On November 19th, the Utah Apartment Association cel-ebrated its 80th Anniversary

at the Little America Hotel.The event braised over $15.000 for

the UAA PAC. Dinner was served around 7:00, and the program began with opening remarks by outgoing UAA Board Chair, Steve Randall. Af-terwards a short documentary video about the history of the association was shown, along with a brief recog-nition of all of the former UAA presi-dents in attendance.

At the 80th Anniversary Gala, the Utah Apartment Asso-ciation presented two Pillar

of the Industry Awards to volunteer leaders who have each given de-cades of service to the rental housing industry and the UAA. The awards were presented at the UAA 80th an-niversary gala at the Little America Hotel.

He wrote the landlord guide the UAA used, most of its forms and did most of the training and education. He was the primary advocate for the UAA at the legislature”.

Speaking while receiving the award Jim told stories about his time serving the UAA and working in the industry over the years, including one about a time he was called up to the legislature “unprepared”. Ask The Director: Problems with the Tree

Dear Director: Dear Paul,I had a bad experience last year with

a tenant putting a live Christmas Tree in their apartment and ruining the car-pet and walls with the sap and needles from the tree. Can I ban live trees in my buildings? Will I get in trouble for dis-crimination if I do? I don’t want to look like a Scrooge, but I don’t want my units damaged like that again!

Dear Evan,Merry Christmas to you too!First, you are completely within

your rights to ban live (or “fresh”) Christmas trees from your apart-ments if you feel that allowing them in will do excessive damage to the

place. Live Christmas Trees not only cause a mess, but are sometimes a fire hazard as well. You would only be discriminating if you prohibited all holiday decorations, or if you were unreasonable about the ones you allowed in your units.

However it may not be necessary to ban all of your tenants from hav-ing a live tree. Instead you might consider telling tenants who want a live tree to contact you to discuss the rules about how they will care for the tree and dispose of it after the holidays are over.

Furthermore, if you decide to al-low a live tree you might want to consider doing an inspection shortly after the holidays to see if there is any damage. If there is, then fix it immediately, deducting the cost of the repairs from the tenant’s security deposit, and tell them that they have to refill their deposit when they next pay rent in February.

ore people who rent their homes are feeling the finan-

cial squeeze following the recession, with younger renters and people in the West feeling the most “cost burdened,” according to new research from the Carsey Institute at the University of New Hampshire.

The research was conducted by Jes-sica Bean, vulnerable families research associate at the Carsey Institute, and is presented in the brief “Renters More Often Burdened by Housing Costs Af-ter Recession.” Renters are considered “cost burdened” if they spend more than 30 percent of their income on rent and utility costs.

“Increased need among American renters indicates that strong public hous ing programs are necessary to protect individuals from becoming overbur-dened. However, this research also dem onstrates that the lowest-earning house-holds experienced the smallest increas-es in cost burden over time, indicating that without the housing programs al-ready in existence, America’s most vul-nerable households likely would have fared even worse,” Bean said.

The key research findings are as follows:

Nationwide, nearly half (49 percent) of all renters were “cost burdened” in

2010, spending more than 30 percent of their income on housing costs, with the highest rates occurring in the West and in central cities.

In all regions and across all place types, the percentage of renters who were cost burdened increased between 2007 and 2010.

The largest increase in cost-burdened renters occurred in rural places, up 4.3 percentage points by 2010, compared with increases of 3.4 and 2.9 percentage points in suburban places and central cities, respectively.

Renters under the age of 25 were most often cost burdened both pre- and post-recession, with nearly 60 percent of young renters spending more than 30 percent of their income on rent in 2010.

In all regions, the largest increase in the proportion of renters who were cost burdened occurred among those with a household income between $20,000 and $50,000.

individuals with the Pillar of the Industry Award for their contribution to the association over the last quarter century: James Deans and Kirk Culli-more, Executive Director. Paul Smith proceeded to give the 2014 Annual Report, and the Government Affairs Committee gave a report on the 2015 Leg-islative Initiatives. Finally, Cheri Goss, the 2015 UAA Board Chair introduced herself and swore in the UAA Board and UAA Committee Members.

What started out as a small meeting of con-cerned landlords in 1934 in the Newhouse Hotel (located right next to where the Little America now stands) has grown and blossomed into the association we know today. So, Happy Birthday to the UAA, and here’s hoping for many happy returns.

As I look back over 80 years of board chairs

who have served the UAA, I know a single board chair has only a brief time to influence the organization. I have set 5 goals for my time as chair:

1. Build a board culture of ac-countability, contribution and own-ership by assigning areas of respon-sibility to every board member (33 volunteers this year) and tracking

progress to empower ownership of UAA’s mission. This organization is run by the board, and I want my board members to each have own-ership and an area of accountability while on the board.

2. Make membership growth and outreach the #1 priority of UAA leadership and membership. We just received a national award for mem-bership growth, I think the more we grow the better we can serve our in-dustry. So I would ask each of you to help us grow this year by referring at least one new member each to the UAA this year.

3. Establish UAA as the go-to

place for data by developing and im-proving data and resources offered by UAA including market and con-tact information. We already have great publications and resources and I want us to continue to provide more.

4. Continue to provide Quality Education opportunities for apart-ment managers like Apartment All-Stars, UPRO and Good Landlord training etc. We have so many great programs I hope you will take ad-vantage of.

5. Create opportunities for mem-bers to have “fun” and release from the stress of business. I personally

love to have a good time and think this an important role of the associa-tion.

It is an honor to serve the UAA as Board Chair this year and I look for-ward to continuing the great tradi-tion of 80 years of volunteer leader-ship, as the UAA makes a difference in our business and in the lives of people in Utah.

Jim, who has recently had both legs amputated due to complications of diabetes, is still going strong and walked up to the stage on his own with two prosthetic legs. “You’ll have to excuse me for being a little wobbly, he said. I’m getting used to some new legs."

One of the things Jim is known for is his dry humor. One of the favorite

stories he tells in classes and semi-nars is about when he had to serve a three day notice to one of his proper-ties. When he knocked on the door, the lady of the house, who was a senior citizen, was sitting at the din-ner table and told him to come in. So he walked over to the dinner table and served her the three day notice and left. When he tells that story, he

deadpans at the end “the reason I will always remember serving that particular notice is that the lady was completely stark naked at the time”.

Another story that illustrates Jim’s humor concerns an apartment as-sociation board member that com-plained one year that he didn’t want to get another “plaque” for his office wall for being on the board. He com-

plained he already had six. So Jim, instead, presented him with a six foot toothbrush instead – so he’d be able to fight off all the “plaque” in his life.

Thanks Jim for all you have done for the UAA and the rental housing industry for 30 years.

It is renewal season, and many of you have seen your renewal invoices in the mail. For big complexes that have previously budgeted them for January, this is a reminder. For small

owners, paying early means you can claim your dues on your 2014 taxes!

Because we have a diverse mem-bership population in the UAA many people have a variety of rea-sons for being members of the Asso-ciation. Some join for the legislative efforts that the UAA provides and the support that is given proactive-ly to protect owners, investors, and landlords. Others have joined for the UAA to become more involved and more engaged in the industry. The Utah Apartment Association was recently awarded the highest mem-bership increase throughout the en-tire National Apartment Association. This was a HUGE honor for us, and we are very excited. But we have

The Utah Apartment Associa-tion maintains the most com-prehensive list of Apartment

Communities in the State as a part of our Membership Directory. The list has almost a thousand communi-ties on it and represents more than 100,000 units in every corner of the state. It is hard work to maintain this

list, but it is a valuable service we provide to our members.

One of the interesting things I no-ticed as I worked on compiling this list was the amount of thought and care that went into coming up with

the names for the Apartment com-munities. Not surprisingly names that evoke nature, comfort, com-munity, and home are at the top of the list. Here are the top 10 most common words (other than “Apart-ments”) found in community names throughout the state:

Increase Your Profitability by Becoming Pet-Friendly

The majority of Americans view their pets as members of their family and as a result,

Best Friends Animal Society receives hundreds of inquiries about pet-friendly housing each year. Given the huge demand, one might think there would be enough pet-friendly housing for renters. However, a 2005 study entitled “Companion Animal Renters and Pet-Friendly Housing in the U.S.” indicates something quite different. Only about 9 percent of landlords have no restrictions on the type of pets tenants may own. A further look at the study’s statistics shows that landlords with pet restric-tions are only hurting themselves be-cause when they offer pet-friendly rentals their bottom-line profits in-crease.

A 2011 analysis of the condomin-ium market in the Journal of Real Estate Finance and Economics found that pet-friendly landlords who place no restrictions on pet owner-ship currently enjoy an 11.6 percent rental premium over landlords who do not allow pets (after controlling for waterfront rentals, vacancies, age, bedrooms, and other factors). In ad-dition to increased profits, the earlier study showed a variety of reasons why landlords should not restrict dog or cat ownership. Despite the more expensive rent, tenants with pets were found to stay significantly longer — by an average of 23 to 46 months — than tenants without pets. The vacancy rate for pet-friendly housing and the amount of money landlords had to spend on advertis-ing was also significantly lower than “no pets allowed” rentals. Addition-ally, landlords spent less than half the usual amount of time marketing pet-friendly housing and received twice as many applicants for a vacant unit, allowing them to pick the cream of the crop in tenants.

So why are the majority of land-lords and property management companies missing out on this chance for increased profitability? Possibly it’s because of risk aversion hysteria,

exacerbated by a recent Maryland case, Tracey v. Solesky. In Solesky, the Maryland Court of Appeals held the owner and the landlord strictly liable for a bite from a “pit bull ter-rier.” However, this case is an aberra-tion because Maryland has no strict liability statute making dog owners responsible for their pets.

In contrast, Utah, like the major-ity of states, has a good strict liability statute which makes all dog own-ers, not their landlords, liable for dogs. Indeed, a Lexis-Nexis search revealed no Utah case law in which a landlord was held liable for a ten-ant’s dog. Therefore, the ramifica-tions of Solesky are not an issue in the Beehive State. Luckily for Maryland landlords, legislators have vowed to overturn the ill-conceived, judicial activist decision next session.

Size and Appearance Don’t MatterSome landlords choose to allow

only small dogs, thinking that they are less likely to be aggressive. How-ever, size doesn’t matter. According to the American Veterinary Medical Association (AVMA), breeds that were more aggressive toward people were small to medium-sized dogs, such as toy breeds and spaniels.

A dog’s appearance also is irrel-evant. There’s a strong breed stigma against pit-bull-type dogs, but con-trolled studies have not identified this breed group as disproportion-ately dangerous. Some companies — such as Stonesfair Properties, which has rental units in Arizona Montana and California — welcome all responsible dog owners and do not place any restrictions on size or breed. In 2011 Karisa Simmons, a Stonesfair Properties assistant man-ager, stated, “Not allowing pit bulls or other ‘restricted breeds’ is purely discriminatory and does not reflect any real reasoning. More damage to apartments, bite incidents, and noise complaints come to us through the breeds that most landlords welcome with open arms.”

In addition, many dogs are mis-takenly identified as “pit bulls” when they are not. DNA testing shows that it is extremely hard to visually identi-

fy the heritage of a mixed-breed dog. So while a mutt may look like a “pit bull” (which, by the way, isn’t one specific breed), the dog might really be a Labrador retriever or a whippet. The bottom line is that consideration of a dog’s behavior, not his size or breed, makes the most sense when applying rental restrictions.

Problems and SolutionsWhile some issues do arise for

landlords offering pet-friendly rental housing, there are solutions, and the economic benefits of renting to peo-ple with pets usually outweigh any

problems. Here are a few of the com-mon concerns landlords have regard-ing pets — and some solutions:

against dogs because of their breed.Landlords who rent to pet owners

for the first time might consider re-quiring the following:

• Pet sterilization (studies show that the majority of bite cases in-volve unsterilized dogs)

• Obedience training certificates

• Health or rabies vaccination cer-tificates

• Pet references

Becoming Pet-Friendly: The Right Thing to Do

A 1998 study found that 29% of pet relinquishments to animal shelters were for housing issues, primarily having to move. And the most com-

mon specific reason given for relin-quishment was “landlord refused to allow pets.” Tragically, this percent-age has probably increased with the foreclosure crisis.

Every day, more than 9,000 pets are unnecessarily killed in America’s shelters, simply because they don’t have a home. Each one of these pets is an individual; each one is a val-ued life worth saving. That number should be zero — and it can be if landlords and property management companies do their part to make more pet-friendly housing available.
