The DA-REGIONAL FIELD OFFICE IV-A, with principal office and business address at RMIC Building, BPI Compound , Visayas Ave. Diliman Quezon City represented by its Regional Executive Director, MS. VILMA M. DIMACULANGAN, herein referred to as DA-RFO IV-A;

and

The CITY GOVERNMENT OF STA ROSA, LAGUNA a government entity organized and existing under and by virtue of the laws of the Philippines, with office address at City Bldg., Sta Rosa, Laguna represented herein by its City Mayor, HON. ARLENE B. ARCILLAS, herein referred to as CLGU .

and

The Regional Agricultural and Fishery Council (RAFC), a semi-government sector with office address at RMIC Bldg., Visayas Avenue, Diliman, Quezon City, represented by its RAFC-Chairman, MR. GUILLERMO AGRIPINO M. ARGOSINO.

WITNESSETH

WHEREAS, the Aquino Administration shall pursue the Philippine Millennium Development Goal (PMDG) of reducing poverty from 33.1% in 1991 to 16.6% by 2015. This is likewise reflected in Executive Order No. 45, series of 2011 and the

Philippine Development Plan for 2011- 2016;

WHEREAS, Executive Order No. 43 series of 2011 enjoins all department and agencies to orient their programs, projects and activities towards the pursuit of five (5) Key Results Areas that include Poverty Reduction and Empowerment of the Poor

and Vulnerable;

WHEREAS, a well thought strategy to reduce poverty incidence in the country is the implementation of Bottom up Budgeting (BuB) that aims to ensure the inclusion of the funding requirements for the development needs of the poorest municipalities and cities in the program and budgets of National Government Agencies (NGA);

WHEREAS, the Department of Agriculture (DA) is one of the NGAs participating agencies as identified in the DBM-DILG-DSWD-NAPC JMC No. 6, series of 2015 dated February 27, 2015 re: Policy Guidelines and Procedures in the

Implementation of the Bottom-up Budgeting Projects for FY 2015;

WHEREAS, the DA-RFO IV-A supports and undertakes activities to assist and promote the development of the agriculture and fishery postharvest industries in the countryside;

WHEREAS, the Sustainable Agri - Fishery Based Livelihood and other Agri Business Investment at Sta. Rosa, Laguna is envisioned to enhance the Agricultural Production. Introducing the values of basic food production, healthy food system and clean urban environment.

WHEREAS, under the circumstances, Project, Facilities, program and services of DA RFO IV - A maybe undertaken together with the CLGU thru an appropriate

Memorandum of Agreement (MOA);

NOW THEREFORE, for and in consideration of the premises and mutual covenants and undertaking herein set forth, the parties have agreed to the following terms and conditions:

A. The DA-RFO IV A shall:

1. Conduct joint validation with LGU of the proposed recipient to ensure that recipient/beneficiary meets the criteria based on the existing Guidelines on Agri-Pinoy,

2. Upon approval of project and verification of supporting documents, enter into MOA with the concerned LGU;

3. Regularly monitor the activities of the beneficiaries;

4. Allocate an amount of One Million Five Hundred Thousand Pesos (Php 1,500,000.00) as grant for the Sustainable Agri - Fishery Based Livelihood and Other Agri Business Investment;

5. Provide such other support or assistance as maybe required by the composite teams to ensure the successful implementation of the project;

6. Reserve the right to intervene, institute corrective measures and repossess the facilities when not fully utilized, or properly used and in case of non­compliance of the parties with the stipulations of this Agreement.

7. Issue a Certificate of Availability of Fund (CAF) to the LGU for the corresponding amount of the approval project within ten (10) days after signing ofMOA and subject to the submission of the following documents.

7.1 Certification from a Government Bank (GB) that the LGU has opened Special Trust Account (STA) for the project;

7.2 Appropriation ordinance to cover the total project cost (Counterpart Funds)

8. Require the refund/return of unused funds and disallowed amount after post audit;

.. B. The City Government of Sta. Rosa, Laguna shall:

1. Assist the RFO 4-A in the validation of the proposed recipient to ensure that recipient/beneficiary meets the criteria based on the existing Guidelines on the implementation ofBuB Projects.

2. LGU shall provide counterpart based on their approved Annual Investment Plan (AIP CY 2015);

3. Furnish monthly progress report to the DA RFO IV-A relative to the progress of Project Implementation including the amount generated, if any

4. Conduct public bidding and Awarding of the Contract based on the approved detailed designs programs of work and cost estimates and/or pertaining to the livelihood projects and the procurement of equipment and goods;

5. Strictly abide and follow the provisions, terms and conditions of the agreement as stipulated in the MOA

6. Refund/return of unused funds and disallowed amount after post audit;

C. The RAFC Shall:

1. Act as an observer during the bidding. 2. Monitor and inspect the implementation of the project until 100%

completion and report any delay in the progress of project implementation to Higher Authorities/Commission on Audit (COA).

D. SPECIFIC GUIDELINES

1. The prov1s10ns and stipulations of RA 9184 shall be applied in the

implementation of the project.

2. The provisions and stipulations embodied in the Department of Agriculture Policy Guidelines and Procedures in the Implementation of Bottom-up Budgeting (BuB) Program for FY 2015.

3. The MLGU shall prioritize the hiring of displaced local workers, whether implementation of project is done by administrations or by contract .

E. OTHER COVENANTS

All existing rules, regulations, policies and guidelines related to or connected with Agri-Pinoy Program on which maybe set forth and promulgated by the DA shall form an integral parts of this Agreement.

F. TERMINATION AND PENAL CLAUSE

1. In the event of any breach of this Agreement by the CLGU, the DA RFO IV­A has the option to terminate this Agreement given a ten (10) days notice,

beside other rights and remedies it may avail of. Any misappropriation of the fund by the CLGU shall subject to same administrative/penal sanction

under the law as contained in the DA Policy Guidelines and Procedures in the Implementation of Bottom-up Budgeting (BuB) Program for FY 2015.

A. EFFECTIVITY

This Agreement shall take effect immediately on the date of signing by the concerned parties and shall continue to be enforced and in effect, and shall be terminated upon the satisfactory fulfillment of all the terms and conditions contained herein
