NEW DELHI, Dec 6:

The Delhi High Court hassought the Centre's responseon a plea seeking to ensure theRight to Education for chil-dren with disabilities.

A bench of Acting ChiefJustice Gita Mittal and JusticeC Hari Shankar issued noticeto the Centre and the Ministryof Social Justice andEmpowerment, asking them tofile a response within fourweeks and listed the matter onMarch 6 next year.

The plea, filed by VidhiCentre for Legal Policy, saidIndia, having ratified theUnited Nation Convention onRights of Persons withDisabilities, was under anobligation to make 'inclusiveeducation' effective in allschools in the country.

Inclusive education is asystem of education whereinstudents, with or without dis-ability, learn together and thesystem of teaching and learn-ing is suitably adapted.

The petition has allegedthat non-inclusion of normsand standards specific to chil-dren with disabilities in theRight to Education (RTE) Actresults in a situation whereschools, which are required toobtain recognition under theAct, are under no obligation toensure that such facilities areprovided by them to the chil-dren with disabilities.

"The right to education ofchildren with disabilitiesmakes it the government'sobligation to ensure that

schools provide the requisitefacilities to meet the learningneeds of different types of stu-dents with disabilities," it said.

In order to satisfy the com-mitment made under the UNConvention, provisions relat-ed to 'inclusive education'ought to have been includedunder the RTE Act, the pleasaid.

"However, by only ensur-ing access to mainstreamschools without clearly speci-fying norms and standards forinclusion, individualised sup-port and reasonable accommo-dation, the RTE Act is merelypaying lip service to the con-cept of inclusive education," itsaid.

The petition sought toissue directions to the Centreto introduce norms and stan-dards of inclusive educationwithin the ambit of the RTEAct. It also sought ensuringthat the requirements of inclu-sive education are met by allschools and enforced in caseof non-compliance.

The principle of inclusiveeducation was adopted in2006 by the United Nationsunder the United NationConvention on Rights ofPersons with Disabilities.India had ratified it in 2007.

Article 24 of the UNConvention provides thatState parties will ensure theprovision of an inclusive edu-cation system at all levels forrealising the right to educationand on the basis of equalopportunity. (PTI)
