CONCEPT NOTE
The bar and the bench are the pillars of any judicial system. They play a pivotal role in
ensuring that the principles laid down in the Constitution are upheld. The Preamble of our
Constitution echoes the words “Justice – Social, Economic and Political”, indicating that
access to justice would be a cardinal principle guiding our legal system.
In order to facilitate access to justice with ease, there must exist a cordial relationship
between the bar and the bench. An advocate’s primary duty is to uphold the interests of his
client through all fair and honourable means, albeit staying loyal to the law. The Bar Council
and the Advocates Act, 1961, play a crucial role in ensuring that advocates maintain and
follow the professional code of conduct.
The other pillar of our judicial system is the judiciary, who through their actions influence the
entire society. History bears witness to exceptional members of the bench who were revered
for their legal acumen and integrity. On the other hand, recent events in the form of
allegations of corruption and the lack of accountability have cast aspersions on the conduct
and functioning of the bench.
However, due credit has to be given to judiciary for its timely interventions. The broadening
horizon of the fundamental rights reflects the changing needs of the society. This was made
possible by the active participation of both the judges and the advocates thus, ultimately
befitting the society as a whole.
It is in this backdrop that the School of Law, National Conference, focuses on the theme
“Bar, Bench & the Constitution of India” We invite research papers on the various facets of
this core concept in light of the following sub-themes:
1. Bar, Bench and Access to Justice.
2. Advocates Act and Professional Ethics.
3. Judicial conduct and accountability.
4. Judicial crusade and the Indian Constitution.

MODERATOR’S POLICY
Each presenter will have – 10 minutes each.
The moderator plays a key role in the delivery of the session and contributes to the success of
the event. A good moderator can establish a friendly atmosphere in the room, make the
speakers feel welcome, and go a long way toward ensuring that interesting questions area
asked and a solid discussion ensues. It is important that the individuals who agree to serve as
moderators understand their responsibilities fully. The moderator:
• Introduces the subject to be discussed in very general terms – he/she “sets the scene”
for the discussion to follow.
• Introduces each speaker. If a speaker runs over his/her allotted share of time, it is the
moderator who must politely interrupt and invite the next speaker to begin.
• May draw out information from a speaker by asking questions or inviting the
audience to react to things a speaker has said. The moderator usually establishes the
procedures for asking questions and may repeat those questions that are difficult to
hear. The moderator must also make certain that questions asked by the audience are
answered completely and appropriately.
• Make sure that the discussion initiated is in line with the central theme of the paper.
• Keeps track of what each panelist is saying. If conflicting points are raised by
different speakers, the moderator may use these differences of opinion to stimulate
further discussion.
• Tactfully interrupts and explains that an issue cannot be discussed, if sensitive
subjects are raised by participants.
• Is a key contact for speakers needing assistance in developing their remarks.
• Conclude the session with feedbacks to the participants.
SCORING:
• Every Moderator is required to mark the participants according to the level of their
performance on a score sheet which will be provided before the start of a session.
• The score sheets are to be filled up only with the use of a blue/black pen to prevent
tampering.
• The score sheets are to be marked out of 50.
• Scoring is to be done based on the various parameters along with its mark split
prescribed on the score sheet
• Any changes to be made in the score sheet must be accompanied with the signature
of the moderator next to the changes made on the score sheet.
