CALL TO ORDER

Dr. House called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.

AGENDA

Dr. Antalis submitted a motion, seconded by Dr. Retterbush, to approve the agenda of the

February 4, 2016 meeting. The motion carried unanimously.

MINUTES

Dr. Retterbush submitted a motion, seconded by Dr. Gross to approve the minutes of the

January 7, 2016 meeting. The motion carried unanimously.

Dr. Antalis submitted a motion, seconded by Mr. Wallace to amend the minutes of the

November 5-6, 2015 meeting. The motion carried unanimously.

BOARD CHAIR’S REPORT

Dr. House reminded the board members to fill out the forms before them on the table. Take a

look at the recusal list and initial the front of the list if you do not have any recusals.

EXECUTIVE DIRECTOR’S REPORT

Robert Jeffery, interim Executive Director, presented the following information for the

Board’s review. Dr. Retterbush submitted a motion, seconded by Dr. Weil to accept the report.

The motion carried unanimously. The Board took the following actions:

1. Question; Do store-and forward tele-consultations comply with the Board’s

telemedicine requirements? Per say not in violation of Rules. But each doctor would

still be held to minimum standard. Certain skin conditions could not be appropriately

treated from a picture and it would be incumbent upon the physician to only treat

conditions they can adequately diagnose.

2. Question Does the Board support HB 826 (Truth in Advertising)? Dr. Antalis

motioned for the Board to support HB826. Dr. Powell seconded the motion and it

carried. Five board members abstained.

3. Phyllis White provided information concerning accommodations for the April meeting

at the Georgia Regent’s University Health Sciences Campus in Augusta, Georgia. For

information only.

4. Reviewed Fiscal Year 2017 budget request. For information only.

5. Department of Public Health issued a bulletin concerning the Zika virus alert. The

Board will include this information in its next monthly newsletter; additionally, the

Board will post a link to the DPH alert on the Board website.

Dr. Weil motioned to go into closed session. Dr. Powell seconded the motion and it carried

unanimously.

Dr. House declared Open Session.

Betsy Cohen, Legal Service Officer, presented the Law Enforcement Action Report. Dr. Gross

submitted a motion to approve the report, and Dr. White seconded the motion. The Board

accepted the report by unanimous vote.

inform MFCU there are no cases regarding other request

Dr. House declared the meeting in recess at 9:00 a.m. for the purpose of holding committee

meetings.

Dr. House called the meeting to order 2:00 pm

Dr. Weil motioned to go into Closed Session to discuss investigations. Dr. White seconded the

motion and it carried unanimously.

Dr. House declared open session.

APPEARANCE BEFORE THE BOARD

Kiran Sharma, M.D. requested an appearance before the Board. Dr. Sharma stated additional

information had been sent to the Board for their review the day before. The Board members

tabled the appearance to review the additional information and reconvene this matter latter in

the day.

PERFUSIONIST ADVISORY COIMMITTEE

Dr. Powell presented the Perfusionist Advisory Committee report as a motion and was

seconded by Dr. Antalis. The Board accepted the report by unanimous vote. The Board took

Dr. Gross presented the Rules Committee report as a motion, and was seconded by Dr.

White. The Board accepted the report by unanimous vote. The Board took the following

actions:

1. Leave Rule 360-3-.02 “Unprofessional Conduct Defined” as it currently stands and adopt

the AMA language (Opinion 8.21 – Use of Chaperones during Physical Exams) as a

separate guideline when the patient and the physician are of the same sex.

2. Rule 360-3-.02(16)(b)(1) - “Unprofessional Conduct Defined” revise and repost.

3. Rule 360-3-.02(21) “Unprofessional Conduct Defined” revise and repost.

Kiran Sharma, M.D. requested an appearance before the Board. Dr. Sharma described his

background and gave statements concerning medical school training and residency training. He

explained past difficulties and his future practice plans. The Board members asked questions.

Dr. Sharma responded. The Board tabled the discussion for further information.


Louis Binion, M.D. requested an appearance concerning a student loan. He was accompanied by

his attorney Ted Pound and his wife Mary Binion. Dr. Binion gave facts pertaining to the student

loan, his multiple sclerosis and he is not practicing today. Mr. Pound gave background

information concerning the student loan. The Board members asked questions. The Board tabled

the discussion for further deliberation.
