Oñati-IISL Newsletter Boletín del IISJ-Oñati This edition of the Newsletter provides information about the Institute’s activities between January and June, 2009. The IISL is twenty years old and to celebrate, between the 7th and 9th of July we organised a Conference on Complexity, Conflicts, Justice: 20 years of Sociology of Law. Then, on the 10th, we held our twentieth anniversary celebrations. With these activities the IISL reiterated its identity as a centre for studying, researching and meeting in the field of sociology of law. The end of this month marks the end of my time as Scientific Director, and the beginning of another era under the management of the new Director, Sol Picciotto who will undoubtedly provide new projects and ideas and with them the continuity and renewal that characterizes the dynamic nature of the IISL. So the time has come to say my goodbyes and with them close an institutional, personal and professional era. I cannot objectively appraise the results of this period yet and what is more, others will be able to do that better than me. But as always happens, achievements are relative and there is still a lot to be done and improve. The Institute has been a very pleasant and welcoming place for me. I have always received the backing of the Basque Government authorities and especially the Board’s Chairman, Mr. Josu Sagasti, whom I should like to thank for his assistance. As for the RCSL and most especially its Chairwoman, Anne Boigeol, I should firstly like to thank them for having given me the opportunity to be the Institute’s Scientific Director and for having supported my management of it over the last two years. And once again I must highlight the invaluable contribution of the staff. I have been lucky enough to co-ordinate an excellent team of people. I have fed off the experience of all the members of staff: their opinions, suggestions and advice have helped me learn and avoid mistakes – and what is more they have been very receptive to my proposals and decisions. My thanks go to each and every one of them and I would like them to know that I will always have fond memories of the time we have spent together and the work we have shared. A special recognition goes to José Antonio Goyenaga, the Administrative Director, for his support and for the possibility of sincerely and openly discussing all the issues relating to the Institute. The list of researchers, lecturers, visitors and pupils who have taken part in the activities and cooperated with the Institute over the last two years is too long for a detailed mention. I have been extremely fortunate in being able to share conversations and experiences with them. I have been the main person to profit from this exchange of know-how, since it has enabled me to learn continuously and in-depth. I am certain that I leave the IISL in good hands. Its new Scientific Director, in addition to his well-known academic and intellectual merits, has clear objectives and is fully involved in the activities being developed. I offer my co-operation to the new Director and his staff. I feel enormously proud and honoured to have formed a part of this institution. Perhaps, for this reason I have this ambivalent feeling in my conscience, that in a very short time I will form a part of its history and past and at the same time, like so many others, of the very promising future that awaits Oñati and its Institute. The content of this Newsletter means that it is unnecessary for me to give more details because they will inform of the work that has been done and the projects of the future. After twenty years of continuous work, the IISL has met the objective for which it was created: to contribute towards the development of sociology of law around the world. Its work is successful and in several senses has actually reached outside the limits of its own remit. Many lecturers, researchers and students have come here and they are now a whole community scattered around all the continents. For the majority, the Institute is still an important point of reference. We can state that today the IISL goes much further than just this building and Oñati and is now the centre of a network, or, if you prefer, a privileged part of it which it feeds and from which it takes sustenance. It has also gone beyond the subject-limits for which it was created, because today it provides us with different visions of sociology of law and from different social science perspectives. For all of this, the IISL is in a privileged position to capitalize its achievements by making its contribution outside it’s geographic boundaries even more visible. The new Director will do his best to achieve this and I am sure that those who form part of this community will contribute towards making that objective attainable. See you soon, Carlos A. P r e s e n t a c i ó nPresentación Este número del Boletín informa sobre las actividades desarrolladas durante el período comprendido entre enero y julio de 2009.El IISJ ha cumplido dos décadas de existencia. Por ese motivo, entre el 7 y el 9 de julio se organizó el Congreso Complejidad, Conflictos, Justicia. 20 años de Sociología jurídica, que culminó, el día 10, con la celebración del 20º aniversario. Con estas actividades la institución ratificó, una vez más, su identidad como centro de estudio, investigación y encuentro en el área de los estudios socio-jurídicos.Al concluir el mes finalizaré mi desempeño como director científico, con lo cual se inicia una nueva etapa y la gestión de un nuevo director, Sol Picciotto, quien, sin lugar a dudas, aportará nuevos proyectos e ideas y con ello la continuidad y la renovación que caracterizan la dinámica del IISJ.Es tiempo entonces de despedirme y con ello cerrar una etapa institucional, a la vez que personal y profesional. Aún, no puedo evaluar objetivamente los resultados y además, otros podrán hacerlo mejor que yo. Como siempre ocurre, los logros son relativos y queda mucho por hacer y mejorar.El Instituto ha sido, para mí, un lugar de grata convivencia. Conté siempre con el apoyo de las autoridades del Gobierno Vasco y en particular del presidente del Patronato, Josu Sagasti, a quien agradezco su colaboración.Al Board del RCSL y en especial a su presidente, Anne

Boigeol, quiero agradecer, en primer lugar, la oportunidad que me brindaron de ser director científico del Instituto y luego, durante dos años, el apoyo ofrecido a mi gestión.Una vez más quiero destacar la invalorable contribución del personal. He tenido la suerte de coordinar un excelente equipo de trabajo. La experiencia acumulada por sus integrantes me nutrió; sus opiniones, sugerencias y advertencias me permitieron aprender y evitar errores; y además, fueron muy receptivos a mis propuestas y decisiones. A cada uno de ellos mi agradecimiento y quiero que sepan que los llevaré en mi recuerdo, por tanto tiempo y tareas compartidas. A José Antonio Goyenaga, el director administrativo del Instituto, mi especial reconocimiento, por su apoyo y por la posibilidad de discutir con sinceridad y apertura todos los problemas concernientes al mismo.La lista de investigadores, profesores, visitantes y alumnos que han participado en las actividades y colaborado con la institución durante estos dos años es demasiado extensa para una mención pormenorizada. He sido muy afortunado de poder compartir con ellos conversaciones y experiencias. De ese intercambio he sido el principal beneficiario, pues mi aprendizaje ha sido intenso y constante.Tengo la certidumbre de que el IISJ queda en muy buenas manos. Su nuevo director científico, además de sus conocidos méritos académicos e intelectuales, posee claridad

de objetivos, y se encuentra profundamente involucrado en las actividades en desarrollo.A las autoridades del Instituto, a su nuevo director y a su personal ofrezco mi cooperación. Me siento muy orgulloso y honrado de formar parte de esta institución. Quizá por eso tengo la ambigua sensación que nace de la conciencia de que, a partir de poco, formaré parte de su historia y de su pasado y a la vez, como tantos otros, del futuro promisorio, de ese lugar que es Oñati, el Instituto.Los contenidos del Boletín hacen innecesarios más detalles, pues dan cuenta de las tareas realizadas y de las proyectadas.Tras veinte años de labor continua el IISJ ha cumplido el objetivo para el que fue creado: contribuir al desarrollo de la sociología jurídica a nivel mundial. Su labor es exitosa y en varios sentidos ha trascendido los límites de su propio ámbito. Por él ha pasado gran cantidad de profesores, estudiantes e investigadores, quienes constituyen una amplia comunidad dispersa en todos los continentes. Para la mayoría, el Instituto sigue siendo una referencia importante.Se puede afirmar que hoy el IISJ se extiende mucho más allá de su recinto y de Oñati y constituye el centro de una red, o si se quiere, un punto privilegiado de ella, a la que nutre y de la que se nutre. También ha trascendido las propias fronteras disciplinarias

de su creación, porque hoy articula distintas visiones de la sociología jurídica con otras perspectivas de las ciencias sociales.Por todo ello, el IISJ se encuentra en una situación privilegiada para capitalizar sus logros haciendo todavía más visible y presente su contribución fuera de sus fronteras geográficas. El nuevo director pondrá su empeño en ello y estoy seguro de que quienes forman parte de esa comunidad contribuirán a que tal objetivo sea posible.Hasta pronto,

Hori dela-eta, Konplexutasuna, gatazkak, justizia. Lege soziologia 20 urtez izeneko kongresua antolatu zuen institutuak uztailaren 7 eta 9 bitartean. Uztailaren 10ean eman zitzaion amaiera kongresuari, 20. urteurrena ospatuz. Beste behin ere, antolatutako ekintza horien bitartez, institutuak bere izaera aldarrikatu du, eta ikasketa sozio-juridikoen arloko ikasketa-, ikerketa- eta topaketa-zentroa dela berretsi.Hilabete hau amaitzeaz batera amaituko da zuzendari zientifiko lanetan egin dudan ibilbidea ere; aro berria eta kudeaketa berria hasiko da aurrerantzean, Sol Picciotto zuzendaria gidari jartzen denean. Prés en ta t i onPrésentationCe numéro du Bulletin rend compte des activités réalisées au cours de la période comprise entre janvier et juillet 2009.L’IISJ a vingt ans d’existence. C’est pourquoi, entre le 7 et le 9 juillet, s’est tenu le Congrès Complexité, Conflits, Justice. 20 ans de Sociologie du droit, qui s’est terminé, le 10 juillet, par la célébration du 20ème anniversaire. À travers ces activités, l’institution a une fois de plus ratifié son identité de centre d’étude, de recherche et de rencontre dans le domaine des études socio-juridiques.À la fin du mois mon rôle de directeur scientifique arrivera à son terme, une nouvelle étape va s’ouvrir et c’est un nouveau directeur, Sol Picciotto, qui prendra le relais et qui sans aucun doute apportera de nouveaux projets et des idées nouvelles pour assurer la continuité et la rénovation caractéristiques de la dynamique de l’ IISJ.Voilà donc venu le moment de prendre congé et de conclure une étape institutionnelle, mais aussi personnelle et professionnelle. Il est encore trop tôt pour évaluer objectivement les résultats, d’autres seront sans doute mieux à même de le faire. Comme c’est généralement le cas, les succès sont relatifs et il y a encore beaucoup à faire et à améliorer.L’Institut a été pour moi un lieu d’agréable convivialité. J’ai toujours pu compter sur l’appui des responsables du Gouvernement Basque et en particulier du président du Conseil de l’IISJ, Josu Sagasti, je tiens ici à le remercier pour son aide précieuse.

J’aimerais remercier le Conseil du RCSL, et tout particulièrement sa présidente, Anne Boigeol, tout d’abord pour m’avoir offert la possibilité d’occuper le poste de directeur scientifique de l’Institut, mais aussi pour le soutien qu’ils ont apporté à mon travail au cours de ces deux années.Je voudrais encore une fois souligner la collaboration inestimable du personnel. J’ai eu le privilège de diriger une excellente équipe de travail. L’expérience de ses différents membres m’a enrichi; leurs opinions, leurs suggestions et leurs remarques m’ont beaucoup appris et m’ont permis d’éviter des erreurs; ils se sont par ailleurs montrés très à l’écoute de mes propositions et de mes décisions. Un grand merci à chacun d’eux, tout ce travail et tout ce temps partagés resteront présents dans ma mémoire. Je remercie tout particulièrement le directeur administratif de l’Institut, José Antonio Goyenaga, pour son soutien et pour m’avoir donné l’occasion de discuter avec franchise et ouverture d’esprit de tous les problèmes qui se sont présentés.La liste des chercheurs, des professeurs, des visiteurs et des étudiants qui ont participé aux différentes activités et ont apporté leur collaboration à la vie de l’institution durant ces deux années est trop longue pour en donner ici le détail. J’ai eu le grand privilège de pouvoir partager avec eux conversations et expériences. Et j’ai été le principal bénéficiaire de ces échanges, source pour moi d’apprentissage intense et constant.

Je suis persuadé que l’IISJ est entre de bonnes mains. Le nouveau directeur scientifique, dont les mérites académiques et intellectuels sont bien connus, a des objectifs précis et participe d’une manière très poussée à des activités en développement.J’offre ma coopération aux responsables de l’Institut, à son nouveau directeur et à son personnel. Je suis très fier d’appartenir à cette institution, c’est un honneur pour moi. C’est pourquoi j’éprouve l’étrange sensation, dans mon for intérieur, que je ferai très bientôt partie de son histoire et de son passé, mais aussi en même temps et comme tant d’autres, de l’avenir prometteur de cet Institut ici à Oñati.Le contenu de ce Bulletin rend tout détail supplémentaire superflu, on y trouve en effet l’état des travaux réalisés et des différents projets.Après vingt ans d’effort continu, l’IISJ a atteint l’objectif pour lequel il a été créé: apporter sa contribution au développement de la sociologie juridique au niveau mondial. Son travail couronné de succès a même parfois dépassé les limites du domaine qui est le sien. Nombre de professeurs, d’étudiants et de chercheurs y ont séjourné, ils forment désormais une vaste communauté présente sur tous les continents. Pour la plupart d’entre eux, l’Institut est toujours une référence importante.On peut affirmer que l’influence de l’IISJ s’étend bien au-delà de son propre périmètre et bien au-delà d’Oñati, c’est le centre d’un réseau, ou si

l’on veut, un lieu privilégié qui enrichit et est enrichi par ce réseau. Il a également dépassé les limites disciplinaires de sa création, car il permet de nos jours l’articulation de différentes visions de la sociologie juridique avec d’autres perspectives des sciences sociales.C’est pour toutes ces raisons que l’ IISJ occupe une situation privilégiée pour capitaliser ses réussites en mettant encore plus en évidence sa contribution au-delà de ses frontières géographiques. Le nouveau directeur s’y attachera et je suis persuadé que tous ceux qui font partie de cette communauté feront leur possible pour que cet objectif puisse se réaliser.À bientôt

Al asumir el relevo como nuevo director científico del IISJ, soy consciente de que –como decimos en el mundo científico–, estaré “a hombros de gigantes”. Mis predecesores, así como el tan motivado y eficaz personal permanente del Instituto, han logrado establecer a lo largo de los últimos 20 años una base extremadamente sólida sobre la cual construir el futuro.

Un tema común en la sociología jurídica es que, en la era reciente de la globalización, los juristas han actuado como mediadores entre lo local y lo mundial. Sin ninguna duda, el Instituto lo ha conseguido, logrando traer a Oñati a gran parte de la comunidad de la sociología jurídica y contribuyendo así a poner a Oñati en el mapa del mundo.

Su máster ha atraído a cientos de excelentes estudiantes de todo el mundo, que han aprendido juntos gracias a la presencia de muchos de los mejores expertos mundiales en disciplinas socio-jurídicas. Y desde aquí se han forjado ilustres carreras, que no desmerecen en nada a las de los propios profesores de sociología jurídica. Oñati ha sido el destino de numerosos profesores visitantes, llegados para estudiar, reflexionar, escribir y disfrutar del maravilloso paisaje, hospitalidad y gastronomía de Euskal Herria. El Instituto se ha convertido en un lugar cada vez más buscado para organizar talleres, un lugar que ha abierto sus puertas a eminentes estudiosos, profesionales y activistas, reunidos para debatir sobre muchos de los problemas sociales de nuestra época. Todas estas actividades han creado un suelo fértil donde ha crecido una rica cosecha de publicaciones.

En la próxima fase, nuestro objetivo será llevar Oñati al mundo.

De hecho, el Instituto ya ha asumido la Secretaría del futuro Consorcio Mundial de Derecho y Sociedad. Para ello, algo básico será la web interactiva, que esperamos sea una importante fuente de información para la comunidad socio-jurídica y ayude

a los expertos a debatir y desarrollar actividades y proyectos conjuntos.

El Instituto debería también desarrollar su presencia internacional, a través de Internet. Ya contamos con la revista electrónica Sortuz, creada por antiguos alumnos, y preveo un cambio significativo para que la producción académica del Instituto esté cada vez más disponible en Internet. Espero que podamos crear también un archivo de ponencias y entrevistas con prestigiosos especialistas e investigadores, que pueda ser un recurso en el futuro. La calidad de nuestros cursos podría beneficiarse de un mayor uso de Internet, permitiendo a estudiantes y profesores compartir materiales y mantenerse en contacto.

Esto no significa que vayamos a ignorar el nivel local: al contrario, la experiencia del Instituto confirma que la presencia mundial exige un fuerte arraigo local.

In taking on the mantle of Scientific Director, I am very conscious that, as we say in the world of science, I will be ‘standing on the shoulders of giants’. My predecessors, and the highly motivated and effective permanent staff, have over the past 20 years established an extremely strong foundation on which we can build for the future.

A common theme in the sociology of law is that in the recent era of globalisation, lawyers have acted as mediators between the local and the global. The Institute has certainly succeeded in this, bringing much of the world of sociology of law to Oñati, and helping to put Oñati on the world map.

Its Master’s programmes have brought hundreds of excellent students from all over the world, to learn together with many of the world’s best socio-legal scholars. They have gone on to make illustrious careers, not least as socio-legal scholars themselves. Oñati has also attracted many visiting scholars, to study, think and write and enjoy the wonderful countryside, hospitality and food of Euskal Herria. The Institute has also become an increasingly sought-after location to organise workshops, which also have attracted eminent scholars, practitioners and activists, to debate many of the key social issues of our age. All these activities have provided fertile ground producing a rich crop of publications.

Our emphasis in the next phase is to take Oñati to the world.

Already, the Institute has accepted the task of acting as the Secretariat of the proposed World Consortium for Law in Society. Central to this will be an interactive website, which we hope will be an important source of information for the socio-legal community, and help scholars debate issues and develop joint activities and projects.

The Institute should also develop its own global presence, via the internet. We already have the electronic journal Sortuz, established by former students, and I anticipate a significant shift towards making much more of the scholarly output of the Institute available on the internet. I hope we can also build up an archive of lectures and interviews with leading scholars and researchers, to provide a resource for the future. Our teaching could also benefit from more use of the internet, enabling students and teachers to share materials and keep in contact.

This does not mean that we will neglect the local. On the contrary, the Institute’s experience strongly confirms that a global presence requires strong local roots.

Zuzendari zientifiko izateko erantzukizuna hartuta, oso kontziente naiz, zientzia-jendeok esaten dugun bezala, “erraldoiaren bizkarrean igota noala”. Nire aurrekoek eta langile iraunkorrek –oso motibatuak daudenez eta lana fin egin dutenez– ondo errotutako sustraiak jarri dituzte azkeneko hogei urteotan, eta orain guk aukera daukagu horren gainean etorkizuna lantzeko.

Soziologia juridikoan askotan agertzen den kontua da globalizazioaren garai berri honetan, legelariek bitartekari lana egin behar izan dutela askotan bertakoaren eta globalaren artean. Institutuak, dudarik ez da, asmatu du zubi-lan hori egiten; Oñatira hurbildu du soziologia juridikoaren mamia, eta, aldi berean, Oñati munduko mapan jarri du, agerian.

Master programek ehunka ikasle bikain erakarri dituzte mundu zabaletik, soziologia juridikoko munduko aditu onentxoenekin ikastera etorriak. Sortuz aldizkari elektronikoa badaukagu dagoeneko, ikasle ohiek sortutakoa, eta aurreratzeko moduan nago adituen lan eta ekarpenak gero eta gehiago jarriko ditugula eskura interneten. Espero dut modua izango dugula, horrez gain, lehen mailako aditu eta ikerlariek emandako eskolen edo haiei egindako elkarrizketen fitxategia sortzeko, etorkizunerako baliabide. Jakina, horrek ez du esan nahi ber-bertakoa alde batera utziko dugunik. Alderantziz, institutuaren beraren esperientziak argi eta garbi erakusten du mundu zabalean adarrak zabaltzeko, nork berean sustraiak ondo errotu behar ditugula lehenbizi.

En acceptant de prendre le relais comme nouveau Directeur Scientifique de l’IISJ, j’ai conscience d’être – comme nous le disons dans le monde scientifique – « sur des épaules de géants ». Mes prédécesseurs, comme le personnel permanent de l’Institut, si motivé et si efficace, ont réussi au cours de ces 20 dernières années à asseoir une base particulièrement solide sur laquelle édifier l’avenir.

Un thème récurrent en sociologie juridique c’est que, dans la mondialisation actuelle, les juristes ont joué le rôle de médiateurs entre le local et le mondial. L’Institut y est indubitablement parvenu en accueillant à Oñati une grande partie de la communauté mondiale de la sociologie juridique et en faisant qu’Oñati ait sa place dans le monde.

Le Master a attiré à Oñati des centaines d’excellents étudiants venus du monde entier. Ils ont appris ensemble grâce à l’enseignement de nombreux experts mondiaux, parmi les meilleurs dans les disciplines socio-juridiques. Ici se sont forgées d’illustres carrières qui n’ont rien à envier à celles des professeurs de sociologie juridique eux-mêmes. Ici de nombreux professeurs visiteurs sont venus étudier, réfléchir, écrire et jouir du magnifique paysage, de l’hospitalité et de la gastronomie de Euskal Herria. L’Institut est devenu un lieu de plus en plus recherché pour organiser des ateliers, un lieu qui a ouvert ses portes à d’éminents spécialistes, professionnels et activistes, réunis pour débattre de nombreux problèmes actuels. Toutes ces activités ont constitué un terreau fertile à l’origine de très nombreuses publications.

L’objectif de la prochaine étape sera de conduire Oñati vers le monde.

L’Institut a déjà accepté le Secrétariat du futur Consortium Mondial de Droit et Société. Un élément de base en sera le site web interactif qui constituera, nous l’espérons, une importante source d’information pour la communauté socio-juridique et qui aidera les experts dans leurs discussions, le développement d’activités et l’établissement de projets communs.

L’Institut devrait étendre sa présence sur le plan international, grâce notamment à Internet. Nous avons déjà la revue d’électronique Sortuz, créée par d’anciens élèves, et j’envisage un changement significatif pour faire en sorte que la production académique de l’Institut soit de plus en plus disponible sur Internet. J’espère que nous pourrons également créer des archives des conférences et des entretiens avec des spécialistes et des chercheurs prestigieux, une aide précieuse pour l’avenir. La qualité de nos cours pourrait être améliorée par une plus grande utilisation d’Internet, ce qui permettrait aux étudiants et aux professeurs de partager des ressources et de garder le contact.

Ce qui ne veut pas dire que nous allons négliger le niveau local: au contraire, l’expérience de l’Institut confirme que la présence mondiale demande un fort enracinement local.

“Renato Treves” PhD. in Law and Society

The Oñati Institute and the University of the Basque Country are members of the Renato Treves PhD. Programme together with the following universities: Università degli Studi di Milano, Università degli Studi di Milano-Bicocca, Università degli Studi dell’Insubria, Università degli Studi di Bologna, Università degli Studi di Urbino “Carlo Bo”, Universiteit Lunds, Universidad Carlos III de Madrid, Universiteit Antwerpen - UFSA, and the Centro nazionale di prevenzione e difesa sociale di Milano. Students who obtain the International Master’s in Sociology of Law can apply to register as PhD. students of the Renato Treves network.

During the first year, PhD candidates are required to attend one of the two-week seminars devoted to socio-legal methodology within the programme of the Oñati International Master’s in Sociology of Law. They are also required to attend, during the second year, two more seminars of their choice, provided that places are available.

A former Oñati IISL Master’s student has defended her PhD. at the University of the Basque Country.

Sonia Boueiri Bassil, from Venezuela, obtained the International Master’s in Sociology of Law in 1993-94 (the title of her Master’s Thesis was Acceso a la Justicia y servicios jurídicos en Venezuela).

She continued with her PhD. at the University of the Basque Country and on 2nd July 2009 she defended her thesis Una Interpretación Histórica-Institucional de Acceso a la Justicia en Venezuela (1936-2006). Her tutor was Dr. Francisco Javier Ezquiaga. Three members of the panel were Dr. Manuel Calvo García, Dr. Joxerramon Bengoetxea and Dr. Carlos Lista, previous and current Scientific Directors of the IISL.

What is the Friendship Programme?

The Friendship Programme offers international visitors (students, teachers and researchers) and local people the chance of mutual cultural exchange, unforgettable experiences and improving their language skills. Oñati Friends from the local community make it possible to learn about Basque/Spanish culture and everyday life.

All activities within the Friendship Programme are voluntary, which means that the international visitor and his/her “Oñati Friend” decide on their own how much and in what way they want to spend time together. Also the international visitors can suggest activities.

Who are the Friends?

Participants on the programme are ordinary local people living in Oñati.

How to take part in the Friendship Programme?

The first meeting with the Friend is organized in September 2009

1. The Friendship Programme aims to promote internationalisation and knowledge of new cultures among both international students/visitors and local friends.

2. The programme is voluntary, and the international students/visitors and their local friends decide for themselves how and when they meet.

3. The local friend and the student/visitor are introduced to each other: they are given each other’s contact information and the first meeting is arranged by the programme coordinators. From then on, participants in the programme get together at their own convenience.

4. Feedback will be collected from both local friends and students/visitors in writing at the end of the term. This will help to develop and improve the programme.

ESTABLISHING NEW RELATIONS: OÑATI HIGH SCHOOLS

There are three High Schools in Oñati: Elkar-Hezi, Txantxiku Ikastola, and Zuazola Larraña Institute.

Students from Elkar-Hezi school in Oñati visited the IISL (6th May 2009). They wanted to learn more about what Sociology of Law was (photo enclosed). Itziar Esparza from Mexico went to the School to explain to them in detail her experience in Oñati and at the IISL.

Some students from this year Master’s Programme have given talks at the Instituto Larraña-Zuazola about their countries: Iagê Miola about Brazil, Mark Ramadji about Chad, Restaria Hutabarat about Indonesia, Itziar Esparza about Mexico and Megan Murray about US. Sharyn Roach Anleu, a lectiurer on the Master’s Programme, talked about Australia. The IISL signed a formal agreement with the Zuazola-Larraña Institute on March 10th, 2009 (photo enclosed).

We have had contacts with the Director of Txantxiku Ikastola and the possibility of an agreement between both institutions is being looked into.

Los días 30 de abril y 1 de mayo de 2009 tuvo lugar en el Instituto Internacional de Sociología Jurídica de Oñati, el workshop El neoconstitucionalismo multicultural en América Latina, coordinado por Albert Noguera Fernàndez, Pavel H. Valer-Bellota y Daniel Bonilla Maldonado. Durante los dos días de duración del workshop, los participantes analizaron y discutieron cómo, en el último cambio de siglo, estamos asistiendo a un salto cualitativo en el reconocimiento constitucional de los derechos colectivos de los pueblos indígenas en Latinoamérica. Existen ya varios países (Argentina, Brasil, Guatemala, México, Nicaragua, Panamá, Paraguay, Perú) donde se desarrolla una extensa legislación indigenista en el plano constitucional, aunque son las Constituciones de Colombia de 1991, la venezolana de 1998, la ecuatoriana de 2008 y, sobre todo, la boliviana de 2009, las que vienen a dedicarle a los pueblos indígenas, como sujetos colectivos de derechos así exactamente

identificados, una atención impensable ya no digamos hace un siglo sino hace veinte años.En el workshop, que contó con la participación de profesores expertos en el tema, de diferentes países, entre ellos, Colombia, Perú, Guatemala, Ecuador, Estado español, Austria, etc., se presentaron 13 ponencias, seguidas cada una de ellas de largas e interesantes discusiones entre los asistentes. Algunas de las ponencias y el resultado de las discusiones se recogerán próximamente en una publicación del Instituto de Oñati.

Who believes in the human rights of migrants?7 – 8 May 2009. Coordinators: Marie-Bénédicte Dembour (United Kingdom) and Tobias Kelly (United Kingdom)The workshop focused on the prospects and limitations of defending migrants through human rights language. It was planned as an opportunity for in-depth exchange, with long periods reserved to discussion. Last-minute cancellations meant that we were an even smaller group than originally anticipated. We made the most of it, and managed to identify points of both agreement and disagreement among participants. We are now preparing an edited volume which we think will be cohesive and of high quality. We thoroughly enjoyed the congenial atmosphere of the Institute and wish to thank all those who made this memorable workshop possible.

One World, Different Cultures, Clashing Values: legal education in a global context23 – 24 April 2009. Coordinators: Fiona Cownie (United Kingdom) and Carlos Lista (Argentina - Oñati)This Workshop, which considered the place of values in legal education in a number of different contexts, took place at Oñati in April. Researchers from a number of different countries, including Argentina, Mexico, Canada and the U.K. met to discuss the values which permeate legal education, and ways in which they might be uncovered and subject to analysis.Papers addressed a range of topics, including: * the place of values in the construction of professional identities, *the implicit and explicit values found in legal education, and their incompatibility with the management practices that are frequently now found in large law firms *the ‘values-sensitive’ classroom, what it might involve, and what implications it might have for the legal educator * the notion of ‘democratic professionalism’ and how this might be enhanced by training involving the use of specialised computer software *the ways in which the values transmitted –verbally and non-verbally– by law teachers affect their students’ perceptions of legal education * the views of law teachers on the values they hope to communicate through their teaching and the ways (i.e. teaching methods) in which they purport to achieve their goal, * the possibility of conceptualising values as ‘threshold concepts’ in legal education.Participants in the Workshop were able to engage in discussions about the place of values in legal education from a number of different perspectives, and in particular to debate the difference between ‘education’ and ‘indoctrination’ which underlies much of the debate.

Challenging Gender Inequality in Tax Policy Making14 – 15 May 2009. Coordinators: Åsa Gunnarsson (Sweden), Lisa Philipps (Canada), Kimberley Brooks (Canada) and Maria Wersig (Germany)

On 14-15 May 2009, 18 well-established tax scholars met for the Challenging Gender Inequality in Tax Policy Making workshop. To our knowledge, this was the first time such an internationally representative, interdisciplinary group was brought together to focus on the challenges for tax scholars and policy-makers who take gender equality seriously. Topics ranged from the history of women’s engagement with the tax system and tax reform to the ways tax system design promotes particular visions of the family. The workshop will undoubtedly serve as the beginning of a world-wide collaboration and we are working toward publishing the papers in an edited collection. We were delighted to be part of the Institute’s workshop series and were grateful for the support and organization of the Institute staff during our visit to beautiful Oñati.

More conciliation-less punishment. Possibilities and obstacles for an extended use of restorative justice21 – 22 May 2009Coordinators: Kjersti Ericsson (Norway) and Hedda Giertsen (Norway)The workshop More conciliation-less punishment. Possibilities and obstacles for an extended use of restorative justice (rj) was arranged in Oñati in May 2009. 28 persons from 12 countries took part. Some sessions discussed experiences of rj in different societies: Greenland, Albany, Norway, and in online communities. Experiences from rj in Russian prisons, conflicts between young people in Scandinavia, and in partnerships, were presented.One discussion attracting much attention dealt with the relation between rj and legal systems: on similarities and differences between the two approaches. Looking at reasons for punishments: is retribution a fundamental human crave, and could rj take care of this? Or may conciliation be seen as a fundamental human reaction to such acts? Further, should rj first and foremost be seen in relation to the legal system, as a helping hand to lessen their tasks, or should rj be seen in relation to democratic, civil activities, to improve such standards?

Constitutionalism, the Rule of Law and the Politics of administration in Egypt and Iran28 – 29 May 2009. Coordinator: Said Arjomand (USA)Egypt and Iran are two of the most populous countries of the Middle East, and share the same historical pattern of modernization through centralized state-building and a significant impact of Islam, albeit in different ways. The rule of law in both countries had faced significant problems stemming

from the centralized pattern of state-building and the authoritarian regimes it generated. Given the shared legacy of authoritarianism and modernization through centralized state-building, constitutional politics would be meaningless without close attention to the politics of administration as the latter dominates the political and legal life of the two countries compared. In both countries, the rule of law suffers from a lack of independence from the autocratic executive. Yet in Egypt, the Judges insist more forcefully on the rule of law and that the procedures of the administration are abided by than is the case in Iran. The strength and organization of the legal profession as well as judiciary organization and autonomy in the two countries will be examined as factors that can explain the difference.The workshop was the first to attempt a systematic comparison of the two countries which examines the problems of the rule of law in authoritarian Middle Eastern regimes under the impact of political Islam. The papers discussed the meaning and character of the rule of law under authoritarian, post-revolutionary regimes by focusing on the current constitutional and administrative politics of these two countries (see the final program). The participants were

roughly divided into experts on the Egyptian and the Iranian political and legal system (see Photograph), and an expert on Egypt was asked to offer a short commentary on a paper dealing with Iran to open the discussion, and vice-versa.The papers presented at the workshop are being edited by Said Arjomand and Nathan Brown, and will be submitted for publication in the IISL series with Hart Publishers (Oxford).

Shooting to Kill: The Law Governing in the Use of Lethal Force in Context18 – 19 June 2009. Coordinators: Simon Bronitt (Australia), Hilary Charlesworth (Australia) and Gerry Simpson (United Kingdom)In mid June, a group of scholars gathered at the Institute to explore the topic of Shoot to Kill”: The Law Governing the Use of Lethal Force in Context. The scholars, drawn from Europe, North American and Australia, represented many disciplines as diverse as philosophy, ethics, political science, policing studies, criminology, psychology as well as international law and criminal law. Yet again, Onati provided a unique and collegial environment in which to study matters of international significance, and to share ideas with a group of leading scholars from around the globe. The event included papers delivered by senior police and military lawyers who have been assisting with counter-terrorism in Europe and anti-piracy operations in Somalia. It also provided a forum for PhD students to present research on related topics, many of whom took the opportunity to extend their visit to benefit from the world class library facilities and the ambience of the Institute. Muchas gracias to Carlos and Malen and the team at the Institute, from the convenor Professor Simon Bronitt (ANU, Australia) and all the participants at the workshop.

Gender and Judging11 – 12 June 2009. Coordinators: Ulrike Schultz (Germany), Gisela Shaw (United Kingdom) and Sally Kenney (USA)

Does gender matter in judging? Do women decide cases differently? Do they affect the court atmosphere? Are there other ways in which they could influence judicial proceedings and procedure? Is access to legal positions still more difficult for women than for men after up to a century has passed since the first women judges were admitted? Are women disadvantaged or even discriminated against on account of their sex?These are the questions dealt with in our workshop on Gender and Judging. The response to our call for papers proved overwhelming. 25 colleagues from 13 countries attended (Finland, England, France, Germany, Italy, the Netherlands, Israel, Syria, Canada, USA, Argentina, Australia, Japan), presented papers on a wide range of topics: Feminist Judging, Judges’ Gender Consciousness, Gender Training for the Judiciary, Gendered Views of Judges, Pioneers and Eminent Women Judges, Gender and Judging in Modern and Traditional

Societies, Women Judges´ Careers, Diversity on the Bench. Seven of the presenters had already taken part in the Workshop on Women in the Legal Profession in 1999, thereby demonstrating the continuing lively scholarly interest in the Women/Gender in the Legal Profession Group.The general atmosphere and participants’ well-being were much enhanced by Malen’s efficient organisation, enjoyable dinners and a tour of the city under the expert guidance of José Antonio Azpiazu.The workshop topic will be further pursued at future Law and Society conferences and at meetings of the RCSL Legal Profession Group.

Las ciencias sociales y el derecho ante la violencia social. Memoria, identidad y quiebras de lo cotidiano4 – 5 junio 2009. Coordinadores: Gabriel Gatti (País Vasco), Cecília MacDowell Santos (USA / Portugal) y Sílvia Rodríguez (Portugal)En el Workshop Las ciencias sociales y el derecho ante la violencia social. Memoria, identidad y quiebras de lo cotidiano, que se celebró los días 4-5 junio 2009 bajo la coordinación de Gabriel Gatti (UPV), Cecília MacDowell (CES, UC y University of San Francisco), Sílvia Rodríguez (CES, UC) un grupo de once ponentes procedentes de disciplinas muy distintas y diversos también en las instituciones y países de procedencia discutieron acerca de las consecuencias derivadas de las situaciones de violencia social. Catástrofes sociales, terrorismo de Estado, guerra, violencia política... fueron algunas de las cuestiones que se encararon, todo dentro de una perspectiva fundamentalmente académica, preocupada por orientar la investigación en una dirección provechosa a la hora de encontrar conceptos y categorías de análisis en situaciones, a veces, poco dadas a la reflexión. La experiencia resultó, por eso, enormemente positiva y se espera que de ella deriven, más pronto que tarde, algunos proyectos con la misma vocación de interdisciplinariedad y reflexión que marcó el propio encuentro.

Congress and Celebration / Congreso y celebraciónCongress and Celebration / Congreso y celebraciónComplexity, Conflicts, Justice. 20 years of Sociology of Law.Oñati, 7 - 10 July 2009.

Between the 7th and 9th of July the Conference on “Complexity, Conflicts and Justice. Twenty years of sociology of law” was held within the University of the Basque Country’s summer course programme. This event was followed on the 10th of July by the 20th anniversary celebrations of the IISL’s creation.

The programme comprised 40 sessions (at times six were being held at the same time) in which over 180 papers were presented. In addition to the papers, there were also four keynote speeches given by André-Jean Arnaud, Roger Cotterrell, Boaventura de Sousa Santos and Rogelio Pérez Perdomo. 210 people from 34 different countries attended the conference.

To celebrate the Institute’s 20th anniversary and to encourage the participation of those who have taken the Institute’s Master’s and those who are researching at Oñati, a special call was made for people to organize sessions. No specific subjects were set, participation was open and each session was to appear in the programme with the name that the organizers had proposed plus “Oñati Network”.

Four of the Conference’s sessions were held with this title and all of them were proposed and co-ordinated by at least one Master’s student.

The Institute gave ten accommodation (in a shared room) and enrolment grants and a further ten were given by the University of the Basque Country within its summer course programme.

In addition to the academic side of things, participants were able to enjoy a typical dinner at a Basque “gastronomic society” which meant they were able to savour local cuisine and some of the local customs of the Basque Country.

And the whole conference would have been missing something without some kind of musical event. Conference participants, their accompanying guests, Institute staff and locals were all able to enjoy a concert at the Arantzazu Basilica with a programme of ten choral pieces sung by the

En el marco de los Cursos de Verano de la UPV/EHU, entre el siete y el nueve de julio se celebró el congreso “Complejidad, Conflictos, Justicia. 20 años de Sociología Jurídica”. Este evento fue seguido, el día 10 de julio, por la celebración del 20 aniversario de la creación del IISJ.

El programa quedó compuesto por 40 sesiones (hasta seis paralelas), en las que se presentaron más de 180 comunicaciones. Las presentaciones mencionadas fueron acompañadas por cuatro conferencias plenarias a cargo de André-Jean Arnaud, Roger Cotterrell, Boaventura de Sousa Santos y Rogelio Pérez Perdomo. La reunión contó con la participación de más de 210 personas provenientes de 34 países diferentes.

Nueve grupos de trabajo del RCSL organizaron sesiones en las que participaron numerosos expositores.

Con motivo del 20º aniversario y a fin de estimular la participación de quienes estudiaron en los distintos programas de Máster del Instituto y de quienes desarrollaron tareas de investigación en él, se realizó un llamado especial para la organización de sesiones. La temática sería libre, la participación abierta y cada sesión figuraría en el programa con el nombre propuesto, acompañado de la denominación “Oñati Network/Red Oñati”.

Cuatro sesiones del congreso llevaron esta denominación y todas ellas fueron propuestas y coordinadas por, al menos, un estudiante del Máster.

El Instituto concedió diez becas para estudiantes que cubrieron el alojamiento en habitación compartida y la cuota de inscripción. Otras diez becas fueron ofrecidas por la Universidad del País Vasco, en el marco de los Cursos de Verano.

Además de lo académico, los participantes pudieron disfrutar de una cena en una típica sociedad gastronómica vasca, lo que les permitió apreciar la cocina local y tomar contacto directo con algunas costumbres del País Vasco.

No podía faltar una actuación musical de un grupo vasco. Los participantes del congreso, acompañantes, personal del Instituto y ciudadanos del valle pudieron disfrutar de un concierto integrado por diez obras interpretadas por la Coral Santa Cecilia de Donosita-San Sebastián. El concierto se celebró en la Basílica de Arantzazu, situada a 9 km de Oñati, lugar en el que tienen su presencia obras de los artistas Nestor Basterretxea, Eduardo Chillida, Javier María de Eulate, Julio Muñoz y Jorge Oteiza, entre otros.

The 10th of July was the date set for the IISL anniversary celebration. After the aurresku of honour (a Basque dance of respect) the opening ceremony was held in the presence of (amongst others) the Mayor of Oñati, the Deputy Minister for Justice, The Director of the UPV/EHU’s summer courses and the Chairwoman of the RCSL. This was followed by a session entitled “The Creation of the IISL” with speeches given by Francisco Javier Caballero Harriet, Volkmar Gessner and Juan Ramón Guevara, and co-ordinated by Fernando Tapia Alberdi.

To mark the 20th anniversary celebrations a commemorative work of art was given to the Scientific Directors, Board Chairpersons and Institute’s staff with a silk-screen print by the sculptor Eduardo Chillida on one of its sides.

Before the closing ceremony, tribute was paid to Eli Galdos, Imanol Murua and Renato Treves, all of whom participated in the Institute’s creation.

In accordance with what had been agreed at the Institute’s Board meeting, the name of Eli Galdos was given to one of the Institute’s rooms. The plaque was unveiled by one of Eli’s grandchildren and the ceremony was attended by his widow and members of his family

Afterwards, everybody enjoyed some drinks and nibbles laid on by the local council in the university’s cloister. Once the celebration was over, those attending the event went on an outing to San Sebastian, the capital city of the province of Guipuzcoa.

El viernes 10 de julio tuvo lugar la celebración del 20 aniversario del IISJ. Después del aurresku de honor (danza vasca que se baila a modo de reverencia), se celebró el acto de apertura que contó con la presencia de la Alcaldesa de Oñati, el Viceconsejero de Justicia, el Director de los Cursos de Verano de la UPV/EHU, la presidenta del RCSL y el Director Científico del Instituto, entre otros. A continuación se desarrolló la sesión Creación del IISJ, con la intervención de Francisco Javier Caballero Harriet, Volkmar Gessner y Juan Ramón Guevara, coordinada por Fernando Tapia Alberdi.

Con motivo de la celebración del 20 aniversario se entregó un detalle que lleva, en una de sus caras, la imagen de una serigrafía del escultor Eduardo Chillida. La obra está referida a la ley. Este objeto se entregó a los directores científicos, presidentes del Patronato y personal del Instituto.

Antes de la clausura, se rindió homenaje póstumo a Eli Galdos, Imanol Murua y Renato Treves, quienes participaron en la creación del Instituto.

Cumpliendo con lo acordado en la reunión del Patronato del Instituto, se puso el nombre de Eli Galdos a una de las salas. La placa fue descubierta por uno de sus nietos. El homenaje contó con la presencia de su esposa y familiares.

A continuación, los presentes disfrutaron del cocktail ofrecido por el Ayuntamiento de Oñati en el claustro de la Universidad, sede del Instituto. Al concluir la celebración, los asistentes al evento realizaron una excursión a Donosita-San Sebastián, capital guipuzcoana.

Without a doubt the Conference and the anniversary celebrations were a success. This is clearly proven by the number of participants, the variety of subjects covered by the programmes, the diversity of participant’s origins, the quality of many presentations and the satisfaction level of those who took part in both events. Once again this shows the Institute’s organizational capacity and the possibility of it becoming a venue for future events of this kind.

In the introduction to the previous newsletter, which was a special issue dedicated to the IISL, we mentioned that anniversaries make at least three things possible: taking stock or appraising a situation, thanking and celebrating. This means that when organizing a celebratory event, on many occasions organizers ask themselves what the sense of the celebration is.

It was by no means simple to find out about and include the wishes and actions of so many people, although, looking at the path the Institute had followed and what we supposed would be the results of the meeting, we took a risk with our own interpretation. We are pleased to be able to say now that the objectives and intentions of the organizers happily coincided with what everybody was hoping for and produced an optimum result.

Those who attended the event as well as those who were unable to attend but sent their support and congratulations, celebrated (just as we had sensed they would) a vision, a coming together of people and a promise. We celebrated the past that marks us, the present we are committed to and the future that entices us. The activities were guided by the following objective: to thank, meet up again and reassert the promise of a better time and place and in this way make it possible to recreate a vision, maintain action and keep a promise

Congratulations to all those people who gave life to the celebration of two decades of the IISL, for their presence, commitment and excellent predisposition. The Institute has already begun a new era with a clear understanding of the present and a firm orientation for the future.

muchas presentaciones y el nivel de satisfacción de quienes formaron parte de ambos eventos. Ello evidencia, una vez más, la capacidad organizativa del Instituto y la posibilidad de ser sede de futuras reuniones de este tipo.

En la presentación del boletín anterior dedicado como número especial al IISJ, se mencionaba que los aniversarios hacen posible, al menos, tres cosas: realizar balances, agradecer y celebrar y que durante el proceso de organización del evento los organizadores se plantearon, con cierta frecuencia, cuál era el sentido de la celebración.

No era sencillo entonces conocer y abarcar los deseos y acciones de tantas personas, aunque, ateniéndonos a la trayectoria del Instituto y a lo que supusimos serían los resultados de la reunión, arriesgamos nuestra propia interpretación. Hoy resulta muy grato ratificar que los propósitos e intenciones de los organizadores tuvieron un feliz

encuentro con lo que estaba en el ánimo de todos, para dar lugar a un óptimo resultado.

Quienes estuvieron presentes y quienes sin poder asistir hicieron llegar su adhesión y felicitaciones, celebraron tal como había sido intuido, una visión, el encuentro y una promesa. Se celebró el pasado que identifica, el presente que compromete y el futuro que provoca. Las actividades estuvieron guiadas por esos mismos objetivos: agradecer, reencontrarse y reafirmar la promesa de un tiempo y un lugar mejores, para, de ese modo, hacer posible que la visión se recree, la acción se mantenga y la promesa se cumpla.

Congratulaciones a todos aquellos que dieron vida a la celebración de las dos décadas del IISJ, por su presencia, compromiso y excelente predisposición. El Instituto ha comenzado ya una nueva etapa con una clara comprensión del presente y una firme orientación hacia el futuro

The IISJ Residence Grant –between October and December 2008– was perfectly timed for my doctoral research. I am undertaking my PhD at the Law Faculty, University of Sydney, focusing on migration policing in Australia, particularly the experiences of people living without visas. The peaceful studious environment of the library was perfect for writing. It is the most contemplative, reflective, and stimulating space I have every

enjoyed, and I am happy to report my research and writing progressed. The librarian staff was helpful and generous with their time, and the library collection was rich in the area of policing, social control, and migration which form key parts of my investigation. I also appreciated getting to know other students and academics from around the world whom visited Oñati and stayed at the Residence. Two rooms novelly monikered “The Study Room” and “The Island” were the main study areas at the Residence –the constant presence of someone bent over a book made it possible to distance myself from the suspicion I was “becoming nerd”. In this collegiate environment, I also learnt a number of Latin American recipes, slang words, became acquainted with the siesta, generally made a travesty of the Basque and Spanish language, and enjoyed many walks in and around Oñati. I am grateful to the IISJ for this invaluable and precious time, thank you.

Una espléndida biblioteca, una residencia en la cual es posible compatibilizar momentos de plena concentración con también una interacción constante con profesores invitados, estudiantes, personas siempre predispuestas al diálogo académico, personal eficiente: un entorno perfecto para quien necesita un periodo de plena concentración.

Actualmente me encuentro en el último año de mi doctorado en

la Universidad de Florencia, Italia, siendo mi tema de estudio la construcción del campo de la justicia transicional. La beca de residencia otorgada por el IISJ me brindó la posibilidad, fundamental en mi caso, de emprender la ultima etapa de mis estudios doctorales en un clima y en un espacio de perfecta armonía, un espacio en donde la tranquilidad y la eficiencia se relaciona de una forma particular con la calidez del personal, con la efervescencia de un espacio académico intenso. Mi estancia de tres meses en Oñati ha sido una experiencia provechosa, enriquecedora.

I am doing my PhD in Coimbra Faculty of Law. In my doctoral thesis I am talking about Costumary Law and the phenomenon of “transplant of Law” in the field of Criminal Law.

Once in 2007 Professor Daniel dos Santos, a criminologist and social scientist from Ottawa University, who is my tutor, for that part of my essay, told me about IISJ. I send a message to Malen Gordoa and received a formal letter coming from Doctor Carlos Lista, who told me that IISJ had given me the grant for residence I had asked.

In residencia Antia I could find beautiful conditions. I found Professors, researchers, and students coming from Africa, Latin America, America, Asia, Canada and Europe. There, I could get together with them, talking and discussing on several issues.

My work was essentially done in the library where I could access to the catalogue and personally take the books and revues from the racks and make the photocopies I needed. The staff in the Library was very nice and always ready to help.

Oñati is a beautiful place to study, to stay and to visit.

It was a wonderful experience to be in the IISJ.

Han pasado cerca de dos meses desde que dejé Oñati y recién ahora puedo expresar algunas de mis experiencias y sentimientos; ello no sólo por mi carácter introvertido en dichos asuntos, sino que también mi estadía en el País Vasco estuvo atravesada por

la complejidad que implica el encuentro de distintos aspectos que aparentemente se contradicen y excluyen.

Lo local representado por la vida cotidiana de sus habitantes y lo universal encarnado en la presencia de personas provenientes de distintas partes del mundo que coincidimos por nuestro gusto hacia la Sociología Jurídica; el Medioevo presente en la arquitectura de la ciudad y la Modernidad por el nivel de vida de sus habitantes, la gran industria radicada a metros de lo urbano y la producción artesanal de los caseríos.

Entre esos contrastes, confortablemente alojado, en medio de un paisaje inigualable y rodeado del afecto de las personas que hacen posible que esa maravilla de Instituto Internacional de Sociología Jurídica funcione trascurrió un mes de mi vida que por lo grato difícilmente olvidaré.

Por el momento no me quedan nada más que palabras de agradecimiento a todos aquellos que posibilitaron que mi estadía fuera tan placentera, especialmente a Malen, Carlos, Susana y las pacientes

chicas de la Biblioteca, espero volver a verlos y mostrarles mis avances en los temas que fueron enriquecidos por la bibliografía que custodia el Instituto.

El Instituto es perfecto, tiene una biblioteca extraordinaria, con muchos materiales y con las más recientes producciones académicas, las personas que trabajan son muy profesionales y la construcción antigua tiene un aire muy especial; la residencia es muy buena, pues es un espacio para conocer nuevos amigos y debatir sobre nuestra investigación; el pueblo también es precioso, es pequeño, pero tiene todo lo que yo necesitaba, buena comida, deportes y mucha felicidad. Desde el comienzo de mis estudios de doctorado me he propuesto realizar actividades de intercambio académico, ya que las considero fundamentales para la producción de una tesis de excelencia. La experiencia de haber realizado una estancia de investigación en el IISJ de Oñati me ha confirmado lo acertado de su elección como lugar para llevar adelante ese proyecto.

En primer lugar, por la posibilidad que el Instituto ofrece para la investigación en una biblioteca de primer nivel, actualizada y especializada en la temática, con lo que ello implica en términos de acceso a publicaciones, bases de datos, servicios de búsqueda, asesoramiento bibliotecológico, etc. Todo lo cual adquiere la mayor relevancia si se tiene en cuenta las dificultades para el acceso a este tipo de servicios en países como Argentina. En segundo lugar, por la oportunidad que ofrece para interactuar con la comunidad académica y establecer vínculos con otros estudiantes e investigadores provenientes de los más diversos países. Por último, pero no por ello menos importante, por la posibilidad de conocer la cultura, las costumbres, la geografía, la gastronomía, etc. de un lugar único como es el País Vasco.

Por todo ello, Oñati ha influido decididamente en mi trayectoria académica, lo cual ya se ve reflejado en mi trabajo de investigación, así como ha resultado una experiencia sumamente enriquecedora.

Visité el Instituto Internacional de Sociología Jurídica durante el mes de febrero gracias a la beca de residencia otorgada por esta institución. Durante mi estadía realicé búsquedas bibliográficas especialmente para mi tesis doctoral. De esta manera, el trabajo implicó un rastreo de los temas de pluralismo jurídico, mafia, derecho y crimen organizado. Sin embargo, y aprovechando el maravilloso material que se puede encontrar en la biblioteca, no pude resistir el ponerme al día con algunas lecturas fundamentales y adelantar un poco de la bibliografía para otros dos proyectos en los que trabajo: Feminización de la Justicia con la Universidad Paris II y Mediación y clínica con la Universidad Paris I. Este período que me sirvió para repensar mi trabajo investigativo y adelantar en la escritura del texto, también lo aproveché para escaparme un poco del frío y del spleen parisino.

Venir a Oñati, considero que es importante en el proceso de formación de cualquier sociólogo del derecho; ya sea para la construcción de un texto o para búsquedas bibliográficas. Las condiciones de trabajo son las mejores. Lo único que lamento es no haber podido estar más tiempo.

El Centro de Documentación y la Biblioteca están llenos de descubrimientos increíbles y estar en Oñati fue una gran experiencia. Es un lugar muy especial y con gente linda, y a quienes debo agradecer inmensamente: Malen, Carlos Lista, Susana y sin duda a Ainhoa, Raquel y Elvira. Además, guardo un recuerdo sincero de los estudiantes del máster y becarios con quienes compartí esta temporada y con quienes conocí el droit vivant que encierra Oñati y el País Vasco, porque en Oñati hay tiempo para el derecho y para el non-droit.

The award of the Residence Grant provided me with the opportunity to spend a wonderful month in Oñati and at the Institute’s library in 2009. In my opinion this has been a unique experience on more levels than one! First of all, I must say that I was astonished by the large opus of the library and to me it is a scholarly heaven. Namely the library is especially rich in bibliographical references not only in the wider socio-legal field but in the various areas of the legal and social sciences, politics, philosophy. However, it is very well organized and easily accessible. Moreover I must underline the amiability of the staff at the library and at the Institute in general who were always very helpful and caring for whatever I needed. Therefore I was able to do a valuable research for my PhD dissertation in an atmosphere that was both work stimulating and friendly.

On the other hand my stay in Oñati has been especially rewarding since I shared the premises at the charming Residencia Antia with the students at the master course and Professor Carlos Lista. It is a rare opportunity to meet such amazing people from all around the world with whom I could ponder upon academic issues relevant to me. Moreover they presented me with a remarkable insight in their cultures and I truly believe that the personal experiences we shared in Oñati have made us friends for life.

Finally, the Residence Grant allowed me to get familiar with the Basque country that virtually I knew nothing about. Owing to the unique location of the Institute, placed in the heart of the Basque Country, I found out about the exceptionality of its history, the richness of its culture and the beauty of its nature.

In summary, I can say that my visit at the Institute of Sociology of Law has indeed been a life-time experience that I will always look very fondly at. I truly hope to get back there some time in the near future.

En el marco de la beca Juan Celaya me encuentro desarrollando el proyecto de investigación titulado Globalización, constitucionalismo y derechos: límites y retos, en el cual se aborda cómo la globalización neoliberal ha afectado y ha puesto abiertamente en crisis la noción tradicional de constitucionalismo, entendido, en su sentido normativo, como sistema de vínculos y límites a los poderes públicos y privados en beneficio de los derechos de las personas. Y, a su vez, trata también cuáles serían las vías inminentes y mediatas para una reconstrucción estatal y global, de un constitucionalismo material y garantista.Después de una primera estancia de investigación en el Instituto de Oñati, dedicada al análisis de bibliografía, en la actualidad me encuentro redactando un primer borrador del estudio, que después de una segunda estancia de investigación en la biblioteca del Instituto, que realizaré en los próximos meses, será completado con el objetivo de poder presentar el estudio final.

The Masaji Chiba Fund has been established at the International Institute for the Sociology of Law (IISL) in Oñati. In the words of the donor the money is to be used “to help the social scientific study of non-Western peoples, including indigenous law among Western peoples, and studies by non-Western young scholars”

He is working in his report entitled Tensiones entre la visión del desarrollo de las políticas y los derechos de los pueblos indígenas.

Desde allí y alertado por un buen conocedor del centro (Prof. Ignacio Aymerich) he podido hacer una estancia de investigación

Esta ha consistido en la búsqueda y consulta bibliográfica, monografía, comunicaciones (en especial workshops del mismo instituto) para crear una base de datos con elementos prácticos y teóricos, que resultan esenciales para un estudio empírico tanto de la eficacia de normas que han de ver con la igualdad, como con la integración social del inmigrante (de la persona inmigrante), proyectos en los que trabajamos desde el área de Filosofía del Derecho de la Jaume I de Castellón, como conjuntamente (el segundo de ellos) con el respectivo departamento de la Universidad de Valencia.

En lo que me toca, seguro se beneficiará de la estupenda hospitalidad del personal del Instituto, de la magnífica biblioteca, de los estudiantes de su máster y del inmejorable entorno de Oñati.

It was a very interesting, fervent and fruitful debate with scholars from all around the world! Then I spent some other days in the library studying and researching mainly anthropology of law and the role of women jurists in current changes of legal cultures. On the whole it was a very interesting and stimulating experience! The company was very pleasant, the “Residencia” a very comfortable place and all people I met was very kind!

In the second week I did research on my PhD comparing Australian and European police cooperation strategies and worked on my historical/descriptive chapter. I further used the extensive and very up to date resources of the library at the International Institute for the Sociology of Law to revise the readings for my course Law and Society at the University of Canberra and to prepare my lectures.

Mónica Zapico BarbeitoUniversidad de A Coruña (Spain)27 June – 11 July 2009Esta ha sido mi segunda visita al IISJ, pues ya había tenido la oportunidad de acudir a un curso de verano en 2006, momento en el que pude apreciar la calidad, amplitud y variedad temática y por tanto las inmensas posibilidades que ofrecía a mi investigación la biblioteca del Instituto. Esta estancia de dos semanas, en la que mi objetivo era eminentemente la búsqueda de bibliografía para avanzar en mi tesis doctoral, tesis en la que investigo acerca de la evolución del concepto de impunidad en el nuevo orden global, no vino sino a confirmar mi primera impresión: la biblioteca es excelente, así como el catálogo y clasificación de las miles de referencias disponibles (de hecho, puede llegar a abrumar la avalancha de artículos, libros, revistas... con los que uno se encuentra). Pero no menos excelente es el ambiente en el Instituto. El personal administrativo y de la biblioteca es sumamente hospitalario, amable y en todo momento dispuesto a ayudarte ante cualquier duda o problema que se te presente, lo que facilita muchísimo el trabajo. Todo ello, unido a la inmejorable localización del Instituto, la pequeña y hermosa Oñati, hacen obligada una tercera visita.

I work on international institutionalization and legalization related to economic issues. Presently, my focus is in the possible autonomization of an international legal field (Bourdieu; Dezalay) around the dispute settlement system of World Trade Organization and the legitimacy it brings to both the decision-making bodies and the organization itself. As some findings, after a quantitative analysis of the profiles of panelists and members of the appellation tribunal, it is possible to trace a strong tendency towards a more legal composition of panels, sustained by three reactive changes: rise and fall of figures of professors and lawyers and a strong growth of the preference to diplomats and civil servants with some legal background. Nevertheless, there is still a lot to be done…

Since I really love this Institute, I became a habitué here. I think I came over five times in the last five years, though it is necessary to cross the Atlantic to do so. The conditions to work are perfect: a very complete library, wireless internet in the Sancti Spiritus University building, and in the Antia Residence, calm and cozy atmosphere, and a very pleasant and efficient staff. It is also a place to meet people: master students, professors, visiting scholars and peers from all around the world in the conferences and workshops. Last, but not least, being here makes possible to have a rich encounter with the Basque culture and an ethos that joins strength and resilience and helps one to work in becoming a better person. Eskerrik asko eta agur!

ConsortiumConsortium(Consorcio Mundial de Derecho y Sociedad / World Consortium on Law and Society-WCLS)

The WCLS Steering Committee organized two meetings during the Oñati Conference held in July. The first, held on Tuesday, 7th July was open to all conference participants and aimed to up-date people on the activities that had been carried out so far. This meeting (which was the first for some of the participants) was similar to the ones held in Berlin in 2007, and Montreal and Milan in 2008.

The second meeting was for those members of the Steering Committee present in Oñati and was aimed at carrying on the discussion concerning those elements necessary to actually set up the Consortium, including those regarding the creation of a web site, organizational structure, financial matters and a possible country in which to register the organization.

The three working groups created in 2008 offered informative material and material for debate.

a) The web site group (co-ordinated by Carlos Lista): the web-site is being developed by the IISL. The group agreed that in order to make optimum use of the latest technological and IT advances, the web-site will be more interactive than had originally been envisaged. Access will be free but not unlimited. Although so far the IISL has accepted responsibility for creating and maintaining the Consortium’s web-site, for it to be sustainable in the long term it will be necessary to cover financial costs.

b) Organization and governance group (Terry Halliday and Ulrike Schulz): progress was made in making some aspects more specific.

− The WCLS is an association of associations. No individual membership will be possible.

− Full membership is granted to all associations / societies from a broad range of disciplines.

− Research Institutes can be members, but will not have a vote at the general assembly.

− Networks are invited to join but not as full members.

− The IISL will be the WCLS secretariat.

− A smaller number of founding associations will initiate the WCLS, with more associations joining in the course of the following years.

− A review of the proposed governance structure will take place after the first two years.

− Different criteria will be followed when asking for financial contributions from societies.

c) Activities: Susanne Karstedt informed of what the working group that she is in charge of had spoken about. The following activities were suggested:

Esta reunión, la primera para algunos participantes, fue similar a las realizadas en Berlín, 2007; Montreal, 2008 y Milán 2008.

La segunda reunión contó con la participación de los miembros presentes del Comité Ejecutivo y tuvo por objetivo continuar discutiendo los distintos aspectos que hace a la constitución del Consorcio, en particular los referidos a la creación de la página web, la estructura organizativa, los aspectos financieros y un posible país de registro de la organización.

Los tres grupos de trabajo creados en 2008 ofrecieron material para informar y discutir.

a) Sitio web (grupo de trabajo coordinado por Carlos Lista): su creación se encuentra en desarrollo y estará a cargo del IISJ. Se acordó que el mismo tendrá un carácter más interactivo que el previsto con anterioridad, a fin de aprovechar los últimos desarrollos tecnológicos en informática. El acceso será libre, pero no irrestricto. Si bien, hasta el momento, el Instituto ha tomado la responsabilidad de crear y mantener el sitio web del consorcio, se acordó que su sostenibilidad a largo plazo requerirá cubrir costos financieros.

b) Organización y gobierno (a cargo de Terry Halliday y Ulrike Schulz): avanzó en la especificación de algunos aspectos.

− El WCLS es una asociación de asociaciones. La asociación de personas individuales no es posible.

− La calidad de miembro pleno es reconocida a todas las asociaciones/sociedades de una amplia gama de disciplinas.

− Los institutos de investigación serán miembros, pero no tendrán voto en la asamblea general.

− Las redes son invitadas a participar, aunque no con carácter de miembros plenos.

− El IISJ actuará como Secretaría del WCLS.

− Un número reducido de asociaciones fundacionales iniciará el WCLS, mientras que otras asociaciones se incorporarán en el curso de los próximos años.

− Una revisión de la estructura de gobierno tendrá lugar después de los primeros dos años de funcionamiento.

− Las contribuciones financieras que se soliciten a las sociedades miembros estarán basadas en distintos criterios.

c) Actividades: Susanne Karstedt informó sobre lo discutido por el grupo de trabajo a su cargo. Se sugirieron las siguientes:

− el WCLS propondrá uno o dos “workshops con denominación” dentro del marco usual de solicitudes de este tipo de reuniones en Oñati. Serán organizados de acuerdo a las condiciones presentes requeridas a los mismos, pero

NEW INITIATIVESa. 8th Basque Conference on Sociology and Political Science, 2010.

Contact has been made with the Basque Association of Sociology and Political Science www.ehu.es/avsp/es/. As a result of this, the IISL has been invited to organize a session on sociology of law within the Conference on Sociology and Political Science which will be held in 2010. This session will be coordinated by Joxerramon Bengoetxea and Manuel Calvo García, former IISL Scientific Directors.

This will provide both the Institute with a greater profile in the field of sociology and also sociology of law within the context of sociology in the Basque Country.

b. 10th National Conference on Sociology of Law, Argentina, 2009. (Oñati Network)

Organized by the Argentinian Society for Sociology of Law (SASJU) and the National University of Cordoba, Argentina, the 10th National Conference on Sociology of Law will be held between the 12th and 14th November this year in Cordoba. Its title is “Legality and Legitimacy: social confrontations in law”.www.sasju.dyndns.org

Carlos Lista proposed that the organizing committee hold a session to commemorate the 20th anniversary of the IISL entitled “Extralimitation: justice and law in “glocalized” conflicts”. It will be co-ordinated by Carlos Lista (Argentina), Ricardo León Pastor (Peru) and Iagê Zendron Miola (Brasil). Bothe Iagê and Ricardo have taken the Oñati Master’s.

This proposal has been very warmly received. 30 people have signed up from 8 countries (Argentina, Brazil, Colombia, Spain, Mexico, Peru, Puerto Rico and Venezuela) and 31 papers have been submitted. Out of those who have enrolled, 16 are students , grant-holders or visitors and the remaining 22 are from different universities, mainly in Argentina and Brazil.

NUEVAS INICIATIVASa. VIII Congreso Vasco de Sociología y Ciencia Política, 2010

Se estableció contacto con la Asociación Vasca de Sociología y Ciencia Política www.ehu.es/avsp/es/. Como resultado de ello el IISJ fue invitado a organizar una sesión sobre sociología jurídica dentro del congreso de sociología y ciencia política que se celebrará en 2010. Dicha sesión será coordinada por Joxerramon Bengoetxea y Manuel Calvo García, directores científicos del IISJ en años anteriores.

De esta manera, se favorece la presencia tanto del Instituto en el campo sociológico, como de la disciplina, en el contexto de la sociología en el País Vasco.

b. X Congreso Nacional de Sociología Jurídica, Argentina, 2009 (Oñati Network/Red Oñati)

Organizado por la Sociedad Argentina de Sociología Jurídica (SASJU) y la Universidad Nacional de Córdoba, el 12-14 de noviembre de este año se realizará en Córdoba, Argentina, el X Congreso Nacional de Sociología Jurídica “Legalidad y legitimidad: confrontaciones sociales en torno al derecho” www.sasju.dyndns.org

Carlos Lista propuso a la comisión organizadora una sesión en conmemoración del 20º aniversario del IISJ “Más allá de los límites: justicia y derecho frente a conflictos glocalizados”. Será coordinada por Carlos Lista (Argentina), Ricardo León Pastor (Perú), Iagê Zendron Miola (Brasil). Iagê y Ricardo son alumnos de distintos años del Master.

La propuesta recibió muy buena acogida. Se inscribieron 30 personas de 8 países (Argentina, Brasil, Colombia, España, México, Perú, Puerto Rico y Venezuela) y se presentaron 31 trabajos. De los inscritos en la comisión 16 fueron alumnos, becarios o visitantes y los 22 restantes provienen de distintas universidades, principalmente de Argentina y Brasil.

Multicultural Jurisprudence. The result of increased migration is the interaction among cultural communities and inevitably clashes between state law and customary law. These cultural conflicts have given rise to a new multicultural jurisprudence. In this volume scholars grapple with the immense challenges judges are currently experiencing everywhere. To what the extent can and should courts accommodate litigants’ request by taking their cultural backgrounds into account? This collection brings together powerful examples of the cultural defense in many countries in Western Europe, North America, and elsewhere. It shows the ubiquity of this defense, contrary to the mistaken impression that it has been invoked principally in the United States. This book makes the case for undertaking studies of the use of the cultural defense in jurisdictions all over the world where this has not been previously documented.

Many of the essays concentrate on criminal cases including homicide in the context of honour crimes, provocation based on “loss of face” or witchcraft killings. Some deal with other areas of law such as asylum jurisprudence, family law, and housing policy. They show in concrete cases how cultural claims have arisen and how legal systems wrestle with these arguments. It is clear that judges have had considerable difficulty handling many of the cultural claims.

The authors demonstrate persuasively the need to reconsider the proper use of cultural evidence in legal proceedings. Those interested in the ways in which expertise influences the disposition of cases will find this book compelling.

Regulating Deviance. Living Law. Reconsidering Eugen EhrlichEdited by Marc HertoghThis collection of essays is the first edited volume in the English language which is entirely dedicated to the work of Eugen Ehrlich. Eugen Ehrlich (1862-1922) was an eminent Austrian legal theorist and professor of Roman law. He is considered by many as one of the ‘founding fathers’ of modern sociology of law. Although the importance of his work (including his concept of ‘living law’) is widely recognised, Ehrlich has not yet received the serious international attention he deserves. Therefore, this collection of essays is aimed at ‘reconsidering’ Eugen Ehrlich by bringing together an interdisciplinary group of leading international experts to discuss both the historical and theoretical context of his work and its relevance for contemporary law and society scholarship.

This book has been divided into four parts. Part I of this volume paints a lively picture of the Bukowina, in southeastern Europe, where Ehrlich was born in 1862. Moreover it considers the political and academic atmosphere at the end of the nineteenth century. Part II discusses the main concepts and ideas of Ehrlich’s

sociology of law and considers the reception of Ehrlich’s work in the German speaking world, in the United States and in Japan. Part III of this volume is concerned with the work of Ehrlich in relation to that of some his contemporaries, including Roscoe Pound, Hans Kelsen and Cornelis van Vollenhoven. Part IV focuses on the relevance of Ehrlich’s work for current socio-legal studies.

Breaches of contracts may occur more frequently and business relationships may be terminated more often in international than in domestic trade. But most business people engaged in exporting or importing products or services seem to operate in a sufficiently predictable environment allowing successful ventures into the global market. The apparent paradox presented by cultural/institutional diversity and contractual efficiency in cross-border business transactions is the focus of this volume of essays. The wide range of approaches adopted by contributors to the volume include: the Weberian concept of law as a tool for avoiding the risk of opportunism; economic sociology, which treats networks and relationships between contractual parties as paramount; representatives of new institutional

economics who discuss law as well as private governance institutions as most efficient responses to risk; comparative economic sociologists who point to the varieties of legal cultures in the social organisation of trust; and national and international institutions such as the World Bank which try to promote legal certainty in the economy.

Sortuz continúa divulgándose por el mundo. Diversos buscadores, bases de datos y páginas web de regencia (Dialnet, Lantindex, Ancilla Juris, etc) han incluido a Sortuz como revista electrónica en la materia de estudios socio-jurídicos. En un mismo sentido,

los propios textos publicados gracias a su libre distribución sirven de carta de presentación de la revista. Una consecuencia de esto anterior es que los accesos electrónicos a su contenido continúan incrementándose. En lo que vamos de año 2009 hemos recibido

alrededor de 4.000 visitas y cada vez se abre más el marco geográfico y temático de las propuestas de publicación. Esperamos

que en un breve periodo de tiempo vea la luz la primera “edición invitada”, y os animamos a que exploréis esta opción de publicación de los materiales de vuestras redes y encuentros. El reto está ahora en regresar al propósito fundador y que los

estudiantes y académicos vinculados directamente al Instituto, vean a Sortuz como un lugar referente donde publicar sus artículos,

ensayos y reseñas.

of what happened in San Salvador Atenco (Paloma Soria.) Sortuz is spreading around the world. Several relevant search engines, data

bases and web sites (Dialnet, Lantindex, Ancilla Juris, etc) have included Sortuz as an on-line magazine in socio-legal subjects. Thanks to its wide circulation, the texts themselves are a kind of “letter of introduction” to the magazine. As a result of this the number of people accessing the magazine’s content electronically has continued increasing. So far in

2009 there have been around 4,000 hits and we are getting more and more widespread texts for publication – both

subject-wise and geographically.

We are hoping to bring out the first “issue with special invited contributors” soon and we encourage you all to use the magazine as an option for publishing all the materials of your networks and meetings. The challenge now is to return to one of Sortuz’s founding principles, which is that the students and academics directly linked to the Institute consider it

as a place of reference to publish their articles, essays and reviews.
