Amol, now a full-time di-rector, says he became an ac-tor by accident. All the same he believes the craftneeds discipline.

“No one is a born actor. Itis a skill which can be learntlike any other and fine-tuned,”

he says. So would he subscribeto the principles of methodacting? “I don’t mean that. Noone is a born singer. One hasto learn music, the ragas, thesur. Likewise, acting too islearnt,” he says.

“Take pot-making. Youneed mitti, the right amountof water. You mould it and runthe wheel at a particularspeed. Mitti is not the pot.”

Why hasn’t he acted in thelast two decades? “I acted inAks. It was a blink-you-will-miss-me role. My characterwas killed in a jiffy... I strayedinto acting. While doing mymasters at JJ School of Art,I’d watch a lot of plays. Oncethe legendary Satyadev Dubeysaw me hanging around thereand asked me if I would act. Isaid yes. Then he told mesternly: ‘I have asked you toact not because I saw a sparkin you but because you werehanging around my sets andyou seem to have plenty of time on hand.’ Recently I acted in the Marathi filmSamantar.”

Why is he so against Bol-lywood, the mainstream cine-ma, you want to know.

“Which mainstream cine-ma are you talking about? Thecinema which flops 95% of the

time? Why do you keep talk-ing about the cinema not want-ed by the audience? Otherwise,they wouldn’t flop. Yet, every-one calls it mainstream cine-ma, entertaining. Entertain-

ment means different thingsto different people. Filmmak-ers fool the audience by dish-ing out insipid fare and saythat’s what the audiencewants.”

New Delhi: Law is supposed tobe enforced uniformly, and with-out sorting the guilty on the ba-sis of their economic and socialbackground. On Monday, how-ever, the Supreme Court saidthat economic status of a mur-der convict needs to be takeninto account to determinewhether he should be awardeddeath penalty or life sentenceeven in respect of offencesfalling in the “rarest of rare”category.

In an order that is sure tospark a debate, the court saidpoor background of the accusedshould, along with old age andyears spent behind bars whileawaiting death sentence, be con-sidered as mitigating factorswhen courts ponder whether lifesentence should be used in anotherwise fit case for deathpenalty.

The order was passed by aBench comprising Justices PSathasivam and H L Dattu whilehearing an appeal against deathpenalty awarded by the trialcourt as well as Allahabad HighCourt to two members of a gangof bandits convicted for killingfour persons in December 1995.

The Bench noted that apartfrom being old, the convicts had

been in custody since 1996 anddeath penalty had hung overtheir heads since 2005, when thetrial court gave its verdict.

The Bench further said, “Theconvicts (Mulla and Guddu) be-long to an extremely poor back-ground. One thing which is clearto us is that they have commit-ted these crimes for want ofmoney. Though we are shockedby their deeds, we find no rea-son why they cannot be re-formed over a period of time.”

Courts have always treatedold age and the duration of in-carceration as attenuating con-siderations while settling ‘lifesentence or death penalty’ ques-tion, but it is the first time thatthe top court has introduced af-fluence or lack of it in play.

Justice Sathasivam, writingthe judgment for the Bench,stressed that the SC was not sug-gesting that economic depriva-tion could be a justification formoral depravity as shown by thetwo convicts. But he also saidthat “we certainly recognize thatin the real world, such factorsmay lead a person to crime”.

“Therefore, we believe, socio-economic factors might not di-lute guilt, but they may amountto mitigating circumstances. So-cio-economic factors lead us toanother related mitigating fac-

tor, that is, the ability ofthe guilty to reform,” the Bench said.

The court also seemed to sug-gest that since poor commitcrimes because of compulsion,they are more likely to mend.

“It may not be misplaced tonote that a criminal who com-mits crimes due to his econom-ic backwardness is most likelyto reform. This court on manyprevious occasions has held thatthis ability to reform amountsto a mitigating factor in cases ofdeath penalty,” it said.

While substituting the deathsentence awarded to Mulla andGuddu to life imprisonment, theBench said, “The punishment oflife sentence in this case mustextend to their full life, subjectto any remission by the govern-ment for good reason.”

The significance of the orderstretches beyond its repercus-sions for Mulla and Guddu. Itcomes after a spell when courtswere seen to be going by the let-ter of law, especially on a hostof issues — economic re-forms/liberalization, rights oftrade unions, etc.

Whether it marks, in keepingwith the political zeitgist, the be-ginning of a tilt towards aamaadmi, only time will tell.

Chennai: Social networkingsites are used by many to re-connect with old friends but

for 60-year-old Ko-ruthu, tech-n o l o g yhelped himtrace his

son who had left home almost12 years ago.

When Jimmy Koruthu, 31,opened an Orkut profile, henever thought that an email IDhe had mentioned in it wouldhelp his relatives and father totrace him all the way to Chen-nai from Kerala.

The email ID rang a bellfor one of Jimmy’s relativesbecause it contained his fam-ily name Koruthu. The rela-tive alerted Koruthu who hadbeen trying to trace his sonall these years. The cyber cellof Kerala police traced the in-ternet protocol address to alocation at Adyar and direct-ed Koruthu to approach theChennai police who tracedJimmy’s address to a brows-ing centre.

The centre had installed aCCTV which helped the po-lice to identify the youth.

“We showed the videofootage to Koruthu who iden-tified Jimmy,” said inspector Gajapathy.

The police traced the ad-dress. But, he had shifted hisresidence. “But, we managedto find the new address and re-united the father and son,” Ga-japathy added. “I had men-tioned my email ID in my net-work profile. A relative saw myemail ID and found out that it’sme, through the name. I hadnot posted my photograph inthe profile,” said Jimmy whois happy to meet his father.

Although it was an urge todo something on his own thatprompted Jimmy to leave hishouse in Pathanamthitta wayback in 1998, he ascribed noparticular reason for not con-tacting his parents for so long.

“I have been working in acall centre. But now I have re-signed from my job to start afirm on my own,” Jimmy said.

“I’ll go home, meet my rel-atives and then think about theplans,” he added.

Nobody in the Congresscamp believes that Pawar spokeabout cricket for so long and thatno politics was discussed be-tween the two big leaders ofMaharashtra. However, chiefminister Ashok Chavan whocalled on Congress presidentand UPA chairperson SoniaGandhi in Delhi has been ad-vised to play down the tete-a-tetebetween Pawar and Thackeray.

After Rahul Gandhi’s suc-cessful visit to the city and theeuphoria created by his jour-ney in a suburban train, theShiv Sena’s morale is low.Pawar’s visit to Matoshreecame as a relief to the Sena.

Pawar, who held a two-daycamp for Aurangabad workerson Saturday, had slammedThackeray for his ban on Aus-tralian cricketers. However, af-ter landing in the city from Au-rangabad, the first thing he did

Judges appointments: HCs’views on RTI queries sought

New Delhi: Faced with increasing number of queriesunder Right to Information (RTI) Act on judges’ ap-

pointment to higher judiciary, theSupreme Court on Monday soughtthe views of all High Courts on thisissue.

Responses of HCs were soughtby a Bench comprising Justices BSudershan Reddy and S S Nijjar,which was hearing a petition filed

by the CPIO of the apex court challenging an order ofthe Central Information Commission directing mak-ing public such information.

“We see that such matters frequently arise and HighCourts are dealing with these problems. Why shouldwe not issue notice to the registrar generals of all HighCourts,” the Bench asked.

On an application from S C Agarwal, the CIC, apartfrom asking the SC to give information about the ap-pointment process of judges, had also directed theapex court to furnish information under RTI aboutthe correspondence between the Chief Justice of In-dia and the CJs of HCs.

It had also allowed the plea of Agarwal asking theSC to disclose the communication between Justice RRegupathy of Madras HC to the CJI after he allegedthat a central minister had tried to influence him ina case. Attorney general G E Vahanvati, who ques-tioned the CIC decision, argued that if opinions ex-pressed by judges were to be laid out in the public do-main, nobody could expect a frank opinion.
