Working ‘unlicensed’ in California can really ‘sting’. If you are ‘planting’ pipe are you a contractor, a farmer or both? Another contractor discovers that his ‘judgment’ has limitations that might never go away…

As 2013 winds down, we can look back at the many illegal and unlicensed individuals that were taken off the street by the CSLB. While there is no way to fully alleviate unlicensed activities in CA, the Contractor’s Board Enforcement Unit is doing its best to level the playing field for those who are properly licensed and playing by the rules.

For instance, in late July, fifteen illegal individuals were arrested and cited in Concord for working without a contractor’s license. According to the CSLB, back in May Statewide Investigative Fraud Team (SWIFT) Investigators were in Ridgecrest “doing what they do best…citing (another fifteen) illegal operators masquerading as licensed contractors”. Eight unlicensed individuals were ‘stung’ and cited by the CSLB in one San Jose neighborhood last February, while more recently in September, the Board apprehended another eight suspected illegal “contractors” bidding work in Santa Monica.

To date, SWIFT, in conjunction with various State and local government agencies, have conducted over 30 stings throughout the State. It is common knowledge that some homeowners

fail to check whether a person has a valid contractors license or go with the unlicensed operator thinking they are saving money. “Unlicensed contractors put homeowners in jeopardy,” said CSLB Registrar Steve Sands. “If a contractor isn’t properly licensed and insured, the homeowner could pay more than expected to get the job done right or could be liable for accidental onsite injuries.”

Q: We are a General Building contractor and a question has been raised as to whether a contractor’s license is required for installing irrigation and drainage pipelines? All of this work is done on agricultural operations. Thank you in advance for your response.

A: B&P Code section 7049 allows for an agricultural exemption from requiring a contractor’s license for any “construction or operation incidental to the construction and repair of irrigation and drainage ditches of regularly constituted irrigation districts, reclamation districts, or to farming, dairying, agriculture, viticulture, horticulture, or stock or poultry raising, or clearing or other work upon the land in rural districts for fire prevention purposes”.

So if the work being done is strictly for agricultural operations, then it appears based on the above code section that a Contractor’s License would not be needed. However, if you would like an official determination I

recommend contacting the CSLB.

Q: I had a judgment on my previous sole owner license but the judgment is over 8 years old. I recently applied for a new contractor’s license in the name of my corporation. The application was denied based on the 8-year old judgment that is “unsatisfied”. It was my understanding that judgments go away after a period of 7 years. Is that not true?

A: It is our understanding that the CSLB has no statute of limitations for a judgment on a license. The Superior Court of California does have a 10-year statute of limitations. After 10 years if the Superior Court does not renew the judgment, you can provide proof of non-renewal to the CSLB in order to have the judgment forgiven.

on replacing plumbing fixtures in 2014

IRS ANNOUNCES 2014 STANDARD

MILEAGE RATES FOR BUSINESS,

MEDICAL AND MOVING

The Internal Revenue Service recently issued

the 2014 optional standard mileage rates used

to calculate the deductible costs of operating an

automobile for business, charitable, medical or

moving purposes.

Beginning on January 1, 2014, the standard

mileage rates for the use of a car (also vans,

pickups or panel trucks) will be:

• 56 cents per mile for business miles driven.

• 23.5 cents per mile driven for medical or

moving purposes.

• 14 cents per mile driven in service of

charitable organizations.

The business, medical and moving expense

rates decrease one-half cent from the 2013 rates.

The charitable rate is based on statute.

The standard mileage rate for business is

based on an annual study of the fixed and variable

costs of operating an automobile. The rate for

medical and moving purposes is based on the

variable costs.

Taxpayers always have the option of

calculating the actual costs of using their vehicle

rather than using the standard mileage rates.

Under California Labor Code Section 2802,

employers must fully reimburse employees for all

expenses actually and necessarily incurred. Many

employers typically choose to use the IRS mileage

reimbursement rate, but its use is optional.

The Division of Labor Standards Enforcement

has stated that using the IRS mileage rate will

generally satisfy an employer’s obligation to

reimburse for business-related vehicle expenses,

absent evidence to the contrary.

If an employee can show, however, that the

chosen mileage reimbursement rate, even the

IRS rate, does not cover all actual expenses the

employee has incurred, the employer must pay the

difference.

In addition to gasoline, business vehicle

expenses include wear and tear (depreciation),

repairs, oil, insurance and other costs

TRIGGER NEW RULE ON REPLACING

PLUMBING FIXTURES IN 2014

California homeowners saving up to overhaul

that 1980s-era kitchen or build a porch off the

family room face an additional cost in the new

year: replacing plumbing fixtures throughout the

house.

Starting Jan. 1, any improvement or alteration

to a single-family home more than 20 years

old will trigger a 2009 state law mandating the

installation of water-saving toilets, shower heads

and faucets.

Local government building officials,

contractors and would-be home remodelers only

recently started becoming aware of the rule.

The exact impact is uncertain, with jurisdictions

likely to interpret the replacement requirement

differently. Some officials predict a run on

building permits before year’s end.

“We go down to the Capitol and ask them not

to legislate our building code. And this is exactly

why we do it,” said Gene Paolini, Roseville’s

chief building official. “The way it reads is not

real clear.”

Water agencies were the main supporters of

the 2009 law. Officials said the upcoming rule

will, at relatively low cost, make a huge dent in

the state’s urban water consumption and help

the state meet a goal to reduce water use by 20

percent by 2020.

“This is part of a larger effort to double-down

on water conservation,” said Dave Bolland of

the Association of California Water Agencies.

People will save money in the long run as water

becomes more expensive in California, he said.

Contractors and building inspectors, though,

warn that the requirement poses a major headache.

Homeowners could rebel against the rule, either

because they object to the look of low-flow

fixtures or because of the requirement’s potential

cost, and do the work without going through the

permitting and inspection process.

Darius Baker, CEO of D&J Kitchens and

Baths in Sacramento, said the rule could set back

a remodeling industry still recovering from the

recession.

“From a remodeling perspective, it’s huge.

People don’t want to do something they’re told

they have to do, particularly when it costs a lot of

money,” Baker said, adding that he’s mentioned

the upcoming rule on sales calls. “I’m just the

messenger. And I’m going to get shot like a

hundred times.”

The upcoming rule is the the latest

government attempt to improve water

conservation. Since the 1990s, new homes have

had to include various water-saving features. Over

subsequent years, the Legislature has approved

laws setting low-flow standards for toilets, faucets

and other products.

Largely untouched, though, are aging, water-

guzzling fixtures in many of the more than 11

million single-family houses and apartment

buildings around California built in 1994 or earlier

– roughly 80 percent of the state’s housing stock,

according to U.S. census estimates. The state’s

population continues to grow, and experts say

climate change will reduce the Sierra snowpack

that is the foundation of the state’s water supply.

State Sen. Alex Padilla, D-Pacoima,

introduced Senate Bill 407 to address the issue.

Modeled on ordinances in San Francisco and

other cities, it created several triggers to require

the installation of low-flow fixtures in homes,

apartments and commercial buildings built before

1994: home improvements starting in 2014; all

homes in 2017; and commercial and apartment

buildings in 2019.

Padilla’s bill cleared the Legislature on the

final day of the 2009 session after initially falling

several votes short. Almost every Democrat

backed the bill, which was opposed by almost

every Republican. Groups supporting the measure

included the Metropolitan Water District of

Southern California, the U.S. Green Building

Council, and Plumbing-Heating-Cooling

Contractors of California. Then-Gov. Arnold

Schwarzenegger, who had set the 2020 water-

saving goal, signed it a few weeks later.

“Many people in Southern California

have already done this type of retrofit. This

is completing the loop,” Metropolitan Water

District spokesman Bob Muir said of the law.

“Conservation is going to be a prime source of

water.”

Local building officials and contractors

say they learned about the upcoming rule only

recently. It’s been more than four years since SB

407’s approval, and the law bypassed the months-

long building-code process. Instead, the law went

straight into the California Civil Code, which

covers subjects ranging from medical records

confidentiality to gift certificates.

“Once we figured it out, folks were saying,

‘Oh no,’” said Kelly Sherfey of California

Building Officials, a statewide group.

Sherfey’s group recently issued its

interpretation about when the plumbing-

replacement rule applies. Building permits for

projects deemed to be repairs or maintenance –

such as re-roofing, replacing a hot-water heater, or

new windows – will not trigger the rule. Projects

viewed as improvements or alterations will.

Contractors say they are still left with

questions. “I’m faced with a different

interpretation of this everywhere I go,” said Dale

Nichols, owner of Granite Bay-based Artisan

Remodeling, Inc.

Muir and others say qualified faucets,

showerheads and toilets can be purchased and

installed at a relatively low cost. On Home

Depot’s website last week, for example, an

eligible toilet sold for $98, a low-flow faucet for

$29, and a “luxurious” multispray showerhead for

$60.

But Sacramento-area building officials and

contractors said the requirement likely will be

significantly more complicated and costly than an

existing rule mandating people to install smoke

and carbon-monoxide detectors on any home

improvement.

In older homes, plumbing projects sometimes

involve tearing into walls, replacing obsolete

galvanized pipe, and other costly work, they said.

Bill Carter, a Sacramento remodeling contractor,

added that the sewer lines in some older

neighborhoods have minimal incline. Water from

low-flow fixtures won’t be enough to carry waste

to the city system, causing backups.

Ryan DeVore, Sacramento’s chief building

official, and others said they worry that the rules

could discourage people from pulling building

permits. DeVore estimated that about one-half of

the 15,000 or so building permits issued this year

in Sacramento would trigger the 2009 law.

“This is exactly the kind of legislation that

motivates people to not obtain a building permit

and to do work that may endanger themselves

or their property,” said Jay Salazar, Vacaville’s

building official.

Padilla, the author of the law, was unavailable

to comment on the upcoming rule, a spokesman

said. In an October 2009 statement after then-Gov.

Arnold Schwarzenegger signed the measure,

Padilla said the bill would ensure that “plumbing

fixtures throughout the state will systematically be

modernized, saving billions of gallons of water in

the process.”

Sacramento contractor Kent Eberle said he

agrees with the need to save water but expects

a backlash to the cost of complying with the

upcoming rule.

“There are people who are clients who are

going to say, ‘I don’t want to get a permit because

I’m going to have an out-of-pocket cost of $2,000

for a couple of bathrooms,’” he said. “They are

going to be outraged, I think.”

Driver Safety – Winter Driving

Fair or foul weather driving always presents hazards. But winter months present drivers with conditions that are far different from those they face during the rest of the year. Brakes:

• Know your brakes: When your brakes lock up on wet and slippery roads or during a panic stop, you lose steering control and your vehicle can spin.

• Anti Lock Braking Systems (ABS): In vehicles equipped with ABS, the driver's foot remains firmly on the brake pedal, allowing the system to automatically pump the brakes. Rear wheel ABS prevents wheel lockup so your car stays in a straight line. If your car has ABS control on all four wheels, you also keep steering control. If you have steering control, it is possible to avoid a crash by steering around hazards if a complete stop cannot be accomplished in time.

• Get the feel of the road: While braking or accelerating, do so gently. Be aware of how slippery the road is and adjust your speed accordingly. Rising temperatures greatly increase the slipperiness of ice and snow.

• Brake before curves: All vehicles are particularly sensitive to over-powering and over-braking on curves. Unseen hazards around the bend may require an evasive action, so turn your steering wheel slowly and smoothly, keep a constant speed in the turn, and pump your brakes carefully if it's necessary to slow down or stop.

• Stretch your "following" distance: Knowing that winter surfaces increase stopping distance three to 12 times, the smart driver increases their normal dry road following distance. Heavy trucks require a longer stopping distance on slippery roads than passenger cars. Remember… don't tailgate.

Driver Safety – Winter Driving

Tires:

• Make sure you have the right tires: Tires with deep treads are essential for safe cornering and handling on slippery roads. Check the air pressure frequently to maintain the manufacturer's recommended pressure.

Visibility:

• Be able to see and be seen: Clean all the snow and ice off of your windshield, other windows, outside mirrors, lights, and reflectors.

• Make sure your vehicle is equipped with good wipers: Check that wiper arms exert enough pressure on the blades to ensure a clean sweep. If moisture or ice builds up on the inside or outside of your windshield, stop and clean it off.

Lights:

• Use proper lights: Never drive with parking lights instead of headlights during late winter afternoons or in the early evening. Parking lights can cause an oncoming driver to think you are farther away than you are. Keep headlights clean; dirty headlights can greatly reduce your long-distance vision at night.

Lastly, assure that you and your vehicle are prepared for winter weather with emergency gear and proper tires, chains, and excellent vehicle maintenance.

Seguridad al conducir – En invierno

Conducir en clima bueno o malo siempre implica riesgos. Pero los meses de invierno presentan a los conductores condiciones que son muy diferentes a las que enfrentan durante el resto del año.

Frenar:

• Conozca sus frenos: Cuando se bloquean sus frenos en las carreteras mojadas o deslizantes o al frenar de emergencia, pierde el control de dirección y su vehículo puede sufrir un trompo.

• Sistemas de frenos antibloqueo (ABS): En vehículos que cuentan con ABS, el pie del conductor permanece firmemente sobre el pedal del freno, permitiendo que el sistema bombee los frenos automáticamente. El ABS de las ruedas traseras evitan el bloqueo de la rueda, de tal modo que su vehículo continúa en línea recta. Si las cuatro ruedas de su vehículo tienen control de ABS, también mantiene el control de dirección. Si tiene el control de dirección, es posible evitar una colisión por medio de manejar para eludir peligros si no puede parar a tiempo.

• Familiarícese con la carretera: Al frenar o acelerar, hágalo suavemente. Tenga en cuenta qué tan deslizante es la carretera y modifique su velocidad en consecuencia. Cuando sube la temperatura, hace que el hielo y la nieve sean mucho más deslizantes.

• Frene antes de las curvas: Todos vehículos son particularmente sensibles a acelerar y frenar demasiados en curvas.
