ORDER Whereas, uncontrolled extraction of Minerals like Sand, Bajri and

RBM from local Rivers/Nallahs like Devak, Basantar and Balole etc andalso in the close vicinity of Motorable as well as Rail Bridges is likely tocause damage to the basements and super-structures of thesebridges;

Whereas, Section 3(2) of Jammu & Kashmir Water Resources (reg-ulation and Management Act 2010) states that no person shall use anywater from any source (Surface or ground) or extract any material fromsuch water sources except in accordance with the provisions of Act.Further, as per norms of the Geology and Mining Department noextraction is allowed near the motorable and Railway bridges within adistance of 500 Mtrs. Both upstream and downstream of these bridgesand major hydraulic structures and 150 Mtrs. upstream and 100 Mtrs.downstream of the culverts on the local nallahs;

Whereas, this office vide order No. DMS/JC/269/15-16/269/17-18/896-917 dated 19-7-2017, issued under section 144 Cr. PC hasalready imposed ban on extraction of minor minerals from rivers/nal-lahs within the periphery of 01 Km. of all major structures like bridges,aqueducts, siphons, protection bunds and also in local nallahs within adistance of 150 Mtrs. periphery of culverts/vented causeways withinthe territorial limits of this District;

Whereas, it is imperative that illegal mining/extraction activitiesmentioned above which are prejudicial to the maintenance of publichealth and safety shall be prevented/controlled for common good;

Now, therefore in view of the above mentioned facts, I, SheetalNanda, IAS, District Magistrate, Samba, in exercise of powers vestedin me under section 144 of Cr. P.C. do hereby extend the ban alreadyimposed on the following for a further period of two months from thedate of issuance of this order:-

(i) Excavation of minor minerals like sand, Bajri and RBM fromRivers/Nallahs within the periphery of 01 Km. upstream anddownstream of all major structures like bridges, aqueducts,siphons, protection bunds and also in local nallahs within dis-tance of 150 Mtrs. Upstream and downstream of culverts/vent-ed causeways in District Samba.

(ii) Lifting of Clay, Sand, Bajri and RBM from Khasra No. 1734 ofvillage Birpur upper side of Railway line and Khasra No. 815 ofvillage Kartholi, Tehsil Bari-Brahmana and District Samba.

(iii) Excavation of minor minerals like sand, Bajri and RBM withinthe distance of 100 ft. from earthen "Bunds" alongside the RiverDevak downstream from Bridge at National Highway to VillageNanga on right Bank and Chak Bhim on the left bank of theriver.

(iv) Ban Ban on excavation of minor minerals like sand, Bajri etc.out of Devak river from Purmandal downstream to Utterbehni.

(v) Ban of excavation of minor minerals like Sand, Bajri, RBM etc.within periphery of 01 Km. upstream and downstream ofmotorable and Railway bridges of Basanter river.
