153 MINUTES EXETER TOWNSHIP BOARD OF SUPERVISORS MEETING JANUARY 14, 2013 A Regular Meeting of the Exeter Township Board of Supervisors was called to order on Monday, January 14, 2013, at 7:00 P.M. in the Township Building by Chairman Donald R. Rogosky, P.E., Great Valley Consultants Pledge of Allegiance The Meeting was opened with the recitation of the Pledge of Allegiance. Public Comment Joseph Cox, 71 Shelbourne Road, proposed a second amendment preservation ordinance, read the proposed ordinance and asked the Board to seriously consider its adoption. Mr. Smith stated the Board did not have the authority to have a referendum on an issue because the State says you can't do it. Mr. Bukowski stated the public debate that is ongoing did not include discussion of amending the Second Amendment and he had no interest in passing an ordinance in the Township as. the Second Amendment is the law of the land and the Township could not do anything to violate that law. He also noted the Board had taken an oath to protect and defend the law. Mr. Bukowski noted Mr. Cox's proposal would be a part of the minutes on the Township website. Louise Swartley, 31 Troxel Road, addressed the proposed changes to the Agricultural Preservation Zone (AP). She would like to keep the AP Zoning in place as more people than the Board realized wanted to preserve agricultural space in this community and she would not like to have too many doors remain open. She suggested using the Solicitor to review what it would mean. She wanted the Board to keep agricultural preservation and not to listen to business development people. Mr. Bukowski asked if Mrs. Swartley had something in mind; to which she responded she had talked with a member of the Planning Commission and was looking carefully at the language so the agricultural zone would not be put in jeopardy when changes were made. Mr. Bukowski asked her to identify which wording was problematic for her to which she responded she would do that. Mr. Wilson suggested not just questioning one person only and that she should bring her concerns to the entire Planning Commission so there could be no misunderstanding of her intent.

EXETER TOWNSHIP BOARD OF SUPERVISORS MEETING JANUARY 14, 2013

A Regular Meeting of the Exeter Township Board of Supervisors was called to order on Monday, January 14, 2013, at 7:00 P.M. in the Township Building by Chairman Donald R. Wilson.

Pledge of Allegiance The Meeting was opened with the recitation of the Pledge of Allegiance.

Public Comment

Joseph Cox, 71 Shelbourne Road, proposed a second amendment preservation ordinance, read the proposed ordinance and asked the Board to seriously consider its adoption. Mr. Smith stated the Board did not have the authority to have a referendum on an issue because the State says you can't do it. Mr. Bukowski stated the public debate that is ongoing did not include discussion of amending the Second Amendment and he had no interest in passing an ordinance in the Township as. the Second Amendment is the law of the land and the Township could not do anything to violate that law. He also noted the Board had taken an oath to protect and defend the law. Mr. Bukowski noted Mr. Cox's proposal would be a part of the minutes on the Township website.

Minutes of December 17, 2012 Regular Meeting and the January 7, 2013 Reorganizational Meeting. MOTIONby Mr. Lloyd, seconded by Mrs. Starr, to approve the minutes of the December 17, 2012 regular meeting and the January 7, 2013 reorganizational meeting as presented. Motion carried unanimously.

Disbursements MOTIONby Mr. Smith, seconded by Mr. Lloyd, to approve for payment the bills presented on the Disbursements List dated January 11th in the amounts of $212,501.58 in the General Fund; $9,142.74 in the Utility Fund; $3,185.00 in the Fire Services Fund; $526,519.32 in the Sewer Fund; $2,308.10 in the Capital Projects - GOB 2009 Fund; $408,340.75 in the Debt Service Fund; $145.00 in the Park Improvement Fund; $6,501.42 in the State Fund; and, $1,014.88 in the Traffic Improvements Fund. Motion carried unanimously. O

CO Communications CD A list of incoming and outgoing communications was presented for the Board's review; and, is available for public inspection in the Township Office.

Department Reports The Engineering, Police, Wastewater, Highway and Parks & Recreation Monthly Reports were submitted for the Board's review.

Planning Commission Annual Report MOTIONby Mr. Lloyd, seconded by Mrs. Starr, to accept the Planning Commission's 2012 Annual Report. Motion carried with Mrs. Starr, Mr. Smith, Mr. Lloyd and Mr. Bukowski voting in favor, and Mr. Wilson abstained. Mr. Bukowski thanked the Planning Commission for commencing the ordinance review and stated he looked forward to continuing the same.

2013 RCC Tree Replacement Bid Mr. Bingaman stated there was only one bid and it was $20,000 higher than the original costs coming in at $118,500 from Buddies Nursery. The Solicitor stated the Board could either accept it or reject it if it wanted to seek more bids. Lisa VanderLaan, 5560 Boyertown Pike, stated at a budget meeting the Board felt it would cost $50,000 to handle the tree replacement at the Country Club and felt the Board should have bid the trees prior to removal. She asked them to consider a re-bid to include a broader spectrum and different species of trees with a greater life span than those chosen. Brian Ahrens, from A&M Golf Management, explained why he chose the trees, which are American Red Maple, and disagreed with Mrs. VanderLaan's assessment of them. Mrs. VanderLaan in answer to Mr. Bukowski's question stated the chosen trees were fast growing maples which were the types with weaker limbs that were susceptible to storm damage. Mr. Ahrens stated there was no ideal tree. Mrs. Starr noted the trees chosen were on the Township's approved tree list. Mr. Bukowski asked what would be done this year to which Mr. Ahrens stated 18 trees would be planted this year even though purchase and planting was not broken up over the length of time covered by the bid. He noted the bid covered the entire planting process including preparation of the planting sites. Mrs. VanderLaan asked that the 8" caliper trees be reduced in size to save money. There was a brief discussion on accepting only a portion of the bid or re-biding. It was noted the funding came from the Exeter Commons Environmental Fund. Mr. Lloyd asked Mr. Hamm if the removed trees were in good condition, to which Mr. Hamm responded he felt they were. Mr. Lloyd questioned the ability of the arborist as his judgment was not correct. Mr. Ahrens stated he intentionally hired an arborist he did not know personally and told them they would not get the job to remove or replace the trees.

Mr. Ahrens stated all the trees in question had signs of rot and storm damage. He stated his company followed procedure regarding when they had legitimate concerns. He stated they were to come to the Board and that was what they did. Two Board members noted the company providing the trees was an Exeter Township company. MOTIONby Mr. Bukowski, seconded by Mrs. Starr, to accept the bid of $118,500 for the purchase and planting of 44 trees from Buddies Nursery, L.P. for the replacement trees to be planted at the Reading Country Club. Motion carried with Mr. Smith, Mr. Bukowski and Mrs. Starr voted in favor, and Mr. Wilson and Mr. Lloyd opposed.

UNFINISHED BUSINESS

Proposed Historical Controls Mrs. VanderLaan presented a basic outline of the language she was suggesting be used regarding the Historical Preservation Overlay District. She stated the Solicitor would have to review her language to make sure it was appropriate. The Board thanked her for her efforts. MOTIONby Mr. Bukowski, seconded by Mr. Smith, to forward the draft ordinance to the Planning Commission for the crafting of an ordinance for consideration. Motion carried unanimously.

2013 Fee Schedule #2013-04 Mr. Bingaman stated Mr. Seltzer, from Parks & Recreation, had proposed increasing the fees for various events and rentals. He also stated a change had been previously discussed in the annual renewals for zoning permits for home occupations with neighborhood impacts and those with no impact. Mr. Lloyd questioned the rationale for changes to the Parks Department fees to which Mr. Bingaman stated it would generate more income and they had not been changed for a few years. Mr. Smith stated he would like to see no fees for no impact home occupations. Mr. Bukowski felt encouraging home occupation businesses was the way to go so no fees would be acceptable to him. Mrs. Starr suggested $100 for neighborhood impacts, $50 for no impact with no annual renewal fees. She stated this way the Board would have a record of who was operating businesses. Mr. Bukowski suggested going lower on the neighborhood impact and none on the no impact. Mr. Wilson suggested home occupations, both with neighborhood impact and no impact, be $50 with no renewal fees. The Board after more discussion agreed. Mrs. VanderLaan suggested changing the burning permit fees as it was counterproductive. Mrs. Swartley stated agriculture burning was exempt. Mrs. Starr suggested contacting the DEP to determine if agricultural burning was exempt from regulations. Mrs. Starr stated the purpose for controlling burning was to control it in residential areas, to encourage environmental preservation and to encourage people to bring their brush to Trout Run. Fire Chief Robert Jordan stated no revenue was received by the Fire Department from burning permits and they were not sure there were inspections done. MOTIONby Mr. Bukowski, seconded by Mrs. Starr, to adopt the 2013 Fee Schedule including the proposed changes, including the amendment of the zoning permit fees for home occupations, both with neighborhood impact and no impact to $50 and no fees for renewals. Motion carried unanimously.

Police Range Update Police Chief Neidert stated the Department had been working with the University Rifle Club to use the shooting range for training and practice, during certain times and with certain conditions, at a fee of $1; and, that one person from the department was to become a member of the club. He stated the Department had to resolve a small issue or two, and wanted to proceed with this agreement.

He stated doing this would eliminate the $1,000 membership fee to the Cumru Range. The regular membership fee for University is $100.

NEW BUSINESS

Tax Collector Compensation 2014 - 2017 Mr. Bingaman stated every four years the compensation was reviewed. He stated in 2009 the compensation was increased 5 cents every two years. He suggested no increase for a first two years and a 5 cent increase for the second two years bringing the total to $1 per bill for 2016 and 2017. He noted changes in compensation could only be made prior to the Tax Collector's election. His suggested fee would put the Township fees in line with other municipalities. To clarify, Mr. Bingaman stated the Tax Collector was paid 95 cents for every bill he collected ^ including real estate tax bills and per capita tax bills. Mr. Smith felt the per capita bill should be O eliminated in conjunction with the school district to lower the fees for both. Mr. Bingaman ^o stated he would pursue that idea with the School Board. CO MOTIONby Mr. Bukowski , seconded by Mrs . Starr, to pay the Tax Collector 95 cents per bill for 2014 and 2015; and increase the amount by 5 cents for a total of $1 per bill processed in 2016 and 2017. The Motion was amended without a vote at this point due to Mr. L loyd ' s question on why fees had to be raised at all. Mr. Bingaman replied they did not have to be raised. MOTIONby Mr. Smith, seconded by Mr. Bukowski , to not increase the Tax Collector 's compensation for the years 2014 through 2017.

Mr. Howell stated there was no indication of the t ime or cost the Tax Collector incurred.

Motion did not carry with Mr. Lloyd and Mr. Smith voting in favor, and Mr. Wilson, Mrs . Starr, Mr. Bukowski opposed.

On the original mot ion made by Mr. Bukowski , the Board voted as follows. Motion did not carry with Mrs . Starr, and Mr. Bukowski voting in favor, and Mr. Wilson, Mr. Smith and Mr. Lloyd opposed.

Mr. Wilson stated he was concerned about the Tax Collector 's cost to which Mr. Bingaman stated the Township paid for his office, and his office related expenses; however, providing office space was not required. MOTIONby Mr. Smith, seconded by Mr. Lloyd, to pay the Tax Collector 95 cents per bill for 2014, 2015, 2016 & 2017. Mot ion did not carry with Mr. Smith and Mr. Lloyd voting in favor, and Mr. Wilson, Mrs . Starr and Mr. Bukowski opposed. MOTIONby Mr. Lloyd, seconded by Mrs . Starr, to pay the Tax Collector 95 cents per bill in 2014; and $1 per bill in years 2015, 2016, & 2017. Motion carried with Mr. Wilson, Mrs . Starr, Mr. Lloyd voting in favor, and Mr. Smith and Mr. Bukowski opposed.

Replacement HVAC Unit - RCC Banquet Bar Area Mr. H a m m explained the problems with the 20 year old H V A C Unit and stated it was not worth putting repair dollars into it. MOTIONby Mr. Lloyd, seconded by Mrs . Starr, to approve the replacement of the H V A C unit servicing the Reading Country Club Banquet Bar area at a cost not to exceed $7,500. Motion carried unanimously.

SAFER GRANT Deputy Fire Chief Chris Jordan stated a $416,000 grant was received from FEMA at $208,000 a year for two years. The grant was for hiring three, full time employees for the Fire Department for two years; however he was looking into possibly making this money stretch over several part-time employees. He stated the intention was to continue with some programs; but, it was not necessary to do so. He stated the $100,000 grant previously announced and received did not need a match as he had previously stated. Mrs. Starr asked what would happen after the two years to those positions. Mr. Jordan responded the program could be scaled back to some degree due to the other available volunteers. The Solicitor asked if the new employees would be civil service protected to which Mr. Jordan responded no. Mr. Smith asked if they would be full-time Township employees to which Mr. Jordan responded they would be employees of the Exeter Township Volunteer Fire Department. Mr. Jordan stated the three positions were a Fire Chief, Fire Training Officer and a Fire Inspector. He also stated they would be working directly out of the Fire Station and dedicated to that work. Mr. Wilson suggested the people hired should understand they are not guaranteed employment after two years. He also felt there might be a conflict with the Fire Inspector position as the one in place was a union position. Mr. Jordan felt there would be plenty to do for both people. Mr. Wilson expressed his concerns about paid fire personnel snowballing and there might be a precedent for having a paid firefighting force. Mr. Jordan stated the snowball was already started and the Fire Department was trying to encourage volunteer firefighting positions; however, there were problems and that was why they were trying new programs. Mr. Bukowski felt Mr. Wilson's concerns were valid and asked Mr. Jordan what the process would be for those hired. Mr. Jordan felt the Fire Advisory Board should be involved in the interview as well as the Board of Supervisors, and the goals set forth would be followed. Mr. Lloyd encouraged Mr. Jordan to determine his space needs for the proposed emergency services building. Mr. Bingaman stated space needs in general would be discussed at the January 28th meeting.

SOLICITOR'S REPORT

The Solicitor stated the Zoning Hearing was set for February 14th for Windy Willows and he Zoning Hearing Board Date Set for Windy Willows The Solicitor stated the Zoning Hearing was set for Ft asked the Board to consider whether or not it wanted a Solicitor to attend the hearing.

Second Amendment The Solicitor asked if the Board wanted an analysis on Mr. Cox's proposed ordinance to which the Board stated it wanted to read it first.

INDIVIDUAL REPORTS

Lincoln Business Park Redevelopment Grant Mr. Bingaman updated the Board on the grant application submitted through Senator Schwank's office. He stated there was a clarification on the amount and the grant was submitted for $10 million. He stated that would mean a $5 million grant requiring a $5 million match. Mr. Bingaman felt an incoming business might see this as an incentive to come here and would provide the $5 million match.

Warranty for Sludge Dryer Swivel Mr. Herb updated the Board on the part warranty issue for the Sludge Dryer which he felt was poor. He stated he felt it should be a year, not 3 months, and he asked the Board to authorize the Solicitor to approach the company on this issue. Mr. Smith asked if this part was one that would fail periodically to which Mr. Herb responded he was investigating that very point with a company that has had the dryer in place for a long time. Mr. Smith felt if this part did fail frequently, it might be worth buying a spare. Mr. Herb agreed citing the fact that not having the dryer in operation meant sludge had to be landfilled and that was very expensive.

William Penn Grant The Police Chief announced he had received a $70,000 grant from the William Penn Foundation.

G) Crime Summit ^ The Police Chief announced he received his invitation from Commissioner Leinbach to attend 00 the Crime Summit. Mr. Bukowski asked about the Swat Team to which the Police Chief stated {jP approximately 14 municipalities had joined forces to specially train swat team members to handle certain types of crime. Mr. Bukowski asked if municipalities provided manpower and funding to which the Police Chief stated both were provided. Mr. Bukowski asked how much money was provided by the County to which the Chief answered $125,000 was provided by the County at the start in 2007; and about $50,000 is contributed every year. He stated the City of Reading was not a part of the County Swat Team as City Police Chief Heim had his own plan.

Planner Timetable Mr. Lloyd asked the timeline for hiring the Planner and the meeting with Pam Shupp to get her thoughts. Mr. Bukowski stated he mentioned to her at a school event that the Board would be calling her.

RCC Painting & Caulking Mr. Lloyd stated the painting and caulking at RCC had been put off due to the prevailing wage laws and asked what the status of the problem was. Mr. Hamm stated he would get prices to see if we could get the job done. Mr. Bukowski asked Rep. David Maloney to take some leadership and get the pending State Bill passed.

RCC Second Entrance Mr. Lloyd asked the status of the additional RCC entrance. Mr. Smith stated the money was in the budget; but, not approved. Mr. Ahrens felt less damage would occur if the matter was handled in the summer when the ground was hard. The Board asked Mr. Hamm and Mr. Ahrens to get together and develop a plan.

Sam Loth-Planner Mr. Bukowski stated he plans to informally meet with Sam Loth, who is a Planner, to have an informal discussion about what the Board has in mind and he would report back to the Board with whatever irrformation he gathered.

Easter Egg Hunt Mr. Bukowski stated he heard from Mr. Seltzer of the need for sponsors for the March 16th

Easter Egg Hunt. He stated $100 donors were needed.

Planner Mr. Wilson stated he planned to attend the Exeter School Board Meeting tomorrow night to discuss the Board's vision, and ask for their thoughts and any funding they may be able to contribute. He felt the two boards should work together to save taxpayers money. He felt two Board members, two School Board members and two Planning Commission members would make up the task force to approach the problem. Mr. Wilson noted School Board President Robert Quinter had been approached and Mr. Bukowski stated Mr. Quinter said the School Board would consider making a contribution toward funding and would help look for ways to save the taxpayers money through combined efforts.

Mr. Wilson stated another approach would be to involve the County Planning Commission and the Albright Center for Excellence in Local Government. Mr. Bukowski stated he would call Alan Piper to see what he would suggest and asked Mr. Bingaman to contact Albright. Mr. Howell commented on economic statistics and stated continuing the grants for the Fire Company meant an additional $400,000. He asked what the plan was for generating all the money for a Fire Company without raising taxes. Mrs. VanderLaan stated a Planner was discussed at the Planning Commission Meeting and leaders, as a whole, were having difficulty articulating their visions. She asked that the public be included in the planning process by having a town hall meeting. She also asked how much the tree project cost to date to which Mr. Lloyd responded $175,000 by the time it is all finished. He noted $14,000 was in labor for tree & stump removal.
