TheappointmentisinrecognitionofthePMAasthenationalassociationofprovidersforphysiciansandiscontainedintheMemorandumofUnderstanding(MOU)signed

May14,2012.TheMOUfurtherstatesthatPhilHealthshallfollowthePMAclassificationorcategorizationbasedonthemember’sspecialtyorsubspecialty,certification,trainingandexperience. TheMOUrequiresthephysiciantobeaPMAmemberingoodstandingandtohaveactive,continuousandupdatedPhilHealthmembership.ItalsodirectsthePMAtocollectthePhilHealthparticipationfeeoffivehundredpesos(P500.00)peryearpermemberwhichtheformerwillremitASAPtothelatter.

TheresolutiontoextendthecorporateexistenceofthePMAforanother50yearswasunanimouslyapprovedbythe2011-2012PhilippineMedicalAssociationBoardofGovernors.PMA’scorporatelifeexpiresin2013.ItlikewiseapprovedtoamendthecorporateaddressoftheAssociationfromManilatoQuezonCity.

TheCorporationCodeofthePhilippinesrequiresthatanyextensionmustbedonethroughanamendmentoftheArticlesofIncorporationandmustbeapprovedbymajorityofthemembers.

Tocomplywiththerequirement,themembersarebeingrequestedtosignifytheirapprovalbysigningtheformreleasedbythePMAthrutheComponentSocieties.Thosewhohavenotyetsignedtheformwhenitwasfirstreleasedduringthelastquarterofthefiscalyear2011-2012areenjoinedtodosoassoonaspossible.ThesignedformshouldbesubmittedtothePMASecretariatonorbeforeSeptember15,2012.TheNationalOfficersandBoardofGovernorsareseekingthecooperationofallmembersforthisendeavour.

Ourmembershadentrustedtomethe4thtermasPMApresident,maybebecausetheybelievedandtheywantedmetoaccomplishthatimportantmissionforthemedicalprofession:unitingallthemembersoftheprofessionintooneunified,solidandstrongorganizationthatwillbeinastrongerpositiontoupholdtherightsofthephysiciansandthemedicalprofession.Thisdreamhaseludedusforsolong,letnoonedaretoderailitnortakethatawayfromus!

Theunificationprocesswillnotbeeasy!Fortunately,recentdevelopmentsareonourside.TherequirementsofPhilhealthandtheProfessionalRegulationCommission–BoardofMedicine(PRC–BOM)forPMAmembershipforthoseseekingPhilhealthaccreditation,andlicensure

registration,respectively,haveenhancedandmadeourjobeasier.AddtothisthePhysicians’Actof2012whichispendingincongressandwithagoodchanceofbeingapprovedinthenextfewmonths.Thebillhasaprovisionsonintegrationofthemedicalprofession,requiringmembershipintheintegratedaccreditedprofessionalorganizationwhichcurrentlyisthePMA.TheauthoritiesentrustedtoPMAbyPhilhealthandPRCarenoeasyjobeither,thoughatediousundertaking,werecognizetheopportunityandwillcertainlyliveuptothechallenges. Withorwithouttheintegrationlaw,thekeytoareallonglastingunificationismakingourPMAmorerelevanttothemembers,thefeelingofbelongingandthegloryofbeingapartofthePMA.Mydearcolleagues,thisisourresponsibilityasyourPMAofficerswhichwewillpursueunrelentlessly.

WehumblyrequestourcolleaguestojoinusinourjourneytochangethePMA,toimprovethePMA,makingittrulyrelevanttoallthemembersandthesocietieswithinthePMAorganization,andtoourpeopleandthenationasawhole.

Thereisapressingneedtoupdatethemembershiplist.

Atpresent,thelistofPMAmembersisalreadyoutdated.ThetotalnumberofPMAmembersstandsat70,000.However,thereareonly40,000activemembers,whichconsistoftheEmeritusmembers,Lifemembers,aswellastheregularmemberswhoareupdatedintheirarrearsandhaveattendedtherequiredCME.

The30,000whoareinactiveincludenotonlythosewhohavenotupdatedtheirpaymentoftheannualduesbutalsomemberswhomayhavemigratedtoothercountries,nolongerpracticethemedicalprofession,mayhavegonetootherfieldsofendeavor,ormayhavepassedaway.Notallbeneficiariesofmembersavailofthedeathbenefit.ThePMAdoesnottakeoutfromtherosteranymemberwithoutduenotification.

TheMOUexecutedbetweenthePMAandthePhilhealthlastMay162012,authorizesthePMAtocollectthePhilheathduesfromeachphysicianwhowillbethehealthprovider.ThismeansthataphysicianshouldbeaPMAmemberingoodstandingbeforethe/shecanbeaccreditedwithPhilHealth.

ThePhilippineMedicalAssociationhassignedaMemorandumofAgreementwiththePhilippineHealthInsuranceCorporationlastMay2012,whereinthePHICwillbecontractingthePMAtoaccreditphysiciansforthecorporation.SincethePMAisthebiggestassociationofphysiciansinthecountryandtheonlyAccreditedProfessionalOrganization(APO)inMedicineoftheProfessionalRegulatoryCommission(PRC),thePHICrequestedPMAtoperformthefunctionofaccreditationandensurethatphysiciansareclassifiedintocategoriesthatwilldefinestandardsofquality,safetyandcompetency.

ThePMA,throughtheAdhocCommitteeonPhysicians’Classification,headedbyyourstruly,anduponinstructionofthePMAPresident,Dr.ModestoLlamas,subsequentlyconductedatwophaseworkshop.ThefirstphasewasheldlastJune16,2012atthePMAAuditoriumwiththevariousspecialtydivisionsandthespecialtyandsubspecialtysocietiesunderthemtogetherwiththerepresentativesofPHICandtheRegulatoryBoardofMedicine,representedbyDrMikeNoche.ThePRCproposed

onlytwoclassificationsmadeupofSpecialist/subspecialistandthegeneralist.Thiswasactuallyechoedbythespecialtyandsubspecialtysocieties.However,sincePMAismoreconcernedatpresentinensuringthatweareabletoserveasmanyclientsofPHICaspossibleincongruencewiththeUniversalHealthProgramoftheDepartmentofHealthandthePhilippinegovernmentingeneral,itwasdecidedthatthethreetierclassificationofphysiciansintospecialist/subspecialists,boardeligibles,andgeneralistsbeadaptedasatransition.SpecialistsandsubspecialtiesaregraduatesofaccreditedtrainingprogramsrecognizedbyPMAandhavepassedthecertifyingexaminationsgivenbytheirrespectivespecialtyorsubspecialtyboards.BoardEligiblesaregraduatesofaccreditedtrainingprogramswhohavenotyetpassedtheircertifyingexaminations.GeneralistsontheotherhandarephysicianslicensedbythePRCtopracticemedicineinthecountrybuthavenotcompletedtraininginanaccreditedtrainingprogram.ThisoutputwaspresentedduringthesecondphaseoftheworkshopheldonJune26,2012andattendedbytherepresentatives

ofthespecialtydivisions,affiliatesocietiesandotherstakeholderslikethePhilippineSocietyofMedicalSpecialistsoftheDOH,thePhilippineAcademyofMedicalSpecialists,thePACD,andotherassociationsofphysiciansingovernment.IssuesonthemandategiventoPMAbythePRCandPHIC,theclassificationofphysiciansandtheaccreditationprocesswerediscussedandtheinputsofthevariousstakeholderswerecompiled.PMAassuredthevariousstakeholdersthatthethreetierclassificationaspreviouslyadoptedbyPHICwillbeatransitionclassification,andthatfurtherclassificationsbasedontrainingorexperienceoutsideoftherecognizedtrainingprogramswillbediscussedagainwiththespecialtydivisionsandthevariouscompetenciesandstandardsforeachclassinareasofthecountrywherespecialistsorboardeligiblesareinadequateinnumberorabsentwillbedetermined.

ThePMAwillbeutilizingthevariousregionalandcomponentsocietiesofthePMAintheaccreditationprocessalloverthecountry.CoordinationwillthenbedonebythevarioussocietieswiththevariousregionalofficesofPHIC.Howeversince

theguidelinesanddatabasesofphysiciansstillneedtobefinalizedbothatthelevelofthePHICandPMA,andthatworkshopsstillneedtobeconductedtotrainthevariouscomponentsocietiesintheaccreditationproceduresandrequirements,thePMAhasrequestedthePHICtopostponetheimplementationasagreeduponintheMOUfromJuly1,2012toSeptember1,2012.PMAwillinitiallystartpilottestingtheaccreditationprocessfirstattheNCRlevel,utilizingthecentralPMAoffice.Oncetheprocessisrunningsmoothlyandturnovercouldbedonetothecomponentsocietieseffectively,thentheprocesswillbecomenationalinscope.WhilePMAispilottestingtheNCRphysicians,otherphysiciansalloverthecountrycouldstillapplyatthevariousPHICoffices.

WewouldliketoremindallphysiciansthatforthemtobeaccreditedbyPMAinbehalfofPHIC,theyhavetobemembersingoodstandingofthePMAanditscomponentsocietiesandmustbeuptodatewiththeirPHICpremiumpaymentsatleastfortheentireyearthattheyareapplying.TheirPRClicensesmustalsobecurrentandnotexpired.ForSpecialists/subspecialiststobeaccredited,theyhavetobemembersingoodstandingoftheirspecialtyandsubspecialtysocietiesaswellasofthespecialtydivisionswheretheybelong.PhysiciansmustrenewtheirPHICaccreditationatleast4monthspriortotheexpirationoftheiraccreditationtoavoidgapsinpaymentsoftheirservices.AccreditationwithPHICthroughPMAwillbeforaperiodof3years.

Memorandum of Understanding

WITNESSETHTHAT:

WHEREAS,Section11,ArticleXIIIofthe1987ConstitutionoftheRepublicofthePhilippinesdeclaresthat“theStateshalladoptanintegratedandcomprehensiveapproachtohealthdevelopmentwhichshallendeavortomakeessentialgoods,healthandothersocialservicesavailabletoallthepeopleataffordablecost.”

WHEREAS,RepublicActNo.7875,otherwiseknownasthenationalHealthInsuranceActof1995,inrecognitionoftheneedtoprovideamechanismforfinancialaccesstohealthservices,createdtheNationalHealthInsuranceProgram(NHIP)toprovideinsurancecoverageandensureaffordable,acceptable,availableandaccessiblehealthcareservicesandestablishedthePhilippinehealthInsuranceCorporation(i.e.thehereinPhilHealth)toadministerandimplementtheNHIPtothefullest.

WHEREAS,thedevicetowardsUniversalHealthCare(UHC)asenunciatedinDOHAdministrativeOrderno.2010-0036entitled:“TheAquinoHealthAgenda:AchievingUniversalhealthCareforAllFilipinos”demandsnewwaystoengageHealthCareProviders

intheNationalhealthInsuranceProgram(NHIP)tomaximizetheirroleinachievingfinancialriskprotectionandimprovementofthehealthstatusofFilipinos;

WHEREAS,RepublicActNo.10155,otherwiseknownasthe“generalAppropriationsActof2012”providesforautomaticaccreditationofgovernmenthealthcarestarting1April2012,subjecttoappropriaterulesandguidelinethatshallformulatedforimplementation;

WHEREAS,recentpolicydirectionsinbenefitpaymenttoachieveUHCsuchastheshiftfromfee-forservicetocasepaymentnecessitatedareviewoftheprocessandparametersonhowphysiciansarecurrentlybeingaccreditedbyPhilHealthinthelightofthefutureexpansionofcasepaymenttootherconditionsandprocedures;

WHEREAS,PhilHealthacknowledgesprofessionalorganizationsdulyrecognizedandaccreditedbytheProfessionalRegulatoryCommission(PRC;

WHEREAS,thePhilippineMedicalAssociation(PMA)iscurrentlythePRC-accreditedprofessionalorganizationforphysiciansandthePRCadoptedthePMACodeofEthicsforRegisteredandLicensedPhysicians;

WHEREAS,PhilHealthrecognizesthePhilippineMedicalAssociation(PMAasthenationalassociationofprovidersforphysicianssuchthattheCorporationrequiresmembershipwiththePMAanditsrecognizedspecialtysocietiesinitsaccreditationprogram;

WHEREAS,thePMAderivesitsmembershipfromcomponentmedicalsocietiesandistheumbrellaorganizationofmedicalspecialtysocietiesinthePhilippines;

WHEREAS,thePMAhasrecentlyextendedanamnestyprogramtoitsdelinquentmembersinthegovernmentsectortoallowthemthechancetorenewandupdatetheirmembershipwiththeOrganization;

WHEREAS,PhilHealthandthePMAmutuallyagreedtotapthelatterinutilizingitsmembershiptoqualifyphysiciansforautomaticaccreditationasprofessionalhealthcareprovidersoftheformer.ThePartiesfurtheragreedthatthespecialtyclassificationofthephysiciansshallallowtheCodeofProfessionalSpecializationofthePMA;

NOW,THEREFORE,forandinconsiderationoftheforegoingpremises,thepartieshaveagreedtobindthemselvesasfollows:

1. UNDERTAKINGOFTHE PARTIES

1.1 PhilHealth

1.1.1 ItshallappointPMAtoregisterphysiciansforPhilHealthaccreditationasaprofessionalhealthcareprovidersubjecttotheircompleiancetostrictandspecificparameterstobemutuallyagreeduponbytheParties;

1.1.2 ItshallclassifyphysiciansfollowingthePMAClassificationofCategorizationbasedontheirspecialtyorsubspecialtycertififcation,trainingorexperience;

1.1.3 ItshallformulateandaccordinglyissuethenecessarypoliciesandoperationalguidelinesforimplementationincoordinationwiththePMA.

1.2 PMA

1.2.1 ItshallshareitsmembershipdatabasewithPhilHealthaccuratelyindicatingthename,specialty,address,emailaddressandotherdetailsrelativetothephysician;

1.2.2 ItshalladoptandcomplywithmutuallyagreedqualityassurancepoliciesofPhilhealthincludingbutnotlimited,topeerreview,healthtechnologyassessment,evidence-based

medicine,credentialingandprivileging,amongothers;

1.2.3 ItshallensurethattheirmembersandemployeesareingoodstandingwithPMAandhaveactive,continuousandupdatedPhilHealthmembership;

1.2.4 ItshallcollectthePhilHealthparticipationfeesoffiveHundredPesos(P500.00)peryearpermembersubjecttousualregularincreasesuponpriornoticeandimmediateremitthesametoPhilHealthwithinareasonableperiodtobesetbythelatter;

1.2.5 ItshallfullyandunconditionallysupportthemutuallyagreedPhilHealthpoliciesandanti-fraudmeasuresintheimplementationofthenationalhealthInsuranceProgram(NHIP);

1.2.6 ItshallallowPhilHealthtoinstall,freeofcharge,exhibitboothsduringPMAsponsoredand/orinitiatedconferences/foraandincludetopicsonPhilHealthintheprogramthatareaimedtoinformitsmembersonPhilHealthpolicies.

1.2.7 Itshallexertcontinuouseffortandgiveconsiderationtophysicianswhosearrearagesandpenaltiesintheirmembershipfeeshaveaccumulated,thereby

preventingthemfromapplyingforaccreditationwithPhilHealth;

1.2.8 ItshallallowPhilHealthtoconductperiodicreviewofitsimplementationoftheautomaticaccreditationpolicies,rulesandguideline.

2.EFFECTIVITY&TERMINATION

Thisagreementshalltakeeffectonthe1stdayofJuly2012andshallremainineffectsubjecttoregularperformancemonitoringrelativetocompliancewiththeapplicableandexistingcirculars,rulesandregulationofPhilHealth.Anypre-terminationofthisagreementshallbemadeinwritingandshallbeeffectiveaftersixty(60)daysfromnoticethereof.

3.REVISIONORAMENDMENT

AnyrevisionoramendmentofthisAgreementshallrequirethewrittenconsentofallpartieshereto.
