Adopted an order, granting the petition to abandon the natural gas supplier license of Coral Energy Resources LP; amending the electric generation supplier license of Premier Power Solutions LLC to include the service territories of all electric distribution companies (EDCs) within the Commonwealth of Pennsylvania; adopting a letter of notification for West Penn Power Co. with respect to the reconductoring of the Mitchell-Shepler Hill 138 kV transmission line in Forward Township, Allegheny County, and Rostraver Township, Westmoreland County; approving the PECO Energy Company request to implement a surcharge for the recovery of consumer-education plan costs; adopting a letter of notification for PPL Electric Utilities Corp. with respect to the West Hempfield–Dillerville Nos. 1 and 2 138 kV tie and the Dillerville Nos. 1 and 2 138/69 kV taps in Lancaster, Lancaster County.

Adopted an order suspending and investigating by operation of law a proposed rate increase of Pennsylvania American Water Co.; rescinding the tentative order entered for NOS Communications Inc.; revoking the Starvox Communications Inc. certificate of public convenience after a 30-day comment period following publication in the PA Bulletin, absent adverse comment; and revoking Vilaire Communications’ certificate of public convenience after a 30-day comment period following publication in the PA Bulletin, absent adverse comment.

Adopted Secretarial Letters approving a computation, in accordance with Section 3015 of the Public Utility Code, of the amount of assessments for the Broadband Outreach and Aggregation Fund and the Education Technology Fund for the Fiscal Year July 1, 2009, to June 30, 2010, on those local exchange telecommunications companies that have filed an amended network modernization plan under Section 3014(B)(2) or (3) of the Public Utility Code.

Adopted opinions and orders granting the petition for an 18-month extension with the provision that Montour Railroad first file a plan for approval within six months regarding the investigation into the matters pertaining to rail crossings of the Montour Railroad Co.; appointing two nominees

to serve on the Commission’s PA Relay Service Advisory Board for two-year terms; referring the matter to the Office of Administrative Law Judge (OALJ) for evidentiary hearings in BTS vs. Ronald E. Norris Jr. (Dauphin and York counties); adopting a motion of Vice Chairman Christy seeking comment regarding the settlement in LBPS vs. Equitable Gas Co. and providing a 20-day comment period prior to issuing the final opinion and order; granting the petition of Citizens’ Electric Co. of Lewisburg and Wellsboro Electric Co., seeking clarification of its default service procurement plan.

Approved a wireless interconnection and reciprocal compensation agreement for Fairpoint Communications Inc., SPRINT, NEXTEL and NPCR.

Approved the requested review and renewal plans for the Lycoming County, Columbia County, Clarion County and Allegheny County 911 systems.

Adopted the 2009 Price Stability Index/Service Price Index filings of Fairpoint Communications, Hickory Telephone Co., Lackawaxen Telecommunications Services Inc., Marianna & Scenery Hill Telephone Co., North-Eastern Pennsylvania Telephone Co., Consolidated Communications of PA, Windstream Pennsylvania LLC, Buffalo Valley Telephone Co., Conestoga Telephone and Telegraph Co., and Denver and Ephrata Telephone and Telegraph Co.

Approved a securities certificate for York Water Co.

Established smart meter technology procurement standards that the state’s largest EDCs must meet as modified by a motion of Vice Chairman Christy requiring EDCs to file cost data with their smart meter plans.

Adopted the secretarial letter denying the petition of Consolidated Communications of Pennsylvania Co. as moot.

Approved the settlement in Dave Brestensky vs. Pittsburgh & Shawmut Railroad Co.

Adopted the ALJ initial decision dismissing the complaint in Kimberly Glombowski vs. UGI Penn Natural Gas; and dismissing the case in Robert Taylor vs. PA American Water Co.

Adopted a motion of Commissioner Gardner remanding to the Office of Administrative Law Judge the case in William J. Borlak vs. Columbia Gas of Pennsylvania Inc. and a motion of Chairman Cawley reversing the order of the ALJ, denying Knox’s preliminary objections, reinstating the formal complaint of William L. Jones and remanding back to the ALJ the case in William L. Jones vs. Knox Energy Cooperative.

Accepted the Distribution System Improvement Charge (DSIC) reconciliation statement of Newtown Artesian Water Co.; United Water Pennsylvania Inc.; Pennsylvania American Water Co.; York Water Co.; Columbia Water Co.; and Aqua Pennsylvania Inc.

Adopted a total resource cost (TRC) test to analyze the costs and benefits of energy efficiency and conservation (EE&C) plans submitted by EDCs as amended by a motion of Chairman Cawley.

Adopted the ALJ’s recommended decision approving the settlement without modification for the Borough of Camp Hill (Cumberland County) regarding the Pennsylvania American Water Co. increase in water pressure following main breaks.

Adopted a motion of Chairman Cawley regarding appointments to the Consumer Advisory Council.

Approved the application of Pennsylvania American Water Co. for approval of the right to offer, render, furnish or supply water service to the public in a portion of Paint Township, Clarion County.
