Subject: Appointment of Tree Authority

Whereas, the Maharashtra Industrial Development Corporation has been appointed as

the Special Planning Authority (hereinafter referred to as 'The said Authority'), by virtue of

provisions ofsub section 1A of section 40 of the Maharashtra Regional and Town Planning

Act, 1966 or for any area where Chapter VI of Maharashtra Industrial Development Act,1961

applies or for any other area comprising Gort. Land transferred to the Maharashtra Industrial

Development Corporation (hereinafter refened to as 'MIDC')

And whereas, under section 3 of Maharashtra (Urban Area) Protection and

Preservation of Trees Act, 1975 (hereinafter referred to as 'the said act'), the said authority

can constitute a Tree Authority for giving permission for Protection and Preserwation ofTrees

in jurisdiction of said authority.

And whereas, it is necessary to constitute a Tree Authority in accordance with the

provision of the said act for Protection and Preservation of Trees and granting permissions

expeditiously within the jurisdiction of Special Planning Authority.

Therefore, as per section 3 ofthe said act, MIDC constitutes its Tree Authority

comprising following members-

As per section 5 of the said act, Dy. Engiheer/ Executive Engineer and Dy. Planner,

Assistant Planner functioning as SPA for particular area are appointed as Tree Offrcer for the

mea under theil jurisdiction.

The functions of Tree Authority and Tree Officer are as per section 7 of the said Act.

As and when required Tree Officer shall submit the proposal to Tree Authority for the

approval.

In every municipal area, theChief Ofticer of thd municipal council concemed shall be Tree Officer, and the Councilmay appoint one or more of its other officers as Tree Officers.
