100 DRAWINGS Reference to drawings throughout the specification shall be

deemed to be reference to the latest revision of that drawing at all times.

101 DOCUMENTS The drawings and specification are intended to convey an

accurate description of the nature, extent and standard of the work to be performed by the Contractor along with any other documentation provided in connection with the carrying out of the works. Should the Contractor be in any doubt regarding the true meaning and intent of any clauses in the Conditions of Contract, specification, or details or information shown on the drawings or in any documentation, he is to have these fully resolved before providing his tender for carrying out the works, as no additional monies will be paid for any loss or expense involved through any misunderstanding arising from his failure to comply with this requirement. The Contractor must include for carrying out the works strictly in accordance with the true intent of the meaning of the drawings and Specification. Minor works not specifically mentioned but necessary and required to undertake the works will be deemed to be allowed for in the Contractor's tender.

102 SITE For the avoidance of doubt reference to the site within this specification is reference to the area required to carry out the works, including any area used for storage of materials, area occupied by site accommodation and area upon which access is required to be made for these purposes.

103 ACCESS BY OTHERS The Contractor shall permit safe access as necessary to others

along access tracks and to fields surrounding the area of the works for the purpose of carrying out their business.

104 INSPECTION BY OTHERS

The Contractor shall afford reasonable facilities for the inspection and testing of the works by the Employer or any representative of the Employer or person authorised by the Employer.

105 SITE MEETINGS The Contractor shall include for the attendance of his appointed representative at site meetings as required and shall provide the necessary accommodation and facilities to allow such meetings to take place.

106 ACCOMODATION The contractor shall provide for use by the Employer or his representatives an appropriate area either within either his own site office or as a separate office on site an area for a desk, chair and filing cabinet, and shall provide a desk with two lockable draws, a filing cabinet with a minimum of two lockable draws and an office chair. Sufficient artificial lighting shall be provided within the office to allow working during the hours of darkness. The contractor shall also provide adequate tea/ coffee making facilities for use by the Employer or his representative, along with tea, coffee, milk etc. as required. These facilities may be shared with the contractor. The contractor shall also provide adequate and appropriate PPE to allow 4 persons, visitors to attend site. This shall include as a minimum appropriate footwear, waterproof high visibility jacket, hard hat and gloves. The contractor shall provide for use by the Employer, if and when requested, surveying equipment equivalent to that as used by his own engineering / site staff.

107 SITE MANAGEMENT The Contractor shall insure adequate management of the site and

supervision of the works at all times, and shall include within his tender for a competent site manager to be continuously employed at the site while work is in progress and for him, as the Contractor's representative, to receive and carry out any instructions given by the Employer or any duly authorised representative of the Employer.

108 SERVICES No services, other than land drains, are known to be present within the area of the site. However, prior to commencement of the works the Contractor shall satisfy himself that this is correct. The cost of doing so shall be included within his tender.

109 SEQUENCE OF OPERATIONS

The Contractor shall not proceed with work which is likely to conceal any previous operations until the Employer or his appointed representative has inspected and approved such work. The Contractor shall give adequate notice, a minimum of 12 hours, to the Employer, or his representative of the completion of any item which is likely to be concealed by subsequent operations so that arrangements for inspection can be made.

110 PRECAUTION AGAINST DISEASE

All plant to be used within the works and on the site is to be cleaned and disinfected before being brought to site and before being removed from site to prevent the spread of disease.

111 ACCESS TO SITE Vehicular access to the site shall be via Old Hall Lane only. The Contractor shall establish the condition of the access to the site prior to commencement of work. The Contractor shall take photographs of the access route from the commencement of Old Hall Lane prior to commencement of the works and reinstate the access route to its original condition upon completion should any defects arise. The Contractor shall provide the Employer or his representative with one full set of these photographs prior to moving any plant onto site. The access is shared with the area of a working farm, residential properties and access to an Anglian Water Sewage treatment works. Due regard of other users of the access shall be given at all times and the Contractor shall notify other parties who use the access of the works being carried out and provide contact details for those users of a contact on site, and out of working hours, should the users have a need to contact the contractor over use of the access at any time. There shall be no parking of any vehicles on the access and the access shall remain unobstructed as a result of the works being carried out at all times. Access onto the site and between the field and embankment shall be at the locations shown on the contract drawings. The contractor shall undertake such works as appropriate to form an access suitable for his needs but shall reinstate the access points to their original condition, including any planting necessary upon completion.

112 POSSESSION OF SITE The Contractor shall give seven days notice to the Employer of the date of commencement of site work so that all other parties may be informed.

113 SITE INFORMATION Details of the existing site can be obtained from the topographical survey, the soils information and by site inspection. Contractors‚ will be deemed to have visited the site during the Tender period.

114 SETTING OUT Prior to commencement of the works the Contractor shall ensure that the existing topographical survey is correct and establish permanent datum’s sufficient to allow adequate control of line and level to be established at all times throughout the works and for the period of the rectification period following completion. All record drawings and information relating to level shall be related to Ordnance Datum and line to National grid as used in the topographical survey.

Permitted tolerances:- Finished levels of crest - 0mm/ + 150mm. Level of embankment and cutting slopes prior to and after topsoiling -0mm / + 75mm

Maximum deviation from embankment/cutting gradients. + 5% Maximum variation on topsoil thickness from that shown on the drawings. –0mm/ + 75mm

The Contractor shall be responsible for the establishment and maintenance of any additional temporary Bench Marks or survey stations in addition to the permanent stations referred to above necessary to complete the works.

115 ELECTRICITY SUPPLY The Contractor shall make his own provision for an electricity supply. The use of temporary generators is acceptable.

116 WATER SUPPLY The Contractor shall make his own provision for a supply of fresh clean water, including as necessary to maintain acceptable moisture contents of fill materials.

117 PUBLIC FOOTPATHS

AND RIGHTS OF WAY The Contractor shall take all steps necessary to ensure that public and private rights of way are not interrupted or obstructed as a result of the carrying out of the works other than as may result from the direct implementation of the works themselves, and that the works are also carried out with minimum disturbance to the public and in particular to the adjacent nature reserves.

118 PRECAUTION AGAINST TRESPASS

The Contractor shall take every precaution to ensure that his employees or people connected with the works are prevented from trespassing on land which does not form part of the construction area.

119 WEATHER All earthmoving operations shall cease when weather conditions are inappropriate such that acceptable moisture contents of embankment fills are unable to be maintained. Prior to recommencing earthmoving operations all material in areas of cut and fill which have a moisture content above acceptable limits shall be allowed to dry or shall be removed. No additional monies whatsoever will be paid or delays considered for double handling of material or delay due to effects of the weather on fill material. The Contractor shall ensure that all material available as fill shall be kept in a condition suitable for inclusion in the embankment.

120 FIRST AID

The Contractor shall provide and maintain, in a readily accessible position on the works, adequate first aid facilities. As a minimum these are required to comply with all current legislation and guidance relative to the works to be carried out.

121 TIDINESS AND SITE CLEARANCE

At all times the site and surrounds shall be kept in a tidy condition. No rubbish shall be allowed to accumulate on the site, and the works area shall be kept clear of rubbish at all times The Contractor shall clear away all surplus materials on completion and leave the site in a clean and tidy condition. The area to be occupied by the embankment shall be cleared of all trees, stumps, roots, and other vegetation. The Contractor shall by his own investigation determine the extent of clearing required. Outside of the area mentioned above no tree or hedgerow shall be disturbed or cut down without specific approval from the Employer or his representative.

Materials from any clearance works shall not be burnt nor shall they be stockpiled on any farm land.

122 MAINTENANCE OF

SURROUNDINGS The Contractor shall exercise care to preserve the surrounding landscape and shall conduct his construction operations so as to prevent any unnecessary destruction of the natural surroundings in the vicinity of the work. Where unnecessary destruction, damage or defacing occurs as a result of the Contractor's operations, the same shall be repaired, replanted, reseeded or otherwise corrected at the Contractor's expense.

123 FISHING AND SPORTING RIGHTS

The Contractor shall take all reasonable practical precautions to protect fishing and sporting rights.

124 REMOVAL OF WATER

FROM THE WORKS The Contractors attention is drawn to the findings of the site investigation and the presence of water as recorded in that investigation. It is the Contractors responsibility to establish the potential effects of the presence of water on the implementation of the works as no additional cost shall be accepted by the Employer as a consequence of the Contractors failure to do so. The Contractor shall construct and maintain all necessary channels, drains, sumps, and/or other temporary protective works for the removal of surplus water from the works, during construction. The Contractor shall provide all materials required and shall provide, install, maintain and operate all necessary pumping and other equipment for the removal of water from any part of the work and for maintaining the works free from water. For the avoidance of doubt this includes any dewatering. The cost of furnishing all labour, equipment and materials for constructing channels and other protective works; maintaining the work free from water as required; and all other work required by this section shall be assumed to have been included in the Contractor's tender.

125 REMOVAL / STOCKPILING OF TOPSOIL

Topsoil shall be placed into temporary stockpiles as necessary before inclusion in the permanent works as required by the drawings. The maximum height of any topsoil stockpile shall be 1m above adjacent ground level.

126 EXISTING LAND DRAINS The contract drawings show the assumed layout of land

drainage within the field that is to be used for the recovery of clay for use in the embankment. The location and depth of any land drain encountered during the carrying out of the works is to be recorded and the information provided within the “As Constructed” drawings. Any land drain damaged / removed as a necessary part of carrying out the works is to be reinstated to the detail as shown on the contract drawings.

127 EXCAVATION: GENERAL All necessary precautions shall be taken to preserve the material below and beyond the established lines of all excavation in the soundest possible condition. All excess excavation for the convenience of the Contractor or over excavation performed by the Contractor for any purpose or reason, except as may be ordered in writing by the Employer or his representative, shall be at the expense of the Contractor. Where required to complete the work all such excess excavation and over-excavation shall be refilled with suitable material, placed and compacted in accordance with this specification at the expense of the Contractor.

Areas beneath the embankment and beyond the established line of excavation which are considered by the Employer or his representative to be unsound shall be excavated to a depth to be agreed with the Employer or his representative and backfilled in accordance with the instructions given. All excavation for the embankment and other foundations shall not be carried out during wet weather.

On excavation, materials shall be appropriately classified for use in the zones shown on the drawings.

Materials to be used for fill which for whatever reason become or when excavated are too wet for immediate compaction in the embankment shall be placed temporarily in stockpiles until the moisture content is reduced sufficiently to permit adequate compaction. The contractor is to assess the likelihood of this and its implications on programme etc. as this will be deemed to be included within his tender as no additional monies will be paid by the Employer for undertaking such treatment. Conversely, excavated material with a moisture content lower than that required to ensure adequate compaction shall be wetted before placement using equipment and water supplied at the Contractor's expense.

128 PREPRATION PRIOR TO

PLACING OF FILL The finished formation surfaces against which any fill is to be placed within the embankment construction shall be cleaned of all loose, soft, and disintegrated materials including the removal of such materials from pockets, irregularities, fissures, and depressions in the foundation.

129 DISPOSAL OF EXCAVATED MATERIAL

It is intended all suitable materials from excavations required under this contract shall be used in the embankment construction. Excavated materials that are unsuitable for use in the embankment construction shall be used to fill the excavations formed to recover suitable fill. No excavated material shall be removed from site other than at the direction of the Employer or his representative.

130 EMBANKMENT CONSTRUCTION: GENERAL

All earthworks shall be carried out in accordance with the latest edition of the "Specification for Highway Works" produced by the Department of Transport. Appendices relating to the specification for Highway works are included below as additional clauses to the specification.

The completed embankment shall be to the lines and the grades shown on the drawings and to within tolerances stated in this Specification.

131 WORKS TO EXISTING EMBANKMENT

Works required to the existing flood embankment shall be carried out to minimise any disturbance to that embankment. Any disturbance howsoever caused shall be rectified by the contractor at their expense, this shall include disturbance to the path at the top of the embankment. No plant shall work from the existing embankment all works shall be carried out from the area of the proposed embankment. No plant, or vehicle, shall travel within 9m of the toe of the existing embankment except for the express purpose of carrying out the contract works within the area of the proposed embankment. The Contractor shall prepare a method statement, including necessary diagrams to show how the works to the existing embankment are to be carried out. The method statement shall be provided to the Employer or his representative for approval a minimum of 14 days before such works are intended. This shall include proposals for ensuring safe passage of public using the path to the top of the embankment past the works. The Contractor’s attention is drawn to the Special Requirements relating to the Environment Agency as set out below.

132 FORMATION

PREPARATION No materials shall be placed on any portion of the embankment until the formation for each section has been de-watered and stripped and suitably prepared and has been approved by the Employer or hid representative. All cavities and depressions and irregularities which are either existing or resulting from the removal of rocks or boulders found within the area to be covered by the embankment and which extend below or beyond the established lines of excavation for the embankment foundations shall be filled with material suitable for use in the embankment construction and compacted in accordance with the specification. No vegetable matter or other perishable or unsuitable material shall be placed in the embankment.

PLACING EMBANKMENT MATERIAL

In the construction of the embankment each layer of each zone shall be constructed continuously and approximately horizontal for the width and the length of the embankment at the elevation of the layer. Should the Contractor propose to construct the embankment such that a length, part, is completed, or completed to a predetermined level before the next part the extent of each part shall be agreed with the Employer or his representative, along with the methodology proposed by the contractor for ensuring the integrity of the completed embankment is maintained. Details of any such proposals shall be shown on the programme to be prepared by the contractor and notified to the Employer or his representative before such works are implemented along with a proposed method statement giving the necessary details as identified above.

The Contractor shall maintain the embankment in an approved manner, including maintaining surfaces free of standing water, weeds or other vegetation until final completion and acceptance of all the work under the contract.

134 EMBANKMENT CONSTRUCTION

The embankment shall be constructed in the manner as shown on the drawings. This requires there to be excavation of existing material from within the area of the foundation to the embankment and replacement of this material with material of appropriate quality excavated from within the adjacent field. To allow material of appropriate quality to be excavated requires the superficial materials to be excavated, these materials being the same as the material to be removed from the foundation of the embankment itself. The depth of suitable material to be excavated within the field, the depth below the superficial materials, is to be determined by the contractor to suit his method of working. The same suitable material is to be used in the general construction of the embankment. The excavation so generated by the above process is to be backfilled using the material removed from the area of the foundation to the embankment with any shortfall in the quantity of fill required within the field resulting from the embankments construction being sourced from the existing stockpile in the south west of the field as shown on the contract drawings.

Should cobbles, boulders or rock fragments having maximum dimensions of more than 75mm be found in otherwise suitable fill material for the embankment construction, they shall be used in the backfilling of the excavation within the field. The surface of any prepared foundation or the compacted surface of any layer of fill shall be moistened if required to provide a satisfactory bonding surface before the next succeeding layer of earth fill material is placed. This will not be necessary where the moisture of the surface is not significantly below optimum.

135 FILLING TO FIELD The area used by the contractor to recover material for use within the embankment construction shall be filled with material unsuitable for use in that construction as recovered from the area of the embankment, and superficial material excavated from the area of excavation also not suitable for use in the embankment construction. The finished ground level within the area of excavation shall be as existed prior to excavation taking place, including an allowance for consolidation of the placed material. Any shortfall in the volume of material arising as result of that described above shall be sourced from the existing stockpile located in the south west part of the field from which the suitable material is to be excavated as noted elsewhere in this specification. The material from the stockpile shall not be placed within 1m of the underside of the reinstated topsoil. The topsoil removed from the areas of excavation shall be reinstated to the same depth as existed prior to it being stripped. The topsoil used in reinstatement shall be sourced from the stockpiles formed at the time of topsoil strip only. The Topsoil stockpiles being a maximum of 1 m in height above adjacent ground level. The contractor shall undertake the compaction of the fill placed in the excavation in an appropriate manner such that consolidation of the finished ground surface within 1 year from completion shall be limited to an extent that is not detrimental to the use of the land for its intended purpose and that finished levels are as noted above. The contractor shall determine if this requires the land to be “overfilled” to allow for consolidation to take place. The contractor shall present to the Employer or his representative his written proposals for approval taking into account the above before he commences reinstatement of the excavated area. The reinstatement of the excavated area shall include the reinstatement of any land drains as referred to elsewhere in this specification.

136 EXISTING STOCKPILE The stockpile from which material to make up any shortfall in fill required to the excavation used to recover suitable material for use in the embankments construction is located within the south eastern part of the field in which the excavation referred to is to be located. Any topsoil / vegetation is to be removed from the topsoil prior to recovery of material to fill any excavation. The topsoil contains arisings from a development site at Clacton Factory outlet Centre, Stephenson Road, Clacton, and has been stockpiled at its current location for the intended use. It therefore contains typical materials as would be anticipated generated by such a development. The findings of a trial pit excavated into the stockpile is included in the site investigation. The stockpile will require “picking” to remove significant pieces of timber, concrete, and other deleterious material. Significant pieces being pieces having a greater dimension than 150mm. For this reason material from the stockpile shall not be used within 1m of the underside of the reinstated topsoil. All material “picked” and identified as unsuitable for use as fill material shall be stockpiled at the edge of the filed adjacent to the existing stockpile. It shall only be removed from site and disposed of following instruction from the Employer or his representative. Upon completion of recovery of material from the stockpile, the stockpile shall be profiled to be similar to that which currently exists, and topsoil removed from the stockpile used to reinstate any disturbance to the ground surface in the vicinity of the stockpile.

137 WATERCOURSES Watercourses exist as shown on the topographical survey.

138 GRADING EMBANKMENTS

As the embankment progresses the slopes shall be roughly trimmed to the correct slope as shown on the drawings and slopes shall be finely graded after the completion of the bulk filling. The crest of the embankment shall be trimmed to a 1 in 50 fall (vertically to horizontally) to prevent ponding. This fall shall be formed in the embankment fill as well as topsoil. The overall height of the embankment shall be such that the final level is as specified on the drawing on the low side following forming of the above cross fall. The minimum width of the top of the embankment shall be as shown on the drawing.

139 TOPSOIL Topsoil shall be placed on the slopes and on the crest of the embankment as shown on the drawings. Areas to receive topsoil shall be finished and compacted before the topsoil is applied. Topsoil shall be evenly placed and spread over the graded area and compacted in two layers. The finished topsoil shall be fine, smooth and evenly firm but not over compacted. All topsoil generated by the topsoil strip shall be placed on slopes of the embankment. Any surplus topsoil over and above that required to achieve the depth shown on the contract drawings being placed at the toe to create a fillet. Upon completion of all other works the embankments and crest shall be grass seeded with a seed mixture consisting of; 30% Perennial Ryegrass 7.5% Browntop Bent 20% Sheeps Fescue 25% Hard Fescue 2.5% Wavy Hairgrass 15% Slender Creeping Red Fescue or an alternative mix approved by the Employer or their representative. The area of the field used to recover fill for use in the embankment construction shall be returned to its original topography with all topsoil stripped from the area of excavation reinstated evenly over that area. The Contractor shall include for reinstating any access and areas trafficked / walked over during the course of the works to its original condition by ploughing / harrowing as necessary. The complete area of the field in which the excavation has taken place shall be ploughed such that it is returned to the land owner in a condition sufficient to allow immediate preparation for the sowing of a crop.

140 PERMIT TO WORK

It is expected the Contractor will operate a permit to work system for the following work types as a minimum;

• Excavation works

• Entry into confined spaces

• Lifting operations

• Hot working

141 AS BUILT SURVEY / INFORMATION

The Contractor shall carry out an "as-built" topographical survey of the works. Allowance shall be made for recording the finished profile of all areas affected by the works. The survey shall, as a minimum, extend over the same area as the site boundaries shown on the contract drawings. The survey shall be fully annotated and shall have spot levels at centres suitable for accurate modelling of the finished surfaces. Typically this will involve 3D co-ordinated points on a 20m grid plus strings on all feature lines e.g. toe and top of all slopes, etc. The survey shall relate to Ordnance Datum and shall be to the same grid as the existing topographical survey. The Contractor shall supply all “As Built” information electronically with drawings as .dwg files. The Contractor should note that no certificates for partial or substantial completion shall be issued until such time as the as-built survey has been received by the Employer.

142 CONSTRUCTION, DESIGN AND MANAGEMENT REGULATIONS

The Contractor shall be responsible for, and include in his tender, the cost of meeting all of his legal obligations under the Construction Design and Management Regulations. The successful Contractor will be the "Principal Contractor" under these Regulations and shall carry out the necessary duties. In addition‚ the Contractor shall provide all of the necessary information to the Principle Designer to allow preparation of the Post Construction information as required by the Regulations. The information being provided electronically and within two weeks of the issuing of any certificate of practical completion for the works. The Contractor shall‚ in accordance with the Regulations‚ develop the Pre Construction information contained within the tender documents to the satisfaction of the Principle Designer and the Employer. He shall ensure that the plan is sufficiently developed and approved before starting work on site and liaise as required and requested with the Principle Designer throughout the implementation of the works.

143 THE FOLLOWING APPENDICES ARE TO BE READ IN CONJUNCTION WITH THE MANUAL OF CONTRACT DOCUMEMTS FOR HIGHWAY WORKS: VOLUME 1 SPECIFICATION FORHIGHWAY WORKS: AND SHAL FORM PART OF THE CONTRACT SPECIFICATION FOR THE UNDERTAKING OF THE WORKS 143.1 Applicability If the Specification for Highway Works contradicts the above specification, as it applies to the works to be undertaken, the requirements / clauses of the Specification for Highway Works shall take precedence. In such circumstances the Contractor shall immediately bring the discrepancy to the attention of the Employer or his representative. Reference in this Specification to the Section Appendix shall be taken as identifying the requirements of the Series within the Specification for Highway Works to which that Specification relates also applying, cross referenced to any other Series as appropriate within that document.

143.2 Appendices; APPENDIX 6/1: REQUIREMENTS FOR ACCEPTABILITY AND TESTING ETC. OF EARTHWORKS MATERIALS. 1. The Contractor shall be responsible for carrying out all testing necessary to determine the

classification of soil types to enable the appropriate method of compaction to be chosen. 2. During construction of filled areas to the embankment, the Contractor shall arrange for insitu-

density testing of fill at the minimum rate of one test per 1,000 m³ of fill material placed within the embankment construction (for the avoidance of doubt this includes the foundation to the embankment). The location and timing of all tests shall be agreed with the Employer or his representative.

3. The Contractor shall include within his prices for all testing and shall employ an approved

independent soils laboratory to undertake all tests. The test results are to be submitted to the Employer or his representative in electronic format within one day of receipt.

4. Testing to be carried out in accordance with the procedure set out below. PROCEDURE TEST TO COMPARE INSITU DRY DENTISTY TO THAT OBTAINED UNDER PROCTOR COMPATIVE REPORT. General The method compares the insitu dry density of a sample to that obtained when recompacted in the laboratory under Proctor comp active effort at the same moisture content. Apparatus a) Apparatus required for insitu density determination by core cuter (BS 1377, Test 15D) or any

replacement method. b) Apparatus required to determine the dry density/moisture content relationship (4.5kg method) –

Proctor test (BS 1377, Test 12). Procedure The insitu dry density of the fill material should be determined by the core cutter method (BS 1377, Test 15D) for the clay fill or any replacement method for more coarse grained materials. Sufficient material should be taken back to the laboratory to allow the Proctor mould to be filled, this may require excavation of additional material at the sampling point. It is important that the material does not dry out between sampling and testing in the laboratory. A sample should be taken from the material for moisture content determination following measurement of the insitu bulk density. The material should then be compacted in the Proctor mould as specified in Test 12 and the bulk density found. This is equivalent to carrying out one stage of a complete Proctor test, and care should be taken to use the correct number of blows per layer (27 for 105mm dia. moulds, 25 for 101mm or 4 inch dia. moulds). Where fragments in excess of 20mm in size are present, the density found under Proctor compactive effort should be amended as described in the relevant test sheet. Although the Specification requires the dry densities to be compared, it is acceptable to compare bulk density as the moisture content should be unchanged for both field and laboratory determinations. However, the moisture content should be measured and the insitu and laboratory dry densities determined.

The ratio of the insitu bulk density divided by the laboratory bulk density under Proctor compactive effort (“percentage Proctor”) should be determined. It should be noted that this figure will frequently exceed 100%. Reporting of Results

The following results should be given:-

APPENDIX 6/2: REQUIREMENTS FOR DEALING WITH CLASS U2 UNACCEPTABLE MATERIAL 1. The Contractor shall notify the Employer or his representative if any unacceptable material is

encountered during the works to enable the Employer or his representative to give instructions for its disposal within or adjacent to the site.

2. It is not envisaged that any material will need to be removed from site. 3. There is no known unacceptable material likely to be encountered during the works.

APPENDIX 6/3: REQUIREMENTS FOR EXCAVATION DEPOSITION AND COMPACTION 1. The requirements for earthworks including finished line and level are given on the Contract

Documents. 2. No blasting will be permitted on site. 3. Additional earthworks requirements over and above those of the Specification for Highway

Works are included in the contract documents. 4. End product compaction shall be used in the construction of all areas of fill. All areas of fill

shall obtain an absolute minimum compaction of 95% of the maximum dry density for the relevant class of fill. (4.5kg Rammer) Any areas of fill not complying with this requirement shall be completely removed back to areas proven to be of adequate compaction and reconstructed, all at the Contractors expense. Additional testing to determine the extent of unacceptable compaction shall be at the Contractors expense.

APPENDIX 16/15: STEEL SHEET PILES

i) All steel sheet piles are to be manufactured from steel grade S355.

ii) Steel sheet piles shall be of minimum elastic section modules 1200cm3/m and web thickness of 9mm minimum.

iii) The contractor shall allow sufficient length of sheet pile, when pitched, so that upon driving any part of the head of the sheet pile that may become damaged during driving can be removed to leave a sufficient length of pile to achieve the penetration required, head and toe level, all as shown on the contract drawings.

iv) The contractor shall provide driving records containing the following as a minimum.

v) The sheet piling as shown on the contract drawings as specified above (Steel grade, section modulus and length) has been designed on the basis of the sheet piling being used to support the excavated face for a temporary period only, they have been designed as works. Should the contractor require the excavated face to be supported by the sheet pies for greater than a period of 3 months as a result of his intended method / sequencing of working, he shall re assess the pile section, length etc. required as if it is acting as permanent works and include the cost of any alternative within his tender. No additional cost will be accepted by the Employer as a result of any change in that method / sequencing of the works. The contractor shall clearly identify any such changes in his tender submission, and the design for such shall be carried out by the contractor at his expense, and the design caculations to support the contractors proposals shall be submitted to the Employer for approval a minimum of 3 weeks before implementation.

144 SPECIAL REQUIREMENTS RELATING TO THE ENVIRONMENT AGENCY

1. In these Special Requirements the following terms shall have the meanings assigned to them:-

(a) “The Agency” means the Environment Agency. (b) “Agency's Representative” means the area engineer and appropriately authorised

staff of the Environment Agency or its Authorised Representatives and Agents. (c) (d) 'Watercourse means all water resources including ground and/or percolating water

together with all rivers streams ditches drains cuts culverts dykes sluices lakes ponds reservoirs docks channels creeks bays estuaries or arms of the sea together with all associated apparatus and appliances administered by 'The Agency' in pursuit of or as part of its Statutory functions.

2. The Contractor shall particularly note that The Agency is established by Act of Parliament and

that its responsibilities for Watercourses property and premises are the subject of Statutory Law and/or local Bye Law with which the Contractor should familiarise himself.

3. The Contractor shall give the Employer, for passing onto The Agency, at least 14 days written

notice before commencing any work or moving heavy plant or equipment over any portion of the Site that is within the jurisdiction of The Agency and shall provide the Employer for passing onto The Agency with an outline programme for the Works for such areas which shall be kept fully updated throughout the period of the contract. The Contractor shall give the Employer NOT LESS than 7 days written notice of any change in programming which affects any jurisdiction of The Agency so that The Agency may be advised.

4. All operations on in or affecting Watercourses property or premises for which The Agency is

responsible shall be carried out in such a manner so as not to endanger the Watercourses property or premises for which The Agency is responsible and/or any persons entitled to be present.

5. The Agency's Representative shall at all reasonable times have access to any part of

Watercourses property or premises for which The Agency is responsible on the Site. 6. Where for the purposes of completing the Works in accordance with the Contract excavation

is required affecting Watercourses property or premises for which The Agency is responsible the Contractor shall give the Employer 3 days written notice of such excavation work so that the Agency's representative may attend upon the Site to supervise the excavation as required.

7. If the execution of the Works requires access onto or over the floodbank of a Watercourse or

in any affects a flood defence of any description or form, the Contractor shall provide proper means for such access by way of temporary ramps of suitable gradient surfaced with stone or other material as shall be approved by the Employer / Agency's Representative. ON NO ACCOUNT shall the level of the floodbank crest be reduced without the written permission of the Agency's Representative and then ONLY under such conditions and restrictions as the Agency’s Representative may require.

8. Where for the purposes of completing the Works in accordance with the Contract there is a

requirement for a bank and/or floodbank or part thereof to be temporarily removed such removal shall ONLY be carried out with:-

(a) The written permission of the Agency's Representative and then ONLY under such

conditions and restrictions as the Agency's Representative may require. (b) The provision of a suitable alternative flood barrier to be approved by the Agency's

Representative which shall be maintained to the full height of the original floodbank until such times as reinstatement of the original floodbank is completed to the satisfaction of the Agency's Representative.

9. Throughout the period of the Contract the Contractor MUST take all necessary measures with

regard to the Watercourse flood plain and/or continued operation of land drainage systems to ensure :- (a) flow rates are maintained; (b) the FULL AND PROPER discharge of any flood waters.

10. The Contractor SHALL NOT at any time construct temporary access or haul roads within any

floodplain area whose surface level is higher than the existing floodplain ground level. Upon the completion of the Works all such Temporary Works shall be removed and the floodplain reinstated to the satisfaction of the Agency's Representative.

11. The Contractor SHALL NOT at any time store or stockpile on the floodplain area equipment

and/or materials that will float or contaminate a Watercourse in the event of the floodplain being inundated.

12. Throughout the period of the Contract the Contractor shall ensure that the structural integrity

of any fluvial tidal and/or sea defence Works is fully protected and maintained. 13. The Contractor shall take all necessary measures to secure the protection of all Watercourses

including water in underground strata against silting erosion flooding and/or pollution of the water so as to affect adversely the quality or appearance thereof or cause injury or death to animal aquatic or plant life and/or damage to property and land. Such protective measures shall include, but not be limited to, the following:-

a) All fuel lubricating oil and/or other liquid chemicals stored on the Site shall be located as far as reasonably possible and in any case NOT LESS THAN 10.0M from any Watercourse and such stores shall be sited on impervious bases and surrounded by an effective impervious bund capable of containing the full contents of the store plus 10% and with a sealed drainage system with no discharge to any Watercourse land or groundwater. All such stores shall be kept locked or otherwise secured when not in use and all containers therein must bear clear labels giving full descriptions of the contents. A stock of absorbent material suitable for use on the contents of the store MUST be maintained on the Site.

(b) Any leaking and/or empty oil/fuel/chemical containers shall be removed from the Site

immediately. (c) All equipment using fuel/oil shall be located as far as reasonably possible from any

Watercourse and shall be surrounded with oil absorbent material to contain spills and leaks.

(d) The refuelling of machines shall be strictly controlled and confined to a location as far

as reasonably possible from any Watercourse. (e) Providing for silted or discoloured water from the Works and/or the cleaning of

vehicles or cement/concrete using plant to be treated or settled in a lagoon prior to discharge into a Watercourse, which discharge shall only take place with the approval of the Agency's Representative.

(f) Prevention of the unauthorised abstraction extraction and/or drawing off of water for

any reason from any Watercourses property or premises for which The Agency is responsible. While protecting any existing abstraction arrangements whether licensed or not together with any domestic abstractions exempt from such licensing requirements. (A list of licensed abstractions is available on a public register).

(g) Ensuring that any ford required to allow plant or vehicles to cross a Watercourse

consists of steel plank roadway hardcore road and/or exceptionally a series of concrete pipes sufficient to carry the dry weather flow of the Watercourse topped with

concrete slabs at such a level that flood water will overtop the obstruction without causing flooding or other adverse effects and that such construction as is permitted by the Agency is entirely removed from the Watercourse upon the completion of the Works and any access ramps or banks shall be fully reinstated to the satisfaction of the Agency's Representative.

(h) Ensuring that any plant used in or fording a Watercourse is/does not leak/leaking fuel

oil and/or any other fluid. (i) Ensuring that the use of any concrete mixing plant or ready mix vehicle together with

the placing of any wet concrete in or adjacent to any Watercourse is strictly controlled in such a manner that cement contamination of the Watercourse does not occur.

(j) Ensuring that only material free from polluting toxic substances is used at locations

where drainage from new material can directly or indirectly enter any Watercourse. (k) Where for the purposes of completing the Works in accordance with the Contract any

work is required on a sewer of any kind in particular a trunk sewer ensuring that such work is only carried out with the full knowledge of the sewer authority and then ONLY under such conditions and restrictions as The Agency's Representative and the sewer authority may impose.

(l) Ensuring that the banks and foreshore of any Watercourse are kept clear of material

plant and other items unless actually in use for the purposes of the Works. (m) Ensuring that materials intended for or arising from the Works together with any other

plant and/or equipment are not stored or disposed of:- i) In the Watercourse. ii) Placed in such a manner where such items might fall slip or be washed into

any Watercourse. (n) Preventing the spread of the following plant species:

i) Japanese Knotweed ii) Giant Hogweed.

In particular any spoil or other such arisings contaminated with or suspected of being contaminated with the rhizomes and/or roots of these species SHALL NOT be spread to areas currently free of these plants but shall be disposed of as directed by the Agency's Representative.

(o) In the preparation of his programme for the Works ensuring that the Watercourse is

NOT disturbed during: i) the period October to March inclusive where significant populations

of salmonoid fish are present, and/or

ii) the period April to June inclusive where significant populations of

coarse fish are present

unless otherwise specifically agreed in writing by the Agency's Representative (and then ONLY under such conditions and restrictions as the Agency's Representative may apply).

(p) Regularly scraping and maintaining free from deposits of slurry or other debris haul

roads on the Site and the approaches to any Watercourse. Any arisings shall be disposed of as directed by the Agency's Representative.

(q) Ensure that surface water drains are not contaminated by any debris or other arisings

from the Works.

(r) Provide suitable sheeting under any structure over a Watercourse where the structure

is to be cleaned by mechanical or chemical means and/or painted in order to prevent material entering the Watercourse.

In the event that notwithstanding the taking of such protective measures any incident occurs which

may place the Watercourse including water in underground strata or fish populations at risk the Contractor shall IMMEDIATELY inform the Agency's Representative and the Employer and shall immediately carry out instructions to abate and remedy the situation. 14. The Contractor shall NOT without the specific written permission of the Agency's

Representative, (and then ONLY under such conditions and restrictions as the Agency's Representative may require), do any of the following:- (a) Remove 'bed' material for use in the construction of the Works or elsewhere.

(b) Remove from any part of the bottom channel or bed of a Watercourse a deposit

accumulated by reason of any dam weir or sluice and SHALL NOT undertake such removal by causing the deposit to be carried away in suspension in the waters.

(c) Remove vegetation other than fallen trees from or adjacent to any Watercourse.

(d) Allow cut vegetation from approved clearance works to enter any Watercourse.

(e) i) Remove aquatic weeds in the period May to August inclusive

ii) Spray aquatic weeds.

(f) Use floating plant barges and/or pontoons and the like in any Watercourse.

(g) Display any advertisement or other material, except as specifically required by this

Special Requirement, on or above The Agency's Watercourses property or premises for which The Agency is responsible.

(h) Discharge surface water of any kind in any way into Watercourses property or

premises for which The Agency is responsible.

(i) Construct any Temporary Works in the Watercourse and/or temporarily divert obstruct and/or pipe any Watercourse and/or obstruct any floodplain by spoil heaps or by any other means except where and to the extent that approval has been specifically given and/or previously obtained.

(j) Close any navigable Watercourse to waterborne craft or traffic without giving the Agency's Representative at least 28 days written notice. (The granting of permission for such a closure MUST NOT be presumed).

(k) Notwithstanding the approval of any other Statutory and/or Regulatory body use

explosives in or adjacent to any Watercourse property or premises for which The Agency is responsible (permission for such use by The Agency will ONLY be granted IN THE MOST EXCEPTIONAL CIRCUMSTANCES).

15. Where for the purposes of completing the Works in accordance with the Contract any work is

required above or in the Watercourse the Contractor shall, except where otherwise specified in the Contract or agreed in writing by the Agency's Representative:-

(a) Provide and maintain a minimum height clearance as shall be specified in writing by

the Agency's Representative above the water surface of the Watercourse or highest expected water surface where this is variable.

(b) Stockpile keep clean and replace on completion of the Works any 'bed' material

necessarily removed from the Watercourse in the course of the construction of the Works.

(c) Submit to the Agency's Representative written proposals for maintaining at all times

the free passage of fish. THE CONTRACTOR SHOULD PARTICULARLY NOTE WHEN PLANNING ANY WORK IN

RELATION TO THE WATERCOURSE THAT THE EMPLOYER OR THE AGENCY CANNOT GUARANTEE ANY PARTICULAR WATER LEVEL OR DEPTH NOR PREVENT ANY FLUCTUATIONS TO SUCH WATER LEVEL DEPTH OR SPEED OF FLOW IN ANY WATERCOURSE.

16. Where for the completion of the Works in accordance with the Contract work is required on or near the edge of a navigable Watercourse and such work involves projections of any kind into the navigable channel and/or anywhere vertically above the line of its edge the Contractor shall:-

(a) Throughout the course of the Works provide permanent markers on the extremities

from the bank of the projection by the placing thereon of warning markers/notices/lights as specified by the Agency's Representative.

(b) If the projection of the work into the navigable channel exceeds 0.Sm the projecting

works shall be protected from the impact of passing waterborne craft as specified by the Agency's Representative.

(c) Provide notice boards of a type size shape colour and with a written warning as

specified by the Agency's Representative shall be sited on the Watercourse edge as required by the Agency's Representative.

17. Any floating plant barge and/or pontoon on the Watercourse for which the Contractor has

obtained the permission of the Agency's Representative shall at all times be properly secured so as not to constitute a hazard to navigation and/or Watercourse management and all reasonable precautions shall be taken by the Contractor to prevent accidental or malicious casting adrift or sinking.

18. If any plant floating plant barge and/or pontoon falls or sinks or is cast adrift in the

Watercourse the Contractor shall immediately inform the Agency's Representative and the Employer and take immediate steps to make the hazard known to users of the Watercourse. The Contractor shall immediately arrange the salvage/re-securing of the plant floating plant barge and/or pontoon from the Watercourse and until such salvage/re-securing has been completed the Contractor shall provide buoys, and markers and erect warning notices indicating the navigation hazard to Watercourse users to the satisfaction of the Agency's Representative.

19. The Contractor shall not reduce the width of any Watercourse at any time without the written

approval of the Agency's Representative. In order to consider a request for a temporary reduction in the width of any Watercourse the Agency's Representative will require fully detailed proposals, which show evidence that the Contractor has made every effort to minimise:-

(a) The risk of damage to the Watercourse and/or its channel;

(b) The risk of flooding at all potential flow conditions within the Watercourse;

(c) The length of time such reduction in Watercourse width will be required.

20. If for the purposes of completing the Works in accordance with the Contract work

necessitates the closure and/or the reduction in width of any Watercourse access or footpath the Contractor shall give to The Employer at least 7 days written notice and shall provide to

the satisfaction of the Agency's representative:-

(a) An alternative pedestrian access with a minimum width of 2.0m with adequate fencing

to each side which shall be smoothly surfaced with 75mm of clean hardcore or such similar material as may be specified by the Agency's Representative.

(b) An alternative emergency access for The Agency's plant if required by The Agency

and equipment with a minimum width of 3.5m and adequately surfaced for the passage of vehicles plant and/or equipment which surface shall have a maximum gradient of 1 in 10.

21. The Contractor shall keep the Watercourses property or premises for which The Agency is

responsible free from rubbish. The Contractor shall not leave rubbish on or in Watercourses property or premises for which The Agency is responsible and shall subject to the approval of the Employer clear away and remove all constructional plant surplus materials and Temporary Works from Watercourses property or premises for which The Agency is responsible as and when these cease to be required for the purposes of the Works.

22. Unless otherwise expressly stated in the Contract upon completion of the Works the

Contractor shall remove any ford coffer dam and/or other Temporary Works from the Watercourses property or premises for which The Agency is responsible.

23. Except where otherwise provided for in the Contract every part of the bank and/or channel of the Watercourse shall be fully reinstated by the Contractor to the surrounding bank profile topsoiled seeded and/or turfed as appropriate.

24. Except where otherwise provided for in the Contract all property and premises affected by the

Works for which The Agency is responsible shall be fully reinstated and all damage to land property or premises for which the Agency is responsible shall be made good by the Contractor to the satisfaction of the Agency's Representative.

EMERGENCY ACTION

25. The following actions shall be taken by the Contractor in the event of any breach and/or risk

of major pollution to a Watercourse or land drainage area or any incidence of fish kill:-

(a) IMMEDIATELY inform The Agency the Employer and (if required) the Emergency services in that order.

(b) Secure the area from the approach of traffic and/or the general public.

(c) Render every assistance to The Agency and/or the Emergency Services as shall be

requested for the purposes of mitigating damage and/or for the purposes of securing public safety,

(d) With regard to landslope and any apparent flow direction of any water flowing from any

breach, construct if possible and as necessary dams bunds with earth board and/or sheet to prevent or restrain loss of water from the Watercourse and/or flows inundating any adjacent property.

(e) With regard to landslope and any apparent flow direction of any potentially polluting

material or liquid, construct if possible and as necessary dams bunds with earth board and/or sheeting to prevent or restrain such material from reaching the Watercourse and/or flows inundating any adjacent property.

(f) Where not withstanding the above potentially polluting material or liquid has entered a

Watercourse construct if possible dams/booms with board and/or sheet materials to retain and limit the extent/effect of such pollutants within the Watercourse pending instructions for full remedial action while permitting the continued flow of water.

26. Compliance with the above requirements shall not relieve the Contractor of any of his obligations under the Contract.
