Kevin completed the Fellowship of Arbitrators Qualifica�on and currently specialises in large scale

Construc�onClaimsandDisputeResolu�on.Overthelast10yearsKevinhasbeeninvolvedasMediator,

Adjudicator, Arbitrator and expertwitness on numerousma�ers. He is presently appointed on Dispute

Boards(DB’s)inSouth,CentralandWestAfrica.Kevinisanadmi�edmemberoftheFIDICPresident'sListof

Adjudicators.

HeisconsideredanexpertontheFIDICsuiteofcontractdocumenta�on.HeistheonlyFIDICAccredited

TrainerinSouthAfrica.

COURSEOVERVIEWIthasbeen18years since the last releaseof the FIDIC Rainbow Suite. A�ermanyyearsofinterac�onwith industry,theconsul�ngprofessionandaffectedstakeholders,FIDICformallyannouncedthereleaseofthenew2017versionsoftheRed,YellowandSilverBookcontracts.Significant changes have been made to the 2017 addi�ons adding to the already complexconstruc�oncontractdocuments.

Thecontractdocumenthasessen�allydoubledinsize,highligh�ngcomprehensiveanddetailedrulesunderconstruc�oncontracts,aswellasmakethemmoreuserfriendly

Basedon thismuchhaschangedwithin thenewcontract, specificallywithin the roleof theEngineer,qualitymanagement,advancedwarningandspecificallytheclaimsprocedure.

It examines the roles of both the Employer and the Engineer and highlights the essen�aldifferencesbetweenthevariouscontractdocuments.Theresponsibilityfordesignisdealtwithandasubstan�alamountof�meisdevotedtotheissueofextensionsof�me,varia�onsandcer�fica�on.

Disputeresolu�onundertheFIDICContractsishighlightedandtheissuesofno�ces,claimsand�mebarsarediscussedindetail.
