“UNION-IP unifies IP®“ is a slogan that perfectly describes the scope of duties and responsibilities assumed by UNION-IP. Over the last few years more than a dozen Round Tables have identified, analyzed and discussed the discrepancies that still remain between national IP-law structures that are not harmonized, as well as harmonized European law. At these Round Tables, it appeared that even harmonized European law could still be treated differently by national or regional regimes. There is therefore no question that there is a place for UNION-IP in continuing its task and, in particular, in focussing on the forthcoming EU unitary patent law. This law will establish the first unitary patent-related legal system and is a milestone not only establishing a „real“ European patent having the desired unitary effect, but also regulating patent infringement proceedings before a single court making decisions for the entire territory of the European Union. In UNION-IP’s experience, when implementing a new legal IP framework in the territory of the European Union, a preparation period for practitioners particularly in the IP world is essential. It is rather difficult to predict the dynamics of the new system and it is barely possible to provide proven practical advice on how this system will work and which strategy will fit the needs of clients, enterprises and inventors. Therefore, the UNION-IP Congress in Berlin intends to provide workshops and sessions in which anticipation and prognosis can be ventured and explored.UNION-IP invites all of you who are interested in the development of IP in Europe, to come to Berlin and to work and prepare ourselves for the future. Let’s unify IP!

See you!Nils T.F. Schmid President of UNION-IP

09.45 – 10.45  PLENARY Session [PL I]:Unitary Patent – industry‘s perspectiveUnitary patents, classical European patents and national patents will soon all coexist. Which strategic considerations determine the patentee’s choice - perhaps the “all in one basket” argument will be pitted against the desire for full coverage in Europe. How do the costs for obtaining and enforcing patents in Europe infl uence the IP strategy? Of course, an important question that affects all holders of classical European patents - do we stay-in or opt out? What consequences will patentees face should they stay in the new system and the Unifi ed Patent Court has jurisdiction over their European patents? The option to opt-out avoids possible risks of the new system but could be irrevocable. Are there any options which lie between those of stay-in and opt-out? These are some of the issues to be discussed with experienced IP in house councils.

Do the parties get enough time before and in the hearing?Option of one of the two systems (bifurcation and unifi ed proceedings) is possible: What can we expect how this will infl uence decision-making? Will the national courts take advantage of this new option or will they stick to their tradition? The role of the Reporting Judge: Does this role pre-infl uence the decision-making process in the hearing? Berlin History Tour

Timing: Hotel Adlon Kempinski

09.00 – 17.30 with lunch

Dress code: good walking shoes

This day’s programme will lead you to the historic side of the German capital and in detail to the roots of Frederick the Great, King of Prussia.

During the sight seeing tour historical monuments, buildings and places will be shown and your guide will give you an overview of these former days in Berlin.

Also, two important locations will be visited in detail. One of them is the famous “Schloss Charlottenburg” (Charlottenburg Palace) whose cupola is one of Berlin’s emblems. Built from 1695 on, Frederick the Great amplifi ed the building with the New Wing in the 1740s. In an 2-hour-tour, the older part of the palace as well as the garden will be visited.

The “Königliche Porzellan-Manufaktur Berlin“ – short: KPM – (Royal Porcelain Factory) was founded in 1763 by Frederick the Great. The production of the ‘white gold’ was established from this time onwards in Berlin.

Until today, the KPM is a manufactory i.e. all porcelain is handmade and there is only one of a kind.

You will enjoy a guided tour through the exhibition. It will lead you from the development of the blue sceptre (the company’s logo) over the handmade painting to porcelain parts which can be found in cars.

In addition, you have the possibility to paint porcelain on your own!

The museum is located within walking distance of the Hotel Adlon Kempinski Berlin at the famous boulevard “Unter den Linden”.

The place is reserved exclusively for UNION Congress’s attendees and spouses. All with nice musical entertainment performed by a jazz group.
