INTERNATIONAL SEABED AUTHORITY

PROTOCOL ON THE PRIVILEGES AND IMMUNITIES OF THE INTERNATIONAL SEABED AUTHORIT¥
The States Parties to this Protocol,
Considering that the United Nations Convention on the Law of the Sea establishes the International Seabed Authority,
Recalling that article 176 of the United Nations Convention on the Law of the Sea provides that the Authority shall have international legal personality and such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes,
Noting that article 177 of the United Nations Convention on the Law of the Sea provides that the Authority shall enjoy in the territory of each State Party to the Convention the privileges and immunities set forth in section 4, subsection G of Part XI of the Convention and that the privileges and immunities of the Enterprise shall be those set forth in annex IV , article 13,
.Recogni;ing that certain additional privileges and immunities are necessary for the exercise of the functions of the International Seabed Authority,
Have agreed as follows:
Article 1
Use of terms
For the purposes of this Protocol:
(a) "Aut!"":ority" !:'leans the International Seabed Authority;
(b) "Convention" means the United Nations Convention on the Law of the Sea of 10 December 1982;
(c) NAgreementM means the Agreement relating to the Implementation of Part XI of the United Nations Convention on the La'''' of the Sea of 10 December 1982 . In accordance with the Agreement, its provisions and Part XI of the Convention a~e to be interpreted and applied together as a single instrument; this Protocol ar.d references in this Protocol to the Convention are to be interpreted and applied accordingly;
(d) "Enterprise" means the organ of the Authority as provided for in the Convention;
(e) "member of the Authority" means:
(i) any State Party to the Convention; and
(ii) any State or entity which is a member of the Authority on a provisional basis pursuant to paragraph 12 (a) of section 1 of the annex to the Agreeme nt;
(f) "representatives" means representatives, alternate representatives , advisers, technical experts and secretaries of the delegations;
(g) "Se:cre:'!:ary·General" means the: Secretary·General of the International Seabed Authority.
Article 2
General provision
Without prejudice to the legal status, privileges and immunities accorded to the Authority and the Enterprise set forth in section 4, subsection G, of Part XI and Annex IV , article 13, of the Convention respectively , each State party t o this Protocol shall accord to the Authority and its organs, the representatives of members of the Authority, officials of the Authority and experts on mission for the Authority such privileges and immunities as are specified in this Protocol .
Article J
Legal personality of the Authority
1. The Authority shall possess legal personality. It shall have the legal capacity:
(a) to contract;
{bl to acquire and dispose of immovable and movable property;
(c) to be a party in legal proceedings.
Article 4
Inviolability of the premises of the Authority
The premises of the Authority shall be inviolable.

The Authority shall, in exerc1s1ng its rights under paragraph 1 of this article, pay due regard to any representations made by the Government of any member of the Authority insofar as it is considered that effect can be given to .uch representations withou~ detriment to the interests of the Authority.

Article 6
Flag and emblem
The Authori:.::: shall be entitled to display its flag and emblem at its premises and on yenicles use d for o fficial purposes.
Article 7
~epresentatives of members of the Authority
l. Representatbes of meT:lbers of the Authority attending meetings convened by the Authority shall, while exercising their functions and during their journey to and from the place of meeting, enjoy the following privileges and immunities:
la) immunity from legal process in respect of words spoken or written, and all acts per!ormed by them in the exercise of their functions, except to the extent that t~e member which they represent expressly waives this immunity in a particular c~se:
(b) immunit~' f:::-om personal arrest or detention and the same immunities and facil ities in respect of their personal baggage as are acco r ded to diplomatic envoys;
(c) in·;iolabil::'ty for all papers and documents;
Id) the rig~~ :0 use codes and to receive papers or correspondence by courier or in sea!.-ed bags;
(e) er.empti=n in respect of themselves and their spouses from immigration restrictions, alien registration or national service obligations in the State they are visiting or through which they are passing in the exercise of their functions;
If) the same facilities as regards exchange restrictions as are accorded to representativ-es of foreign Governments of comparable rank on temporary official missions.
1 2. In order to secure, for the representatives of members of the Authority, complete freedom of speech and independence in the discharge of their duties, the immunity from legal process in respect of all acts done by them in discharging their functions shall continue to be accorded, notwithstanding that the persons concerned are no longer representa~ives of members of the Authority.
3. Where the incidence of any form o~ taxation depends upon residence, periods during ... ·t:ich the representatives of members of the Authority attending the meetings of the Authority are present in the territory of a member of the Authority for the discharge of their duties shall not be considered as period. of re.idence.
4. Privileges a~d immunities are accorded to the representatives of members of the Authority, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions in connect ion with the Authority. Consequently, a member of the Authority has the right and the duty to waive the immunity of its representative in any case where in the opinion of the member of the Authority the immunity would impede the course of justice, and it can be waived without prejudice to the purpose. for which the int:: .. mity is accorded.

6. The provisions of paragraphs 1, 2 and l are not. applicable as bet.ween a representat ive and the aut.horities of the member of the Authority of which he is a national or of which he or she iz or has been a represent.ative.
Article 8
Officials
1. The Secretary· General will specify the categories of officials to which the provisions of paragraph 2 of t.his article shall apply. The SecretaryGeneral shall submit. these categories to the Assembly. Thereafter these categories shall be communicated to the Governments of all members of the Aut.hority. The names of the officials included in t.hese categories shall from t.ime to time be made known to the Governments of members of the Authority.
2. Officials of the Authority, regardless of nationali ty, shall:
(a) be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity;
(b) be immune from personal arrest or detention in relatio~ to acts performed by them in their official capacity;
(c) be exempt from tax in respect of sa:aries and. emol\.:r.;e:1t5 ;aid or a::.y other form of pa}'tlIent made by the Authori ty;
(d) be immune from nat.ional service obligations provided that, in relation to States of which they are national, such immunity shall be confined to officials of the Authority whose names have, by reason of their duties, been placed upon a list compiled ;,y the Secretary-General and approved by tr.e State conCer:ledi should other officials of the Authority be called up for national service, t~e State cor.cerned shall, at the re~uest of the SecretaryGeneral, gran::. such tE.~porary deferments i:1 the cllll-up of such o!ficiala as may be necessary to avoid interruption in the continuation of essential work;
(e) be exempt, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration;
If) be accorded the same privileges in respect of exchange facilities as are accorded to t6e officials of comparable ranks forming part of diplomatic missions t.o the Governments concerned;
(g) have the right to import free of duty their furniture ar.d effects at the time of first taking up their post in the country in question;
(h) be exempt from inspection of personal baggage, unless there are serious grounds for believing that the baggage contains articles not for personal use or articles the import or export of which is prohibited by the law or controlled by the quaran~ine regulations of the Party concerned; and inspection in such a case shall be conducted in the presence of the official concerned, and in .the case of official baggage, in the presence of the secretary-General or his or her authorized represent.ative;
(i) be given, toget.her with t.heir spouses and relatives dependent on them, the same repatriat.ion facilitie s in t.ime of internationsl crises as are accorded to diplomatic agents.

J. In additicn :0 the privileges and ~mmun~tles specified in paragraph 2, the Secretary-General or any official acting on his behalf during his absence from duty and the Director-General of the Enterprise shall be accorded in respect of themselves, their spouses and minor children the privileges and immunities, exemptions and facilities accorded to diplomatic envoys, in accordance with international law.
4. Privileges a~d immunities are accorded to officials, not for the personal benefit of the individuals themselves, but in order t~ safeguard the independent exercise of their functions in connection with the Authority. The secretary-General has the right and the duty to waive the immunity of any official where, in the opinion of the secretary-General, the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Authority . In case of the Secretary-General, the Assembly shall have the right to waive immunity.
5. The Authority shall cooperate at all times with the appropriate authorities of merrDers of the Authority to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuse in connection with the privileges , immunities and facilities referred to in this article.
6 . Pursuant to ~he la,,",,8 and regul ations of the State concerned, the officials of the Authority shall be required to have insurance coverage against third-party risks in res pect of vehicles owned or operated by them.
Article 9
Experts on mission for the Authority
1 . Experts (other than officials coming within the s cope of article 8 ) performing missions for the Authority shall be accorded such privileges and immunities as are necessary for the independent exercise of their functions during the period of their missions, including the time spent on journeys in connection with their missions. In particular they shall be accorded :
(.) immunity from personal arrest or detention and from seizure of their peraonal baggage ;
(b) in res~ect of words spoke~ or written and acts done by them in the exercise of their functions, immunity from l egal process of every kind. This immunity shall con:inue notwithstanding that the persons concerned are no longer employed on missions for the Authority;
(c) inviolability for all papers and documents;
(d) for the purposes of their communications. with the Authority, the right to use codes and to receive papers or correspondence by courier or in sealed bags ;
(e) exemption from tax in respect of salaries and emoluments paid or .any other form of payment made by the Authority. This provision is not applicable •• between an expert and the member of the Authority of which he or she is • national:
(f ) the same· facilities in respect of currency or exchange restrictions •• are accorded to representatives of foreign Governments on temporary official missions .

Article 10
Respect for laws and regulations
Without prejudice to their privileges and immunities, i t is the duty of all persons referred t o i n articles 7, a and 9 to respect the laws and regulations of the member of the Authority in whose te rritory they may be on the business of the Aut hority or through ' ... hose territory they may pass on such business. They also have a duty not to interfere in the internal affairs of that member .
Article 11
Laissez-passer and visas
1, Without pre j udice to the possibility for the Authority to issue its own travel documents, the States Parties to this Protocol s ha l l recognize and accept the United Nations laissez-passer issued to officials of the Authority.
2. Applications for visas (' ... here required ) from officials of the Authority shall be dealt with as speedily as possible. Applications for visas (where required) from officials of the Authority holding United Naticns laissezpasser shall be accompanied by a document confirming that they are travelling on the official business o f the Authority.
Article 12
Relatic::.shi::. bet· .. ·een the Headauarte rs Agr,ement and the Protocol
The provisions of this Protocol shall be complementary to the provisions of the Headquarters Agreement. I nsofar as any provision o f this Protocol relates to the same subject matter, the two provisions shal l , wherever po •• ible, be treated as complementary, so that both provisions shall be applicable and neither shall narrow the effect o f the other; but in any case of conflict, the provis ions of that Agreement sha l l prevai l .
Article 13
Sucple~entary agreemer.t
This Protocol shall in no way limit or prejudice the privileges and immunicie. which have been, or may hereafcer be, a ccorded to the Authority by any member of the Authority by r eason of che location in the territory of that member of the Authority'S headquarters or r egional centres or offices. This Protocol shall not be deemed to prevent the conclusion of supplemencary agr.ements between the Authority and any member o f the Authority.

Article 14
Settlement of dispute.
1. In connection with the implementation of the privileges and immunities granted under this Protocol, the Authority shal l make suitable provision for the proper settlement of:
(a) disputes of a private law character to which the Authority is a party;
(b) disputes involving any otficial of the Authority or any expert on mission for the Authority who by reason of his or her official position enjoys immunity, it immunity has not been waived by the Secretary-General.
2 . Any dispute between the Authority and a member of the Authority concerning the interpretation or application of this Protocol which is not settled by consultation, negotiation or other agreed mode of settlement within three months following a request by one of the parties to the dispute shall, at the request ot either party, be referred for a tinal and bindinq decision to a panel of three arbitrators:
'a) one to be nominated by the secretary-General, one to be nominated by the other party to the dispute and the third, who shall be Chairman of the panel, to be chosen by the first two arbitrators;
(b) if either party has failed to make its appointment of an arbitrator within two months of the appointment of an arbitrator by the other party, the Pre.ident of the International Tribunal for the Law of the Sea shall proceed to make such appointment. Should the first two arbitrators fail to agree upon the appointment of the third arbitrator within three months following the appointment of the first two arbitrators, the third arbitrator shall be chosen by the President of the International Tribunal for the Law of the Sea upon the request of the Secretary-General or the other party to the dispute.
Articl, 15
Signature

at the headquarters of the International Seabed Authority in Kingston, Jamaica , from 17 August until 28 August 1998 and aubsequently until 16 August 2000 at unit~d Nations Headquarters in New York.
Article 16
Ratification
This Protocol is subject to ratification, approval or acceptance. The instrument. of ratification, approval or acceptance shall be deposited with the Secretary-Ganeral of the United Nation •.
Article 17
Accelsion
Thi. Protocol shall remain open for accession by all members of the Authority. The instruments of acces.ion shall be depolited with the secretary-General of the United Naeion •.

Article 18
Entry into force
1 . The Protocol shall enter into force )0 days after the date of deposit of the tenth instrument of ratification , approval , acceptance or accession.
2 . For each member of the Authority which ratities, approves or accepts thi s Protocol or accedes thereto after the deposit of the tenth instrument of ratification, approval, acceptance or accession, this Protocol shall enter into force on the thirtieth day following the deposit of 'its instrument of ratification, approval, acceptance or accession .
Article 19
Provisional application
A State which intends to ratify, approve, accept or accede to this Protocol may at any time notify the depositary that it will apply this Protocol provisionally for a period not exceeding two years .
Article 20
penunciation
1 . A State Party may, by written notification addre.sed to the SecretaryGeneral of the united Nations, denounce this Protocol . The denunciation shall take etfect one year after the date of receipt of the n~t i fic.tion, unless the notification apecities a later date .
2 . The denunciation shall not in any way affect the duty of any State Party to fulfil any obligation embodied in this Protocol to which i t would be subject under international law independently of this Protocol .
Article 21
Depo,it.ry
The secretary-General of the United Nations shall be the depositary of this Protocol.
Article 22
Authentic texts
The arabic, Chinese, English , French, Rus.ian and spanish texts of this Protocol are equally authentic.

Art icle 10
RESPECT DES LO I S ET RB:lLDlENTS
Sans pr~judice de leurs privil~ges et immunit~s. toutes les personnes visees 8UX articles 7, 8 et 9 sont tenues de respecter les lois et reglements du membre de l'Autorit~ sur Ie terriloire duquel elles se trouvent ou par Ie territoire duquel elles transitent au service de I·AutoTit~. Elles sonl egalement tenues de s'abstenir de s'ingerer dans les affaires int~rieures de ce me.bre.
Article 11
LAISSEZ-PASSER ET VISAS
1. Salis prejuger de la possibilite que l'Autorite d6livre ses propres docu.ents de voyage, les ttats Parties au present Protocole reconnaissent et acceptent les laissez-passer des Nations Unies delivres aux fonctionnaires de l'Autorite.
2. RAPPORTS fNl'RE L' ACCORD DE S IaJE ET LE PROTOCOLE
Les dispositions du present Protocole co.pl~tent celles de l'Accord de si~ge. Dans la .esure ou une disposition du present Protooole et une disposition de l'Accord de si~ge portent sur Ie .e.e sujet, les deux di:)positions sont, chaque {t"lis que possible, considhees co..e ca.ple.entaires, de sorte qu'elles soient toutes de~~ applicables et qu'aucune d'elles "'ait sur l'autre un effet restrictif: toutefois, en cas de conflit. ce sont les dispositions de I 'Accord de si~ge qui l'e_portent.

ACCORDS ADDITIONNELS
Le present Protocole ne remet en cause ni ne restreint en rien les privileges et immunites que l'Autorite a pu obtenir, au qu 'e lle pourrait obtenir par 18 suite , d'un de ses membres en raison de 1 'implantation de son s iege au de centres ou bureaux r egionaux sur Ie territoire de ce dernier. II n'interdit pas la conclusion d'accords additionnels entre l'Autorite et l'un ou I 'autre de ses membres.
Article 14
ROOLEMENT DES D I FFllRENDS
1. Concemant la mise en prat ique des privi leges el immuni tes accordes en vertu du present Protocole, l 'Autorite prend des dispositions appropriees en vue du reglement satisfai sant :
a) Des differenus de droit prive auxquels elle est partie;
b) Des differends mettflnt en cause tout fonctionnaire de l'Autorite ou tout expert en mi ss ion pour Ie compte de l'Autorite qui en raison de ses fonctions officielles jouit de l'immunite, si celle-ci n'a pas ete levee par Ie Secretaire general.
2. Tout differend I!ntre l 'Autorite et 1 'un de ses melllbres concernant l'interpretation ou l'appiication du present Protocole qui n'est pas regie par voie de consultation au de negociation ou par un autre mode convenu de reglement des differends dans les trois mois suivant Ie depOt d'une demande par t'une des parties au differend est renvoye, A la demande de l'une au 1 'autre des parties, devant un college de trois arbitres dont 18 sentence sera definitive et contraignante :
a) L'un des arbitres devant etre designe par Ie Secretaire general, un deuxieme devant etre designe par 1 'autre partie au differend et Ie troisi ~me, qui assurera la presidence, devant etre choisi par les deux premiers arbitres;
b) Si I 'une au les deux n~i s suivant
I 'autre des parties n'a pas designe d'arbitre dans la designation d'un arbitre par I 'autre partie, Ie

Le present Protocole sera cuvert A la signature de tous les me.bres d~ l'Autorite au siege de l ' Autorite internationale des fonds .arins a Kingston (Ja~lque) du 17 au 28 aout 1998, puis au Siege de l'Organisation des Nations Unies A New York jusqu ' au 16 aout 2000.

RATIfiCATION
Le present Protocole est soumis a ratification, approbation ou acceptation. Les instruments de ratification, d'approbation ou d'scceptation seront deposes aupres du Secreta ire general de I 'Organj sat ion des Nations Unies.

Le present Protocole restera ouvert A 1 'adhesion de tous les .eabres de l'Autorite. Les instruments d'adhesion seront deposes aupres du Secr~taire general de I ' Organisation des Nations Unies.

ENTRIlE EN VIGUEUR
1. Le present Protocole entre.a en vigueur 30 jours apres la date de depOt du dixieme instrument de ratification, d'approbation. d ' acceptation ou d'adhesion.

Pour chaque me.bre de l'Autorite qui Ie ratifiera . l'approuvera. l'acceptera ou y adherera apres Ie depOt du dixieme instrument de ratification, d'approbation, d ' acceptation ou d ' adhesion, Ie present Protocole entrers en vigueur Ie trentieme jour suivant la date de depOt de I'instru~nt de ratification. d'approbation . d'acceptation ou d'adhesion.
Article 19
APPLICATION PROVISOIRE
Tout Etat qui a J ' intention de ratifier, d ' approuver ou d'accepter Ie present Protocole ou d'y adherer pourra, a tout moment, aviser Ie depositaire qu'il I'appliquera A titre provisoire pendant une ~riode ne pouvant exceder deux sos .
Article 20
OtNoNCIATION
1. Tout Etat Partie pourra denoncer Ie present Protocole par voie de notification ecrite adressee au Secretaire general de l ' Organisation des Nations Unies. La denonciation prendra efret un an apres la date de reception de Is notification. a moins que celle-ci n'indique une date ulterieure.
2. En cas de denonciation, tout Etat Partie demeurera tenu de s'acquitter de toute obligation prevue dans Ie present Protocole A laquelle I'astreint Ie droit international independamment du Protocoie.

PROTOCOLO SOBRE LOS PRIVILEGIOS E INMUNIDADES DE LA AUTORIDAD IN'I'ERNACIONAL DE LOS roNDOS MARINOS
Los Estados partes en e1 presente Protocolo,
Considerando que en la Convenci6n de laa Naciones Unidas sobre el Derecho del Mar se establece la Autoridad Internacional de loa Fondos Marinos,
Recordando que en el articulo 176 de la Convenci6n de las Naciones Unidas sobre el Derecho del Mar se dispone que la Autoridad tendr! personalidad juridica internacional y la capacidad juridica necesaria para el desempefto de sus funciones y el log_~ de sus finea,
Tomando nota de que en el articulo 177 de la Convenci6n de las Naciones Unidas sobre el Derecho del Mar ae dispone que la Autoridad gozar! en el territorio de cada Estado parte de los privilegios e inmunidades establecidos en la subsecci6n G de la secci6n 4 de la Parte XI de la Convenci6n y que los privilegios e inmunidades correapondientes a la Empresa seriD los establecidos en el articulo 13 del anexo IV,
RecoDociendo que para el funcionamiento adecuado de la Autoridad de los Fondos Marinos ae necesitan ciertos privilegios e inmunidades adicionales,
Han convenido en 10 siguiente:
Articulo 1
T6rminos empleadoe
A loa efectoa del presente Protocolo:
al Por HAutoridad" se entenderA la Autoridad Internacional de los Fondos Marinos;
b) Por "Convenci6n" Unidas del Derecho del Mar
oe de
entendera la Convenei6n de las Naciones 10 de diciembre de 1982;
c) Por "Acuerdo " se entendera el relativo a la aplicaci6n de la Parte XI de la Convenci6n de laa Naciones Unidas sabre el Derecho del Mar de 10 de dieiembre de 1982. De conformidad con el Acuerdo, sus disposieiones y la Parte XI de la Convenci6n ae interpretarAn y aplicarAn conjuotamente como un tinieo instrumento. El presente Protocolo y las referencias que en 61 se hacen a la Convenci6n se interpretaran y apliearAn en consecuencia;

d) Por "Empresa" se entender~ el 6rgano de la Autoridad que se define en la Convenci6ni
e) Por "miembro de 1a Autoridad" se entendera :
i) Todo Estado parte en la Convenci6n; y
ii) Todo Estado 0 entidad que sea miembro dd la Autoridad con carActer provisional de conformidad con el parrafo 12 a) de la secci6n 1 del Anexo del Acuerdo;
f) Por "representantes" se entender~ los representantes titulares, 108 repreaentantea auplentes, los asesores, los expertos t~cnicos y los secretarios de las delegaciones;
g) Por "Secretario General" ae entendera el Secretario General de la Autoridad Internacional de los Fondos Marinos.
Articulo 2
Disposici6n general
sin per]u1cio de la condici6n juridica y de los privilegios e inmunidadea de 1a Autoridad y de la Empresa , estab1ecidos respectivamente en 1a subsecci6n G de 1a secci6n 4 de la Parte XI y en e1 articulo 13 del Anexo IV de la Convenci6n, los Estados partes en el presente Protoc010 reconoceran a la Autoridad y a sus 6rganos, a los representantes de los miembros de la Autoridad, a los funcionarios de esta y a los expertos en miai6n para ella, l oa privilegios e inmunidades que se indican en ~l.
Articulo 3
Personalidad ;uridica de la Autoridad
1 . La Autoridad tendra personalidad juridica y tendra capacidad juridica para:
a) Celebrar contratoa;
b) Adquirir y enajenar bienes muebles e inmuebles;
c) Ser parte en procedimientos judiciales .

Los locales de la Autoridad serAn inviolables .
Articulo 5
Facilidades financieras de la Autoridad
1. La Autoridad no estara sometida a ningUn tipo de controles , reglamentaciones 0 moratorias de indole financiera y podra libremente :
a) Comprar, p~r los cauces autorizados , monedas para si 0 para disponer de elIas;
b) Poseer fondos, valores, oro, metales preciosos 0 moneda de cualquier clase y tener cuentas en cualquier moneda ;
cJ Transferir sus fondos, valores, oro 0 monedas de un pais a otro o dentro de cUalquier pais y convertir a otra moneda cualquiera de las que posea .
2. La Autoridad, al ejercer los derechos establecidos en el parrafo precedente , tendra debidamente en cuenta las observaciones que formulen los gobiernos de los miembros de la Autoridad , en 1a medida en que pueda dar1es efecto sin de.medro de sus propios intereses.

La Autoridad tendr' derecho a enarbolar su pabe116n y exhibir s u emblema en sus locales y en 108 vehiculos que se utilicen con fines oficiales.
Articulo 7
Representantes de los miembros de 1& bUtoridad
1 . Los representantes de los miembros de la Autoridad que asistan a reuniones convocadas por 6sta gozaran, mientras ejerzan sus funciones y en el curso de los viajes de ida al lugar de reuni6n y de vuelta de ~ste, de los privilegios e inmunidades siguientes :
a ) Inmunidad judicial respecto de las declaraciones que formulen verbaimente 0 p~r eserito y de los aetos que realicen en el ejercicio de

sus funciones, salvo en la medida en que el miembro que representan renuncie expresamente a dicha inmunidad en un caso determinado;
b) Inmunidad contra detenci6n 0 prisi6n y las mismas inmunidades y facilidades respecto de su equipaje personal que se reconocen a los agentes diplomaticos;
c) Inviolabilidad de los papeles y documentos;
d) Derecho a usar mediante correo especial
claves y a recibir documentos o en valijas selladas;
o correspondencia
e) Exenci6n, para ellos y sus c6nyuges, de las restricciones en materia de inmigraci6n, de las formalidades de registro de extranjeros y de la obligaci6n de prestar cualquier servicio de caracter nacional;
f) Las mismas faci l idades respecto de las restricciones cambiarias que se reconozcan a los represent antes de gobiernos extranjeros de categorla comparable que se encuentren en misi6n oficial temporal .
2. A fin de que los representantes de los miembros de la Autoridad gocen de plena libertad de expresi6n e independencia en el desempeno de su cometido, seguiran gozando de inmunidad judicial respecto de todos los actos que hayan realizado en el desempeno de sus funciones aun cuando hayan dejado de ser represent antes de miembros de la Autoridad.
3. En los casos en que proceda aplicar algUn tipo de impuesto en raz6n de la residencia. no se consideraran periodos de residencia aquellos durante los cuales los represent antes de los miembros de la Autoridad que asistan a las reuniones de esta hayan permanecido en el territorio de un miembro de la Autoridad a los efectos del desempeno de sus funciones .
4. Loa privilegios e inmunidades no se confieren a l os representantes de los miembros de la Autoridad para su propio beneficio, sino para salvaguardar el ejercicio independiente de sus funciones en relaci6n con la Autoridad . En consecuencia, los miembros de la Autoridad tendran el derecho y el deber de renunciar a la inmunidad de sus represent antes en todos los casos en que, a su juicio. ella obstaculizaria la acci6n de la justicia, y siempre que tal renuncia no redunde en perjuicio de la finalidad para la cual la inmunidad haya sido concedida.
5 . Los vehlculos de los representantes de los miembros de 1a Autoridad 0 que ~stos utilicen tendran segura contra terceros con arreglo a las leyes y reglamentos del Estado donde se utilicen.
6. Las disposiciones de los parrafos 1 , 2 Y 3 no seran aplicables a la relaci6n que exista entre un representante y las autoridades del miembro de 1& Autoridad del que aqu~l sea nacional 0 del que sea 0 haya side representante .

Artlculo 8
FuncionariQs
1. El Secretario General determinara las categorias de funciona r ios a quienes se aplicara 10 dispuesto en el parrafo 2 del presente articulo y las presentara a la Asamblea . Posteriormente las categorias seran comunicadas a los gobiernos de todos los miembros de la Autoridad. Los n ombres de los funcionarios incluidos en esas categorias seran dados a conocer peri6dicamente a los gobiernos de los miemhros de la Autoridad.
2. Los funcionarios de la Autoridad, cualquiera que sea su nacionalidad, gozaran de l os s iguientes privilegios e inmunidades:
a) I nmunidad judicial respecto de las declaraciones que f ormulen verbalmente 0 por escrito y de los act os que realicen en el ejercicio de sus funciones oficiales;
b) Inmunidad contra detenci6n 0 prisi6n por los a ctos que realicen en el ejercicio de s u s funciones oficiales;
c) Exenci6n del pago de impuestos sobre los sueldos, emolumentos y cualquier otro pago que reciban de la Autoridad;
d) Inmunidad respecto de la obligaci6n de prestar cualquier servicio de caracter nacional, si bien , en relaci6n con los Estados de su nacionalidad , eaa inmunidad se limitar a a loa funcionar i os de la Autoridad cuy08 nombres , por raz6n de sus funciones, figuren en una lista preparada por el Secretario General y aprobada por el Estado interesado. 5i o tros funcionarioa de la Autoridad fueran l lamados a pres tar serviciOB nacionales , e l Estado interesado concedera, a petici6n del Secretario General , las pr6rrogas necesarias para evitar que se interrumpa la realizaci6n de trabajos esenciales;
e ) Exenci6n, para ellos, sus c6nyuges y sus familiares a cargo, de restricciones en materia de inmigraci6n y de las formalidades de registro de extranjeros;
f ) Los mismos privilegios respe cto de las facilidades cambiarias que los reconocidos a los funcionarios de categoria equivalente que pertenezc an a las misiones diplomaticaa acreditadas ante l os gobiernos de que se trate ;
g ) Derecho a la importaci6n libre de derechos de sus muebles y efectos en e 1 momento en que ocupen por primera vez el cargo en e1 pais de que se trate ;
h ) Exenci6n de 1a inspecci6n de su equipaje perso nal salvo que hubiere motivos fundados para pensar que ese equipaje c omp r ende articulos no destinados al uao personal 0 cuya importaci6n 0 exportaci6n esta

prohibida por la ley 0 sujeta a las normas de cuarentena de la Parte interesada. En tal caso, la inspeccion se hara en presencia del funcionario y, en el caso del equipaje oficial, en presencia del Secretario General 0 su represent ante autorizado;
i) Las mismas facilidades de repatriaci6n para ellos, sus c6nyuges y sus familiares a cargo, que las concedidas a los miembros de las misiones diplomaticas en tiempos de crisis internacionales.
3. Ademas de los privilegios e inmunidades que se indican en el parrafo 2, se reconoceran al Secretario General, a qui en 10 represente en su ausenciQ y al Director General de la Empre9a y a sus conyuges e hijos menores los privilegios y las inmunidades, exenciones y facilidades que se reconocen a los enviados diplomaticos de conformidad con el derecho internacional.
4. Los privilegios e inmunidades no se confieren a los funcionarios para su propio beneficia sino para salvaguardar el ejercicio independiente de sus funciones en relacion con la Autoridad. El Secretario General tendra el derecho y el deber de renunciar a la inmunidad de un funcionario en todos l os casos en que, a su juicio, ella obstaculizaria la acci6n de la justicia y siempre que dicha renuncia no redunde en perjuicio de los intereses de la Autoridad. En el caso del secretario General, la Asamblea tendra el derecho de renunciar a la inmunidad.
5. La Autoridad cooperara en todo momento con las autoridades competentes de los miembros de la Autoridad a fin de facilitar la buena administraci6n de la justicia, velar por el cumplimiento de las ordenanzas de policia e impedir abusos en relaci6n con los privilegios, inmunidades y facilidades a que se hace referencia en el presente articulo.
6. Los funcionarios de la Auto ridad contrataran con arreglo a las leyes y reglamentos del Estado de que se trate, un segura contra terceros para los vehiculos que utilicen 0 que sean de su propiedad.
Articulo 9
Expertos en misi6n para la Autoridad
1. Los expertos (aparte de los funcionarios comprendidos en el articulo a) que desempenen misiones para la Autoridad gozaran de privilegios e inmunidades que sean necesarios para el ejercicio independiente de sus funciones durante el periodo que abarque la que incluira el tiempo de viajes relacionados con las misiones. especial, gozar~n de:

a) Inmunidad de detenci6n 0 prisi6n y de confiscaci6n de su equipa je personal;

b) Inmunidad judicial de toda indole con respeeto a las declaraciones que formulen verbal mente 0 por escrito y a los actos que realicen en el desempeno de sus funciones. Esta inmunidad continuarA aunque hayan dejado de desempenar misiones para la Autoridad;
c) Inviolabilidad de los papeles y documentos;
d) Para los fines de comunicarse con la Autoridad, el derecho a uti1izar claves y a recibir documentos y correspondencia por cor reo especial 0 en valijas seUadas;
e) Exenc i6n de impuestos respecto de los sueldos, emolumentos y otros pagos que pereiban de la Autoridad . Esta disposici6n reg irA entre un experto y el miembro de la Autoridad del eual sea nacional;
f ) Las mismas facilidades con respeeto a las restricciones monetarias 0 cambiarias que se reconozcan a los represent antes de gobiernos extranjeros en misi6n oficial temporal.
2. Los privilegios e inmunidades no se confieren a los expel·toa para au propio beneficio aino para salvaguardar el ejercicio independiente de sus funciones en relaci6n con la Autoridad. E1 Secretario General tendrt el derecho y el deber de renunciar a 1a inmunidad de un experto en los casos en que, a au juicio, ella obstaculizaria la acei6n de la juaticia y siempre que la renuneia no redunde en perjuicio de los intereses de la Autoridad.
Articulo 10
Respeto de leyes y reglamentoa
Sin perjuicio de sus privilegios e inmunidades, todas las personas a que se hace referencia en los articulos 7, 8 Y 9 tienen el deber de respetar las leyes y los reglamentos de los Estados partes en cuyo territorio ejerzan funciones relaeionadas con la Autoridad 0 a trav~s de cuyo territorio deban pasar en el ejercicio de esas funei ones. Tambi~n
estAn obligadas a no inmiscuirse en los asuntos internos de eae Estado.
Articulo 11
Laissez-passer y visados
1 . Sin perjuicio de 1a posibi1idad de que 1a Autoridad expida sus propios doeumentos de viaje, los Estados partes en e1 presente Protocolo reconocerAn y aceptarAn los laissez-passer de las Naciones Unidas expedidos a nombre de funcionarios de la Autoridad.

2. Las solicitudes de visado (cuando ~ste sea necesario) que present en funcionarios de 1a Autoridad ser~n tramitadas con 1a mayor di1igencia posible. Las solicitudes de visado (cuando ~ste s ea necesario) que present en funciona rios de la Autoridad que sean titulares de laissezpasser expedidos par las Naciones Unidas estaran acompanadas de un documento en el que Be confirme que el viaje obedece a asuntos de la Autoridad.
Articulo 12
Relaci6n entre el Acuerdo relativo a la sede y e1 ProtQcQlo
Las disposiciones del presente Protocolo ser~n complementarias de las del Acuerdo relativo a la sede. Cuando una disposici6n del protocoiO se refiera al mismo asunto que una disposici6n del Acuerdo, ambas se considerarAn, en 10 posible, complementarias, de manera que las dos serAn aplicables y ninguna limitara la eficacia de la otra. En caso de discrepancia, sin embargo, prevalecerAn las disposiciones del Acuerdo.
Articulo 13
Acuerdos complementarios
El presente Protocolo no redundarA en modo alguno en detrimento los privilegios e inmunidades que haya reconocido 0 recono zca en 10

Articulo 14
Arreglo de controversias
I, Respecto de la aplicaci6n de los privilegios e inmunidades reconocidos en el presente Protocolo, la Autoridad t omarA las disposiciones del caso para el arreglo satisfactorio de las controversias;
a) De derecho privado en que sea parte la Autoridad;
b ) Que se refieran a un funcionario de la Autoridad o ' a un experto que forme parte de una misi6n de ~sta que en raz6n de eu cargo oficial gocen de inmunidad, 9i el Secretario General no hubiera renunciado a ella.
2. Las respecto

se resuelvan mediante consultas, negociaciones u otro media de arreglo convenido dentro de los tres meses siguientes a la presentaci6n de una solicitud par una de las partes en la controversia seran sometidas, a solicitud de una de las partes y para su fallo definitivo y obligatorio, a un grupo integrado por tres arbitros;
a) Uno por el Estado arbitros ;
de los cuales sera elegido por el Secretario General, uno parte y el tercero, quien 10 presidira, por los des primeros
b) 5i una de las partes en la controversia no hubiese designado arbitro en el plazo de dos meses contados desde la designaci6n de arbitro por la otra parte, el Presidente del Tribunal Internacional del Derecho del Mar procedera a efectuar el nombramiento. En caso de que los dos primeros arbitros no convinieran en el nombramiento de un tercero dentro de los tres meses siguientes a sus nombramientos, el tercer arbitro sera elegido por el Presidente del Tribunal Internaciona1 del Derecho del Mar a solicitud del Secretario General 0 de la otra parte en la controversia.
Articul o 15
El presente Protocolo estara abierta a la firma de tados los miembros de la Autoridad en la Sede de la Auto ridad Internacional de los Fandos Marinos en Kingston (Jamaica ) del 17 al 28 de agosto de 1998 y, posteriormente, en la Sede las Naciones Unidas en Nueva York hasta e1 16 de agosto del ana 2000.
Art iculo 16
Ratificaci6n
El presente Protocolo esta sujeto a ratificaci6n, aprobaci6n a aceptaci6n. Los instrumentos de ratificaci6n. aprobaci6n 0 aceptaci6n seran depasitados en poder del Secretario General de las Naciones Unidas.
ArticulQ 17
Aciheai6n
El presente Protocolo quedara abierto a la adhesi6n de todos los miembros de la Autoridad. Los instrumentos de adhesi6n seran depositados en poder del Secretario General de las Naciones Unidas.

Articulo 18
Entrada en vigor
1 . El Protocolo entrara en vigor 30 diaa despues de la fecha en que se deposite el de c imo instrumento de ratificaci6n, ap robaci6n, aceptaci6n 0 adhesi6n .
2. Respecto de cada miembro de la Auto ridad que ratifique, apruebe 0 acepte el presente Protocolo 0 se adhiera a el despues de depos i tarse el decimo instrumento de ratificaci6n, aprobaci6n, a cepta ci6n 0 adhesi6n, el presente Protocolo entrara en vigor 30 d i as despues del dep6s ito de su instrumento de ratificaci6n, aprobaci6n, aceptaci6n 0 adhesi6n .
Articulo 19
Aplicaci6n provisional
El Es t ado que tenga la intenci6n de ratificar, aprobar 0 aceptar el presente Protocolo 0 adherirse a el podr~ en cUalquier momento notificar a1 depositario que 10 aplicara provisiona1mente por un perfodo no superior ados anos .
Articulo 20
Denuncia
1. Todo Estado parte podra, por notificaci6n escrita dirigida al Secretario General de las Naciones Unidas, denunciar el presente Protocolo . La denuncia surtira efecto un ano despues de la fecha de recepci6n de la notificaci6n , salvo que en esta se indique una fecha ulterior .
2. La denuncia no afectar~ en modo alguno al deber de tod o Estado parte de cumplir las o bligacio nes enunciadas en el presente Protoco10 que, con prescindencia de este, Ie incumbieren con arreglo al derecho internacional .
Articulo 21
Depositar io
El Secretario General de l as Naciones Unidas ser~ depositario del presente Protocolo .

Textos autenticos
Los texto s en arabe, chino, espafiol, frances, ingles y ruso de l presente Protocolo ser a n igualmente autenticos.
