LETTER OF THE INCOMING DIRECTOR

The directors of the Oñati Institute are rotating and I ampleased to be in charge for the next two years. The rotationprinciple seems particularly adequate for an institution like thisone in the Basque country serving so many disciplines, academicschools, legal cultures and policy areas. No single academic isable to represent this plurality of ideas and approaches but over theyears many cultures will have had a chance to contribute to thetasks of the Institute. I can already build on the symbolic capitalcreated by my predecessors: the reputation of Oñati as a coreinstitution of the Sociology of Law, the existence of the (probably)best library in this discipline, a well knownand highly appreciated Master course andnumerous meetings leading mostly toexcellent book publications. There areimpressive figures about the multiculturalsources of these activities. The mailing listincludes more than 4000 scholars who havebeen in contact with the Institute in one wayor another, students from the Master Programcame from thirty-four and the faculty fromtwenty-six different countries. Let me justsay that I am proud of these achievementsand keen on further improving the Institute’sreputation as a global institution.

My program includes fund raising forgrants in order to enable more students frompoor countries to do the Master course andin order to support academics from poorcountries to participate in workshops. I willencourage colleagues with small resourcesto take advantage of the Institute‘s newprogram for visiting scholars offering freeaccomodation during the winter season and teach classes in theMaster. Despite obvious limitations the library should cover moreand ideally all legal cultures and more workshops should beorganized by non-western academics. In some western academiccommunities of the sociology of law there still seems to prevail a“the best comes from the West” attitude, despite activities called“internationalization of law schools”. If these activities consist ofpromoting more knowledge about non-western cultures instead

Los directores del Instituto de Oñati están rotando y me alegrapoder asumir el cargo durante los dos próximos años. El principio dela rotación parece especialmente adecuado para una institución comoésta en el País Vasco, que abarca tantas disciplinas, escuelas acadé-micas, culturas jurídicas y ámbitos políticos. Ningún académico escapaz de representar él sólo esta pluralidad de ideas y enfoques, y conel paso de los años muchas culturas habrán tenido la oportunidad decontribuir a la labor del Instituto. Yo tengo la suerte de poderaprovechar el capital simbólico acumulado por mis predecesores: lareputación de Oñati como institución básica de la sociología jurídica,

la existencia de (quizás) la mejor biblioteca deesta disciplina, un Master muy conocido yvalorado, así como los numerosos encuentrosque en su mayoría dan lugar a excelentespublicaciones. Hay cifras impresionantes so-bre las fuentes multiculturales de dichas acti-vidades: la lista de correo incluye a más de4.000 especialistas que han tenido relacióncon el instituto en una u otra forma, los estu-diantes del Master son originarios de treinta ycuatro países distintos y los profesores, deveintiséis. Permítanme decir que estoy orgu-lloso de todos estos logros y deseoso de mejo-rar aún más la reputación del Instituto comoinstitución de categoría mundial.

Mi programa incluye la recaudación defondos para becas que permitan seguir elMaster a más estudiantes de países pobres ypara que el personal académico procedentede países pobres pueda participar en losworkshops. Animaré a colegas con pocosrecursos a adherirse al nuevo programa del

Instituto para profesores visitantes, que ofrece alojamiento gratuitodurante la temporada de invierno y a impartir clases en el Master.A pesar de sus evidentes limitaciones, lo ideal sería que la bibliotecacubriera todas las culturas jurídicas y que hubiera más workshopsorganizados por académicos no occidentales. En algunas comuni-dades académicas occidentales de la sociología jurídica pareceprevalecer una actitud según la cual “lo mejor viene de occidente”,a pesar de la existencia de actividades llamadas de

of promoting knowledge from non-western countries the resultwill simply be counterproductive. English-written publicationspractically never take notice of non-English-written literature,non-westerners are welcome in Law Schools as students ratherthan as teachers. Networks and conferences all have a strongwestern bias. I am guilty myself when I assign in my comparativelaw classes mostly texts written by Western academics - evenwhen we deal with Japanese, Chinese, Mexican or Islamic legalcultures. We have to overcome such socio-legal ethnocentrism.My program includes active support for the creation of researchinstitutes for the sociology of law in non-western countries andthe organisation of workshops dealing critically with the picturedrawn by Western researchers about non-western socio-legalphenomena (let me take this opportunity to call for workshopproposals in that direction). Despite our Chiba-fellowship (a grantfor studies in non-western law) I am particularly concerned aboutinsufficient coverage of Far-Eastern legal cultures in the Institute‘sprogram: there was recently a workshop on Asia and we hadChinese and Japanese workshop participants from time to timebut not a single Master student and only one Master teacher camefrom this part of the world (this again is a call for applications). Aswe show below in this newsletter we have almost no books orjournals in, say, Japanese or Chinese in the library (dOñations ofsuch publications accompanied by an English summary are mostwelcome). The Internet access to the library from “Asia” is verypoor (only 3 out of 4500 visits so far). I am realistic enough tounderstand the difficulties (which are not only linguistic) ofmaking decisive steps towards more plural and unbiased activitiesbut I will do my best to contribute to slowly overcoming theprevailing Western academic hegemony in our scientificcommunity. There are many reasons that Oñati is a good place todo so: as a Basque institution the world is naturally seen not froma hegemonic but rather from a minority position.

Si estas activi-dades consisten en fomentar un mayor conocimiento sobre lasculturas no-occidentales en vez de promover el conocimiento de lospaíses no-occidentales, el resultado será simplemente contraprodu-cente. Las publicaciones en inglés no mencionan prácticamentenunca la literatura no inglesa, y los no occidentales son bienvenidosen las Escuelas de Derecho como estudiantes más que comoprofesores. Todas las redes y conferencias tienen un claro sesgooccidental. Yo también soy culpable cuando en mis clases dederecho comparativo la mayor parte de los textos que incluyo sonde autores occidentales - incluso cuando abordamos la culturajurídica japonesa, china, mexicana o islámica. Tenemos que supe-rar este etnocentrismo sociojurídico. Mi programa incluye unapoyo activo hacia la creación de institutos de investigación desociología jurídica en países no occidentales y la organización deworkshops que analicen de una forma crítica la imagen que losinvestigadores occidentales han dado de los fenómenossociojurídicos no occidentales (quiero aprovechar la oportunidadpara animar a que se propongan workshops en este sentido) . Apesar de la existencia de la beca Chiba (una beca para estudios dederecho no-occidental) me preocupa particularmente la escasacobertura de las culturas jurídicas de extremo oriente en el progra-ma del Instituto: recientemente se organizó un seminario sobre Asiay de vez en cuando hemos tenido participantes chinos y japonesesen los seminarios, pero no ha habido ni un solo estudiante del Mastery sólo un profesor de dicho curso procedente de esa parte del mundo(una vez más hago un llamamiento a la presentación de candidatu-ras). Tal y como se indica más adelante en este boletín informativo,casi no tenemos libros o revistas en, por ejemplo, japonés o chinoen la biblioteca (todas las donaciones de dichas publicacionesacompañadas de un resumen en inglés serán muy bien recibidas).El acceso vía Internet a la biblioteca desde “Asia” es muy pobre(sólo 3 de 4500 visitas hasta ahora). Soy lo bastante realista como paraentender las dificultades (no sólo lingüísticas) de organizar activida-des más plurales y objetivas, pero haré todo lo que esté en mi manopara intentar poco a poco ir superando la imperante hegemoníaoccidental en nuestra comunidad científica. Hay muchas razones porlas que Oñati es un buen lugar para hacerlo: como institución vasca,el mundo se ve no desde una posición hegemónica, sino más biendesde una posición minoritaria.

Les directeurs de l’Institut sont en roulement et je suis ravi depouvoir occuper ce poste pendant les deux prochaines années. Leprincipe du roulement semble particulièrement approprié à uneinstitution comme celle-ci au Pays Basque, qui recouvre autant dedisciplines, d’écoles académiques et de domaines politiques. Unacadémicien ne peut pas à lui tout seul représenter cette pluralitéd’idées et d’approches; année après année, un grand nombre decultures ont eu la possibilité de contribuer au travail de l’Institut.J’ai la chance de pouvoir dès à présent bénéficier du capitalsymbolique amassé par mes prédécesseurs: la réputation d’Oñaticomme institution majeure de la Sociologie juridique, l’existencede (peut-être) la meilleure bibliothèque dans cette discipline, unMaster reconnu et hautement apprécié, ainsi que les nombreuxséminaires produisant le plus souvent des publications excellentes.Il y a des chiffres impressionnants sur les sources multiculturelles de

ces activités: la liste de courrier comprend plus de 4000 spécialistesqui, d’une manière ou d’une autre, ont été en rapport avec l’Institut,les étudiants du Master sont venus de trente-quatre pays différents, etles enseignants, de vingt-six. Permettez-moi de dire que je suis fier deces performances et désireux d’élever encore plus la réputation del’Institut comme institution mondiale.

Mon programme prévoit la quête de financement pour desbourses permettant aux étudiants de pays pauvres de suivre les coursdu Master et le soutien aux enseignants de pays pauvres afin qu’ilspuissent participer aux séminaires. J’encouragerai des collèguesayant de faibles ressources à profiter du nouveau programme del’Institut pour les professeurs visitants, qui propose l’hébergementgratuit pendant la saison d’hiver, et à donner des cours dans le cadredu Master. Malgré les limitations évidentes de la bibliothèque, l’idéalserait qu’elle couvre toutes les cultures juridiques. Il serait égalementsouhaitable que plus de séminaires soient organisés par des professeursnon occidentaux. Dans certaines communautés occidentales de lasociologie juridique, l’attitude qui semble prévaloir encore c’est cellede dire que “le meilleur vient d’occident”, malgré les activitésappelées d’“internationalisation des écoles de droit”. Si ces activitésconsistent à promouvoir une plus grande connaissance sur les culturesnon occidentales au lieu d’encourager la connaissance des pays nonoccidentaux, le résultat sera simplement contre-productif. Lespublications en anglais ne citent presque jamais la littérature nonanglophone, et les non occidentaux sont les bienvenus dans les écolesde droit en qualité d’étudiants, et bien moins en qualité d’enseignants.Les réseaux et les conférences ont tous un biais nettement occidental.Moi aussi je suis coupable lorsque dans mes cours de droit comparatifla plupart des textes que j’utilise sont d’auteurs occidentaux – mêmelorsque nous abordons la culture juridique japonaise, chinoise,mexicaine ou islamique. Nous devons dépasser cet ethnocentrismesocio-juridique. Mon programme inclut le soutien actif pour lacréation d’instituts de recherche de sociologie juridique dans les paysnon occidentaux et l’organisation de séminaires traitant d’une manièrecritique l’image donnée par les chercheurs occidentaux sur lesphénomènes socio-juridiques non occidentaux (je profite de l’occasionpour faire un appel à propositions dans ce sens). Malgré l’existencede la bourse Chiba (une bourse pour les études de droit non occidental),je suis particulièrement préoccupé par l’absence de couverture descultures juridiques d’extrême orient dans le programme del’Institut : récemment s’est tenu un séminaire sur l’Asie et nousavons reçu des participants chinois et japonais à l’occasion, mais nousn’avons jamais eu un seul étudiant du Master et seulement unprofesseur de ce cours provenant de cette partie du monde (ceci està nouveau un appel à candidatures). Comme il est dit plus loin dansce bulletin d’information, nous n’avons presque pas de livres ou derevues en, par exemple, japonais ou chinois dans la bibliothèque(tous les dons de ces publications accompagnées d’un résumé enanglais seront fortement appréciés). L’accès par Internet à labibliothèque depuis l’“Asie” est très réduit (seulement 3 des 4500visites réalisées jusqu’à présent). Je suis assez réaliste pour comprendreles difficultés (qui ne sont pas uniquement linguistiques) qu’impliquela mise en œuvre d’activités plus plurielles et objectives, mais je feraitout mon possible pour essayer peu à peu de surmonter l’hégémonieoccidentale dominante dans notre communauté scientifique. Pour denombreuses raisons, Oñati est un bon lieu pour le faire: en tantqu’institution basque, le monde est vu non à partir d’une positionhégémonique, mais plutôt à partir d’ une position minoritaire.

BECA - CHIBA - GRANT

LELIA JIMENEZBECA CHIBA / CHIBA GRANT 2003

Mi estancia en Oñati, con fondos de la beca Chiba, fue para avanzaren la investigación de mi tesis para el Doctorado en Derecho: Programade Derechos Fundamentales de la Universidad Carlos III de Madrid. Latesis es sobre: “Multiculturalismo y derechos indígenas en México” ytrata de conocer la situación actual de reconocimiento, tanto legal, comopolítico, de los pueblos indígenas en el Estado mexicano; intenta tam-bién contrastar la situación planteada con los reclamos hechos por dichospueblos, así como con las ideas postuladas por algunos teóricos delmulticulturalismo, todo ello, mediante la utilización de una metodologíainterdisciplinaria, para llegar a conclusiones propositivas acerca de loselementos necesarios para el verdadero reconocimiento de los derechosde los pueblos indígenas.

La estancia en Oñati me permitió poder trabajar en la sistematizacióny análisis de información recabada en México, tanto de distintos ámbitosdel gobierno (en particular poder ejecutivo y legislativo), como dediferentes organizaciones indígenas. Pude escribir acerca del movimien-to indígena en México, así como acerca de la formación de algunasorganizaciones seleccionadas. De igual manera me sirvió para la recopi-lación de material en la biblioteca y centro de documentación del IISJsobre diversas disciplinas relacionadas con el tema del trabajo. Estematerial está siendo y será incorporado para sustentar diferentes capítu-los de la tesis.

Además del trabajo escrito y la búsqueda bibliográfica realizados sepuede destacar de la visita a Oñati la retroalimentación que se pudo tenercon otros investigadores y académicos visitantes en el Instituto y laResidencia con los que se pudo dialogar sobre temas de interés para lainvestigación y obtener valiosas aportaciones.

Agradezco a todo el personal del Instituto el apoyo prestado para lautilización de los recursos tanto de la residencia Antia como de labiblioteca y centro de documentación.

CHIBA-OÑATI PROGRAMME

The Masaji Chiba Fund has been established at the InternationalInstitute for the Sociology of Law (IISL) in Oñati. El Instituto Internacional de Sociología Jurídica de Oñati (IISL)dispone de un Fondo Masaji Chiba. En palabras del donante, el dinerodebe ir destinado a «ayudar al estudio socio-jurídico del derecho nooccidental, incluyendo el derecho indígena de los pueblos occiden-tales, así como los estudios de jóvenes becarios no occidentales»

A un lector desprevenido de la actual Constitución Política deColombia le podría resultar un tanto paradójico encontrar en ella unreconocimiento tan amplio de los derechos de los pueblos indígenas. Talparadoja radica, en parte, en que mientras la realidad colombiana parecerecorrer un camino distinto a aquel que traza el texto constitucional enel ámbito normativo se están produciendo profundas mutaciones en laforma cómo se entiende y define la diferencia cultural. De este modo, altiempo que la Constitución aboga por un país tolerante y respetuoso delpluralismo y la diferencia, la realidad se empeña en señalar con durezalas limitaciones del proyecto constitucional. En todo caso, después desiglos de exclusión e invisibilidad de los pueblos indígenas el Estadocolombiano ha reconocido el carácter plural de la sociedad que loconstituye y, como consecuencia de lo anterior, distintos sectores socia-les, políticos y académicos se han dado a la tarea de encontrar y construirmecanismos que permitan la coexistencia igualitaria de las distintasformas de concebir el mundo. Uno de los temas más candentes se refierea las relaciones entre el derecho estatal y los sistemas legales de lospueblos indígenas. Gracias al apoyo que me ha brindado el InstitutoInternacional de Sociología Jurídica de Oñati a través del ProgramaChiba, he tenido la oportunidad de abordar esta paradoja constitutiva dela cultura jurídica colombiana en un ambiente académico inmejorable.Tanto la apacibilidad de la vida cotidiana de la ciudad como las enormesposibilidades académicas que ofrece el Instituto, me han permitidoimbuirme fructíferamente en la elaboración del trabajo de Investigación“La Política Judicial de Conservación Cultural y la Nueva Construcciónde la Identidad Indígena en Colombia”, el cual he presentado dentro delsegundo año del Doctorado en Derecho de la Universidad de Deusto.Quiero agradecer a las personas que trabajan en el Instituto por laamabilidad y cooperación desinteresada que me ha prestado desde queme vinculé a él como estudiante de la maestría y espero que el ProgramaChiba siga apoyando las investigaciones sobre el Pluralismo Jurídico ylos Pueblos Indígenas en los países no occidentales.

As can be seen the world´s languages are not equally represented in our library (although probably better than in most lawlibraries). We would like to increase the number of publications in non-western languages but need support from outside. Wehave almost no information about relevant books in the sociology of law in those languages and even then in many cases areunable to purchase them. Donations are very welcome. Visitors to the Institute coming from countries with underrepresentedlanguages are kindly asked to bring their publications accompanied by a translation of the title and an English summary ofthe contents.

As probably the largest part of my mates, Ifound the Oñati master course exciting and wellorganized. The Institute is clearly working hardto supply the students with a lot of facilities andit is always a pleasure to find people who lovetheir job and do it at their best. Giving for grantedthat my judgement is largely positive, let me justbriefly focus on a few suggestions I would giveto improve the following aspects: -morecommunication with the police that releases thestaying permits would be of great help especiallyfor students coming from non-EU countries whowant to go to some other non-Schengen countriesother than their own after the end of the course.I realize this might not be easy, but I think itworth trying some strategy, possibly handlingsome deal for the relase of the staying permitswithin a clearly defined period so that to allow,at least, the students who really need the permitto plan what to do. A studying room that studentscould use in the evening somewhere outside theresidencia would also be an important facility. Irealize the access to the Antigua Universidadduring the night is problematic, but maybe it ispossbile to set up some other studying place incollaboration with the ayuntamiento. Considero el programa de maestría enSociología Jurídica de Oñati una etapafundamental en el desarrollo de mi vidaacadémica. Desde antes de empezar ya he podidoapreciar la perfecta organización del Instituto, yuna vez en Oñati he tenido la confirmación.Todos los problemas han tenido una pronta yeficaz solución, tanto en la organización delcurso como en la estancia en la Residencia. Eltrato humano y amable de todo el staff del Institutonos ha permitido vivir seis meses durante loscuales he podido enriquecerme muchísimo anivel personal y académico. La biblioteca es unaperla: nunca en mi experiencia pasada en Italia yen el extranjero había visto y había podidodisfrutar de tantos libros, sobre todo sobre eltema de mi interés: la criminología.

Por lo que atañe al programa, el juicio finalno puede más que ser muy positivo: casi todos losprofesores nos han seguido en un camino decrecimiento cultural con mucha atención, a pesarde las diferentes procedencias académicas(derecho, sociología, etc.). Sólo en 3 casos hetenido problemas de comunicación: en los 3casos se trataba de docentes cuya profesion no esla Académica. En estos 3 casos ha sido muydificil encontrar un punto de encuentro, porquelas ideas diferentes eran vistas por estos docentes,o por lo menos así lo creo, como ganas de partedel estudiante de enfrentarse sin razonar sobrelos puntos en discusión. De todas maneras, en lamayoría de las clases he tenido el honor y laoportunidad de aprender muchas cosas, gracias ala disponibilidad y preparación de los profesores.(Stefano Fumarulo-Italia)

I thoroughly enjoyed my time in Oñati withthe IISJ. If I ever had a question, theAdministration office always had an answer.

OPINION SOBRE EL MASTER DE LOS ESTUDIANTES 2002/03The Masters programme was a great experiencewhich enabled me to meet professors from allover the world and witness their teaching styles.The conferences were also opportunities to meetacademics in our field from different countries.It was also amazing to live at the Residencia. Iam really thankful to the IISJ for making theResidencia internet-ready by installing a wirelessnetwork. It was also helpful to have both the atticcomputers along with the University computers/printers available at all times.

Oñati is also a good location because thetown is rich with history and only a bus ride awayfrom a major city (i.e. Bilbo, Donostia, Gasteiz,etc.). Since the town is relatively small, notowning a car is not a problem since almosteverything (the gym (which is free-of-charge forIISJ students), movie theatre, shops) is walkingdistance.

I also appreciate the fact that the Instituteprovided all of the reading materials for the studentsand therefore, there were no further text charges tobe incurred. The library is a good source forstudents researching Western European or U.S.law. If I was looking for a book the library did notcarry, the library staff never hesitated in requesting/ordering the book from another University.Therefore, I was able to check out books coveringdifferent parts of the world (i.e. former colonieslike India, Kenya, etc.).

Suggestions: Implementing a Spanishlanguage class for students from the beginning. Iwas speaking with some of the other Mastersstudents after the seminars and we all agreed thatthe reason we did not go absolutely insane wasbecause we had other friends outside of theInstitute. When being around such a small numberof people constantly (during seminars, at theResidencia), it is necessary to know some extrafaces and friends to maintain mental health. Ourclass was very lucky to have Victor and Goza

(local residents of Basque country). We werealso lucky in that some of us could speakCastellano or made friends with people that couldspeak English. (Manisha Lal – USA)

It is said that, excellent programs dependfirst on outstanding scholars and students withcuriosity, motivation and passion for learning.But they also require academic facilities thatsupport research in practical ways. That is thevision and what IISL stand for. What I realisedand appreciate about IISL, as an African studentwith different academic socialisation andorientation, is that the IISL offer more than whatis promised. The master’s programme is designedto equip and broaden the students analyticalhorizon and perspectives. The bringing togetherof leading and experienced thinkers andresearchers from different parts of the worldmade the Institution not only unique but the bestof its kind. What is of a great interest to me is thestructure of the course with its student-centredparticipation. This provides congenial intellectualenvironment and opportunities for students toshare their experiences. The well stocked librarywith modern electronic facilities, availabity ofwell functioned internet facility to the studentsand excellent lecturer-student relationshipsmarried with effective, dedicated and efficientwork and support from non-teaching staffs makesthe IISL a home for people who want totaleducation.

But I suggest that, for the institute to benefitfrom its investment, emphasis must be onstudent’s research (tesina), rather than coursework. This could be done by encouraging andallowing students to stay after their course towork on their tesina up to a reasonable levelbefore leaving. This will help to solve low turnout of the number of students who write andsubmit their Tesinas in time. (Julius Ahlijah –Ghana).

Se presentaron 43 solicitudes, fueron admitidos 22 yotros tres han quedado en lista de espera. Para el presentecurso se han concedido becas por la cantidad de 15.000 e

procedentes de la Beca Renato Treves (6.000 e), la ayudaque facilita el Ayuntamiento de Oñati (1.200 e) y, sobretodo, de la generosidad de los profesores del Master (7.800e) que han renunciado a sus honorarios con esta finalidad.Además una estudiante se beneficia del convenio Sócratessuscrito por el Instituto a través de la Universidad del PaísVasco con su Universidad de origen.

Information about the 2003-04 Master’s Programme

We received 43 applications, 22 applicants were acceptedand three were placed on a waiting list. Grants of 15,000 e

were made to students. These grants were made possible bythe Renato Treves fund (6000 e), the financial help givenby the town of Oñati (1200 e) and, above all, by thearrangement whereby funds (7800 e) that in the past werepaid as honorariums to teachers in the program are nowallocated to student scholarships. In addition, one studentwill benefit from the Socrates agreement signed by theInstitute, the University of the Basque Country and heruniversity.

The deadline to submit application for the 2004-05Master’s Programme is the 28th February 2004.

• Healing the Wounds, from a workshop hold on 3-4April 2000. It faces the question of reconstructing ideologies,social peace and legal stability in societies traumatized bywar, violence and terror.

The editors are Trutz VON TROTHA and Marie-Claire FOBLETS.

• Imaginary Bounderies, from a workshop hold on 8, 9and 10 May 2002. It aims at exploring the emergence ofvisions of social justice.

The editor of the volume is Ronnie LIPPENS.

• After National Democracy, from a workshop held on1-2 June 2000. In view of the “thread of globalization” itdeals with the weakening of the “Imagined Community” ofthe nation and its social contract as well as its institutionalcounter-part, the welfare state.

The editor of the book is Lars TRAGARD.

NEW BOARD OF EDITORS OF HART SERIES

For many years the Oñati International Series in Law and Society has been directed by Bill Felstiner and Eve Darian-Smith, colleagues at UCSB. They have been fortunate to have had a board of editors composed of Peter Fitzpatrick, HazelGenn, Eliane Junquiera, Hubert Rottleuthner and Ronen Shamir. Darian-Smith, who has recently had twins, has been replacedby Johannes Feest. With this changing of the guard it seemed an appropriate time to alter the character of the board of editorsas well by appointing scholars representing different national and regional sociolegal traditions. As a consequence, as ofJanuary 1, 2004 it will be composed of Marie-Claire Foblets, Rosemary Hunter, Jacek Kurczewski, Carlos Rivera Lugo,Roderick Macdonald and David Nelken.

• La relación Seguridad-Inseguridad en centrosurbanos de Europa y América latina. Estrategias, políticas,actores, perspectivas, resultados. La reunión se celebró losdías 27, 28 y 29 de junio de 2001, y el material ha sidorecientemente remitido a la imprenta. Los coordinadores dellibro son Ignacio MUÑAGORRI y Juan S. PEGORARO.

DAFNE BORDONE - Università Degli Studi di Milano,Italy (7 – 18 July 2003)

During my visit to the IISJ I did a bibliographicalresearch on the topic of my PhD thesis in order to achievethrough the readings (which focused in particular on theInformation age, the use of the Internet by legal professionals,Legal Ethics as well as the Codes of professional conduct)a good knowledge of the ongoing debate on the Internetsociety and to best develop the theoretical framework,which is indeed the basic step for the future empiricalinvestigation. The articles and the books I found are reallyfundamental to my study.

RUTH MANNELQVIST - Umeå University, Sweden(10 – 16 June 2003)

At my stay at the IISL in Oñati in June 2003, I did someresearch concerning different social security systems invarious European countries. In my doctoral thesis, I havestudied the principles of Swedish welfare law. My researchat the IISL was to draw up the theoretical framework for aEuropean comparison with a theoretical analysis of the legalconstruction of welfare state law, in particular social securitylaw. Different countries have different types of welfarestate, which has a large impact of the welfare legislation.Legal cultures and social policies are determining for theconstruction of different legal systems and I have thereforenot explored the details of social security law in Europe. Itis instead the principles and norms behind the legislationsthat draw my attention. Principles like solidarity and equalitybetween sexes. Therefore I need a background of differentlegal notions and social policies in Europe concerningoverall welfare law and in particular social security law.

The excellent library at the IISL has been very helpful inmy research and I have found many important, interestingand necessary books and articles about social rights, socialcitizenship, welfare policy and social security legislation indifferent European countries and US. Some of the materialwill be used as a base and a context for my study, while other

parts are essential for my research. For a normative study ofdifferent legal systems, it is necessary to have anunderstanding of both the legal system, and of the society.The material at the IISL library has given me an excellentoverview of European research in this field.

LENA WENNBERG - Umeå University, Sweden (10 –16 June 2003)

My stay at the Institute has been very satisfying. I haveenjoyed very much the tranquility at the Institute, the nicelittle town with its surroundings and the accommodation atthe Residence. It has been a great pleasure to work in thewell-organised library and to have an own office withinternet access.

Everybody has been very helpful during my stay and Iwill warmly recommend othe scholars to come here. This isa perfect place for reflection and research.

DAVID McCALLUM - Victoria University, Australia(24 June - 23 September 2003)

David McCallum is Associate Professor in the School ofSocial Sciences, Victoria University, Melbourne. He iscurrently researching a history of the children’s court inAustralia with particular attention to the emergence ofpsychiatric, psychological and social work expertise. He isthe author of Personality and Dangerousness. Genealogiesof Antisocial Personality Disorder (Cambridge, CambridgeUniversity Press, 2001), and a history of educationalpsychology in Australia, The Social Production of Merit.Education, psychology and politics in Australia 1900-1950(London, Falmer Press, 1990). David teaches sociology andcoordinates the legal studies program at Victoria University.

RCSL 2003

The annual meeting of the RCSLtook place in St. Anne’s college, Oxford.It was a relatively small (with less than100 participants), but lively conference.Participants were in their majority fromEurope (Central and West), withqualitatively good representation fromArgentina, Australia, Japan, Mexico,Peru, South Africa, USA. Both theacademic and extra-curricular aspectswere well-prepared by Mavis Maclean.The presentations were organized intothree streams (Family law; Legalsystems; Gender & Feminism). At aplenary business meeting, JohannesFeest (outgoing president)and LawrenceFriedman (president elect) started off adiscussion on the future of the ResearchCommittee.

During the conference, the RCSLBoard met and confirmed the electionof the new president (LawrenceFriedman), as well as that of thefollowing members of the Board: AnneBoigeol (France), Sandra Burman(South Africa), Bryant Garth (USA),Pierre Guibentif (Portugal), JacekKurczewski (Poland), David Nelken(Italy), Masayuki Murayama (Japan),Vittorio Olgiati (Italy), Gunther Teubner(Germany), Alex Ziegert (Australia).Bart Rwezaura was again coopted toupgrade the African representation onthe board. According to the RCSLStatutes, the past presidents and thechairs of Working Groups also havevoting rights on the board.

The following new WGs wereestablished: WG Gender (chair:Rosemary Turner), WG Methodology(chair: Reza Banakar).

The following existing WGs wereconfirmed: WG Legal Professions(chair: Benoit Bastard), WG HumanRights (Stefan Parmentier), WG Lawand Politics (chair: María AngélicaCuellar), WG Urban Problems (chair.

Edesio Fernandez), WG Social andLegal Systems (chair: Vittorio Olgiati),WG European Integration (chair: FrancisSnyder).

Lawrence Friedman appointed RezaBanakar (UK) as new general secretaryof the RCSL.

The board thanked Manolo Calvo(Spain) for his excellent work as directorof the Oñati IISL and sent good wishesto his successor Volkmar Gessner(Germany).

The representation of the RCSL onthe board of the IISL will be as follows:Lawrence Friedman (ex officio untilspring 2006), Setsuo Miyazawa, HéctorFix-Fierro (until spring 2004), AnneBoigeol, Malgorzata Fuszara (untilspring 2007).

The next annual meeting of the RCSLwill take place in Puerto Rico.

La Fundación Asmoz de EuskoIkaskuntza y el Departamento de Dere-cho Constitucional, Administrativo y Fi-losofía del Derecho de la UPV/EHU,bajo la dirección de Francisco JavierCaballero Harriet, Catedrático de Filo-sofía del Derecho de la UPV/EHU yAndrés Krakenberger Larsson, activistade Derechos Humanos y Ex-Presidentede la Sección Española de Amnistía In-ternacional han organizado la 1ª edicióndel Curso de Derechos Humanos a tra-vés de Internet.

El objetivo primordial de este cursode 250 horas de duración es el de formara abogados, alumnos de últimos años decarrera de Derecho, miembros de ONGsy personas en general interesadas encontar con conocimientos prácticos dedefensa de los Derechos Humanos.

Se señalarán las técnicas orientadashacia el esclarecimiento y, en la medidade lo posible, hacia la reparación de

situaciones de vulneración de DerechosHumanos tanto en el plano de la casuísticacomo en los ámbitos legislativo o social.

El curso se divide en una serie demódulos que consisten en una lecciónredactada por el profesor responsable,haciendo hincapié a los casos prácticos alhilo de cada capítulo. La evaluación serácontinua: se deberán resolver los ejerci-cios prácticos de cada módulo y participaren los seminarios o foros de debate que seplantean durante el curso. Al finalizar conel estudio de los módulos, se deberá rea-lizar un examen final. Para todo ello, elalumno accederá mediante una clave per-sonal a la página-web del curso, dondepodrá consultar el material adicional quecontenga cada lección, plantear sus dudasal responsable de área, participar en deba-tes, acceder a los ejercicios prácticos ymantener un contacto personalizado conla secretaría.
