This project restores the creek channel, floodplain and riparian corridor of a tributary to Warner Creek at Boyle Park in Mill Valley, Ca. The project will modify approximately 300 linear feet of a small creek located along Elm Ave., and work includes but is not limited to removal of invasive, non-native vegetation, grading the creek channel and banks, placement of rock structures and stream gravels, installation of fencing to protect the stream corridor and final restoration of Elm Ave. This project, which is funded through an Environmental Protection Agency grant, will increase stormwater infiltration and improve water quality in the tributary to Warner Creek.

The Engineer’s Estimate for this project is $120,000.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Like the chefs at your favorite diner we are cooking up a few ‘short’ orders while providing contractors with a steady diet of ‘Q and A’ at the Capitol Connection. We finish this feast as the CSLB is ‘turning up the heat’ to serve new rules for contractors in disposing of mercury in California…

Q: I came across your website and I’m really hoping you can answer a question for me. One of our employees has two Sole Owner licenses: a “C-10” (Electrical) as well as a “B” General Contractor’s License. We would like him to become the Responsible Managing Employee (RME) for our company and qualify a “C-10” license. Does he have to deactivate both of his licenses or just the Electrical license?

A: Thank you for contacting us. Except in very rare circumstances, an RME can only be on one license at a time, therefore he will be required to deactivate both of his Sole Owner licenses in order to become the RME on the company’s license.

Q: As the qualifying individual for my current company, if I change jobs does my status and test results for the license move with me to the new company?

A: Yes, once you leave the company you have up to five years to obtain a license or add yourself to another company license without needing to re-take the exams.

Q: I currently have Worker’s Compensation Insurance through State Fund. The renewal for the policy is $940.00. We do not anticipate working in CA in the near future. Would you recommend changing the license to exempt from Worker’s Comp, or changing the status of the license to inactive? If we were to inactivate the license, how difficult would it be to reinstate?

A: If you don’t currently have employees and you don’t anticipate any work in the near future then either option would work. If you decide to inactivate the license, you are not required to keep the bond and Worker’s Comp on file with the CSLB, however you would need to make sure that those items are current in order to reactivate the license in the future. Additionally, you would need to pay the reactivation fee in order to reinstate the license when you are ready to begin work in CA again.

New Rules for “C-20” (HVAC) and “C-21” (Building Moving/Demolition) Contractors! Beginning July 1, 2013, a new rule took effect in California for both HVAC and Building Mover/Demolition contractors who dispose of out-of-service thermostats containing mercury. The new regulation requires the contractor to put his/her license number on the thermostat container, or provide the license number at the collection location accepting the device. This regulation requires that collection sites provide the number of mercury thermostats received and the contractor license numbers to manufacturers, who in turn submit an annual report to the California Department of Toxic Substances Control. This new regulation will help aid in the effort to safely recycle old thermostats.

LegISLATuRe ADjouRNS foR SuMMeR ReCeSS Breaking news, the streets of Sacramento are safe to walk again because the Legislature has left town for their annual summer recess! What’s amazing is the fact that the Assembly actually recessed over a week ago, while the Senate recessed this past Wednesday evening. Huh, you ask, how is that possible?

Believe it or not, the egos of the two houses got in the way when they set their respective dates for their recesses back in December. They realized that the commencement dates were one week different, but neither house was willing to make a change to enable them to be on the same schedules. So, the Senate met on their own this week while the Assembly members were already “working on their tans!” Amazing! CoNTRACT VALue MAY LIMIT THe AMouNT of A LIeN CLAIMThe following article was written by Ken Grossbart, partner in Abdulaziz, Grossbart and Rudman.The recent case of Appel v. Superior Court of Los Angeles County (Webcor Construction, real party in interest), deals with the valuation of a a mechanic’s lien on a condominium project. Wilshire Landmark (“Wilshire”) was the developer and Webcor Construction (“Webcor”) was the contractor, performing work to the property under a construction contract with a

guaranteed maximum price of $65.5 million. There were approved change orders which raised the contract price to at least $81 million, and there were claims for an additional $13.5 million, which Webcor alleged were approved changes. The lawsuit was filed against Wilshire as well as numerous individual owners of the condominium units (“Owners”). Just before trial, Webcor and Wilshire entered into a settlement agreement wherein it was agreed that a $32 million judgment would be entered against Wilshire; the agreement also stipulated that the guaranteed maximum price of the work was increased from $81 million to $95.5 million. However, it was also agreed that because Wilshire was insolvent and not able to pay its debts (or the judgment), Webcor would still be able to pursue its mechanic’s lien claim against the Owners. Shortly before trial Webcor filed a Motion in Limine (which is a motion filed before trial to attempt to exclude exclude evidence to be offered in the trial) to prevent the Owners from introducing evidence regarding the final contract value because of the settlement between Webcor and Wilshire. The Civil Code section in force when the work was argued to limit the amount of the lien claim to the lesser of the contract amount, or the value of the work performed. Webcor wanted to rely on the Settlement Agreement price as to the value of the work,

as the value of the work was dispositive of the value of the mechanic’s lien claims. Of course, the Owners opposed Webcor’s Motion. The Owners argued that they should be able to determine the true value of the contract, which they believe is actually lower than the amount determined in the settlement agreement between Webcor and Wilshire. The trial court relied upon language from the court of appeal decision in ECC Construction v. Ganson, and held that because the Owners were not parties to the contract, the contract value had no bearing and only the value of the work was relevant. Thus, the trial court ruled that the settlement agreement entered into by Webcor and Wilshire, which altered the contract valuation, was not relevant and only the reasonable value of services was to be used to determine the value of the lien claims. The Owners filed a Petition for Writ of Mandate (another type of appeal basically asking the higher court to order the lower court to do something - in this case, allow them to introduce evidence related to the value of the construction contract). The Appellate Court agreed that the trial court erred in interpreting Civil Code section 3123(a), which can be summarized to provide: “... liens provided for... shall be... for the reasonable value of the services, equipment, or

materials furnished or for the price agreed upon by the claimant and the person with whom... contracted, whichever is less.” The trial court took this to mean that the amount is based solely on the reasonable value when one is trying to enforce a lien against a property owner who is not a party to the contract. The Appellate Court held this interpretation is inconsistent with the plain language of the statute which does not indicate that there is a limitation on the use of the contract price agreed upon by the claimant when the property owner is not a party to the contract. The plain language of Civil Code §3123(a) would mean that Webcor’s mechanic’s lien is (1) the lesser of

the reasonable value of the work or (2) the value of the guaranteed maximum price contract. In essence, if the work was worth $90 Million but the contractor was entitled to $80 Million under its contract, the value of the lien is limited by the amount due under the contract and the Contractor is entitled to the unpaid balance on the $80 Million contract. Therefore, the Appellate Court granted the Petition and matter was remanded (sent back) to the trial court to be reheard consistent with the decision of the Court. Please note that since this case was heard that the Mechanic’s Lien statutes have

Watch Out for Falling and Flying Objects Objects falling from above can pose a serious on-site danger, and you are at increased risk when you are beneath cranes or scaffolds, or when others are working above you. Not taking this risk seriously? Consider the following accident reported by the Occupational Health and Safety Administration (OSHA): An employee with no head protection was standing under a suspended scaffold hoisting another employee and three sections of ladder. The sections of the ladder became unlashed and fell 50 feet, striking the employee in the head and killing him. Prevention Pays To prevent hazards from falling and flying objects, the following provides some practical things you can do to prevent injuries that can really hurt. General Precautions Always wear a hard hat, and carefully

maintain it. Excessive exposure to paint, some cleaning agents, sunlight and heat can all weaken hard hats. Wash them using warm water and never store them in the back window of your car.

Stack materials securely to prevent sliding, falling and collapse.

Crane and Hoist Precautions Do not work under moving loads. Barricade hazard areas and post

warning signs of the dangers on the job site.

Inspect cranes and hoists to make sure that wire rope, lifting hooks and chains are in good condition.

Use toe boards, screens and guardrails on scaffolds to prevent objects from falling.

Use debris nets, catch platforms or canopies to catch or deflect objects.

Never exceed the lifting capacity of cranes and hoists.

Secure tools and materials to prevent them from falling on others below.

When working at a height, do not keep tools in your pocket. They could slip out when you bend over.

Power Tool and Machine Precautions Wear safety goggles and face shields

when operating machinery or tools that cause flying particles.

Inspect tools to ensure that the protective guards are in good condition before each use.

Do not use power tools unless you are properly trained on how to do so safely.

Air Compressor Precautions Reduce the amount of compressed air

used for cleaning to 30 PSI. Only use this machine with the

appropriate guarding and protective equipment. Objects can be blown at your body, injuring you.

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
