Graduation: Beyond the school of Hard Knocks

There is nothing more powerful for your company and your employees than the investment you make in their education and training.

Growing up in the construction industry gave me a bird’s eye view of the historical effort that we put into training….and it’s not pretty. It’s called “the school of hard knocks.” The construction industry has traditionally relied on employees learning in the field and acquiring knowledge and experience as they go. If they had

the drive and initiative to apply themselves, and a supervisor that was willing to teach them, then they were the lucky and fortunate ones. Otherwise, they were in for a long ride with little opportunity for growth and development.

I’ve been there. When I was growing up, each Ghilotti brother was in charge of their nephew. My father Mario, supervised my cousin Dick when he was starting out, and my uncle Dino was in charge of me (this was designed to keep the father from being “soft” on his son…).

So flash back to 1983, and the summer before my senior year in college, where I found myself still on the back end of a shovel and jack hammering in a ditch on Anderson Drive in San Rafael.

Despite having done basically the same routine for the last 5 years, I was okay with the process, because I knew that eventually I’d get my shot.

Those that can’t, coach/teach. Supervisors are ex-doers. They aren’t normally the ones with the skill-set to do and teach.

But how does that work for the rest of the guys that didn’t have the same last name as the one on the side of the truck? Are they willing to stick it out until someone notices them and gives them their shot?

Our industry is notorious for being made up of hard working guys that will just put their head down, work harder and persevere. But is that really how our industry is going to raise the bar for the quality of new employees that we attract? Is that the way to develop talent for the future?

Of course the answer is no. Especially with today’s workforce. This group is used to having access to everything, immediately. Patience is not a redeeming quality for most. They want to know the answers to three “w’s” and “h” before they’ll commit—When am I going to get my shot? What am I supposed to know? Why am I supposed to know it? And how do I get access to the information you say I’m supposed to know?

Have you ever been out on a jobsite and overheard a supervisor tell someone, “I’ll tell you what you need to know when I want you to know it.” Or how about that always-encouraging response, “You’re not getting paid to think…”?

Is this really the foundation that we want to grow and develop our industry? If you research “increases in productivity” over the last 50 years, you will find construction down at the bottom of the list. We can, and need, to do better.

Now the hard part—how do we do it? When you think about it, it’s not the supervisors’ fault. Those that do, do.

UCON has many of the tools necessary to train and educate mid-level managers and admin personnel. Utilize them. Invest in your team. Help them to “be all that they can be.” They’ll be glad you did; you’ll be glad you did, and so will your bottom-line. u

WORkSSan Francisco Setting the Partnering Pace for 2013Six San Francisco Agencies Adopt Construction Partnering Program

San Francisco hasn’t quite topped the charts when it comes to creating a business friendly environment, but it’s never too late to change, and change often begins with one positive step. That step occurred on December 18th, when six City and County of San Francisco agencies announced their adoption of formalized construction partnering programs for all projects, effective January 1, 2013.

In an executive directive signed by San Francisco Mayor Ed Lee, six City departments, including the San Francisco Department of Public Works (SFDPW), the San Francisco Public Utilities Commission (SFPUC), the San Francisco Municipal Transit Agency (SFMTA), and the San Francisco Recreation and Parks Department,

will utilize the International Partnering Institute (IPI) Collaborative Partnering Model for all future City construction contracts and include partnering language in bid specifications and contracts.

This Collaborative Partnering Model is a formalized, non-adversarial approach to construction-project delivery that emphasizes creating mutual goals, improving accountability and developing dispute-resolution protocols. The resulting collaborative culture will improve schedule, budget, quality and safety.

For UCON and the contractors who bid and perform work within the City and County of San Francisco, this effort has been a long time coming.

The recommendations were developed through the Industry-San Francisco Contractor Liaison Partnering Subcommittee, which met in July and September of last year. The Subcommittee is comprised of representatives from SFO, SFPUC, SFDPW, and SFMTA, the Office of the City Attorney, various City contractors, UCON, AGC, CEA, and the National Association of Minority Contractors (NAMC). The Subcommittee is co-chaired by DPW Director Mohammed Nuru and 2013 UCON President Mike Ghilotti of Ghilotti Bros., Inc. Mike is also a founding member of IPI.

really improving the culture of their construction program and improving the business environment for contractors and subs working in San Francisco.”

UCON knows that it is essential for contractors and owners to have opportunities to meet face to face and work together on challenging issues. We are confident that this structured, collaborative approach will translate to enhanced productivity, increased job satisfaction for the workers in the field and a better value for the taxpayers.

Each participating City department will determine the level of partnering to be utilized for each project, based on the City and County of San Francisco Vertical & Horizontal Construction Project Partnering Profile, created by the subcommittee. Furthermore, each agency will develop internal procedures for implementing partnering practices and identify a point person as a “partnering champion” for each department. ACTIONLeading the Charge to Protect IndustryUCON Stands Out for Contractors on CriticalCA Supreme Court Case

Every so often a court case comes along where the outcome bares tremendous weight not just for the parties directly involved but for our entire industry. When these critical cases arise, United Contractors (UCON) steps in as the voice for contractors. When we say we’re “taking action,” we mean it.

In December 2012, at the direction of our Board of Directors, UCON’s counsel filed an amicus brief with the California Third District Court of Appeal in the case of Department of Water Resources v. Whitaker Contractors, Inc., the result of which will have far reaching impacts on the entire construction industry.

What’s at Stake: To decide this appeal, the Court must determine whether the Depart-ment had the right to terminate Whitaker. The Court’s determination of this appeal therefore requires that it decide under what circumstances a construction contract subject to the State Contract Act may be terminated for default. The Department of Water Resources (DWR) is asking the Court to employ a highly subjective standard for termination.

The subjective and deferential standard that the Department demands be utilized will lead only to arbitrary action and abuse by public agencies. As a result, on behalf of all of our contractor members, and on behalf of California taxpayers, United Contractors is asking the Court to confirm that a public works construction contract can only be terminated for default if the contractor performing the contract is in unexcused material default of its obligations under the contract.

Why this Matters:DWR is arguing that it should be allowed to terminate a contractor’s right to perform a construction contract when the Department’s personnel subjectively believes that a contractor will not be able to complete its work in a timely manner and therefore is likely to breach the contractor.

UCON believes that DWR’s position in this appeal conflicts with controlling statutory authority and established public policy. A public agency may only terminate a contract for default when there actually has been a default. UCON recognizes that to allow termination for default for anything less is to invite arbitrary action and abuse of discretion by public agencies, which ultimately will result in the State and its taxpayers being burdened with litigation from improper contract terminations and higher costs to have construction work performed.

What This Means for You:The vast majority of our contractor members do at least some, and most, a significant amount, of public works projects. If the “Owner” wins on this case, public owners, who we already have seen grow increasingly unreasonable with contractors over the years, will have an absurd amount of discretion in terminating contractors, and not dealing with them fairly in administering their contracts in general.

On the other hand, if the contractor wins, this could be a critically important tool that could help protect contractors from Owners who are incompetent or mean spirited.

Taking the Lead for Industry:UCON knows that a default termination can be a “death sentence” for a contractor, making it impossible to obtain bonding or to prequalify for work with public agencies. That is why ucon is the only industry association making the case to the court that a termination for default is too drastic a remedy to invoke subjectively. Additionally, it is neither fair nor consistent with

California law for an agency to terminate a contract for default when the contractor is not actually in default. If a public agency can terminate a contract or just threaten to terminate – based on nothing more than the belief of its personnel that a default has occurred -- contractors will only be discouraged from bidding and prices for construction will increase.

What now:It will likely be several months before the Court of Appeals issues a notice setting the case for oral argument. We will continue to keep you up to date on this important case. If you have any questions you can contact us anytime!

Kevin Albanese named One of enr’s Top 20 Under 40 Congratulations to Kevin Albanese, Joseph J. Albanese, Inc. for making ENR California’s annual list of the Top 20 Under 40, a competition, which celebrates the excellence of young design and construction professionals around the state. In its third year, the Top 20 Under 40 contest drew its largest collection of entries. An independent jury judged candidates on the basis of their career experience; industry leadership; community service; and other factors. Duran & Venables, Inc. Raises Food for a Good Cause Duran & Venables helped raise a mountain of food for the Milpitas Food Pantry, which marks their 6th year in a row for this charity event. “This event has become so essential in keeping up morale for our company and vendors, as well as our community,” said Sean Venables, president of Duran & Venables. “With the help of employees and vendors, we were able to collect nearly 4500 pounds of food to donate to the Pantry.”

The Milpitas Food Pantry is part of the Second Harvest Food Bank, which assists residents of Milpitas and Alviso by an emergency food box program that distributes food to low and no-income residents.

The month-long Food Drive was held at Duran & Venables’ local office of operations in Milpitas, where they hosted a barbeque to thank employees and vendors for their support, and to present their donations to the Milpitas Food Pantry. Other local vendors that helped contribute

food and prizes for the raffle included: AAA Fence, Broom Service, CB Trucking, Granite Construction, GraniteRock, GreenWaste, Hammer Trucking, Hertz Equipment Rental, Papé Machinery, Peterson CAT Tractor, Pioneer Machinery, Preston Pipelines, Renn Transport, RGW Equipment Rentals, Rich Voss Trucking, SB Transport, SITECH-NorCal, StateWide Traffic Safety & Signs, Stevens Creek Quarry, Sunbelt Rentals, White Cap, and Winchester Auto.
