Although residents may think they are engaged in innocent actions, property managers may wonder “what the heck was that resident think- ing?” after coming across the by-prod- ucts of these actions. Further, your net operating income is likely to be directly and adversely affect- ed by residents’ negligence that leads to flooding, smoke damage or fires. Prop- erty managers can avoid the expensive repercussions of these “goofs” by being proactive. It’s important to have policies clearly stated on the premises and in the lease concerning these risks, and to warn your residents in advance about these con- cerns. Some suggested warnings, based on common negligence-related acci- dents are as follows; they relate to water, smoke and fire, which all have a negative impact on your operation and residents’ quality of life. 1. Absolutely no clothing should be hung from the sprinkler lines; this runs the risk of setting them off or damaging them—which in turn will flood the unit. 2. When mopping or cleaning up behind the toilet be aware of the water supply line; if damaged, this can flood your unit and/or the unit below. 3. Defrosting that holiday turkey? The association continued to lead protests against municipal tax increases and school levies that would dispropor- tionately affect landlords for the rest of the 1940’s. And this is an effort that we are continuing to work on to this day. We have worked hard to build good re- lationships with city and county govern- ments throughout the state, and we have seen some great improvements in the last decade, even if some obstacles remain. If the property is maintained at a constant relatively cool temperature it can end up creating a hap- py tenant and save you a little money. Ensure that there are no gaps where pest and drafts could enter. If you need to secure an exterior gap, door or window you can use calk, weather stripping and padding. After the end of World War II cities throughout the nation started to see massive growth. The services

necessary to accommodate that growth couldn’t be funded by the tax structures of the previous decades which had been forced to deal with the austerity of the depression and the priorities of the war, and many cities began to look for more revenue sources.

In December 1946, then President of the Association Richard F. Harding joined other business leaders in a nearly four hour meeting that stuffed Salt Lake City hall with a record breaking crowd of more than 350 people joined together in what the newspaper called “an almost

unanimous protest against increased city taxation” especially new franchise and resale taxes and the increase of the city budget by 48% over the previous year.

The association continued to lead protests against municipal tax increases and school levies that would dispropor-tionately affect landlords for the rest of the 1940’s. And this is an effort that we are continuing to work on to this day. We have worked hard to build good re-lationships with city and county govern-ments throughout the state, and we have seen some great improvements in the last decade, even if some obstacles remain. Dear Paul,I heard from somebody that the legis-

lature passed a bill making it so that you can’t ban certain dog breeds. Does that mean that I have to allow any kind of dog on my property if I allow pets? Can I still allow small dogs and prohibit big dogs?

Dear Tyler,This year the legislature passed H.B.

97, which was titled “Limitation on Lo-cal Government Regulation of Animals” which is going into effect soon. The bill changed Utah State Law, making it so that cities cannot make any rules about dogs based on the animals breed.

What does this mean for landlords? Well, the bill in question doesn’t do any-thing in particular to landlords. You can still legitimately make whatever rules you would like for pets in your rental units. Just like before, you can limit pets based on their species, weight, breed, length of hair, age, eye color or any other

factor you think is relevant. And, just like before, you must allow somebody with a service or comfort animal to live in rental if they have given you the required ac-commodation request- independent of whether or not you would have allowed the same animal as a pet under your rules for pets.

Likewise, this bill does not impact In-surance companies, some of which might not cover your rental unit if you allow a tenant to have animals of a certain breed live there. (If you ever have a situation where a tenant requests a service or com-fort animal that is prohibited in your in-surance, tell the tenant to contact your insurance and work it out with them. Far better that they sue your insurance for discrimination than that they sue you!)

The only change is that now you have to make and enforce your own rules. If you do not want pit bulls, that is fine, but you have to specify as much yourself; and you cannot expect the city to prohibit them for you, or help you make a tenant get rid of them.

Remember though, service animals are not pets. If you have someone ask for a service animal, even if it is not within your standards (like weight, breed, spe-cies, etc), you still must following fair housing law. I recently attended the National Apartment As-sociation Education Con-

ference and Expo. The keynote speaker this year was Michael J. Fox. Most people know him from his two biggest roles in TV on “Family Ties” and in “Spin City”, or from his starring role as Marty McFly in the Back to the Future movie series. Some may know that he has Parkinson's disease, and in addition to talking, he plays a key role in Parkinson's research and activism. His Michael J. Fox's Foun-dation has raised and invested over half a billion dollars trying to cure that ter-rible disease.

Some days Michael can barely walk.

The day he spoke to us he struggled across the stage, walking like someone who doesn't have full control of his body (because he doesn't). Even his talking is difficult and labored. And yet he in-spired the 8,000 attendees with humor and optimism, bringing many to tears. After his speech he sat down on stage for an interview and took questions. I will never forget his response to a ques-tion about how he teaches his kids per-severance and determination. He said he doesn't really have to do anything other than just live his life because they learn all they need to know as they watch him struggle and persevere. But, being a co-median, he told a story he had heard about a woman in a flood in Africa who had been swept away by the rising wa-ters. As she struggled to stay afloat and find safety she grabbed the branches of a tree and became lodged in the top. She

was found later in the top of a tree. She had been pregnant and while waiting for rescue delivered the child by herself and was found breast feeding her newborn. Michael J. Fox said whenever his kids come to him with a problem they find difficult he tries to get them to put it in perspective by saying "a lady had a baby in a tree - what have you got?"

It reminded me that when our lives or jobs get tough we have others to help us. As a member, you can call the UAA for support any time. You can come to

meetings and network with others who have been through challenges and con-quered them and would love to help you overcome yours. I hope you will take advantage of the network of 4,000 com-panies and individuals that is the UAA when you have hard times, and I hope that you will contribute your experience and knowledge to helping other land-lords in turn.

Recently at the 2014 National Apartment As-sociation Education Con-ference & Exposition in

Denver the Utah Apartment Association was honored to receive a coveted Para-gon award from the NAA in recognition of our outstanding Government Affairs Program.

What makes us unique? Ultimately, the standard for success in our legisla-tive efforts rests on four things. First, we do our best to work by compromise and consultation when possible. By working out compromises we are able to create legislation that is a win-win for all par-ties involved and ensure that we can get what we need for our members, while still being fair and considerate of others (such as tenants, HOA’s, cities and other concerned parties). We are then able to

turn potential opponents into support-ers of our legislation, and as Abraham Lincoln said “am I not destroying my enemies when I make friends of them?”

Second, because of our networking approach we are able to maximize the ef-fectiveness of our political influence and use the funds that members have donat-ed to our PAC (political action commit-tee) to best effect. Wisely using the funds entrusted to us for political actions is one of the best ways that we can increase our effectiveness and ensure that members continue to donate to this vital cause.

Third, we try to focus our efforts on those areas that will save landlords in the state the most time and money, and limit liability. Likewise we do our best to protect our industry and insure that landlords can make a reasonable return on their investment.

Fourth, we do our best to ensure that as a part of the legislative process we en-sure that landlords understand the laws as they are written and are able to assert

their rights and know their limitations. The biggest part of this effort is educat-ing our members and other landlords through the classes we offer and other resources (such as this newspaper). We also do outreach with tenants groups so that they can explain to tenants what their responsibilities and rights are.

Another important factor in the suc-cess of our Government Affairs program is our constant involvement at all levels. We cannot expect to only be involved during the legislative session or during elections and have any impact. We not only attend interim committee meetings and city council sessions, we actively plan out a strategy for the future, focus-ing on the criteria listed above.

Ultimately, however, the success of

the Utah Apartment Association’s po-litical efforts rests on your involvement. We need you to tell us what problems you encounter, and what improvements you think are needed, and we need you to contribute to the effort with time or money for the PAC.

Exterior MaintenanceOne of the best opportunities sum-

mer provides is the ability to work on things that are inaccessible during other seasons. During this optimal time of the year, landlords need to ask and answer 2 question. What needs to be fixed? And what do I want to upgrade? Things that immediately need to be fixed are roof leaks, rain gutter build up, unsafe struc-tures and fixes that would be required to sell the property. Once you identify these things, the only step left is to ask “how do I want to fix it?” This you can do yourself or contact an associate member. When looking at upgrades, it’s impor-tant for a landlord to understand 1) this is an upgrade to YOUR property 2) it will keep the tenant happy 3) You are increas-ing the value of your investment. Often landlords will overlook upgrades, for whatever reason, and pass up the poten-tial to make more money. In the summer look into re-doing the stucco, or buying some new blinds. Your tenants will stay longer, and it will make it easy to rent in the future.

Create a list of property task that could be done. Organize them by importance, figure out which ones are necessary and finally how many of those things you can afford. Landlords who do this and take advantage of these opportunities not only have a better looking property, but a better bottom line as well.

LandscapingThe yard and garden is often regard-

ed as real estate’s biggest selling point. When evaluating whether or not to rent a

house, studies show renters will look first to the landscape/exterior of the house, then to the kitchen, then the restrooms. And like too many landlords know, once a lawn or garden dies it can take years to get it back to what it was. For effectively maintaining your landscape use the fol-lowing tips:• Establish, and communicate, clear

rules on who is responsible for what• Hold individuals strictly accountable

for their landscape responsibilities• Make sure “general maintenance”

(lawn cut, weeds pulled, ete… ) is done once a week

• Clearly define when the lawn is sup-posed to be watered

• Water the lawn at night to avoid losing water to evaporation

• Fertilize the lawn regularly • Trim, and keep up with trees, bushes,

and flowers• Plant flowers and other plants and al-

low your tenants to do the same• Spray weed killer (on weeds) in gar-

den, cement and road• Ensure walkways and driveways are

clear of garbage, dirt and hazards• Don’t be afraid to hire a lawn care pro-

fessional if you need one.The most important thing a Landlord

can do is have seasonal inspections. By doing this you can stay informed about the property’s condition, and know what exactly needs to be done and what can be done.
