• Those who are teaching in elementary school children called as theunsung heroes in the society. They do not work for prestige orfinancial rewards and Mrs Pettit one of the dedicated teachers. Shehad been teaching mentally disabled students for over thirteen years.School authority was fully satisfied with her teaching performance.But suddenly her carrier came to end.

• Pettit and her husband used to lead liberal sexual life such as `wife swapping`. Once they share their ideas on two local television shows but they wore disguises. Although one of her colleagues recognized them and he shared Mrs Pettit views to others. After one year later, one undercover police officer discovered her on diverse sexual parties. And he saw Mrs Pettit perform fellatio on three different men in a one-hour period. She was arrested for oral copulation and she found guilty under California Penal Code for that she paid fine.

• Two years later, school`s disciplinary proceedings against heralthough The State Education found no reason to complainabout her service as a teacher. But the board cancelled herschool life Diploma which is her licence to teach. They showedreason that she was engaged in immoral and unprofessionalconduct at the party. Pettit fought against the decision of TheState Board of Education until the California Supreme Court.Court found no reason to declared Pettit was unfit to teachaccording to majority`s opinion. Pettit`s actions were privateand could not affected her teaching ability. The whole issueswould never have arisen unless had there not been clandestine

surveillance.

• Yes, we believe that The Board of Education violate her right

to privacy.

• From study we found that she was a great teacher and there

was no question about her teaching performance. What she did

in the private party, it was her personal life and there was no

connection between her personal life and professional life

activates. Even though, there is a connection between personal

and professional life what she did in her personal life it did not

affected her students in the classroom.

• Considering that, when an employee is not on duty, do

any immoral activates. It affect in the reputation of the

employer company. When Pettit perform fellatio with

three different men within an hour in a private party

and arrested by police. It affected in the reputation of

school and The State board of Education. So, The

State Board of Education concern with Pettit`s Life

style was legitimate and it was employment related.

• The concept of Maqasid Al Shariah entails understanding the Islamic

principal of preventing harm, which state that a person cannot harm or cause

grief to others while engaging its personal activates.

• Protection of owner is one of the Maqasid Al Shariyah. Privacy in Islam is

included with this. So, when police saw her, he should not express that to

anybody. There is Privacy in the Quran and Sunnah,
