More and more American's are becoming environmen-tally conscious in the way

we live our lives. We are paying in-creasing attention to how we can help the environment as individuals and business, and more than 70% of us take environmental consider-ations into account when we make a major purchase. Going green makes sense for businesses because it is an increasingly important way to distin-guish oneself from the competition.

One way to help the environment and to help your community is to provide recycling services. One com-pany that can help is WSI Trash Va-let & Recycling, which offers door to door recycling pickup at some 5,000 apartments across the Wasatch Front. For just an extra four dollars a month residents at the Palladio Apartments in Salt Lake City get their recycling picked up right at their doorstep.

Ask The Attorney: $1,000 Deposite

Dear Attorney,My tenant paid a

$1,000 deposit, but the tenant has dam-aged the property and owes some late fees.

Can I use the deposit for these?The short answer is probably

“Yes”, but you will want to first check with your lease. Hopefully the lease specifically states what the deposit can and cannot be used for. If the lease is silent, the deposit can normally be used for charges related

to the lease or the property and in-curred by the tenant. For example, if the tenant caused $300 in damage by breaking some windows, the deposit should be able to be used since dam-age occurred on the property and would need to be repaid by the ten-ant anyway.

However, the tenant cannot force the landlord to use the deposit for fees if the landlord won’t agree to it. For example, a common situation we deal with is a tenant that tries to force the landlord to use the deposit for the last month rent. At the end of a lease, a tenant may realize that they have significant expenses coming up (moving, first month rent, deposit,

etc.) and would like to use the depos-it for the last month rent. But without the consent of the landlord the tenant cannot force this situation.

Again, the best option is to use a lease that clearly defines what you

can and cannot use the deposit for.

The apartment industry emerged as one of the stron-gest sectors coming out of the

Great Recession, and a new study shows just how much the Salt Lake City economy benefited from the rental boom. In 2013 – the latest numbers available – apartment con-struction, operations and resident spending contributed $2.7 billion locally and supported 24,800 jobs in the metro area.

The economic data are part of new research commissioned by the Na-tional Multifamily Housing Council (NMHC) and the National Apart-ment Association (NAA), which looks at dollars and jobs from apart-ment construction, operations and resident spending, nationally, by state and in 40 specific metro areas, including Salt Lake City. The data, based on research by economist Ste-phen S. Fuller, Ph.D., of George Ma-son University’s Center for Regional Analysis, are available on the website www.WeAreApartments.org.

Nationally, the apartment indus-try and its 36 million residents con-

tributed an impressive $1.3 trillion to the U.S. economy, supporting 12.3 million jobs across the U.S. in 2013.

The study showed that in the Salt Lake City metro area:

• The local economic contribution from the apartment industry totaled $2.7 billion, supporting 24,800 jobs.

• The economic contribution of local apartment construction totaled $346.7 million.

• The economic contribution of local apartment operations totaled $455.0 million.

• Apartment construction and operations supported $228.1 million in personal earnings for local workers.

• Renter spending in the Salt Lake

City metro area contributed $1.9 billion to the local economy.

• The total economic contribution of the apartment industry and its residents in Utah totaled $4.4 billion and supported 46,300 jobs.

"The Salt Lake City apartment market remains high for multiple reasons. The area's workforce is young and highly educated, jobs are growing at a healthy, consistent pace, and unemployment is at one of the lowest rates in the country. As a re-sult of the increased demand, apart-ment construction in the area is also on the rise," said Paul Smith, Execu-tive Director of the Utah Apartment Association. "The rental boon – both locally and nationally – has been fu-eled by demographic changes like the growing Millennial population and an overall rediscovery of metro-politan urban cores."

"Here in Salt Lake City, we're feel-ing the positive economic impact of the booming apartment industry, which is helping our city thrive," Smith explained. "The great news about the apartment industry is that the dollars and jobs don’t end with construction. The ongoing op-erations and resident spending make each apartment community an eco-nomic engine, supporting local jobs and making a positive economic im-pact in our area – and in towns across the country."

"Our study showed major in-creases around apartment construc-tion, with construction spending, economic contributions and personal earnings all rising substantially,” said Fuller. “The construction for multifamily apartment buildings is a significant and growing source of economic activity, jobs and personal earnings in communities nation-wide."

"According to our study findings, apartment construction has been on the rise over the past five years. In 2009, during the economic recession, there were only 97,000 construction

starts, which was the lowest level since records began in 1964. In com-parison, there were 294,000 construc-tion starts in 2013 – a significant in-crease," said NAA Chairman Tom Beaton, Senior Vice President, Man-agement, The Dolben Co.

"The most visible sign of the rental resurgence – apartment construc-tion – is on the rise, contributing $93 billion to the national economy in 2013, resulting in $30 billion going directly into the paychecks of more than 700,000 workers," said NMHC Chairman Daryl Carter, CEO of Ava-nath Capital Management. “Besides all the dollars and jobs, the increase of available apartments will also help address affordability challenges that we see in many markets across the U.S.”

In conjunction with the study’s re-lease, the website www.WeAreApart-ments.org breaks down the data by each state and 40 key metro areas. Visitors can also use the Apartment Community Estimator – or ACE – a tool that allows users to enter the number of apartment homes of an existing or proposed community to determine the potential economic impact within a particular state or metro area.

Recently we have had a rash of questions in the office about returning security deposits.

So I thought I would go over some issues with security deposits and re-mind everybody of the laws and best practices.

Return Deposits or a Disposition within 30 Days

State law requires landlords to refund deposits or send a disposi-tion (a list of charges) to the tenant 30 days after move out. There are a lot of deposit disputes. Most of them arise because the landlord doesn’t properly account for the renter’s de-posit. So, be sure to send something within 30 days.

PenaltiesIn 2014 the UAA negotiated a in-

crease in the penalties for landlords that fail to respond to their tenants

within 30 days. In return we were given a 5 day opportunity to cure (which we will talk about later). Cur-rently state law says that if a landlord doesn’t reply within 30 days and is given a 5 day “Tenants Notice to Pro-vide Deposit Disposition” form and still does nothing, then the penalties are then as follows:

• 100% of the amount of the security deposit

• $100 as a penalty

• Attorney’s fees and court costs (to the prevailing party)So, there are significant penalties

for not doing this correctly.

Three typical Landlord ResponsesWithin 30 days landlords typically

give one of these three responses. One “Dear Tenant, your deposit was $1000, you left the place immacu-late and without damage. Therefore here is your entire $1000 deposit” Two “Dear Tenant, your deposit was $1000. There were the following damages which equal $500 (list dam-ages and amounts), therefore here is a check for your $500 refund.” Three “dear tenant…. Your damages equal

$2,000. Therefore you owe me $1000, please pay this amount as soon as possible or we will vigorously pur-sue collections.

Who does the deposit go to?When there are multiple room-

mates, questions often arise about who to send the refund check to. Likewise if parties’ divorce or split up, complications arise. The best practice here is always to write the check to all of the adult names on the lease. This forces them to sort it out themselves. Landlords should never take side in deposit disputes between tenants.

What can deposits be used for?Deposits can be used to cover any

damages. Examples include: physical damage to the property, any cleaning or repairs required, past due rent, unpaid utilities, unpaid late or other fees, etc

Resident's get a continent recy-cling pick up service. The apart-ment complex gets to cut down on their trash bill. Since the Palladio began using WSI's recycling services they've cut down their trash pick-up from four pick-ups a week to three.

"It's a win win across the board for everybody," said Jarvis. "The resi-dents win, the property management facility wins, the environment wins. We all win with this program."

WSI picks up at over 5,000 apart-ments several times a week. WSI partners with other local recycling

companies to haul away their dump-sters, but for those locations, like the Palladio, that don't have room for re-cycling dumpsters WSI takes on the job of sorting, bundling and reselling the material from their Salt Lake Val-ley location.

Robert Watson from WSI noted that "up to 80 % of everything that everyone has in their apartment that they use is recyclable. You got the landfill, and if you go out there and look at it, and it just breaks your heart because as you look at it you re-alize how much doesn't even belong

there." However things are look-ing up. "We're close to two million pounds that we've saved from the landfill" said Watson.

With such an easy option available to apartment communities and their residents, more and more apartments are participating. "When we all do this together, every little bit adds up and it makes a huge difference," said Watson.

The UAA App provides a way of tying to-gether all of these different forms of com-munication from the association together in

a way that is accessible to the modern tech savvy member.

The app has been designed to provide a single interface that allows the user to access:

• Educational Videos from the UAA Website

• News feed from various social media platforms

• A digital Membership Directory (including subcategories for Property Management Companies, Independent Owners, Apartment Communities and Vendors)

• Publications (starting with the Landlord Guide)

• A link to the UAA Facebook page

• A notifications feature that allows the UAA to send out digital notification to users

• A feedback option that allows users to send an email from the app to the UAA staff

We are excited to announce that due to popular demand we are expanding our 2015 UPRO schedule to include more

classes. In addition to new morning classes, we are now making evening classes available for those who cannot come in the morning or for those who would like to finish the series quicker by attending both the morning and evening classes.

The series is made up of 8 four hour modules for a total of 32 hours of Real Estate CE Credit. The classes can be taken in any order, and can be pur-chased one at a time or all up front. For more infor-mation contact the UAA.
