BUDGETARY IMPLICATION
The budgetary assessment indicates maximum Community expenditure of 420 m€ over the initial period of the ARTEMIS Joint Undertaking (up to 2017), which would need to be committed before 31 December 2013 when the FP7 budget comes to an end. An initial 42.5 m€ is to be committed in 2008.
The total budget of the IMI JU will be EUR 2 billion. The maximum contribution from the European Community will be EUR 1 billion paid from the budget appropriation allocated to the Theme 'Health' of the Specific Programme 'Cooperation' implementing FP7.
The preliminary budgetary assessment indicates Community expenditure of € 47 million in year 1, a raising annual spending profile peaking at € 140 million in years 5 and a winding up budget of € 267 million in year 6 and 7.Maximum Community contribution – 800 m€
The budgetary assessment indicates maximum Community expenditure of €450m over the initial period of the ENIAC Joint Undertaking (up to 2017), which would need to be committed before 31 December 2013 when the FP7 budget comes to an end. An initial 42.5 m€ is to be committed in 2008.
The running costs of the IMI JU will be financed in equal parts by EFPIA and the European Community. The running costs will not exceed 4% of the total budget for the period ending on 31.12.2017.

Establishment of a Joint Undertaking
For the implementation of the Joint Technology Initiative (JTI) on
Embedded Computing Systems,
Innovative Medicines, "Clean Sky", Nanoelectronics,
a Joint Undertaking
within the meaning of Article 171 of the Treaty

(hereinafter referred to as the "ARTEMIS Joint Undertaking")
(hereinafter referred to as "IMI Joint Undertaking").
(hereinafter referred to as "Clean Sky Joint Undertaking").
(hereinafter the "ENIAC Joint Undertaking")
is hereby set up for a period ending on 31 December 2017.
This period may be extended by a revision of this Regulation.
Legal personality Joint Undertaking shall have legal personality.
Member StatesIn the Member States, it shall enjoy the most extensive legal capacity accorded to legal persons under the laws of those States.
Movable and immovable property
It may, in particular, acquire or dispose of movable and immovable property and be a party to legal proceedings.
International organisation
It shall be considered as an international organisation within the meaning of Article 22(c) of Directive 2004/17/EC and of Article 15 (c) of Directive 2004/18/EC. 2820 Council meeting, Brussels, 28 September 2007
Location The seat of the Joint Undertaking shall be located in Brussels, Belgium.

The objectives of theClean Sky JU shall be thefollowing: • accelerating in the EU thedevelopment of clean AirTransport technologies for earliest possible deployment; • creating a radically innovative Air TransportSystem based on the integration of advanced technologies and full scaledemonstrators, with thetarget of reducing the environmental impact of airtransport through reductionof noise and gaseous emissions, andimprovement of the fueleconomy of aircraft..

The activities of the ARTEMIS JUshall be jointlyfunded throughFinancialContributionspaid in partial instalments andin-kind Contributionsfrom its Membersto support the running costs andthe R&D

The resources of the Clean Sky Joint Undertaking shall bemade up of contributionsbrought in by its Membersand their participating affiliates. A participating affiliateshall be defined as a legal entitythat:
The activities of theENIAC JU shall bejointly fundedthrough financialcontributions paid in instalments andin-kind contributionsfrom its Members tosupport the runningcosts and the R&Dactivities.
- is directly or indirectly owned or controlled by, or owning and controlling, or under the same ownership or control as the relevant ITD leader or Associate;
- is incorporated and resident in, and subject to the law of, a Member State of the Community, or an Associated State to the 7th
Framework Programme of the Commission;
- participates to a substantial extent in the activities of the relevant ITD Leader or Associate in the Clean Sky work programme.

2. The running costs of the ARTEMIS JU for the period ending on 31 December 2017 shall be supported by the following contributions:
2. The running costs of the IMI JU shall be financed by its Members. The community and EFPIA shall contribute in equal part to such running costs.
2. The running cost of the Clean Sky JU shall be shared equally in cash between on the one hand the European Community, which will contribute with 50% of total cost, and on the other hand the rest of the Members, that will contribute to the remaining 50%.
2. The running costs of the ENIAC JU for the period ending on 31 December 2017 shall be supported by the following contributions:
(a) a financial contribution from ARTEMISIA of up to EUR 20 million or up to 1% of the overall costs of Projects3, whichever figure is higher, but not exceeding EUR 30 million;
(a) a financial contribution from AENEAS of up to EUR 20 million or up to 1% of the overall costs of Projects, whichever figure is higher, but not exceeding EUR 30 million;
(b) a financial contribution from the Community of up to EUR 10 million;

(c) in-kind contributions from ARTEMIS MS.

3. The R&D Activities of the ARTEMIS JU for the period ending on 31 December 2017 shall be supported by the following contributions:

The operational costs, hereinafter referred to as the Research Activities, shall be jointly funded through financial contribution of the Community and voluntary contributions by the research based pharmaceutical companies that are full members of EFPIA with resources at least equal to the Community contribution.
3. The R&D activities of the ENIAC JU for the period ending on 31 December 2017 shall be supported by the following contributions:
(a) a financial contribution from the Community of up to EUR 410 million to finance Projects;
(a) a financial contribution from the Community of up to EUR 440 million to finance Projects;
(b) financial contributions from ARTEMIS Member States made in the form of annual commitments to be disbursed directly to research and development organisations participating in the R&D Projects;

(c) in-kind contributions by R&D organisations to bear their share of the necessary cost of carrying out the Projects.

4. The maximum Community contribution to the ARTEMIS JU shall
be EUR 420 million
paid from the budget appropriations allocated tothe Theme "Information andCommunication Technologies" of theSpecific Programme"Cooperation" implementingthe Seventh FrameworkProgramme for research,technological developmentand demonstration (2007-2013), according to theprovisions of Article54(2)(b) of the Council Regulation (EC, Euratom)No 1605/2002 on theFinancial Regulationapplicable to the generalbudget of the EuropeanCommunities.
4. The maximumcommunity contribution tothe IMI JU covering runningcosts and Research Activities shall
