The Contractors State License Board (CSLB) is issuing an Industry Alert to all licensees about to renew current licenses or anyone who has either applied for a CSLB license, or plans to apply.

Be careful if anyone contacts you claiming to be from CSLB, or asks for credit card information over the phone for you to renew your license, get continuing education credit, or take a licensing exam. This is a scam!

“We’ve discovered at least one unscrupulous company that’s using information from CSLB’s website to contact licensees or applicants to mislead and scam them,” CSLB Registrar Steve Sands. “The caller leads the licensee or applicant to believe he or she needs to pay money over the phone to get continuing education credit, renew a license or to schedule a licensing exam.”

CSLB staff will never ask for credit card information over the phone, nor will they process any payment over the phone. CSLB fees are only payable through the mail via check or at CSLB headquarters via cash, check, or credit card. There are no continuing education requirements to renew a CSLB license. A list of all license fees are available on CSLB’s website.

Business and Professions Code section 7080.5 requires CSLB to make public the name and address of every accepted application for a license, on the day following acceptance, at CSLB’s office in Sacramento. Since technology now permits the electronic posting of these lists, CSLB makes them available on its website. These lists are used by many legitimate companies, including bond companies and license assistance companies.

At this point CSLB will continue to post the applicant lists on its website, but the process could change if applicants continue to be preyed upon by unscrupulous companies.

John Howard of Capitol Weekly reports that:

“Months before California voters approved new taxes in the nov. 6 election, accounting practices in the state budget were changed – changes that ultimately could make it much harder to define just how much money the state has taken in or is likely to get. The changes were approved by the Legislature and governor as part of the budget’s assumption that voters would back Propositions 30, which raises some $7 billion annually in temporary sales and income tax hikes, and Proposition 39, which raises $1 billion annually by halting a 3-year-old corporate tax break. At issue is a shift in the state’s accrual accounting procedures related to revenue from the two propositions. The Legislature’s nonpartisan fiscal adviser says the shift should be scrapped and replaced with a “simpler, logical” system by 2015. Budget legerdemain is nothing new: The change this year was only the latest in a series of accounting moves over many years that ultimately have the effect of showing a state budget in better balance than it actually is. Money isn’t hidden, it’s moved around, and it often flows backward instead of forward. In business, cash accounting reflects revenue from a transaction when the money is paid or received. Accrual accounting, universally used by all but the smallest businesses, counts money at the time the transaction is reported. “In recent years, the state has altered its accrual policies,” the

Legislative Analyst wrote on California’s 2013-14 fiscal outlook. “Some of the changes have a theoretical basis in accounting principles, but their effect has been to move more revenue collected in one fiscal year to a prior fiscal year (thereby helping to balance the state budget).” The shifts also affect the way schools are funded under Proposition 98, the guarantee that voters approved nearly 25 years ago. But the change this year, which was part of the Budget Act, could prove more significant. “A portion of final income tax payments paid in, say, April of one year will be accrued all the way back to the prior fiscal year (which ended ten months in the past),” the LAO wrote. April is a critical month in calculating state revenue because of the April 15 deadline to pay income tax. That means “we will no longer have a good idea of a fiscal

year’s revenues until one or two years after that fiscal year’s conclusion. Because the volatile capital gains-related revenues from Proposition 30 are the subject of the accrual changes, the late adjustments to revenues could total billions of dollars — much more than in the past.” “As a result, the LAO added, “the chances of large forecast errors by us and the administration will increase.” The LAO noted that an apparent $1.4 billion budget surplus reflected a shift in accruals. The office urged that future shifts be made available online. The 2012-13 state budget totals some $142 billion, including $91.3 billion in the main General Fund, nearly $40 billion in special funds and $11.7 billion in bonds.”

Safety Practices While Working on Excavation Sites Each year, trench collapses are one of the leading causes of injury and death on construction sites. Of these incidents, most of the victims were new employees who lacked training and guidance prior to entering the job site. Sadly, most accidents were preventable. Whether you are new or a seasoned employee, it is essential that you adhere to Occupational Safety and Health Administration (OSHA) regulations to ensure the safety of the entire work crew. Trench Requirements

• Trenches five feet or more in depth require a protective system.

• Trenches that are four feet or more require a safe means of entrance and exit.

• Trenches that are 20 feet or more require an exit system designed by a registered professional engineer.

Protective Systems The designated competent person should inspect the area and determine which protective system will suit the job site and soil most effectively. This is essential, as equipment movement, underground utilities and vibrations can cause a surcharge load on the sides of the trench, forcing it to cave in on the workers inside. The following are the most commonly used protective systems:

• Sloping: Protects workers by cutting back the trench wall at an angle inclined away from the excavation

• Shoring: Protects workers by installing aluminum hydraulic supports to prevent soil movement

• Shielding: Protects workers by using trench boxes to prevent cave-ins

In addition to one of these three safety measures, a low-traffic zone must be designated around the trench allowing only essential equipment to enter. This will minimize the amount of vibration to which the trench is exposed. Avoiding Accidents Excavation accidents can occur if the underground utilities are not located and removed prior to digging a trench. Contact your local one-call system to locate all of the utility lines. Then, label or remove them to prevent injury. Trench accidents can also happen if safe entrance and exit routes are not present or adequate for the situation. Workers may slip back into the trench as they are trying to climb up a ladder if it is unsupported, placed on a steep slope or is poorly built. To prevent injury while entering and exiting a trench, only the designated competent person should approve the structural device used. Workers should also place the ladder in a trench shield while trying to enter and exit to avoid a cave-in. By complying with OSHA regulations and following these safety precautions, the risk of injury at your job site will be greatly reduced. wants everyone on our team to keep safety in mind!
