1. Scope of Determination

This Determination applies to the undermentioned Ministers ofthe Crown and Officers and Members of Parliament.

2. Electorate Allowances for Members

(1) There shall be payable to a member in respect of theexpenses of discharging duties in the electoral district the memberrepresents, an electorate allowance at the following annual rate:

(a) a successor is elected as a member in his or her place; or

(b) the office is filled by someone other than the formermember,

whichever first occurs.

5. Country Member’s Accommodation Allowance

A member of either House of Parliament (including a Ministerof the Crown or the Leader of the Opposition in the House ofAssembly) whose usual place of residence is more than 75 km byroad from the General Post Office at Adelaide and who is requiredto stay in Adelaide overnight in order to attend not only toParliamentary duties but also to the member’s duty to be activelyinvolved in community affairs and to represent and assistconstituents in dealings with governmental and other publicagencies and authorities, shall be paid an accommodationallowance up to one hundred and fifty-eight dollars ($158) foreach such night up to a maximum of twenty-one thousand threehundred and thirty dollars ($21 330) in each twelve month period,the first such period commencing from 1 July 2000.

6. Travelling and Accommodation Allowances

(1) A Minister who actually incurs expenditure when travellingon official business shall be paid:

(a) outside the metropolitan area, as defined by theDevelopment Plan published pursuant to Part 4 of thePlanning Act 1982, but within the State—up to onehundred and seventy-five dollars ($175) per day;

(b) Interstate—up to three hundred and twenty-three dollars($323) per day for Sydney and up to three hundred andeleven dollars ($311) per day for places other thanSydney;

(c) any extra expenditure necessarily incurred in addition tothe allowances provided in (a) and (b) above.

(2) The allowances provided by this clause shall also be payableto the Leader of the Opposition who actually incurs expenditurewhen travelling on official business, and to the Deputy Leader ofthe Opposition when he or she deputises, at the Leader’s request,for the Leader of the Opposition in his or her official capacity.

7. Date of Operation

The provisions of this Determination, which supersede those ofall preceding Determinations, with the exception of Clause 5which shall operate from 1 July 2000, shall operate from9 February 2002.

DEVELOPMENT ACT 1993, SECTION 48: DECISION BYTHE DEVELOPMENT ASSESSMENT COMMISSION ASDELEGATE OF THE GOVERNOR

Preamble

1. The decision of the Governor under section 48 of theDevelopment Act 1993, to approve the development of HoldfastShores Stage 2A development located adjacent to Chappell Drive,Glenelg was published in the Government Gazette on 8 June2000.

2. An amended proposal to develop the Holdfast Shores Stage2A development was subsequently considered and approved by theDevelopment Assessment Commission and published in theGovernment Gazette on 7 December 2000.

3. A further amended proposal to develop the Holdfast ShoresStage 2A development was subsequently considered and approvedby the Development Assessment Commission and published in theGovernment Gazette on 1 March 2001.

4. Another further amended proposal to develop the HoldfastShores Stage 2A development was subsequently considered andapproved by the Development Assessment Commission andpublished in the Government Gazette on 17 May 2001.

5. A subsequent amended proposal to develop the HoldfastShores Stage 2A development has now been under considerationunder Division 2 of Part 4 of the Development Act 1993.

6. The proposed amendments include:

(a) an increase in café/restaurant seats;

(b) the inclusion of outdoor seating;

(c) an increase in bar area;

(d) a decrease in lounge areas;

(e) a decrease in function areas;

(f) a marginally smaller winter garden lounge;

(g) a smaller coffee shop area;

(h) minor changes to the house layout and circulation areas;and

(i) the provision of an accessway on the eastern façade atthe northern end.

7. The amendments to the development are contained in:

(a) the letter from Woodhead International on behalf of theHoldfast Shores Consortium to the DevelopmentAssessment Commission dated 26 November 2001;

(b) the report entitled ‘Holdfast Shores Stage 2—Pier HotelGround Floor Variations’ prepared by Master Plan SAPty Ltd dated November 2001;

(c) the letters on ‘Car parking review of amendment nos 2/3with a variation including the final layout of groundfloor’ from Murray F. Young and Associates dated 21November 2001 and 13 December 2001; and

(d) the following plan prepared by Terence R. FeltusArchitect:

• Ground Floor Fit-out Plan supplementary plan SP64amendments dated 20 November 2001.

8. The Development Assessment Commission has, in consider-ing the application, had regard to all relevant matters under section48 (5) of the Development Act 1993.

9. The Development Assessment Commission is satisfied thatthe amendments do not require the preparation of a further oramended Development Report.

Decision

PURSUANT to section 48 of the Development Act 1993, theDevelopment Assessment Commission, as delegate of theGovernor, grants development approval to the amended HoldfastShores Stage 2A proposal located adjacent to Chappell Drive,Glenelg for a hotel, car parking, landscaping and associatedworks, subject to conditions.

2. No works may be commenced unless and until:

(a) a private certifier or the City of Holdfast Bay hascertified to the Development Assessment Commissionthat all work that constitutes building work under theDevelopment Act 1993, complies with the BuildingRules;

(b) an Environmental Management Plan (EMP) has beenprepared in consultation with the Environment Protec-tion Authority and the City of Holdfast Bay to addressthe management issues during construction. Matters tobe addressed in the EMP must include:

• traffic management during construction, includingtransport beyond the development site;

• control and management of construction noise;

• dust and mud control;

• working hours;

• stormwater management during construction;

• site security and fencing;

• disposal of building waste and refuse;

• protection and cleaning of roads and pathways;

• site clean up; and

(c) adherence to all relevant Environment ProtectionAuthority codes of practice for construction sites.

3. The hotel must not be used or occupied for the purposesoutlined in the application until:

(a) all car parks proposed for Stage 2A have beenestablished in accordance with the plans listed inCondition 1 (e);

(b) plans for street furniture and directional signs for Stage2A (including siting, elevations and materials) have beenprepared by the proponent to the satisfaction of theDevelopment Assessment Commission in consultationwith the City of Holdfast Bay;

(c) plans for public art for Stage 2A in accordance with plan21 entitled ‘Public Art Masterplan’ and dated December1999 (including siting, elevations and materials) havebeen prepared by the proponent to the satisfaction of theDevelopment Assessment Commis-sion in consultationwith the City of Holdfast Bay;

(d) lighting of all external areas has been provided to thesatisfaction of the Development Assessment Commis-sion to ensure the safety of users of the pedestrian pathsand plazas; and

(e) (i) plans for the drainage of stormwater from the Stage2A site (including siting, elevations and materials)have been prepared by the proponent to thesatisfaction of the Development Assessment Com-mission in consultation with the City of HoldfastBay;

(ii) stormwater infrastructure has been installed inaccordance with the plans prepared pursuant tocondition 3 (e) (i) to the satisfaction of theDevelopment Assessment Commission in consulta-tion with the City of Holdfast Bay; and

(iii) stormwater infrastructure is operational.

4. Street furniture and directional signs for the Stage 2Adevelopment must be established in accordance with the plansprepared pursuant to condition 3 (b) within six months of the firstoccupation of the hotel to the satisfaction of the DevelopmentAssessment Commission.

5. Public art for the Stage 2A development must be establishedin accordance with the plans prepared pursuant to condition 3 (c)within six months of the first occupation of the hotel to thesatisfaction of the Development Assessment Commission.

6. The car parking areas must be designed in accordance withAustralian Standards 2890.1-1993 and line markings must bemaintained in good and substantial condition at all times.

7. The pedestrian paths and plazas proposed in the application,including the area situated between the existing Glenelg Surf LifeSaving Club and the hotel building, must be open for pedestrianuse from the commencement of use and occupation of the hoteland must then be kept open for pedestrian use at all times.

8. An iron-barred gate of at least 1.5 m in height must beconstructed at the entrance to the stairwell on the south-easterncorner of the hotel building.

9. Access for service deliveries and waste disposal vehicles atthe hotel plaza level must only be allowed between 7 a.m. and10 a.m. daily.

10. The proposed toilets to replace the existing toilets adjoiningthe kiosk on the north-eastern side of the site must be establishedto the satisfaction of the Development Assessment Commission inconsultation with the City of Holdfast Bay prior to the demolitionof these existing toilets.

11. Driveways, parking and manoeuvring areas and footpathsmust be kept illuminated during the hours of darkness when thebar and lounge facilities are open to the public, and such lightsmust be directed and screened so that drivers are not distracted bylights.

12. Landscaping proposed in the application must be estab-lished before the first occupation of the hotel and plants must bemaintained in good health and condition at all times. A plant mustbe replaced if or when it dies or becomes seriously diseased withinthe first growing season after the plant dies or becomes seriouslydiseased.

13. Vegetation proposed to be established along the westernedge of the undercroft parking of the hotel must:

• provide sufficient foliage and density of planting to screenthe undercroft to ensure that the presence of cars is notobtrusive when viewed from the promenade; and

• not unreasonably inhibit ventilation from the undercroftparking areas (which may require pruning or thinning ofthe vegetation from time to time).

14. Management of stormwater from the Stage 2A site mustcomply with the Environment Protection Authority’s ‘StormwaterPollution Prevention Code of Practice for Local, State and FederalGovernment’ during construction of the Stage 2A development.

15. The quality of any stormwater entering the Holdfast Shoresmarina from the Stage 2A development must comply with theguidelines applicable to secondary recreational use and theprotection of aquatic ecosystems within the ANZECC AustralianWater Quality Guidelines for Fresh and Marine Waters(November 1992), or any standard that may be subsequentlysubstituted therefore.

16. Stormwater from the Stage 2A site must not be disposed ofby way of a pipe or similar structure that conveys the stormwaterto the beach.

17. Site works, construction work and truck movements to andfrom the site must only be carried out between 7 a.m. and 6 p.m.,Monday to Saturday inclusive.

18. Payment of $1 620.00 shall be made into the Planning andDevelopment Fund (one allotment @ $1 620.00 per allotment).Cheques shall be made payable and marked ‘Not Negotiable’ tothe Development Assessment Commission and payment made onLevel 5, Roma Mitchell House, 136 North Terrace, Adelaide,(opposite the Railway Station) or sent to G.P.O. Box 1815,Adelaide, S.A. 5001.

NOTES TO THE APPLICANT:

1. The plans and documents referred to in Condition 1 of theapproval together describe the development hereby approved.

2. No advertising signs are hereby approved. The display of anyadvertising sign will require separate approval.

HOUSING IMPROVEMENT ACT 1940

WHEREAS by notice published in the Government Gazette on the dates mentioned in the following table the South Australian HousingTrust did declare the houses described in the said table to be substandard for the purposes of Part VII of the Housing Improvement Act1940, the South Australian Housing Trust in the exercise of the powers conferred by the said Part, does hereby fix as the maximumrental per week which shall be payable subject to section 55 of the Residential Tenancies Act 1995, in respect of each house described inthe following table the amount shown in the said table opposite the description of such house and this notice shall come into force on thedate of this publication in the Gazette.

DEVELOPMENT ACT 1993

Car Parking Fund

NOTICE is hereby given that the Minister for Transport andUrban Planning has approved the establishment of a Car ParkingFund by the City of Holdfast Bay, pursuant to section 50A of theDevelopment Act 1993.

The car parking fund applies to the area of Glenelg comprisedin the District Centre Zone, as designated on Map HoB/5 of theHoldfast Bay (City) Development Plan. The Fund shall be knownas the City of Holdfast Bay Car Parking Contributions Fund. TheCouncil has determined that the contribution rate will be $12 000per space for applicants for development approval providing cashpayment in lieu of car parking spaces. The rate may be varied byfurther determination, notice of which will be published in theGazette.

Pursuant to section 50A of the Development Act 1993, the CarParking Fund will come into operation upon publication of thisnotice.

Roads (Opening and Closing) Act 1991

NOTICE is hereby given that in accordance with section 10 of theRoads (Opening and Closing) Act 1991, the City of Mitchamproposes to make a Road Process Order to close the followingroad in the Hundred of Adelaide, being a triangularly-shapedportion of Hillcrest Drive, Eden Hills situate along and adjoiningportion of the northern boundary of allotment 8 in Deposited Plan3570 and marked ‘A’ on Preliminary Plan No. PP02/0014.

BY-LAW MADE UNDER THE DOG AND CAT MANAGEMENT ACT1995 AND THE LOCAL GOVERNMENT ACT 1999

By-law No. 4—Dogs

TO limit the number of dogs kept on premises and for themanagement of dogs in the council’s area.

Definitions1. In this by-law:

(1) ‘Dog’ has the same meaning as in the Dog and CatManagement Act 1995.

(2) ‘Small dwelling’ means a flat, a serviced flat, home unit,strata unit, community lot, or a suite of rooms which iswholly occupied, or designed or intended to be occupied,as a separate dwelling, but does not include a detached,semi-detached or row dwelling house.

(3) ‘Detached dwelling’, ‘row dwelling’ and ‘semi-detacheddwelling’ have the same meanings as in Schedule 1 ofthe Development Regulations 1993.

(4) ‘Dog and Cat Management Officer’ is a personappointed by council as such, pursuant to the Dog andCat Management Act 1995.

(5) ‘Approved kennel establishment’ means a building,structure or area approved by relevant authority; pursuantto the Development Act 1993, for the keeping of dogs ona temporary or permanent basis.

(6) ‘Guide dog’ means a dog used for guiding a person whois wholly or partially blind, or wholly or partially deafand that has undergone the accredited training.

Limit on Dog Numbers2. (1) The limit on the number of dogs kept shall be:

(a) in a small dwelling, one dog;

(b) in premises other than a small dwelling, two dogs.

(2) No person shall, without obtaining written permission of thecouncil, keep any dog on any premises where the number of dogsexceeds the limit:

(a) unless the premises is an approved kennel establish-ment; or

(b) the council has exempted any premises from compliancewith paragraph 2 of this by-law by the granting of anexemption.

Existing Dogs3. Paragraph 2 does not stop a person from continuing to keep a

dog at the addresses at which that dog was registered immediatelybefore the commencement of this by-law.

Dog Free Areas4. (1) No person shall, in a place to which this paragraph

applies, cause, suffer or permit any dog (except a guide dog),under that persons control or authority to be or remain in thatplace.

(2) Signs shall be erected to denote land to which this paragraphapplies.

Dogs on Leashes

5. (1) No person shall, in a place to which this paragraphapplies, cause, suffer or permit any dog under that person’scontrol, charge or authority to be or remain in a place unless suchdog is restrained by a strong leash not exceeding 2 m in length andeither tethered securely to a fixed object or held by a personcapable of controlling the dog and preventing it from being anuisance or danger to other persons.

(2) Signs shall be erected to denote land to which this paragraphapplies.

Dog Exercise Areas

6. (1) Any person may enter upon any part of local govern-mentland to which this paragraph applies for the purpose of exercisinga dog under his or her control.

(2) Where a person enters upon such part of local governmentland for that purpose, he or she shall ensure that the dog or dogsunder his or her control remain under effective control (within themeaning of the Dog and Cat Management Act 1995) while on thatland.

(3) Signs shall be erected to denote land to which this paragraphapplies.

Application of Paragraphs

7. Paragraphs 4, 5 and 6 of this by-law shall apply only in suchportion or portions of the area as the council may by resolutiondirect (in accordance with section 246 (3) (e) of the LocalGovernment Act 1999).

The foregoing by-law was duly made and passed at a meeting ofthe council of the City of Tea Tree Gully held on 12 February2002, by an absolute majority of the members for the time beingconstituting the council, there being at least two-thirds of themembers present.

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999

By-Law No. 3—Streets and Roads

FOR the management, regulation and control of activities onstreets and roads.

Definitions

1. In this by-law:

(1) ‘Authorised Person’ means a person appointed anauthorised person pursuant to Section 260 of the LocalGovernment Act 1999.

(2) ‘Emergency Vehicle’ has the same meaning as in theAustralian Road Rules 1999 and the Road Traffic (RoadRules—Ancillary and Miscellaneous Provisions)Regulations 1999.

(3) ‘Road’ has the same meaning as in the LocalGovernment Act 1999.

Activities Requiring Permission

2. No person shall without permission on any street or road:

Work on Vehicles

(1) perform the work of repairing, washing, painting, panelbeating or other work of any nature on or to any vehicle,except for running repairs in the case of a breakdown;

Preaching

(2) preach or harangue;

Donations

(3) Ask for or receive or indicate that he or she desires adonation of money or any other thing;

Amplification

(4) use an amplifier or other device whether mechanical orelectrical for the purposes of amplifying sound orbroadcasting announcements or advertising;

Canvassing

(5) Convey any advertising, religious or other message toany bystander, passerby or other person except for anymessage or material conveyed for the purpose of a Local,State or Federal election;

Posting of Bills etc

(6) Post any bills, advertisements or other papers or items ona building or structure on a street or road;

Movement of Animals on Roads

(7) (a) The owner or person in charge of any cattle orhorses that are driven over, across or along any roadin any town or township, shall forthwith after suchanimals have completed their passage remove anydung left by those animals during their passage;

(b) The person responsible for looking after any cattle,sheep, goats, horses or other farm animals (but notdogs or cats) shall ensure that any of those animals donot move across, along or on any road unattended.

Removal of Animals and Persons

3. (1) If any animal is found on any part of a road in breach of aby-law:

(a) Any person in charge of the animal shall forthwithremove it from that part on the request of an authorisedperson; and

(b) An authorised person may remove it if the person fails tocomply with the request, or if no person is in charge ofthe animal.

(2) An authorised person may direct any person who isconsidered to be committing or has committed a breach of this by-law to leave that part of the road. Failure to comply with thatdirection forthwith is a breach of this by-law.

Exemptions4. The restrictions in this by-law do not apply to any Police

Officer, Council Officer or employee acting in the course andwithin the scope of that person’s normal duties, or to a contractorwhile performing work for the Council and while acting under thesupervision of a Council Officer, or an emergency worker whendriving an Emergency Vehicle.

Construction5. This by-law is subject to any Act of Parliament and

Regulations made thereunder.

The foregoing by-law was duly made and passed at a meeting ofthe Light Regional Council held on 19 February 2002, by anabsolute majority of the members for the time being constitutingthe Council, there being at least two-thirds of the memberspresent. This by-law will come into effect pursuant to Sections249 (6) (b) and (d) of the Local Government Act 1999.

By-Law No. 4—Local Government Land

FOR the management and regulation of activities and access tolocal government land vested in or under the control of council(except streets and roads).

Definitions1. In this by-law:

(1) ‘Emergency Vehicle’ has the same meaning as in theAustralian Road Rules 1999 and the Road Traffic (RoadRules—Ancillary and Miscellaneous Provisions) Regu-lations 1999;

(2) ‘local government land’ means land owned by thecouncil or under the council’s care, control andmanagement (except streets and roads);

(3) ‘the Council’ means the Light Regional Council;

(4) ‘authorised person’ as defined in the Local GovernmentAct 1999.

Activities requiring permission2. No person shall without permission on any local government

land:

Vehicles Generally(1) (a) being the driver of a vehicle, fail to obey the

indications given by any sign erected by or with theauthority of the Council, for regulating traffic orindicating the direction or route to be followed bytraffic on that land;

(b) drive or propel a vehicle on any part thereof wherethe Council has excluded vehicles generally, or ofthat class, pursuant to Section 359 of the LocalGovernment Act 1934;

Vehicles on parklands and cemeteries

(2) comprising a cemetery or parkland or reserve;

(a) drive or propel a vehicle thereon, (except awheelchair), unless on an area, path, or roadconstructed or set aside by the Council for theparking or travelling of that kind of vehicle;

(b) promote, organise or take part in any race, test ortrial of any kind in which motor vehicles, motorcycles, motor scooters or bicycles take part (exceptin parklands or a reserve on a properly constructedarea for the purpose);

Trading

(3) (a) carry on the business of buying, selling, offering orexposing for sale or the hiring or leasing of anygoods, merchandise, commodity, article, service orthing (including any vehicle, watercraft or aircraft);or

(b) set up a van or other vehicle or stall or otherstructure, tray, carpet or device for the purpose ofbuying, selling, offering or exposing for sale or thehiring or leasing of any goods, merchandise,commodity, article, service or thing (including anyvehicle, watercraft or aircraft);

Advertising

(4) display any sign for the purpose of commercialadvertising, other than a moveable sign which isdisplayed on a public street or road in accordance withany by-law of the Council concerning moveable signs;

Fires

(5) light or maintain any fire, except:

(a) in a place provided by the Council for that purpose;or

(b) in a portable barbecue;

Tents

(6) erect any tent, booth, marquee or other structure (exceptthe Council or Government);

Camping

(7) camp or stay overnight;

Attachments to trees

(8) attach, hang or fix any rug, blanket, sheet, rope or othermaterial to any tree, shrub, plant, tree guard, tree stake,notice board, seat, fence, post, wall or other item orstructure the property of Council;

Flora and fauna

(9) Subject to the Native Vegetation Act 1991, and theNational Parks and Wildlife Act 1972:

(a) damage, pick or interfere with any plant or flowerthereon; or

(b) tease, or cause harm to any animal, bird or marinecreature;

Athletic and ball sports

(10) (a) promote, organise or take part in any organisedathletic sport;

(b) to which this subparagraph 2 (10) (b) applies, playor practice any game which involves kicking, hittingor throwing a ball;

No Liquor

(11) to which this subparagraph 2 (11) applies, (except streetsand roads which are not part of parklands or reserves),consume, carry or be in possession or charge of anyliquor;

Swimming

(12) swim or bathe in any pond or lake to which this sub-paragraph (12) applies;

Fishing

(13) (a) fish in any pond or lake to which this sub-paragraph2 (13) (a) applies;

(b) fish from any bridge or structure;

Animals in Ponds

(14) to which this subparagraph 2 (14) applies, allow orsuffer any animal to enter or remain in a pond or lake;

Removal of Soil etc.

(15) carry away or remove any soil, sand, timber, stones,pebbles, other inorganic or organic materials or any partof the land;

Fruit Picking

(16) pick fruits, nuts or berries from any tree or bush;

Weddings and Private Ceremonies

(17) conduct or participate in a group ceremony on any landor reserve;

Cemeteries

(18) comprising a cemetery:

(a) bury or inter any human or animal remains;

(b) erect any memorial;

Use of Boats

(19) use a boat in any pond or lake to which this sub-paragraph 2 (19) applies;

Closed Lands

(20) enter or remain on any part of local government land:

(a) at any time during which the council has declaredthat it shall be closed to the public;

(b) where the land is enclosed with fences and/or wallsand gates, at any time when the gates have beenclosed or locked; or

(c) where admission charges apply, to enter withoutpaying charges;

Prohibited activities

3. No person shall on local government land:

Smoking

(1) smoke tobacco or any other substance in any building orpart thereof to which this subparagraph 3 (1) applies;

Use of equipment

(2) use any equipment or Council property other than in themanner and for the purpose for which it was designed orset aside;

Annoyances

(3) annoy or unreasonably interfere with any other person’snormal use of the land by making noise or creating adisturbance;

Interference with permitted use

(4) interrupt or disrupt to interfere with any person’s use ofparklands or reserves for which permission has beengranted.

Restricted Lands

4. No person shall enter or remain on any part of localgovernment land except a public street or road:

(1) at any time during which the Council has by resolutiondeclared that part to be closed to the public, and which isindicated by sign adjacent to the entrance to the part; or

(2) where the land is enclosed with fences and/or walls andgates at any time when the gates have been closed andlocked; or

(3) at any time when the Council has fixed a fee for entry tothat part, without payment of the fee, or otherwisewithout permission.

Removal of Animals and Persons5. (1) If any animal is found on part of local government land

in breach of a by-law:(a) Any person in charge of the animal shall forthwith

remove it from that part on the request of an authorisedperson; and

(b) An authorised person may remove it therefrom if theperson fails to comply with the request, or if no person isin charge of the animal.

(2) An authorised person may direct any person who isconsidered to be committing or has committed a breach of this by-law to leave that part of the local government land. Failure tocomply with that direction forthwith is a breach of this by-law.

Application6. Any of paragraphs 2 (10) (b), 2 (11), 2 (12), 2 (13) (a),

2 (14), 2 (19) or 3 (1) of this by-law shall apply only in suchportion or portions of the area as the Council may by resolutiondirect (in accordance with Section 246 (3) (e) of the LocalGovernment Act 1999).

Exemptions7. The restrictions in this by-law do not apply to any Police

Declaration of an area of the State in which a person mayoperate a gas fire or electric element for cooking purposes in the

open air contrary to the terms of a total fire ban

PURSUANT to Regulation 33 (3) of the Country Fires Act 1989,the District Council of Mallala declares that persons may operategas fires or electric elements for cooking purposes in the open aircontrary to the terms of a total fire ban at the following places:

• Port Parham Camping Ground

This notice operates at all times until revoked.

The operation of a gas fire or electric element under this noticeis subject to the following conditions:

1. The space immediately around and above the gas fire orelectric element must be cleared of all flammable material toa distance of at least 4 m.

2. A person who is able to control the gas fire or electricelement must be present at all times while it is lighted orcharged.

3. An appropriate agent adequate to extinguish any firemust be at hand.
