Summer/Fall 2015 in Fernie saw lots of smoke from the fires in British Columbia, and the Northwest United States but fortunately the flames never made an appearance in Fernie. For thousands of years the Ktunaxa, the original First Nations band living in the Kooteanys, traversed the Elk River Valley to reach their bison hunting grou nds on the prairies to the east. In the late 1800’s, William Fernie convinced the railroad to traverse the valley and a steel trail was forged through the mountains connecting the Elk River valley with the outside world at large, east and west.

Today the trails of the valley spread more along the line of the first trails. Hiking, biking, skiing. The valley trails play as integral part in the lives of our residents and visitors as the first Ktunaxa trails and the railroad. They connect. They draw people into the mountains and bring us back to our homes.

When you ask someone about our trails, you’re likely to receive an answer along the lines of the joke about the five blind men describing an elephant. Each man touches a different part—trunk, tail, side, ear, foot—and each describes a very different animal. Our trails are similar. When you ask about someone’s favorite trail, the response parallels the blind men describing the elephant.

“What great work outs.”“I love walking along the river.”“I just want to get into the woods. Away from people.”From Mount Proctor, referred to

fondly as the stair master machine, to the Elk River dyke trails, level casual walks along the river; Fernie offers a trail for everyone. In the winter people head out on snow bikes, cross country skis and snowshoes. In the summer, we’re on bikes and on foot.

The trail network did not happen overnight, but with the concerted and driven effort of a small group of volunteers. As one trail was completed, it opened more terrain and the opportunity to build another trail. The network spread, reaching into every corner of the valley. Today you can ride from Sparwood to Elko without spending any substantial time on a road. You can ride the ridges and drop down into the valley with rippin’ downhills and enough air to need a pilot’s license or you can ride essentially level trails along the Elk River.

the trails, providing GPS maps and elevation profiles used by locals and visitors alike. Along with this effort, they have created a more uniform signage (much needed in the maze of Ridgemont) and implementing it across the valley trails.

One of the notable additions to the valley network is the recently completed Lazy Lizard from the Island Lake Lodge lower parking lot to the Lodges themselves. The Fernie Trails Alliance, the Fernie Mountain Bike Club and Island Lake Lodge worked together to cut in a 7km trail with 337 meters of overall rise at a far lower pitch than many of the other climbing trails in the valley. An immediate hit, the trail generated over 4000 riders a month after opening. While too narrow and steep to groom in the winter, the trail will be perfect for the snowshoer looking for a relatively easy wilderness experience. As a hiker, biker and snow shoe friendly trail, the Lazy Lizard is a clear example of how the concerned activity clubs work effectively together creating better and safer trails around the valley.

With the maturing of Fernie’s trail network, homeowners today have a far wider choice of homes with truly year-round amenities. West Fernie, The Cedars and the Annex easily tie into the Gorby network at one end of

town or the Swine Flu group of trails at the other end. Maintown, Ridgemont, the Airport and Montane tie directly into the Ridgemont and Coal Creek network.

Fernie nordic society: The Nordic Society coordinates the more formal Nordic skiing in the valley on the dyke trails, golf course, Fernie Alpine Resort, Island lake Lodge, Montane and at the Elk Valley Nordic Center. The Montane and Nordic Center trails will come on line in a big way this winter. Montane is a multi-use trail system with a packed sidetrack for skiers. Ever since Fernie Snow Valley opened in 1967 and Heiko Socher took over in 1973, Fernie has been the place to be for epic powder turns. Tracks aren’t fresh enough for you? What is title insurance? Available through several insurers in British Columbia, title insurance provides protection for purchasers, as well as lenders, in respect of problems affecting the title of real property during and after a transfer. If you are considering purchasing property, you may wish to consider obtaining title insurance as part of your transaction.

The land title system in British Columbia is known as a “Torrens” system. In a Torrens system, the government guarantees indefeasible (irrevocable or unalterable) title for those parties listed on the government’s land title register. Transfer of real property in a Torrens system is done through changes to the register, as opposed to transfer by deed. In

British Columbia, the Land Title and Survey Authority (the “LTSA”) is the governmental body responsible for administering the land title registry and survey system. With some limited exceptions, all transfers and modifications to real property titles must be recorded by the LTSA on the land title register to be valid.

The British Columbia land title system provides excellent title security to both purchasers and lenders. However, as a result of several high profile mortgage fraud cases, title insurance has become quite common in real estate transactions in British Columbia. This is especially the case where the purchase is being financed by a mortgage lender. Many, if not most, British Columbia

mortgage lenders may require title insurance as a mandatory part of the transaction for additional security.

There are three types of title insurance policies: lender only (which only protects the lender’s interests), purchaser only (which only protects the purchaser’s interests), and lender/purchaser (which protects the interests of both the lender and purchaser). A lender/purchaser policy will usually require an additional premium be paid for the added protection. Title insurance policies can vary broadly with respect to the coverage they offer, but in general a policy will provide protection for some, or all of the following: • Title fraud and forgery• Improvements or modifications to a property done without proper permits; encroachments

• Municipal zoning non-compliance; unenforceability of mortgages; title defects• Survey defects (title insurance can also replace a lender’s requirement for property survey); and unregistered interests

Title insurance can add additional protection to your British Columbia real property transaction, but like all insurance policies, it will contain exclusions and must be read carefully. If you have questions about, or are interested in obtaining title insurance, speak with your lawyer.
