1. Introduction This report is a document produced by Cornwall Council’s Natural Resources Team. It relates to a site visit to monitor compliance with a planning permission and legal agreement for a minerals / waste site under relevant requirements of the Planning and Compulsory Purchase Act 2004. 1 Disclaimer It should be noted that apparent compliance with any condition at the time of a site monitoring visit by this Authority does not preclude the Authority from instigating enforcement action where any activity being undertaken is subsequently considered to be in breach of a condition or presents a risk of damage or disturbance to the environment or amenity. Any additional site monitoring visit required as a result of non-compliance with a planning condition may result in an additional site monitoring fee being levied. Traffic Lights For ease of reference the Authority has adopted a ‘traffic light’ system to illustrate the level of compliance with each requisite planning condition. The colour coding is based on the following criteria;

Green development was considered to be compliant with the relevant planning condition at the time of the site monitoring visit although some minor works may be required.

Amber development was not considered to be compliant with the condition at the time of the site monitoring visit and/or there are outstanding matters which remain to be resolved at this time by the operator or this Authority. Any continued non-compliance or breach of this condition may result in the instigation of enforcement action.

Red development was not considered to be compliant with the condition at the time of the site monitoring visit. Furthermore it is considered that there is an urgent need to remedy this breach due to the potential risk and/or consequences to the environment or amenity. It is therefore concluded that steps should be undertaken without further delay to remedy this breach. Compliance with Planning Conditions PA10/08871 dated 19/05/2011 Application to vary Conditions 6 (control of development) and 47 (new bank and planting) of Decision Notice 09/00380/MIN dated 12 January 2010.

Condition Number and Description Condition 1

The development hereby approved shall be begun not later than the expiration of three years beginning with the date of this notice of permission. Written notification of the date of commencement of each phase of quarrying, as shown on Drawing No. SP15-2009/e (Rev 2), shall be sent to the Mineral Planning Authority (MPA) within 7 days of such commencement. Notes Following Visit The date of commencement of Phase 1 was confirmed as 13th January 2010 as identified in email dated 13th January 2010. As email dated 14th July 2011 the Operator notified the Mineral Planning Authority of their intention to start stripping in Phase 2 on or around the 1st August 2011. Since this time the Operator has partly stripped the topsoil and overburden from Phase 2. The Operator is aware of the terms of Conditions 20, and 30 through to 45 relating to the requirements during the removal and storage of soils.

Condition Number and Description Condition 2

The winning and working of minerals from within the area outlined in red on Drawing No.SP15-2009 Rev 2, as authorised by this permission, shall cease by no later than 30th September 2023. All operations and uses hereby approved shall be discontinued on or before this date, and the land shall then be restored in accordance with the conditions below. Notes Following Visit This condition identifies that the permission will expire on 30th September 2023 unless planning permission has been granted for a continuation of operations beyond this period.

The date of completion of mineral extraction shall be made known in writing to the MPA within seven days of cessation. Notes Following Visit Developments continue at this time and this condition is non applicable.

Condition Number and Description Condition 4

All buildings, weighbridge, plant, machinery and other structures and debris shall be removed from the site within twelve months of the date of cessation of the permission, as detailed in condition No. 2 above, or within 12 months of cessation of mineral extraction, whichever is the sooner, and the restoration and landscaping referred to below shall be completed within two years of the cessation of such mineral extraction. Notes Following Visit The site is still in use and this condition is non applicable at this time.

The site shall not be worked below the 121 metres Above Ordnance Datum level, as indicated on Drawings SP15-2009/b Rev 2 and SP15-2009/c Rev 2, without the prior written permission of the MPA. Notes Following Visit The estimated current working level remains at around 134m AOD. The Operator continues to work from the southern, western and northern boundaries and not at depth. A Screening opinion was submitted 28th November 2011 for a proposed extension and deepening of Pigsdon Quarry (Ref No: PA11/10523) and is currently being considered by the Mineral Planning Authority.

As outlined against some of the conditions in this report the Mineral Planning Authority has received several complaints relating to the level of dust and noise to the north of the quarry. To assist with resolving the complaints and to provide further screening the Operator constructed a bund along the northern boundary in September 2011 in accordance with details approved as email dated 19th September 2011 using the ‘unless otherwise previously agreed ‘ aspect of this condition. The approved details require the bund to have been seeded within 3 months of completion and the eastern portion of the bund to have been planted with hazel and hawthorn (50-50 split) in the next available planting season. However as email dated 27th October 2011 the Operator indicated that due to the deterioration in the weather it was unlikely the bund would be topsoiled before Spring 2012. Given the time of year the Mineral Planning Authority finds it reasonable for the topsoiling and seeding to be postponed until Spring 2012 with the trees to be planted in the next available planting season.

The Operator has indicated that they may seek to extend and raise the above mentioned bund in the eastern corner to provide further screening for the neighbour to the north, as at the moment there is still a gap in the tree copse which could be channelling noise towards the property behind. As email dated 19th October 2011 the Operator submitted preliminary details of their proposals evoking the ‘unless otherwise agreed’ aspect of this condition. However as email dated 24th October 2011 the Mineral Planning Authority responded to the Operator’s submission and asked whether the site layout could provide for the bund to be raised furthermore at the far eastern point, as from the Operator’s proposals there still appeared to be gap. There have been no further submissions in relation to this and no further changes on site. The Operator should be mindful that any proposal to extend or raise the eastern corner of the bund would need to be approved by the Mineral Planning Authority beforehand.

From the commencement of development until its completion a copy of this permission, including all documents hereby approved and any other documents approved in accordance with this permission, shall always be available at the Site Office for inspection during normal working hours.

Notes Following Visit A copy of this permission and its related documents are available from the quarry site office.

Condition Number and Description Condition 8

Within 3 months of the commencement of Phase 1 of extraction as shown on Drawing No. SP15-2009/e Rev 2, the operators shall have submitted for approval in writing to the MPA a scheme and programme of measures for the suppression of dust. The scheme shall include: a) the suppression of dust caused by the movement and storage of soil and overburden, stone

and other materials within the site; b) dust suppression on haul roads; and c) the provision of dust collection and storage facilities. The approved scheme shall be fully implemented within 1 month of the date of approval and shall be complied with at all times. The scheme shall provide for self monitoring at the request of the MPA with the results of such monitoring to be submitted to the MPA within ten working days of such monitoring being undertaken.

Notes Following Visit A dust scheme was submitted on 9th April 2010 and was approved as correspondence dated 14th May 2010. The approved dust suppression scheme requires the Operator to: (a) Maintain a daily record of the weather conditions and to carry out site inspections to determine the required level of dust suppression. (a) A weather station was installed outside the main office in the Summer 2011 to provide for accurate local weather conditions. Records of the daily weather conditions are retained on site and along with site inspections are used to assess the level of dust suppression required each day.

(b) Use a water bowser to dampen down the haul roads, stockpiles and quarry face. (b) A water bowser is available on site to dampen down the haul roads and is used throughout the day as and when the weather conditions require it. It is also used to transport water from the sump on the eastern side of the river to the water storage tank feeding the dust suppression system on the processing plant.

(c) Use the spray bars on the Finlay Mobile Processing Plant as required (c) Spray bars are fitted on the ends of the conveyors used for the finer grade materials. (d) To mix the dust extracted from the Secondary Crusher Plant on the eastern quarry area with water to form a slurry (d) The Secondary Crusher Plant formerly located on the eastern side of the river has since been sold and removed from site. This aspect of the scheme is no longer applicable.

(e) To carry out dust monitoring at the request of the Mineral Planning Authority. (e) Given the number of dust complaints the Mineral Planning Authority asked the Operator to monitor the dust levels to the north of the quarry. In the first instance the Operator arranged for SLR Consulting to carry out dust monitoring for a three month period (between July 2011 and September 2011). However given the additional dust complaints received over the summer months this was later extended for a further three months until December 2011. SLR Consulting liaised with the Council’s Environmental Protection Team to draw up an acceptable methodology and it was agreed that frisbee gauges combined with sticky strips would be installed at three separate locations identified as PQ1 (to the south west of the quarry) , PQ2 (to the north east of the quarry) and PQ3 (to the north of the quarry). The monitoring commenced on Friday 15th July and results are summarised below: Dust Deposition Comparisons of the dust deposition results for PQ1, PQ2 and PQ3 and analysis of the wind data has indicated the quarry has contributed to the dust deposition levels. However during this period the deposition rate at PQ3 ranged between 29mg/m2/day and 185mg/m2/day, with an average of 96 mg/m2/day. None of the results exceeded 200mg/m2/day, the ‘custom and practice’ limit value for protection against dust annoyance used by the Environment Agency, which relates to the level at which dust could potentially become a nuisance.

thresholds used by the Environment Agency as detailed in M17 guidance. During the monitoring period the average dust soiling levels at PQ3 ranged between 0.14% EAC/day and 1.31%/EAC/day (with 0.2% EAC/ day being identified as a ‘noticeable’ outcome and 2.0 % EAC per day being a ‘probable complaint’). The maximum dust soiling levels at PQ3 ranged from between 0.4% EAC per day and 3.3% EAC per day, (with 0.5%EAC/day being identified as a ‘possible complaint’ and 3.3 %EAC/day falling between 2.0 Probable Complaint and 5.0 Serious Complaint.

(%EAC per day = 0.2 Noticeable, 0.5 Possible complaint, 0.7 Objectionable, 2.0 Probable Complaint, 5.0 Serious Complaint) The Mineral Planning Authority is aware that the site holds a Permit issued by the Council’s Environmental Protection Team under the Environmental Permitting (England and Wales) Regulations 2007. The site operations (including dust emissions) are comprehensively regulated by means of the Permit which has a prescriptive programme of preventative measures to reduce dust emissions. The Mineral Planning Authority has been in close liaison with the Environmental Protection Team to investigate the dust emissions from the site and since receivership of the complaints the Operator has made several improvements to their dust suppression regime as outlined in condition 16 of this decision notice. All of the dust results were forwarded to the Environmental Protection Officer responsible for monitoring compliance with the Permit, who concluded that although PQ3 is always elevated in comparison to PQ1 and PQ2, only the sample collected between 28/10 and 11/11 was anywhere near the ‘Custom and Practise’ limit. The soiling levels are often between ‘Objectionable’ range but given that PQ3 is located some distance from the nearest dwelling they did not believe it would be at an unacceptable level at the nearest property. As per email dated 19th December 2011 they confirmed the site was not breaching any conditions attached to its Permit and that it was their opinion that the Operator was applying ‘all practicable means’ to reduce dust. Given all of the points above for (a) to (e) this condition is identified as compliant.

Within 1 month of the commencement of Phase 1 of extraction, the operators shall have submitted for approval in writing by the MPA a scheme for the provision of surface water management. The details shall include:- - Details of the drainage during phases of the quarry development including a procedure for its implementation

- A timetable of construction - A construction quality control procedure - Provision for overland flow routes - A plan for the future maintenance and management of the system The relevant elements of the scheme shall be fully implemented within 1 month of the date of approval and thereafter subsequent phases shall be implemented as specified in the approved scheme. The surface water management works shall be managed and maintained in accordance with the approved details unless otherwise previously approved in writing by the MPA.

Condition Number and Description Condition 10

Within 6 months of the commencement of Phase 1 of extraction, as shown on Drawing No. SP15-2009/e Rev 2, a detailed composite programme of phased working and restoration, based upon Drawing Nos. SP15-2009/e and SP17-2009 (Restoration Scheme) for the entire quarry, as outlined in blue and red on Drawing No. SP15-2009 Rev 2, shall be submitted to the MPA for approval in writing. The scheme shall specify: a) the volume of overburden and waste to be generated in each phase of the extension area; b) the sequential restoration, slope/bench profiles, landform and contours for the entire quarry

area, with all parts of the quarry to be restored as soon as practicable following the cessation of mineral extraction and/or spoil disposal in that particular area;

c) the landscaping details including; - the location of planting to be undertaken - the species to be planted - the size, types and number of each species to be planted - the method of planting and the spacing between plants - seed mixes to be used - the timescale of the planting - replacement of losses - proposed means of rabbit/stockproofing. The sequential restoration shall ensure that soil stripping within Phase 3, as shown on Drawing No. SP15-2009/e Rev 2, shall not commence until completion of restoration in Phase 4b as shown on Drawing No. SP17-2009. All levels shall be submitted Above Ordnance Datum and all drawings shall be submitted at a scale of 1:1,000. Following agreement by the MPA, the development shall be undertaken in full accordance with the agreed phasing programme.

Notes Following Visit As email dated 9th April 2010 the Operator submitted details of the proposed seed mix to be used on the profiled areas in Phases 3a and 3b. This was submitted in advance of the submission of the restoration scheme required in this condition as the Operator was keen to seed the area during the summer months. The area was seeded in April/May 2010 and the seed mix was approved by the Mineral Planning Authority as email dated 7th June 2010. The restoration scheme was approved as letter dated 20th July 2011 and provides for a phased restoration of the former quarry void on the eastern side of the river, with the commencement of soil stripping in Extraction Phase 3 being prohibited until up to Restoration Phase 4b has been completed. Phase 4ai and most of 4aii have been profiled and seeded and are now leased to a local farmer. The Operator is currently restoring Phases 4bi and 4bii whereby most of 4bi has now reached the required levels and 4bii being partially restored. Limited restoration has taken place in these areas since the last visit due to the time of year and deterioration in weather. However the Operator anticipates further progress in Phases 4bi and 4bii in Spring 2012 when they strip further overburden/soils from Phase 2 on the western side of the river. In the meantime tipping continues at the lower levels of the ROMP quarry void and has now covered the former area of the secondary processing plant. The following photographs show the progress of the restoration on the eastern side of the river at the time of the visit:

Within three years of the date of implementation of this permission an aftercare scheme for the entire quarry, as outlined in blue and red on Drawing No. SP15 - 2009 Rev 2, shall be submitted to the MPA for approval in writing. For those areas of the site to be restored to agriculture the scheme shall, in particular, include provision for:- (i) Preparing the land for cultivation, which shall include sub-soiling, the removal of soil

compaction where necessary, preparation of a seed bed and application of fertilisers; (ii) The provision of a field water supply as required; (iii) Grass seeding of the site and the establishment and maintenance of a satisfactory sward; (iv) The provision of a comprehensive underdrainage system as appropriate; (v) Arrangements for reviewing the progress of aftercare with the MPA, including the submission

of an annual report detailing those works undertaken in the previous twelve months and those works to be undertaken in the following twelve month period.

Following the approval of the MPA the scheme(s) shall be implemented in full and in accordance with the phased working and restoration details to be agreed in accordance with condition No. 10 above. The aftercare of the site shall subsequently be carried out for a period of 5 years following restoration in accordance with the approved aftercare scheme.

Condition Number and Description Condition 12

Except as may otherwise be agreed in writing with the MPA, no excavation, mineral processing or transport of material within the site authorised or required under this permission shall be carried out except between the following times:- 07:00 - 19:00 Monday to Friday 07:00 - 13:00 Saturday Temporary operations, including soil stripping, shall be restricted to the following period:- 08:00 - 18:00 Monday to Friday 08:00 - 12:30 Saturday No such operations shall take place outside these hours or on Sundays or Bank or Public Holidays, without the prior written approval of the MPA. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit –This condition has superseded condition 16 of NC72.ENV(1) dated 31/01/2006. As email dated 12th June the Mineral Planning Authority received a complaint EN11/01395 part of which referred to activities at the site just before 07.00. Upon further investigation the Operator confirmed that some of the plant was started up just prior to 07.00 but no excavations, minerals processing or transport of materials was carried before this time. This was considered in compliance with the terms of this condition and this aspect of the complaint was closed. Following notification of the intention to commence stripping in Phase 2 in August 2011, the Operator should be mindful of the different working hours for temporary operations.

Condition Number and Description Condition 13

Except as may otherwise be agreed in writing by the MPA, the total noise level arising from quarrying operations at Pigsdon Quarry shall not exceed a level of 45dB LAeq (1 hour) as measured at the curtilage of any dwelling measured at 2 metres above the ground. The noise level from temporary operations, including soil stripping, shall not exceed a level of 70dB LAeq (1 hour) at the curtilage of any dwelling measured at 2 metres above the ground and these temporary operations shall not occur for more than 8 weeks in any calendar year. The operators shall undertake noise monitoring to show compliance with this condition at the request of the MPA. The operators shall keep contemporaneous records of the days when soil stripping and other temporary operations are undertaken and shall supply copies of these contemporaneous records to the MPA within five working days of such request being made in order to show compliance with this condition. NB: This condition replaces all other noise conditions at the quarry, including the Tar Coating Plant Operations.

Notes Following Visit This condition has superseded conditions 18 and 19 of NC72.ENV(1) dated 31/01/2006. The Mineral Planning Authority has received noise complaints from three separate residential properties to the north of the quarry referring to the single pitch reversing bleepers and the general noise levels. After being notified of the complaints, the Operator replaced the single pitch reversing bleepers with white noise bleepers on the plant retained at the site. As of May 2011 the three loaders, two dumpers, the CAT245, the artic dumpers, the tracked dozer (x1), the crushers and screeners (x12), the excavators (x2) and the tipper trucks were fitted with white noise bleepers. There has been a positive response since the bleepers were replaced and the Mineral Planning Authority considers that this aspect of the complaints has now been resolved. Given the number of complaints referring to the overall noise levels, the Mineral Planning Authority asked the Operator to undertake noise monitoring to check compliance with the approved noise limit. The Operator instructed SLR Consulting to carry out the monitoring which was undertaken at the curtilage of the closest residential property to the north of the quarry on 15th July 2011 and 19th August 2011. The monitoring recorded a noise level of 47.0 LAeq (1 hour) which was above the approved limit of 45 LAeq (1 hour) and for this reason this condition has been identified in breach. As email dated 14th September 2011 the Mineral Planning Authority invited the Operator to confirm in writing before the end of September 2011 what measures would be implemented to reduce the noise levels to below the approved limit. Further to this in September 2011, the Operator constructed a screen bund along the northern boundary with a view to assisting with noise screening (further details are outlined against condition 6 of this decision notice). As email dated 27th September 2011 the Operator confirmed that a noise specialist from SLR attended the site on 23rd September 2011 to view the operations and to make a preliminary assessment of the sources of noise, the layout of the quarry and potential mitigation measures. They confirmed that four potential noise mitigation measures had been recommended and the feasibility and likely effectiveness of these options would be investigated by the end of October 2011, with a view to the installation of the chosen mitigation measures by the end November 2011, subject to the availability of contractors and equipment. A repeat noise compliance monitoring survey would be undertaken to verify the effectiveness of the improvements within two weeks of the mitigation measures being implemented. As email dated 31st October 2011 the Operator confirmed the review had been completed and the re-orientation of the plant and the installation of the acoustic louvers/covers on plant were the best options for reducing noise to the north of the quarry. The Operator confirmed that they had reconfigured the plant by turning the primary jaw crusher and the secondary cone crusher 90 degrees so that the engines faced west and towards the quarry face instead of northwards. In addition they had held two meetings with specialist plant noise control contractors regarding the installation of sound proofing on the three crushers.

As email dated 1st December 2011 the Operator confirmed they had instructed S B Consulting to manufacture the acoustic panels. They had already visited the site and undertaken the precise dimensional measurements of the three screening machines. As email dated 9th January the Operator confirmed the first of the noise suppression louvers would be fitted on 12th January 2011and they planned to retest the noise measurements with and without the muffler to determine its effectiveness. If successful they would go ahead with the fitment on the other two engines. At the time of this visit the sound proofing had been fitted to one of the engines and in comparison to the other engines there did seem to be a reduction in noise. Following the visit and as email dated 18th January 2012 the Operator submitted a copy of the noise measurements taken before and after the engine muffler was in place which indicated a reduction in noise by 3.4dB. As email dated 23rd January 2012 and given the success of the first louver, the Operator confirmed they had instructed their supplier to go ahead with the fitment of two further units. The two additional units are due to be fitted on 3rd February 2012 with noise retesting to proceed in the next few weeks following completion subject to the weather and availability of the sound technician. ACTION OPERATOR The noise monitoring results have indicated a breach in the noise limit and on this basis Condition 13 has been identified in breach. To remedy this breach in planning control the Operator should implement noise mitigation measures to reduce the noise levels as soon as possible and retest the noise levels to confirm compliance with the noise limit.

Condition Number and Description Condition 14

The operators shall take all practicable steps to prevent mud, stones or other deleterious material being carried out onto the public highway. The word `practicable’ and the phrase `practicable’ means in this condition shall have the meaning assigned to it in Section 79(9) of the Environmental Protection Act 1990 (as defined under 1. in the informatives).

Notes Following Visit The site benefits from a long internal access road which helps prevent debris from reaching the public highway. The public highway outside the site entrance was in good condition at the time of the visit and the Mineral Planning Authority has not received any complaints regarding the condition of the road. The wheel wash remains operational although the current set up provides for vehicles having to cross an area of the yard before reaching the weighbridge and access road. This was previously seen to be in a muddied condition which seemed to be impeding the effectiveness of the wheel wash, although during this visit this area of the yard was relatively clear and the effectiveness of the wheel wash had improved.

Condition Number and Description Condition 15

All loaded lorries leaving the site shall be securely sheeted. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

All practicable means shall be employed by the operators for preventing and minimising the emission of dust, fumes, odour or the creation of noise, vibration and air over-pressure during the approved use of the site. Vehicles, plant and machinery operated within the site shall be fitted with silencers in accordance with the manufacturers’ specifications and shall be maintained to their specification at all times. The word `practicable’ and the phrase `practicable’ means in this condition shall have the meaning assigned to it in Section 79(9) of the Environmental Protection Act 1990 (as defined under 1. in the informatives).

Notes Following Visit

Please note that the amber identified against this condition is in elation to noise and not dust Dust: ( Since April 2011 the Mineral Planning Authority has received several dust complaints referring to dust levels to the north of the quarry. The Mineral Planning Authority is aware that the site holds a Permit issued by the Council’s Environmental Protection Team under the Environmental Permitting (England and Wales) Regulations 2007. The site operations (including dust emissions) are comprehensively regulated by means of the Permit which has a prescriptive programme of preventative measures to reduce dust emissions. The Mineral Planning Authority has been in close liaison with the Environmental Protection Team to investigate the dust emissions from the site. Since this time the Operator has implemented a number of mitigations measures to help reduce the risk of fugitive dust. A weather station was installed outside the main office in July 2011 so that accurate records of

the local weather conditions could be maintained and used alongside site inspections to assess the level of dust suppression required each day.

Tarpaulin covers were fitted on the conveyor/hoppers on the Sandvik 440 screen/hopper and the Sandvik 450 screen/hopper, confirmed as emails dated 9th May 2011and 20th July 2011.

A prototype canopy/ skirt to reduce dust blow was successfully trialled on one of the finer grade conveyors. Following this three more dust control hoods were installed on the processing plant as email dated 19th September 2011.

New spray bars were fitted on the ends of two of the conveyors dealing with the finer grade materials.

A water bowser is available on site to dampen down the haul roads which is also used to transport water from the eastern side of the river to the water storage tank feeding the dust suppression system on the processing plant.

Improvements have been made to their water storage facility in order to have a larger, cleaner and more reliable dust suppression system.

Staff have been reminded of the importance of adhering to the approved dust suppression scheme in condition 8.

A bund has been constructed along the northern boundary to provide screening against noise and dust impacts. Details were approved as email dated 19th September 2011.

Given the number of dust complaints the Mineral Planning Authority asked the Operator to monitor the dust levels to the north of the quarry. In the first instance the Operator arranged for SLR Consulting to carry out dust monitoring for a three month period (between July 2011 and September 2011). However given the additional dust complaints received over the summer months this was later extended for a further three months until December 2011. SLR Consulting liaised with the Council’s Environmental Protection Team to draw up an acceptable methodology and it was agreed that frisbee gauges combined with sticky strips would be installed at three separate locations identified as PQ1 (to the south west of the quarry) , PQ2 (to the north east of the quarry) and PQ3 (to the north of the quarry). The monitoring commenced on Friday 15th July and all of the results were forwarded to the Environmental Protection Officer responsible for inspecting the site’s permit who concluded that although PQ3 was always elevated in comparison to PQ1 and PQ2, only the sample collected between 28/10 and 11/11 was anywhere near the ‘Custom and Practise’ limit. The soiling levels are often between ‘Objectionable’ range but given that PQ3 is located some distance from the nearest dwelling they did not believe it would be at an unacceptable level at the nearest property. As per email dated 19th December 2011 they confirmed the site was not breaching any conditions attached to its Permit and that it was their

opinion that the Operator was applying ‘all practicable means’ to reduce dust. Given the dust monitoring results, the confirmation that the Operator is compliant with the

prescriptive dust conditions in their Permit, compliance with the dust suppression scheme identified in condition 8 of this decision notice, and that the Environmental Protection Team consider the Operator is applying all practicable means to reduce dust, the Mineral Planning Authority considers the Operator to be compliant with the dust aspect of this condition at this time.

Noise: The Mineral Planning Authority has received noise complaints from three separate residential properties. Following the complaints the Operator has: Replaced the single pitch bleepers and fitted auto adjusting white noise bleepers on the loaders

(x3), the dumpers (x2) and the CAT245. Instructed Brigade Electronics to carry out a site noise assessment on 26th April 2011 to

determine the most effective bleepers with regards to both Health and Safety and noise mitigation for the Artic Dumpers, the Tracked Dozer (x1), the Crushers and Screeners (x12), the Excavators (x2) and the Tipper Trucks. Following the assessment the recommended white noise bleepers were fitted to the plant.

The Operator has been operating a one way system around the site to reduce the need for reversing.

Given the number of complaints received referring to the overall noise levels coming form the quarry, the Mineral Planning Authority asked the Operator to undertake noise monitoring to check compliance with the approved noise limit. The Operator instructed SLR Consulting to carry out the monitoring which was undertaken at the curtilage of the closest residential property to the north of the quarry on 15th July 2011 and 19th August 2011. ACTION OPERATOR The noise monitoring results have indicated a breach in the noise limit and the Operator has been asked to implement noise mitigation measures to reduce the noise levels. On this basis the Mineral Planning Authority does not consider that the Operator is undertaking best practicable means to minimise noise and this condition is also identified in breach. To remedy this breach in planning control the Operator should implement noise mitigation measures to reduce the noise levels as soon as possible and retest the noise levels to confirm compliance with the noise limit.

Condition Number and Description Condition 17

The site, as outlined in red on Drawing No. SP15-2009 Rev 2, shall not be artificially illuminated except during the permitted hours of working and all lights and floodlights shall be positioned or screened so the source of light is not directly visible from the public highway or residential properties.

Notes Following Visit There were no lights within the new extension area at the time of the visit.

Condition Number and Description Condition 18

There shall be no burning of any material on site at any time. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit The Operator informed us that health and safety obligations required all explosive packaging to be burnt at the site and not removed from site. As this is a health and safety obligation this requirement would override the terms of this condition. There was no evidence of any other burning at the site.

Notwithstanding the provisions of Part 19 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 or any Order amending, replacing or enacting that order, no fixed plant or machinery, building or structures or erections shall be erected, extended, installed or replaced at the site without the prior approval in writing of the MPA. Details shall include the design, siting, dimensions, cladding, noise and dust suppression measures. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit The Operator installed a wheel wash behind the weighbridge and the specifications were submitted and then approved by the Mineral Planning Authority as letter dated 14 September 2009. As per email dated 6th December 2010 the Operator submitted a plan outlining proposed changes to the office and welfare facilities. In summary the following changes proposed were: Removal of the former workshop adjacent to the weighbridge Removal of the two buildings south of the existing office block Refurbish/convert the existing office building into welfare facilities for the production team Install a new portable office/toilet block adjacent to weighbridge The changes were approved as letter dated 28th June 2011.

There shall be no stockpiling of any material on any undisturbed portions of the site. Stockpiling shall be confined to areas of the extension site or within the excavated area to the east of Lamberal Water and the height of stockpiles shall not exceed the height of the original natural ground. NB: For the purposes of this condition, ‘the site’ relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit This condition has superseded condition 28 of NC72.ENV(1) dated 31/01/2006. There was no unauthorised storage of materials outside of the approved areas.

Ground vibration from blasting shall not exceed a peak particle velocity of 8.5mm per second at or near the foundations of any vibration sensitive building or residential premises in the vicinity of the site. The measurement to be the maximum of three mutually perpendicular directions taken at the ground surface. Unless other wise agreed in writing with the MPA, no blasting shall be carried out other than between 10:00 and 17:00 hours on Mondays to Fridays and between 10:00 and 13:00 on Saturdays. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit - This condition has superseded condition 22 and 23 of NC72.ENV(1) dated 31/01/2006. The Mineral Planning Authority has not received any blasting complaints.

Condition Number and Description Condition 22

Within 3 months of the date of this permission, the operator shall have submitted to the MPA for approval in writing a scheme of blast monitoring for the quarry extension area. The scheme shall include: - The blast monitoring regime for each phase of extraction; - The provision of self monitoring of all blasts; - The release of all readings measured at the request of the MPA, within five working days of such a request being made. The agreed scheme shall be fully implemented within 1 month of the date of approval and all subsequent blast monitoring shall be undertaken in accordance with the approved details unless otherwise approved in writing by the MPA.

Notes Following Visit The scheme was approved as letter dated 8th November 2010.

Condition Number and Description Condition 23

There shall be no secondary blasting or the use of non-explosive gas expanding rock breaking equipment, except with the prior written agreement of the MPA.

No water or other liquid carrying silt or other form of pollution caused by the permitted development shall be allowed at any time to enter onto adjoining land.

Any such scheme shall be supported by detailed information and all dewatering shall subsequently be undertaken in strict accordance with the approved scheme. Any works installed in association with the scheme shall be managed and maintained in accordance with the approved details unless otherwise previously approved in writing by the MPA. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2. Notes Following Visit The quarry is not dewatered.

Condition Number and Description Condition 26

Any fuel, oil, lubricant or other potential pollutants shall be stored and/or handled on the site in such a manner as to prevent pollution of any watercourse. For any liquid other than water this shall include storage in suitable tanks and containers which shall be housed in an area surrounded by bund walls of sufficient height and construction so as to contain 110% of the total contents of all containers and associated pipe work. NB: For the purposes of this condition, 'the site' relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Notes Following Visit- This condition has superseded condition 27 of NC72.ENV(1) dated 31/01/2006. The diesel is stored in a double skinned tank. The hydraulic oils are stored in double skinned containers. The site has the use of a mobile bunded bowser.

There shall be no discharge of foul or contaminated drainage or trade effluent from the site into either groundwater or any surface waters, whether direct or via soakaways. NB: For the purposes of this condition, ‘the site’ relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2.

Condition Number and Description Condition 28

All quarry washings and run-off from stripped or disturbed areas and quarry tracks shall be contained in settlement lagoons to remove solids before discharge to any watercourses. The design and location of any such lagoons shall be in accordance with details to be agreed in writing with the MPA in consultation with the Environment Agency.

Notes Following Visit A surface water drainage scheme was approved as letter dated 6th June 2007 as a requirement of condition 11 of decision notice CC/NC/2004/00433/OCM [NC72.Env (1)] granted on 31st January 2006. In conjunction with the approved scheme a further surface water control system was installed in the 2005 extension area. This is shown on Drawing P/051 and is located on the second bench in the southern area of 2005 extension area. As required by conditions 9 and 28 of decision notice dated 12th January 2010 9 (now superseded by PA10/08871 dated 19th May 2011) the Operator submitted schemes to the Minerals Planning Authority for the provision of surface water management. These schemes were approved as letter dated 20th May 2010.

Before any part of the site is excavated or traversed by heavy machinery (except for the purpose of stripping that part or stacking topsoil on that part), or is used for the stationing of plant or machinery, stacking of subsoil or crossed by a haul road, all available topsoil (on average 0.30m depth) shall be stripped from that part and either stored or directly transferred for restoration purposes.

Notes Following Visit The topsoil from Phase 1 was deployed to the restoration area on the eastern side of Lamberal Water. The Operator commenced stripping in Phase 2 in August 2011 and the topsoil has been used in the restoration area on the eastern side of the river or will be used to surface dress the bund along the northern boundary.

Condition Number and Description Condition 31

Before any part of the site is excavated or crossed by a haul road, all available subsoil (on average 0.30m depth) shall be stripped from that part and either stored or directly transferred for restoration purposes.

Notes Following Visit The subsoil from Phase 1 was deployed to the restoration area on the eastern side of Lamberal Water. The Operator commenced stripping in Phase 2 in August 2011 and the subsoil has been used in the restoration area on the eastern side of the river or will be used to surface dress the bund along the northern boundary.

Condition Number and Description Condition 32

No operations involving soil removal, replacement or cultivation shall take place during the period mid September - mid April (inclusive) without prior written consent of the MPA.

Notes Following Visit The Operator requested the removal of soils outside the permitted months as email dated 14th January 2010. The Mineral Planning Authority confirmed their acceptability subject to the conditions listed in a letter to the Operator dated 14th January 2010. No operations involving soil removal, replacement or cultivation were seen to be taking place during this visit. The Operator notified the Mineral Planning Authority of their intentions to commence stripping in Phase 2 from the 1st August 2011. As email dated 19th September 2011 the Mineral Planning Authority agreed that soil removal operations could take place up until 14th October 2011.

Pockets of suitable soil making material shall be recovered, wherever practicable and necessary during the stripping or excavations operations, for use during the restoration of the site. The word `practicable’ and the phrase `practicable’ means in this condition shall have the meaning assigned to it in Section 79(9) of the Environmental Protection Act 1990 (as defined under 1. in the informatives).

Notes Following Visit All available materials at this time have been taken to the eastern side of the quarry for restoration purposes or stored within approved bunds.

Condition Number and Description Condition 35

Topsoil and subsoil shall be stored separately. There shall be no contamination of the two types of soil and they shall be separated by an approved medium to the satisfaction of the MPA.

Notes Following Visit Subsoils and topsoils from Phase 1 were transferred directly to the eastern side of Lamberal Water and used for restoration purposes. A small mound of topsoil has been retained near the northern boundary to dress the northern bund.

Condition Number and Description Condition 41

Within three months of the topsoil and subsoil mounds and any temporary screening bunds being completely formed to the satisfaction of the MPA, they shall be grass seeded using a low maintenance grass seed mix to be agreed in writing with the MPA. The grass sward established shall be managed throughout the period of soil storage or the life of the temporary screening bund.

Notes Following Visit A low level topsoil mound was stored along the edges of restoration phases 4a and 4b and was grass seeded in April/May 2010. Details of the grass seed mix were approved as letter dated 7th June 2010. The soil has since been used for restoration purposes on the eastern side of the river. The northern bund has yet to be topsoiled but the approved details require the bund to have been seeded within 3 months of completion and the eastern portion of the bund to have been planted with hazel and hawthorn (50-50 split) in the next available planting season. However as email dated 27th October 2011 the Operator indicated that due to the deterioration in the weather it was unlikely the bund would be topsoiled before Spring 2012. Given the time of year the Mineral Planning Authority finds it reasonable for the topsoiling and seeding to be postponed until Spring 2012 with the trees to be planted in the next available planting season.

Condition Number and Description Condition 42

Throughout the operational life of the site, all soil mounds, disturbed and restored areas shall be maintained and kept free of noxious weeds. All necessary steps shall be taken to destroy weeds at an early stage of growth in order to prevent seeding.

Notes Following Visit There was no evidence of any noxious weeds within the new extension area.

Condition Number and Description Condition 43

There shall be no mixing of topsoil or subsoil at any time. Notes Following Visit No officers were present when the top and sub soils were removed form Phase 1 or Phase 2 but the Operator is aware of the requirements of this condition.

Condition Number and Description Condition 45

Following the satisfactory replacement and treatment of the subsoil, topsoil shall be re-spread evenly to a minimum depth of 300mm. The topsoil shall then be cultivated to relieve compaction. Stones larger than 100mm in size or other material capable of preventing or impeding normal agricultural or land drainage operations shall be removed from the site for disposal at a licensed landfill site or shall be buried on site not less than 1.5 metres below the finished topsoil level.

Notes Following Visit Topsoil has been spread over restoration phases 3a and 3b and parts of 4ai and 4aii. Larger stones have been removed.

Condition Number and Description Condition 46

Prior to the commencement of mineral extraction within Phase 1, as shown on Drawing No. SP15-2009/e Rev 2, the length of Cornish hedge lying within the application site as shown on Drawing No. SP15-2009/a Rev 2, shall be translocated to the area labelled `Relocated Hedgebank’ on the same drawing. Such translocation shall be undertaken and thereafter maintained at a minimum height of 2 metres and in full accordance with Appendix B Hedgerow Translocation Methodology Guidance.

Notes Following Visit The hedgerow was relocated to the correct location on the southern boundary of the new extension area. This was undertaken in January 2010 outside the growing season and bird nesting season. The Operator should be reminded of aftercare requirements outlined in the approved document Appendix B.

The `new bank’, as identified along the western boundary of the site on Drawing No. SP15-2009/a Rev 2, shall be formed from topsoil stripped from Phase 1 of the site, as shown on Drawing No. SP15-2009/e Rev 2. The bank shall be fully constructed within six months of the implementation of this permission, as provided in accordance with condition 1 above. The bank shall subsequently be seeded with a suitable grass seed mix and planted with a native hedgerow mix within twelve months of the implementation of this permission. Details of the proposed bank, grass seeding and planting shall be submitted to the MPA for approval prior to its construction and, following the implementation of this permission, all parts of the scheme shall be fully implemented, managed and maintained in accordance with the approved details unless otherwise previously approved in writing by the MPA.

Notes Following Visit This condition was removed as part of the Section 73 application PA10/08871 dated 19th May 2011.

Condition Number and Description Condition 48

During the operation of the site and the stated aftercare period, referred to below, noxious weeds in particular Ragwort and Japanese Knotweed shall not be allowed to colonise the site. Recognised control methods shall be implemented as soon as is practicable following initial infestation until clearance has been achieved. NB: For the purposes of this condition, ‘the site’ relates to the areas outlined in blue and red on Drawing No. SP15-2009 Rev 2. Notes Following Visit This condition has superseded condition 31 of NC72.ENV(1) dated 31/01/2006 As email dated 31 August 2010 the Operator notified the Mineral Planning Authority that Mid-Cornwall Landscaping (MCL) had identified the presence of Japanese Knotweed behind the old workshop. The Knotweed was sprayed in 2010 and 2011. A small crop of Common Ragwort was identified in the Tree and Shrub Survey dated 6th June 2010 which is included in the restoration scheme approved under condition of decision notice PA10/08871 dated 19th May 2011. The survey recommends that the crop is pulled to avoid it spreading. Given the time of year most of the outcrop has died back so the Mineral Planning Authority recommends that any identified regrowth should be pulled in Spring 2012.

Condition Number and Description Condition 49

In the event of a cessation of the winning and working of minerals prior to the completion of the approved working scheme, which, in the opinion of the MPA constitutes a permanent cessation within the terms of paragraph 3 of schedule 9 of the Town and Country Planning Act 1990, a revised scheme to include details of reclamation and aftercare, as detailed in condition 9 above, shall be submitted in writing for approval by the MPA within 12 months of the above cessation or longer period as may be agreed with the MPA. The scheme shall subsequently be fully implemented in accordance with the approved details.

Notes Following Visit The site is still in use and this condition is non applicable at this time.

3. Compliance with Planning Conditions NR/04/00433/ROMPS dated 31/01/2006 CC/NC/2004/00433/OCM [NC72.ENV(1)] Determination of new planning conditions on existing mineral planning permissions. Please note that conditions 7, 8, 15, 16, 18, 19, 22, 23, 25, 27, 28, 31 and 32 have been superseded by Decision Notice PA10/08871 dated 19 May 2011 and have therefore not been monitored or included in this report.

Condition Number and Description Condition 1. Time Limit

These permissions shall not be valid after 30 September 2023. Unless a further planning permission (or permissions) has been granted for a continuation of operations beyond this period, all operations and uses approved by these permissions shall be discontinued on or before this date, and all plant, machinery and buildings no longer required shall be removed from the site and the land shall be restored in accordance with further conditions below. Notes Following Visit This condition identifies that the permission will expire on 30th September 2023 unless planning permission has been granted for a continuation of operations beyond this period.

Condition Number and Description Condition 2. Extent of the Permissions and Nature of the Development

These conditions relate to the planning permissions identified on Drawing No. P/04-1 and P/04-4 Rev A for stone quarrying and associated operations, including the deposit of quarry waste and ancillary development, and to the asphalt coating plant identified on P113/5. Notes Following Visit Developments identified for information purposes.

Condition Number and Description Condition 3. Development in accordance with the approved plans (and phasing)

Unless otherwise agreed in writing with the Mineral Planning Authority (MPA), or required by the conditions attached to this Decision Notice, the development shall be carried out in strict accordance with the following drawings: P/04-1, PII3/5, PQ/00-1 Rev D, P/04-4 Rev A, PQH/95-1 Rev H, and PQH/95-2 Rev C. Notes Following Visit

P/04-1 - highlights the relevant planning permissions included in the ROMP. PII3/5 - details the approved layout of the coating plant. This was previously owned by Tarmac

but has recently been purchased by Glendinning. PQ/00-1 Rev D - the restoration requirements identified on this plan has been superseded by the

restoration scheme under condition 10 of PA10/00871 dated 19th May 2011. P/04-4 Rev A - identifies the method of working i.e. direction of working and areas proposed for

restoration. PQH/95-1 Rev H - Showing levels of proposed restoration now superseded by the restoration

scheme under condition 10 of PA10/00871 dated 19th May 2011 There is no extraction in the quarry void which is being backfilled, whilst the western half of quarry floor is being used to house the sump, wheel wash, workshops, weighbridge and the office welfare facilities. Developments were in accordance with those approved plans which still remain applicable. The progressive restoration phasing for the former ROMPs void identified in Drawing PQ/001 and PQH/95-1 Rev H have been superseded by the restoration scheme submitted for condition 10 of PA10/00871 dated 19th May 2011. Since the date of this site visit the restoration scheme was approved as letter dated 20th July 2011 and will be monitored during future visits. The photographs overleaf show the ROMPs permission area at the time of the visit:

The fence coloured yellow on drawing PQH/95-1 Rev H shall be retained and replaced as necessary for the duration of the operations hereby permitted.

Notes Following Visit The Mineral Planning Authority has been unable to identify the fence and has been unable to ascertain the original purpose of the fence and as such do not consider it expedient or in the public interest to pursue this non compliance matter. On this basis it will be noted as a technical breach although identified green as no further action will be taken. If the Operator wishes to permanently remove this condition from the decision notice then a formal Section 73 application could be submitted. Condition 7 (Restoration) has been superseded by condition 10 in decision notice PA10/08871 dated 19 May 2011. Condition 8 (Restoration) has been superseded by condition 10 in decision notice PA10/08871 dated 19 May 2011.

Within six months of this date of the determination of new conditions (or within such other period as may be agreed in writing with the MPA), a scheme detailing the method of traffic control at the site shall have been submitted and approved in writing by the MPA. The submitted scheme shall include the following provisions: a) the requirement for drivers of lorries serving the site to be notified of specified approach and

departure routes; b) arrangements to secure compliance with the specified routes; c) provision of appropriate signage within the site, to provide information of the specified

approach and departure routes (the sign shall be maintained as approved for the duration of the operations hereby permitted);

Notes Following Visit Details were submitted on the 9th October 2006, 9th July 2007 and the 12th November 2007 and approved as letter dated the 19th November 2007. In accordance with the scheme vehicles should enter the site from the Hersham Cross junction on the B3254 and exit the site via the Rhude Cross junction on the B3254. The Mineral Planning Authority has not received any complaints regarding the route of site traffic. Two signs have been located along the access road opposite the Tarmac facility so that all vehicles entering and leaving the site are informed of the specified routes. One of these signs is in replacement of the sign proposed near the weighbridge. The Mineral Planning Authority received a complaint from a Parish Councillor in June 2010 relating to the route of the lorries accessing the site. However, at that time the Operator contacted the complainant directly and the issue was resolved.

Within six months of the date of the determination of new conditions (or within such other period as may be agreed in writing with the MPA), a scheme detailing the provision of surface water drainage from the site shall have been submitted and had approved in writing by the MPA. The submitted scheme shall include a timetable for the construction of drainage works and shall be implemented and maintained as approved for the duration of operations hereby permitted.

Notes Following Visit A surface water drainage scheme was approved as letter dated 6th June 2007 as a requirement of condition 11 of decision notice CC/NC/2004/00433/OCM [NC72.Env (1)] granted on 31st January 2006. Notes Following Visit Details were submitted on the 9th October 2006 and the 5th July 2007 and the scheme was approved as letter dated the 5th December 2007. Whilst implementing the proposed changes to the office and welfare facilities the Operator should ensure the provisions of approved emergency flood warning and evacuation procedure remains in place. For clarification, a flood warning siren should be located close to the office building as shown on Dwg. No P113SV04A and evacuation procedures should remain placed on notices in the site workshop and near the bridge as shown on Dwg. No P113SV04A. If these areas are unlikely to be suitable following the proposed changes to the office and welfare facilities then the Operator should make a written request to vary the scheme.

The public highway outside the site entrance was in good condition at the time of the visit and the Mineral Planning Authority has not received any complaints regarding the condition of the road. The wheel wash remains operational and heavy vehicles were seen using the facility prior to leaving the site. The current set up provides for vehicles having to cross an area of the yard before reaching the weighbridge and access road. This was previously seen to be in a muddied condition which seemed to be impeding the effectiveness of the wheel wash, although during this visit this area of the yard had been cleared and the effectiveness of the wheel wash had been improved. All practicable means shall be employed by the operators for preventing or minimising the emission of dust, smoke or fumes and the creation of noise, vibration and air over-pressure during the approved use of the site. The word `practicable’ and the phrase `practicable means’ in these conditions shall have the meaning assigned to them in Section 79(a) of the Environmental Protection Act 1990 as defined overleaf. The provisions of this condition include the installation and maintenance of effective silencers on the plant and machinery and these shall be maintained to conform with the manufacturers specification at all times.

The following dust suppression measures shall apply to the site identified in blue on Drawing P/04 -1 and in red P113/5, in order to minimise the escape of dust from the site:- a) In periods of dry and/or windy conditions or when such conditions as may be forecasted by

the Meteorological Office, exposed haul road surfaces, stockpiles and other exposures of material shall be maintained in a damp condition;

b) All unutilised exposed ground capable of generating wind blown dust shall be seeded at the

first available opportunity, in order to establish permanent vegetation on exposed surfaces.

Notes Following Visit (a) Due to heavy rain all exposed surfaces were in a saturated condition at the time of the visit. A

bowser is available for dust suppression (b) There are no unutilised areas of exposed ground. All lights and floodlights shall be screened so as to minimise lightspill to any occupied dwelling and the countryside in the vicinity of the site.

Notes Following Visit The Mineral Planning Authority has not received any complaints regarding lighting. There are only two known fixed external lights at the quarry. One is located on the weighbridge and the other is located on the workshop. These are only used during site operating hours (usually 2-3 hours in the afternoon during the winter months) and are not left on overnight. Condition 27 (Plant and Machinery) has been superseded by condition 26 in decision notice PA10/08871 dated 19 May 2011. Until such time as they are directly affected by quarrying operations and associated activities, all existing trees, shrubs and hedgerows (within the control of the operator(s)) shall be retained, managed and protected from quarrying and associated activities during the period of development, unless otherwise agreed in writing with the MPA.

Notes Following Visit No vegetation is affected by current operations within the Review of Mineral Planning Permissions (ROMP) permission boundary.

Condition Number and Description Condition 30. Landscaping

Any vegetation shall be planted in accordance with approved landscaping schemes at the earliest practicable opportunity. All shrubs and trees shall be maintained free of weed growth within 0.5 metres of the base and any such plants which die within 5 years of planting, or which become seriously damaged or diseased shall be replaced in the next planting season unless otherwise agreed in writing with the MPA.

Notes Following Visit Trees have formerly been planted within two areas of the ROMPs permission, namely on the raised area to the right of the access road and behind the coating plant. A Tree and Shrub Survey was undertaken on 6th June 2010 and was included in the restoration scheme approved under condition of decision notice PA10/08871 dated 19th May 2011. The survey made two recommendations in relation to tree planting:

A targeted vegetation clearance around the smaller trees and shrubs planted in Area B (behind the asphalt plant) and Area C (planting in the south on the western side of the river).

The majority of the trees are now well established and the tree guards should be removed within 18-24 months i.e. between January 2012 and July 2012.

The Operator confirmed they would implement the recommendations in Spring 2012.

Notes Following Visit A low level mound of topsoil was stockpiled alongside the edges of Restoration Phases 4a and 4b but has since been used for restoration.

All plant, machinery and buildings shall be removed from the site on completion of quarrying or when it is no longer needed for the purposes which they were installed unless otherwise agreed in writing with the MPA. All scrap metal, vehicle and machinery parts shall be removed from the site, unless retained in accordance with details and a purpose to be agreed in writing with the MPA. Notes Following Visit The Operator submitted a written request to allow provisions for a small accumulation of scrap near to the weighbridge as letters dated 3rd June 2009 and 11th September 2009. These details were approved as letter dated 18 October 2010. The Operator has recently provided a small skip in this area for scrap storage purposes.

Prior to the commencement of development, the operators shall have submitted to and had approved in writing by the MPA a scheme and programme of measures for the suppression of dust. The scheme shall include: a) The suppression of dust caused by the moving and storage of soil and overburden, stone and

other materials within the site; b) dust suppression on haul roads; and c) the provision of dust collection and storage facilities. The approved scheme shall be implemented and complied with at all times and shall provide for self monitoring at the request of the MPA.

Notes Following Visit A dust scheme was approved by the Mineral Planning Authority as letter dated 24th August 2009. Since this time a further dust scheme was submitted and approved on14th May 2010 for Condition 8 of Decision Notice 09/00380/MIN dated 12th January 2010 (now superseded by PA10/08871 dated 19 May 2011). All quarry washings and run-off from stripped or disturbed areas and quarry tracks shall be contained in settlement lagoons before discharge to any watercourses to remove solids. The design and location of any such lagoons shall be in accordance with details to be agreed in writing with the MPA in consultation with the Environment Agency.

Notes Following Visit A surface water drainage scheme was approved as letter dated 6th June 2007 as a requirement of condition 11 of decision notice CC/NC/2004/00433/OCM [NC72.Env (1)] granted on 31st January 2006. In conjunction with the approved scheme a further surface water control system was installed in the 2005 extension area. This is shown on Drawing P/051 and is located on the second bench in the southern area of 2005 extension area. As required by conditions 9 and 28 of decision notice 09/00380/MIN dated 12th January 2010 (now superseded by PA10/08871 dated 19 May 2011) the Operator submitted schemes to the Minerals Planning Authority for the provision of surface water management. These schemes were approved as letter dated 20th May 2010. Condition 20 (Importation of Waste) has been superseded by condition 29 in decision notice PA10/08871 dated 19 May 2011.

Condition Number and Description Condition 21. Soil Handling

All available topsoil and subsoil shall be stripped from the approved extraction areas whilst in a dry condition and transferred directly onto backfilled areas of the site for restoration purposes unless no such ground is prepared in which case stripped soils shall be stockpiled in areas to be agreed with the MPA for later use in restoration. The topsoil and subsoil shall be stripped and stored separately. Subsoil storage areas shall have the topsoil stripped from them prior to subsoil being deposited. Soil movement shall not take place between October and April unless otherwise agreed in writing with the MPA. Soils shall not be moved off the site.

Notes Following Visit The Operator submitted details regarding the storage of topsoil in the southern corner of the 2005 extension area as letters dated 3rd June 2009 and 11th September 2009 and as email dated 17th March 2010. The Mineral Planning Authority approved these details as letter dated 18th October 2010. Condition 22 (Formation of New Hedgebank) has been superseded by condition 46 in decision notice PA10/08871 dated 19 May 2011 (Extension to Pigsdon Quarry for Extraction of Minerals). Moved in part to a new location on the southern boundary of the 2010 extension area.

The new planting strip at the southern end of the site, shown dotted on drawing PQ/03-2 Rev A shall be completed within 12 months of the date of implementation of this permission unless otherwise agreed in writing with the MPA. The planting scheme shall be as indicated on the approved plan and shall be developed and maintained in accordance with the principles of good sylviculture.

Notes Following Visit The trees were originally planted in the wrong location on the hedge bank running north to south along the 2005 extension area. The 2010 extension permission required the removal of the hedge bank and at this time trees were replanted at the correct location during November/December 2009. According to the Tree and Shrub Survey undertaken on 6th June 2010 and included in the approved restoration scheme 95 trees were planted in this area and only three trees have since died, giving an overall survival rate of 97%. The report recommended that the majority of trees were now well established and the guards should be removed in 18-24 months (between December 2011 and June 2012).

3. Compliance with Planning Conditions NR/96/00006/MIN - 6/96/2293/OCM [NC72(11)] Construction of new internal haul road to serve Pigsdon Quarry - Approved on 09/05/1997

Condition Number and Description Condition 1.

The approved road-shown coloured pink on Drawing No. PQR/96-1 shall be constructed in accordance with the details indicate don the abovementioned plan. The operators shall notify the Mineral Planning Authority (MPA) in writing of the commencement date of haul road construction.

Notes Following Visit The haul road was identified as substantially complete as letter dated 27th February 1998.

Condition Number and Description Condition 2.

Except as may otherwise be agreed with the MPA, within 3 months from the commencement date (to be specified under the provisions of Condition No. 1), the existing gateway opposite Pigsdon Lodge (coloured yellow on Drawing No. PQR/96-1) shall have been stopped up in the manner specified below: (i) a Cornish hedge shall be constructed across the gateway to match the alignment, height and construction detail of the hedge existing on either side; (ii) a bund shall be constructed on the north-west side of the hedge produced for a 2(i) above, to match the height, slope angle, alignment and construction detail of that existing on either side; and (iii) both the new hedge and the new bund shall be planted in accordance with a scheme to be

agreed with the MPA and such planting shall be undertaken during the first tree planting season following construction.

Notes Following Visit The existing gateway opposite Pigsdon Lodge was stopped up several years ago. The area has naturally revegetated and some trees had been planted along the bund.

Condition Number and Description Condition 3.

Surplus overburden arising during the construction of the approved new haul road shall be disposed of in accordance with details to be agreed with the MPA.

Notes Following Visit The construction phase finished in 1999 and this condition is therefore considered no longer relevant for monitoring purposes.

Condition Number and Description Condition 4.

The operators shall ensure that all run-off from the new haul road, both during construction when in use, is channelled to an appropriate settlement lagoon to intercept gross solid prior to discharge to a watercourse. Such lagoons as may be necessary are to be constructed in accordance with details to be agreed with the MPA, in consultation with the Environment Agency.

Notes Following Visit Use of the haul road is very limited so the surface has naturally revegetated. This has resulted in little, if any, surface runoff.

Condition 16 The noise monitoring results have indicated a breach in the noise limit and the Operator has been asked to implement noise mitigation measures to reduce the noise levels. On this basis the Mineral Planning Authority does not consider that the Operator is undertaking best practicable means to minimise noise and this condition is also identified in breach. To remedy this breach in planning control the Operator should implement noise mitigation measures to reduce the noise levels as soon as possible and retest the noise levels to confirm compliance with the noise limit.

11. Summary No mineral extraction takes place within the ROMP quarry void covered by permission CC/NC/2004/00433/OCM [NC72.Env (1)] dated 31/01/2006. A large area of this void is undergoing progressive restoration and the remaining area is currently used to house the coating plant (recently purchased by Glendinning), office welfare facilities, sump, wheel wash and workshops. The former processing plant originally located in the base of the void was removed in the early months of 2011 which now provides for further progression into restoration phases 4a and 4b. The restoration scheme submitted under condition 10 of decision notice PA10/08871 dated 19th May 2011 was approved on 20th July 2011 and compliance with the scheme will now be monitored during future visits.

The 2005 extension area governed by CC/NC/2004/00696/OCW [NC72 (16)] dated 25/08/2005 is now virtually worked to fullest extent and the void is used to house the processing plant, the settling lagoons and various stockpiles.

Permission 09/00380/MIN was granted for a new extension area on 12th January 2010, but this has since been superseded by the Section 73 permission PA10/08871 dated 19th May 2011, which sought to remove the requirements to build the bund required by condition 47 and permitted minor changes to the northern boundary arrangements. Extraction remained in Phase 1 at the time of the visit although the Operator has recently commenced surface stripping in Phase 2. Commencement of extraction in Phase 3 is restricted by the completion of restoration phases 4a and 4b on the eastern side of the river. The Mineral Planning Authority has received complaints referring to the impacts caused by noise and dust to the north of the quarry. On this basis a dust and noise monitoring programme was implemented to check compliance with the relevant conditions. A dust programme was implemented for six months and although the results indicated the quarry was contributing to elevated dust levels to the north of the quarry only the sample collected between 28/10 and 11/11 was anywhere the ‘custom and practice’ limit value for protection against dust annoyance used by the Environment Agency, which relates to the level at which dust could potentially become a nuisance. Given the results of the dust monitoring programme and the confirmation from the Environmental Protection Team that the Operator is compliant with their Permit the Mineral Planning Authority does not consider the Operator to be in breach of any dust conditions in this report at this time. The Mineral Planning Authority will however continue to monitor the dust with a view to undertaking further dust monitoring during the summer months. The noise monitoring was carried out in July and August 2011 at the curtilage of the nearest residential property to the north of the quarry. The monitoring recorded a noise level of 47.0 LAeq (1 hour) which was above the approved limit of 45 LAeq (1 hour) and for this reason Condition 14 has been identified in breach. Since this time the Operator has been implementing a number of noise mitigation measures and the noise is due to be retested to check for compliance in the next few weeks. There are no other outstanding issues arising from this visit although the Operator should be mindful of the landscaping measures which will need attention during the Spring.
