Marin Community Development Agency Conserves, Enhances, Ex p a n d s

SAN RAFAEL, CALIFORNIA. Customers to the Marin County Community Development Agency (CDA) will soon notice changes in

their options for filing building permit applications, achieving quick plan review and scheduling building inspections as CDA begins to

implement long awaited improvements to their permit process.

Beginning July 6th, the planning and building permit counter in Suite 308 of the Civic Center will be closed every Friday. While at first

glance this may not seem like an improvement at all, the closure will allow CDA management to conserve and focus dwindling staff re-

sources more effectively toward a core Monday through Thursday work week intended to increase customer application throughput.

Enhanced customer options for filing building permit applications will also be implemented in July, including greater latitude in mail-in

permit applications and a Friday Drop-Off Box for smaller permit applications that require few plans or are normally issued over the coun-

ter. Online permitting for smaller building permit applications is anticipated within a year and will allow customers to submit their permit

applications from the comfort of their home or office.

Expanding customer choices in how building permits are processed, reviewed and inspected is also part of the CDA strategy to improve

customer satisfaction beginning this summer. These include:

Express Permitting is the new CDA term to describe same-day plan review for certain types of small projects like rooftop solar installa-

tions, landscape retaining walls and minor interior remodels that meet strict criteria for this type of review. This service will allow custom-

ers to secure their building permit in a single day.

Expanded choices for obtaining the fastest possible plan review include requesting overtime plan review for customers willing to pay the

overtime rate, and third-party plan review for customers who prefer to pay extra for potentially quicker review by a private firm of the

customer’s choosing.

Building inspection services will also be offering expanded customer options that include Electronic Inspection for licensed contractors

seeking faster inspection response through self-certification for certain types of inspections. Customers will also have the ability to request

an overtime inspection or third-party inspection if they desire greater control over inspection scheduling and are willing to pay the addi-

tional cost.

This summer, CDA will also commence construction of an expanded permit counter that will help staff better serve customers and visitors,

providing a beautiful and functional space that is respectful of the historic Marin County Civic Center.

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

Can a legal judgment ‘ricochet’ from its intended target? Our first contractor is hoping to get out of harm’s way before the le-gal battle is joined. We share the steps another contractor must ‘dance’ in a corporate shuffle. We will help another questioner ‘plug in’ to the reason he may, or may not, need to file a CA con-tractor’s license application…

Q: Okay, say a contractor disassociates from a company while there is a lawsuit pending but before a judgment is obtained, and then associates with another company. If a judgment is later obtained against the first company will it follow the license holder to the new company?

A: In my opinion, the judgment should not follow the contractor under your suggested scenario. However, he or she will likely be re-quired to divulge a suit is pending when associating with the second company. Generally, the Board’s policy is that judgments apply to personnel who are still listed on the license. Personnel who have previously disassociated should not be held responsible. The date of disassociation is critical and this is not a ‘get out of jail’ free card.

Q: Our Company recently converted from a “C” Corp to an “S” Corp. Ownership has remained the same. Do we need to do any-thing with our License? One of your recent Q&A articles in our local contractor’s builder exchange newsletter spoke about a Sole Owner who converted to an “S”, therefore needing a new license. Are we in the same boat?

A: When converting from a “C” corporation to an “S” corporation (or vice versa), you do not need to do anything with your license. The CSLB is not concerned with what type of corporation you are. If you kept the same corporate number (which according to our research looks to be the case) then a new license is not required. A Sole Owner is an entirely different type of business entity than a corporation, hence the need for filing new license application.

Q: If my corporate license were to be suspended, would I be able to use my personal contractor’s license as a back up and continue to work?

A: First, it depends on why the license was ‘Suspended’ by the Board. If the Board action is simply related to a Bond or Worker’s Compensation cancellation then that’s one thing. If the Suspension is caused by a judgment or disciplinary action this is something totally different. We’ll assume it’s the former reason.

You can use your personal license as long as it is current and Active. You should consider transferring the contracts that are currently under your corporate license over to your personal license in order to continue work in progress, plus you would need to sign new contracts under your Sole Owner business name. You should not do business under your corporate license number and name while it is suspended.

Q: We provide a patient safety monitoring system that utilizes the existing CATV coax system in hospitals and other medical facili-ties. We place a Server at the CATV demarcation point in the hos-pital communication room; a Room Control unit (similar to a cable TV set top box) in each patient room; and a computer at each nurse station using the existing hospital computer network. All we do is install and plug in our equipment. All new cable/coax installations are the responsibility of the facility using their in-house staff or contractors. Are we required to apply/obtain a contractor’s license to install our own equipment?

A: According to the CSLB, a license would not be required for this type of work. However, if the medical facility you’re doing the installations for requests that you have a contractor’s license, then a “C-7” (Low Voltage Communications) would be the proper clas-sification to apply for.

Next Week Will Be Crazy Around the CapitolDespite the fact that the leadership purports to have an agreement about the language to the myriad trailer bills that will ultimately constitute the, roughly, $92 billion budget – no one really knows what’s contained in the “fine print” besides just a few. Hey, despite these “minor details,” I expect the entire package of trailer bills to be approved by the end of Tuesday of next week and the entire “mess” approved by the governor before the close of the month. This will allow the state to stagger into the 2012-2013 calendar year on July 1st acting as if “life is good!” Just one minor detail remains. Much of the “balancing act” is predicated on the fact that the governor’s tax initiative is approved by the voters in November, which is a HUGE IF! Stay tuned!

Next week is the start of the annual “two-week showdown in Sacramento” for many of the surviving bills from the 2011-2012, two-year session. As usual, everything will go down to the wire around the halls as the pace picks up significantly. While I could write a book (literally) on the bills that I will be dealing with, the two most important ones happen to be ours!

They are:

AB 2021 (Wagner) - Back in the late 1980’s the construction industry sponsored legislation to create the prompt pay statutes. These statutes have helped to ensure that all contractors are paid promptly and fairly for both their progress and their retention payments.

Unfortunately, despite the industry’s best efforts, the Prompt Pay statutes have turned into a mess of loopholes over time. Consequently, they provide no relief to contractors against

a sophisticated owner who has found myriad excuses for withholding money that is owed to his contractors. One of the biggest loopholes has been due to the fact that there is no definition in the law for “disputed amount.” This bill will define “disputed amount.”

We have also recently amended this bill to address another important matter dealing with disputed amount - This bill will declare that it is the intent of the Legislatureto overrule Martin Brothers Construction Inc. v. Thompson Pacific Construction Inc. (2009) 179 Cal.App.4th 1401 to the extent that it is inconsistent with these provisions.

SB 1516 (Leno) - Current law encourages contractors and manufacturers to submit an “or-equal” bid, which is an ingenious public works bid proposal that includes an alternative material or method with the same or greater functionality and at a lower cost than the original bid specifications developed by the agency. Unfortunately, current law allows public agencies to require these “or-equal” submittals prior to the actual bid day. This is a major disincentive to any bidder, because there is nothing preventing the agency from sharing the information with other competitors. Consequently, the original “or-equal” bidder is undercut and bidders are discouraged from submitting innovations that are cost effective, so the taxpayers lose in the end.

Due to intense opposition, we have amended the bill. Listening to the public agency’s concerns, here’s what we are now doing:

• Allow the agencies to continue to require bids prior to bid day if a process is put into place that provides for a fair review of the proposal. The intent is not to over-burden an agency; rather, it is intended to ensure that all submittals are given a fair and honest assessment – FOR THE GOOD OF THE TAXPAYER! Further to this point, SB 1516 allows for each agency to develop their own custom process for accepting OR EQUALS prior to bid day, based

upon what works best for them.

• If an agency decides to require the submittals prior to bid day their assessment of the OR EQUALs and the accompanying supporting documents of their assessment must be concluded at least 10 days prior to bid day. This way, the agency can continue to prepare for the actual bid day for the other bids that they will be receiving without being rushed or overburdened; and if an OR EQUAL submittal is rejected, the submitter of the OR EQUAL still has sufficient time to prepare a revised bid utilizing the materials or methods that were originally specified by the agency. It is also very important to note on this point, that the amendments specifically place ALL of the burden on the submitter to substantiate the OR EQUAL material or method.

• The amendments ensure that the agency has final say in any acceptance or rejection of an OR EQUAL.

• To give the agency “carte blanche” without any potential oversight of their decision would be fool hardy at best. For this reason another amendment states that if the pre bid submittal (note, only the pre bid submittal) is rejected, the rejected submitter shall have standing to challenge that decision in an action for declaratory relief, but that action shall not affect the award of the contract.

• It is important to note that we DO NOT want to hold up the award of the contract for a fight over whether a pre-bid OR-EQUAL submission was correctly rejected. Instead, if the submitter who proposed the product wins a decision in court, it can use the court determination to establish equality for future contracts.

And, to this point, if the submitter decides that he wants to pursue declaratory relief he’d better be sure that he’s right, because he will be charged with all court costs, including expert’s fees should he lose! Conversely to this point, why are the agencies contending that this is going to be a huge burden? If they are indeed correct in their assessment that the submittal was not truly equal, they face no peril EVEN if the submitter does ultimately take them to court since he will bear ALL their court costs if he loses!

• The final amendment provides that not only prime contractors, but also subcontractors and manufacturers also have the ability to submit OR EQUALs. We should encourage all interested stakeholders who wish to raise the bar to introduce innovations and new processes which are truly OR EQUAL or better which will save the taxpayers’ money.

Even though we’ve attempted to address each and every concern raised by the public agencies, they are still opposed and are planning to testify en mass at next Tuesday’s hearing in the Assembly Business and Professions Committee. Ought to be interesting, stay tuned!

Horton, Chairman of the State Board of Equalization (BOE) today. The user-friendly service offers a convenient, fast, and free way to apply online for a permit, license, or account.

“eReg is just one more way the BOE is using innovative technology to make it easier to start and conduct business in California,” said Chairman Horton. “Helping businesses to succeed and getting them started quickly and efficiently is vital for California’s economic health.”

Beginning June 18, 2012, users can access eReg from the BOE’s secure website – any time day or night – to apply for a seller’s permit, pay use tax, and register for other tax and fee programs. Answer a few simple questions and the system works to guide the user through the process of getting the permits, licenses, or accounts needed. If users don’t have time to finish the application process, it’s no problem – they can save their application and return later to finish it.

Safety Practices While Working on Excavation Sites Each year, trench collapses are one of the leading causes of injury and death on construction sites. Of these incidents, most of the victims were new employees who lacked training and guidance prior to entering the job site. Sadly, most accidents were preventable. Whether you are new or a seasoned employee, it is essential that you adhere to Occupational Safety and Health Administration (OSHA) regulations to ensure the safety of the entire work crew. Trench Requirements

• Trenches five feet or more in depth require a protective system.

• Trenches that are four feet or more require a safe means of entrance and exit.

• Trenches that are 20 feet or more require an exit system designed by a registered professional engineer.

Protective Systems The designated competent person should inspect the area and determine which protective system will suit the job site and soil most effectively. This is essential, as equipment movement, underground utilities and vibrations can cause a surcharge load on the sides of the trench, forcing it to cave in on the workers inside. The following are the most commonly used protective systems:

• Sloping: Protects workers by cutting back the trench wall at an angle inclined away from the excavation

• Shoring: Protects workers by installing aluminum hydraulic supports to prevent soil movement

• Shielding: Protects workers by using trench boxes to prevent cave-ins

In addition to one of these three safety measures, a low-traffic zone must be designated around the trench allowing only essential equipment to enter. This will minimize the amount of vibration to which the trench is exposed. Avoiding Accidents Excavation accidents can occur if the underground utilities are not located and removed prior to digging a trench. Contact your local one-call system to locate all of the utility lines. Then, label or remove them to prevent injury. Trench accidents can also happen if safe entrance and exit routes are not present or adequate for the situation. Workers may slip back into the trench as they are trying to climb up a ladder if it is unsupported, placed on a steep slope or is poorly built. To prevent injury while entering and exiting a trench, only the designated competent person should approve the structural device used. Workers should also place the ladder in a trench shield while trying to enter and exit to avoid a cave-in. By complying with OSHA regulations and following these safety precautions, the risk of injury at your job site will be greatly reduced. wants everyone on our team to keep safety in mind!
