The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Handymen need to remember the scope and limits of their work or they might find themselves ‘a dollar’ over the line and on the wrong side of the law. Licensed contractors also face significant penalties when projects go astray, including revocation of their license number. Wrapping it up we help settle a ‘buddy’ bet that offers an important reminder about knowledge and power…

Q: I am a licensed contractor and I regularly read your Q&A’s. I came across one recently regarding Handymen performing work under $500. I have never understood this rule completely. Is that per job, per customer or what are the criteria?

A: A handyman is permitted to perform work that is under $500 per job and, important to remember, that includes labor and materials.

Q: You helped me obtain my license recently and I am getting ready to make new contracts but I’m getting confused when looking at the CSLB’s website regarding the Mechanics Lien law. Am I supposed to put the notice on the contract itself?

A: It’s nice to hear from you again. A Mechanics Lien Warning is required to be part of a Home Improvement Contract or new Residential Contract. This applies to every contract or changes in a contract and

it can be incorporated within the contract or as an attachment. The specific wording for the notice that is required is outlined in B&P Code section 7164. Or, if it remains unclear call my office for more help.

Q: I recently had my license revoked because of a judgment and I’ve been getting conflicting information regarding the repercussions of having a revoked license. Does this mean that I will never be able to get a contractor’s license again in the future?A: not necessarily. It really depends on the specifics of your situation. Many times if you can prove that the judgment that resulted in the license revocation has been satisfied then you can in fact obtain a contractor license again in the future. When you apply the CSLB will review your situation and make a case-by-case determination.

Q: I’m hoping that you can settle a disagreement with a buddy who is also a licensed contractor. Can a “B” General Building contractor perform part of the work necessary for pool construction? It is my understanding that a “B” contractor can do anything as long as two unrelated trades are involved on the same project. Is that a good bet?

A: no, that is not correct; a General Building contractor cannot do “anything” as long as two unrelated trades are involved. There are

many trades that are not covered within the General Building classification. In fact, pool construction is one of them! Even though the project involves two unrelated trades, the appropriate classification would be the “C-53” Swimming Pool license.

According to the State’s definition of the “B” classification, “a General Building contractor is a contractor whose principal contracting business is in connection with any structure built, being built, or to be built, for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind, requiring in its construction the use of at least two unrelated building trades or crafts, or to do or superintend the whole or any part thereof.” Sorry, but you lose that bet!This is also a great example what we think we know versus the actual law, and why Capitol Services is here to provide expert assistance in getting it right. Also In This Update• Labor Commissioner’s Wage Theft

Investigation of Public Works Contractor Leads to Two-Year Prison Term

Subdivision Map Extension, AB 116 (Chapter 62), Signed By Governor

I am happy to report that a bill we strongly supported, AB 116 (Chapter 62) authored by Raul Bocanegra, was signed by the governor. As explained in the following article, which was written by Mike Winn of the California Building Industries Association, the bill will extend 3,500 subdivision maps on projects that didn’t get built in time due to the downturn in the housing market.

The Legislature may not be able to agree on much (including their summer break) but it seems they can agree we must do everything possible to encourage California’s housing recovery. That is why during the break Governor Jerry Brown signed a California Building Industry Association-sponsored measure authored by Assemblyman Raul Bocanegra that will fuel California’s housing recovery. The measure, which received only “yes” votes through every step of the legislative process, builds on previous bills and will allow local governments to extend the life of approximately 3,500 subdivision maps representing 400,000 housing units for 24 months. This ensures projects that create thousands of construction related jobs and billions of dollars in economic

output, which goes straight into local and state coffers, will move forward and actually get built. Put simply, this bill will help housing supply keep pace with demand, preventing another bubble that artificially drives up prices. While the recent uptick in most markets is encouraging, it’s critical builders keep pace with supply in order to avoid prices that are artificially high. California needs a strong recovery that’s sustainable and leads to robust growth in every sector. What’s more, the 3,500 tentative tract and parcel maps extended by this bill are the housing supply pipeline that will drive the recovery. Without these hard-earned land use entitlements, builders would have to spend years redoing the process that would certainly delay much-needed projects. Housing and construction jobs are the foundation for our economic upturn. As every homeowner and renter has learned the hard way, it’s been a rocky few years for our state’s economy and for the housing market. Employment in the building sector plummeted from around 800,000 construction-related jobs to 80,000. But the tide has turned and the housing sector is now leading California’s recovery. Once we get rolling again, it generates $328 billion in direct and related economic activity and 10% of the state’s economic output. Even in 2012, new housing construction supported 154,000 jobs. By 2014 the California Homebuilding Foundation estimates housing starts of 75,000 units in 2014 and 100,000 units in 2015. This is the equivalent of 400,000 jobs and $67.2 billion in

output. That is why it is so critical the legislature doesn’t create unnecessary regulatory burdens or duplicative procedures that will stop these projects from moving forward. While the signs of recovery are encouraging, we aren’t yet out of the woods. There are a number of bills that threaten our recovery making their way through the legislative process. We’re grateful the legislature saved these maps and look forward to working with them in these final months of the legislative session as we work through other issues that will move the recovery forward.

Labor Commissioner’s Wage Theft Investigation of Public Works Contractor Leads to Two-Year Prison Term

As the result of a criminal referral by California Labor Commissioner Julie A. Su’s office in January 2012, the owner of a Southern California construction company last Friday pleaded guilty to embezzling more than $350,000 in employee wages from two public works contracts and filing false tax returns to hide his theft.

Reza Mohammedi, 58, of Tustin was sentenced to two years in state prison by Orange County Superior Court Judge R. Fitzgerald on July 26. He is the owner of Irvine-based Southland Construction. Mohammedi is scheduled for a restitution hearing on nov. 29. The Labor Commissioner’s office is working to restore the wages to the 18 workers affected.

Baker, Director of the Department of Industrial Relations (DIR). The Labor Commissioner’s office, also known as the Division of Labor Standards Enforcement (DLSE), is a division of DIR.

In late December 2010, the Labor Commissioner’s office opened an investigation of Southland after receiving numerous complaints filed by workers and by the Center for Contract Compliance, which revealed that Southland did not pay proper prevailing wages and overtime wages to 25 workers. On Jan. 10, 2012, Southland was assessed $121,163 in unpaid wages and $128,300 in penalties on the “The Tracks at Brea” project administered by the City of Brea.

On Jan. 12, 2012, the Labor Commissioner’s office referred their findings to the Orange County District Attorney’s office, which contributed to the successful prosecution of Mohammedi.

DLSE and Orange County District Attorney investigators determined Mohammedi coached his workers on what to say if a public works investigator asked questions regarding their wages. He systematically submitted fraudulent certified payroll records to the Labor Commissioner falsely stating he was paying his workers the correct wage of $42 to $53 an hour

for each project. Mohammedi actually paid his workers $120 to $150 per day and never paid overtime.

Mohammedi then required his workers to return a portion of their pay back to him after they cashed their checks, or required them to pay for another worker’s pay. Using this scheme, Mohammedi embezzled over $396,000 in worker wages from his public works contracts for his personal gain.

“This case sends a clear message to those scofflaws who steal wages from workers, cheat honest contractors, and violate the public trust, that we will not only pursue civil remedies against you but seek criminal prosecution as well,” stated State Labor Commissioner Julie A. Su. “Wage theft is a crime and it will be prosecuted as such in the State of California. In addition, this case should serve as a deterrent to contractors who think they can get away with doctoring certified payroll records to hide the truth.”

In a joint effort, the Orange County District Attorney’s office and the Labor Commissioner’s office investigated the “Hiltscher Trail Improvements” project located in Fullerton, which established that Southland failed to pay employer payment contributions to five workers. On Sept. 11, 2012, the Labor Commissioner’s

office issued a Civil Wage and Penalty Assessment in the amount of $96,652 unpaid wages and $15,450 in penalties.

Mohammedi pleaded guilty to a court offer to 15 felony counts of failing to file a return with the intent to evade tax, 15 felony counts of willful failure to pay tax, seven felony counts of taking and receiving a portion of a worker’s wage on public work, six felony counts of recording false and forged instruments, and three felony counts of filing false tax returns. He admitted to the sentencing enhancement allegations for loss exceeding $100,000 and property damage over $200,000 and a prior strike conviction for criminal threats in 1999.

In a recent report entitled “State of the Division of Labor Standards Enforcement,” released in May 2013, the Labor Commissioner’s office reported that 2012 saw the highest amount of wages and penalties assessed on public works jobs by the Division since 2002. The Labor Commissioner’s office, also known as the Division of Labor Standards Enforcement, adjudicates wage claims, investigates discrimination and public works complaints and enforces state labor law. Cellphone Safety While Driving Distracted driving is a rapidly growing problem and cellphone use is its number one cause.

Research reported by the National Safety Council indicates: An estimated 28 percent of car crashes (1.6 million per year) involve cellphone use at the time of

the crash. Drivers who use cellphones are four times as likely to be involved in a car crash. Talking on the phone or texting while driving is as dangerous (or more so) than driving drunk. Talking on a hands-free device, though it eliminates the physical distraction, causes the brain just as

much distraction as using a handheld phone.

Pledge to take the following steps: I will not talk on a handheld phone or text while driving. I will pull over or let voicemail pick up the call if my phone rings while I’m driving. If I must talk on the phone, I will use a hands-free device (though the safest choice is no cellphone

at all). I will encourage my family and friends to take this pledge as well.

Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
