihclause (d), (e) & (f) of sub-rule (i) of rule 15 shall exceed Rs.3;00,OOO/-orI00 times the monthly pay, whichever is less.

Provided further that in the caseof a subscriber who has availed himself / herselfof advance under the scheme of the Ministry of Works and Housing 'for the grantof advances for house-bullding purposes, or has been allowed any asslstarrce'lnthis regard from any other Gover,nment source, the sum withdrawn under, thisrule together with the amount of advance taken under the aforesaid Scheme orthe assistance taken from any other Government source shall not exceed Rs.3,00,000/- orlOOtimes the monthly pay, whichever is less.

Provided further that in the case of subscriber who has availed himself / herselfof the withdrawal from the fund under rule 15 (ii), the conditions of withdrawalas prescribed under this rule shall not apply.

Note: A subscriber shall not be granted a second withdrawal for house-buildingpurpose at any place if he / shoehas already been granted a final withdrawal forsimilar purposeson the same or another place, In other words flnalwlthdrawalsshould not be allowedfor more than one house.

Final Withdrawal of Accumulations,inlhe;Fund

When a subscriber quits the service, the amount standing to his credit in theFund shall become payable to him / her.

Provided, that a subscriber, who has been disnt?sed from the service' and issubsequently reinstated in the service shall, if required to'da.,-so by the Trustees;repay any amount paid to him from the Fund in pursuance of this rule, withinterest thereon at the rate provided in Rule 11 in the manner provided in theprovision to Rule 18. The amount so repaid shall be credited to htsaccount in theFund.
