Also enclosed are the legislative notification letters required to be provided in accordance with Ark. Code Ann. §23-17-404(e)(8)(D)(ii) and filed with the Commission in accordance with Rule 9.03(C)(2).

Also enclosed are monthly report for the activity months of April and May 2004, detailing the disposition of each grant request (both initial and true up requests) awarded to each telecommunications provider, the exchange in which the grant beneficiary is located, the name and address of each grant recipient, and the number of additional customers to be served are also enclosed. These reports are filed pursuant to Rule 9.03(C)(7)-(9).

We note that each application, except for ETFF No. 2004-40, includes an amount added for taxes. In communicating with Company personnel, we understand that the Company believes it is appropriate to include a provision for taxes in addition to the tariff rate for extensions. We do not see any provision in the Company’s tariff to authorize the tariff to apply a tax factor to its special construction charges for line extensions. We will continue to investigate this issue, and address the tax issue during the true-up process.

You are hereby notified that Application Nos. ETFF 2004-38, 2004-39, 2004-40, 2004- 41, 2004-43, 2004-44, 2004-45, 2004-46, 2004-47 and 2004-49 are APPROVED, having been found to comply with the program requirements.

With respect to ETFF Application No. 2004-48, the Company notified us on June 3 that this application is withdrawn. Accordingly ETFF Application No. 2004-48 is deemed withdrawn and is not approved.
