WHO'S THE BOSS IN DELHISC SAYS ELECTED GOVERNMENT, POLITICAL

PARTIES WELCOME VERDICT

NEW DELHI, (PTI) Various par tiestoday hailed as a "big victory" fordemocracy the verdict of the Su-preme Court laying broad param-eters for governance in Delhi, andhoped the bitter power tussle be-tween the Centre and the stategovernment would end and bet-ter governance del ivered topeople who have suffered till now. While Delhi Chief Minister andAam Aadmi Par ty (AAP) nationalconvenor Arvind Kejriwal wel-comed the verdict terming it a "bigvictory" for people and democ-racy, he blamed the NarendraModi government for creating a"chaos" in the national capital inthe past three-and-a-half years."IfModi govt had not withdrawn thepowers of elected govt throughi l legal orders, precious threeyears would have been saved.People of Delhi are grateful to ju-diciary. Todays order reinforcespeoples fai th in judiciar y,"Kejriwal tweeted. Welcoming theverdict, the Congress hoped thatbetter sense would prevail onboth sides and governance anddelivery of services to people ofDelhi would begin in the right ear-nest.The Congress also hoped that theverdict will put an end to the egoclash between the prime minis-ter and the Delhi chief minister. It

said the AAP should stop makingexcuses for not doing governanceand the BJP should stop creatingunnecessary hurdles in govern-ing Delhi. The BJP asserted thatwith the verdict, it has been es-tablished that the Constitution isthe "boss" and there is no roomfor "anarchism" of the ruling par tyin the national capital. The lef t par ties also welcomedthe judgement. The central gov-e rnment, however, sought todownplay the verdict, saying thecour t only underlined the specialstatus of Delhi as not being a'state' in the conventional sense.A senior government functionarysaid the judgment has made itclear that Delhi cannot framelaws which are in contraventionof laws being implemented by theCentre."Delhi is a special area and the LtGovernor is not like other gover-nors. Therefore, the main pleasof the AAP government have beenrejected by the Supreme Cour t,"he said. Senior Congress leaderP Chidambaram said the SCjudgement contains impor tantlessons for Puducherry as well."Thumping victory for represen-tative democracy. I welcome SCjudgement in the Delhi Govern-ment versus LG case....The SCjudgement contains impor tant

lessons for Puducherry as well,"he said on Twitter.Congress chief spokespersonRandeep Surjewala said, "Noelected government in garb of aconflict with the Centre shouldresort to non-governance as hasbeen happening in Delhi. We wel-come the decision of the SupremeCour t and sincerely hope that bet-ter sense will prevail on bothsides and even though belatedthe task of governance and deliv-ery of services to people of Delhiwill begin in right earnest," hesaid.Surjewala said the Congress dis-played how public welfare wasabove personal welfare when itwas in power in Delhi and provedhow opposition par ties will notprove a deterrent to the growthstory and how different par tiescarried forward one 'agenda ofgovernance'. "While we laud andwelcome the Supreme Cour t ver-dict, the truth is that unnecessar-i ly creating hurdles in gover-nance, be it any party's govern-ment, is wrong," he said."We hope that at least after theSupreme Cour t verdict, now thatthings have been made clear, then a par ty will stop making ex-cuses for not doing governanceand another par ty will stop creat-ing hurdles," he said. Taking a digat Kejriwal, BJP spokespersonSambit Patra said he is celebrat-ing his "loss" as the SupremeCour t has rejected the demandfor absolute powers for his gov-ernment.He said the apex cour t has up-held the Constitution in its orderon the fight between Kejriwal andthe LG over their powers andDelhi 's status while speakingagainst anarchy.

Premier Doug Ford Announces End of Cap-and-Trade Carbon Tax Era in OntarioTORONTO - Ontario Premier Doug Ford today confirmed that, as the first order of business ofOntario's Government for the People, his cabinet revoked the regulation that punishes Ontarioresidents at the gas pump through a wasteful cap-and-trade carbon tax regime; this measure comesinto effect July 3, 2018. In order to fulfill this election commitment, the Government of Ontario willimmediately begin an orderly wind-down of all programs funded out of cap-and-trade carbon taxrevenues."Every cent spent from the cap-and-trade slush fund is money that has been taken out of the pocketsof Ontario families and businesses," said Ford. "We believe that this money belongs back in thepockets of people. Cancelling the cap-and-trade carbon tax will result in lower prices at the gaspump, on your home heating bills and on vir tually every other product that you buy." According to theAuditor General, who conducted an audit of the program, the cap-and-trade system could cost Ontarioconsumers and businesses $8 billion, with a negligible impact on the province's carbon emissions.

"Cap-and-trade and carbon tax schemes are no more than government cash grabs that do nothing forthe environment, while hitting people in the wallet in order to fund big government programs," saidFord. "I promised that the par ty with taxpayers' dollars was over and that this would include scrappingthe cap-and-trade carbon tax slush fund. Today we are keeping that promise." To ensure an orderlywind-down of programs funded through the cap-and-trade carbon tax, Ford committed that his govern-ment will honour arrangements where contracts have already been signed and orders have alreadybeen made, such as energy efficient insulation and window retrofits.Decisions to continue any specific initiatives currently suppor ted by the fund will need to be paid forout of the tax base and will be made on a case-by-case basis in alignment with the Ford government'sPlan For the People and the upcoming value-for-money audit. "We are getting Ontario out of the carbontax business," concluded Ford. "Our focus will be to give people lower gas prices, lower energy billsand a real break in their wallets in order to get our economy going and create jobs. Help is here."

WITH POLITICAL SELF GOALS, PUNJAB'SAAM AADMI PARTY IS IN DISARRAY

ONE YEAR OF GST: LONG WAY TO GO FORA SIMPLE, UNIFORM TAX REGIME

BY VISHAV

For a political par ty that was taking a serious shot at coming topower in Punjab less than two years ago, the Aam Aadmi Par ty(AAP) appears to have gone wayward. Despite the electorate inPunjab reposing trust in the par ty by making it the principalopposition in the first ever assembly polls that it contested inFebruary last year, the par ty leadership in Punjab and in Delhi havebrought it to a new political low with a series of flip-flops and self-goals. The AAP, which has 20 seats in the 117-member stateassembly, relegated the formidable political alliance of theShiromani Akali Dal and BJP to a humiliating third slot but is fastlosing its votebank in the state. In recent by-elections, be it for Lok Sabha or assembly seats, theAAP candidates have not only fared badly but had to face humilia-tion by even losing their security deposits. In the Shahkot assem-bly seat bypoll last month, the AAP candidate got a mere 1,900votes. Each one of the top leaders in the AAP Punjab unit is on itsown journey while the Delhi leadership of the par ty, including AAPnational convener and Delhi Chief Minister Arvind Kejriwal andPunjab in-charge Manish Sisodia, show wariness, indifference andeven suspicion about the Punjab leaders.Senior AAP leader and Leader of Opposition in the state assemblySukhpal Singh Khaira is known to shoot off his mouth on everymatter. His recent comments justifying the 'Referendum 2020'propped up by foreign-based radical elements who are demandinga separate Sikh homeland, or Khalistan, has sparked a newcontroversy for him and the AAP. Khaira, a former Congressman, has lef t the par ty embar rassed on earlier occasions as well. Justabout two years back, the AAP was riding high on popularity inPunjab and many believed it was all set to form its first full-fledgedstate government.

That was not to be. Kejriwal and his core group of leaders seem tohave lost interest in Punjab affairs for now. Kejriwal's apology tosenior Akali Dal leader and former cabinet minister Bikram SinghMajithia earlier this year, which happened without even consultingthe Punjab leadership of the par ty, led to resignations within thepar ty with the cadres on the ground feeling disappointed. AAPPunjab unit president and MP Bhagwant Mann, who has had hisown string of controversies earlier, and co-president Aman Arora, resigned from their posts after Kejriwal's sudden apology.Kejriwal and other AAP leaders, in the run-up to the 2017 assembly polls, hadopenly accused Majithia of patronising the drugs mafia in Punjab. Theyeven called him a "drug lord". When Majithia went to cour t in adefamation case against the AAP leadership, the Delhi leaderschickened out and Kejriwal wrote an apology letter to Majithia.Offering apologies and doing voluntary service (kar seva) to atonefor political sins is nothing new for AAP leaders.

The 'Youth Manifesto' of AAP, released before the assembly polls, carried a photograph of 'Harmandir Sahib', the holiest and mostrevered Sikh shrine of Sikh religion, with an image of a broom, theAAP's par ty symbol. This led to a religious uproar in Sikh domi-nated Punjab. Kejriwal and other leaders washed utensils at theGolden Temple complex to "atone" for the political and religiousfaus pax. AAP leader Ashish Khetan compared the same manifesto toreligious scriptures like Granth Sahib, the Bible and the Gita. The AAP had toagain seek forgiveness for this. The AAP's stand on sharing of river watersvaries in Delhi and Punjab, leaving the par ty embarrassed at times. Theelectorate in Punjab, which gave four seats to AAP (out of 13 Lok Sabhaseats), has been left disaapointed. Two of the AAP MPs continue to besuspended from the par ty for the last three years. If AAP is to revive its positionin Punjab, its leadership - in Punjab and in Delhi - would have to take drasticsteps to stop the erosion of its base. Otherwise, the par ty wouldend up being a one-time wonder.

Touted as the biggest economic reform since Independence, theGoods and Services Tax (GST) was supposed to replace thecomplex indirect tax system prevalent in the country with a moresimplified, uniform regime. As its roll-out completes one year onJune 30, it can be argued that while India has come a long wayfrom a complicated taxation system, with over a dozen differenttaxes and many more cesses, GST is still far away from an idealtaxation regime. Also, the one year journey of the GST has not been a smooth oneeither with glitches and teething problems experienced from dayone. While many of those glitches were addressed by a proactivegovernment, some still remain to be resolved including simplifica-tion of return filing and fur ther rationalisation of tax rates. Accordingto NITI Aayog Vice Chairman Rajiv Kumar: "GST has put theeconomy on a completely different paradigm now because moreand more pressure will be on people to register under GST andbring their economic activity into the formal sector."It is not enough only to analyse the one year journey, but it isimpor tant to understand the future roadmap. While many economistwould argue that an ideal GST structure should have a universalcoverage and a single tax rate, most would also agree that it wasnot practical for a country like India with vast economic disparities. This is a stand the government has also maintained often giving theexample that "a BMW car and a Hawai 'chappal' (flip-flops) can't betaxed at the same rate".However, having six different rates -- 5, 12, 18 and 28 per centapart from some items being taxed at zero per cent and gold at 3per cent -- makes India's GST one of the most complex in the world, something acknowledged by the World Bank in its biannual IndiaDevelopment Update repor t. "To make things worse, petroleumproducts, power and real estate have been kept outside the GSTambit," the repor t noted. It added that not only India has one of thelargest number of tax slabs, but at 28 per cent, it has the higheststandard GST rate in Asia and the second highest in the world afterChile. Soon after the new indirect tax system was rolled out, NITIAayog Member Bibek Debroy -- who is now also the chairman ofthe Prime Minister's Economic Advisory Council -- had told IANSthat "India is a long way off from the ideal GST structure and it maynot get there anytime in the near future." Favouring a maximum ofthree GST rates with all items covered, Debroy had said thatstar ting with seven rates, "depending on how you count it", has putIndia in a situation where it may not get to the ideal GST.Fast forward to present. The economy is still grappling with therather high multiplicity of tax rates while also debating bringingpetroleum products, electricity and other items into the GST netwith little clarity in the picture. While there has been expression ofintent by the government to merge some of the tax slabs, there hasbeen little progress on that front so far. Right from the first day ofthe roll-out on July 1 last year, there were technical glitchesappearing on the GST Network por tal causing a lot of hardship totaxpayers in registering on the network. There were of ten instances of the por tal not being able to take the

load of last-minute rush to file returns, forcing the government topostpone the filing deadlines several times. The glitches also led toexpor t refunds piling up, resulting in a grave situation of cashcrunch for expor ters, whose working capital was getting blocked. However, to address this, the government initiated two specialfor tnight-long drives (extended by a few days later) to processpending refunds -- one in March and another in June -- clearing amajor por tion of the backlog while some still remains. To address the GST network issues, the GST Council has set up afive-member ministerial panel headed by Bihar Deputy ChiefMinister Sushil Modi to oversee its functioning and smoothen theprocess. "GST is a very huge and complex exercise and one has tobe honest that it could be implemented better and the details couldhave been (better) thought through," the NITI Aayog's Kumar toldIANS. While there was consensus that no reform could be under-taken without some glitches and teething problems, which could beaddressed as we go along, one major concern was that GST mightlead to some loss of revenue, especially for the states. This fear almost came true when GST collections fell for twoconsecutive months from over Rs 92,000 crore (later revised to Rs95,132 crore) in September to Rs 83,346 crore (later revised to Rs85,931 crore) in October, and Rs 80,808 crore (later revised to Rs83,716 crore) in November. This prompted the GST Council in itsDecember meeting to prematurely roll out the e-way bill mecha-nism for inter-state movement of goods from February 1 to pluggaps and check tax evasion. The e-way bill por tal crashed on DayOne prompting the government to extend the trial period andeventually postponing the roll-out to April 1.According to the NITI Aayog Vice Chairman, in a country like India, which is proud of its IT sector, there is hardly any excuse for the ITsystems not to work. However, when the system was rolled out thesecond time on April 1, the technical issues were sor ted out andinfrastructure boosted enough for a smooth implementation. Therevenue collections also picked up subsequently crossing the Rs 1lakh crore mark in March (collected in April) -- which was, however, attributed to the financial year-end effect -- and then againshowing credible buoyancy in April when it crossed the Rs 94,000crore.Kumar said now that the GST has stabilised, it would give amassive fillip to economic activity. Finance Secretary HasmukhAdhia said earlier this week that GST had now entered a "smoothphase" with good tax compliance. He added the priority of thegovernment would now be simplification of tax return forms.Deloitte India Par tner Prashant Deshpande said while GST hasresolved the issues of multiple taxable events and double taxation, there are some concerns which still need to be addressed."On the legislation side, GST can be improved by extending it topetroleum products, electricity, land and building which arecurrently taxed under old laws... The number of tiers in tax ratestructure are required to be reduced to resolve classificationissues," Deshpande told IANS. On the execution side, he added, prime concern is the GST compliance infrastructure "which iscomplex and cumbersome" which needs to be replaced with "asimple and robust compliance system". It would a while beforesuch a system comes into effect.

Canada stands up for steel, aluminum workers and industryOTTAWA - Canada's steel and aluminum industries have made Nor thAmerican steel and aluminum more competitive around the world. It isinconceivable and completely unacceptable to view any trade with Canadaas a national security threat to the United States. The US has a US $2 billion annual trade surplus on iron and steel productswith Canada. Canada buys more American steel than any other country inthe world, accounting for 50 per cent of U.S. exports. Canadian steel isused in American tanks, and Canadian aluminum in American planes.Indeed, Canada is recognized in US law as par t of the US National Tech-nology and Industrial Base related to National Defence. Today the Gov-ernment of Canada announced that in direct, measured and propor tionalresponse to US tariffs on Canadian steel and aluminum, reciprocal sur-taxes on $16.6 billion of impor ts of steel, aluminum and other productsfrom the United States will come into effect July 1.Canada continues to work towards full and permanent removal of theseunjustified and illegal US tariffs. In addition, the Government of Canadawill make available up to $2 billion to defend and protect the interests ofCanadian workers and businesses in the steel, aluminum and manufac-turing industries. This includes a comprehensive set of measures:" Extending the duration of work-sharing agreements by 38 addi-tional weeks under the Employment Insurance program to help employ-ers retain their skilled workforce and avoid layoffs during challengingtimes." Increasing funding to the provinces and territories to increasethe capacity of the job and training programs available to workers af-fected by the U.S. measures.

" Providing liquidity support to affected businesses." Offering up to $250 million in new suppor t through the StrategicInnovation Fund to help bolster the competitiveness of Canadian manu-facturers and better integrate the Canadian supply chain of steel andaluminum." The Government of Canada will invest $50 million over fiveyears to help Canadian companies diversify their expor ts to take advan-tage of new trade agreements, such as CETA and CPTPP. Working inpar tnership with business associations, this will include new "expor treadiness" grants."Canada has always been a safe, secure and reliable source of steel andaluminum for the U.S. market. The tariffs introduced by the United Stateson Canadian steel and aluminum are protectionist and illegal under WTOand NAFTA rules - the very rules that the United States helped to write. Itis with regret that we take these countermeasures, but the U.S. tariffsleave Canada no choice but to defend our industries, our workers and ourcommunities, and we will remain firm in doing so. The real solution tothis unfor tunate and unprecedented dispute is for the United States torescind its tariffs on our steel and aluminum." - Chrystia Freeland, P.C.,M.P., Minister of Foreign Affairs"The Government of Canada suppor ts our country's steel and aluminumworkers and their families. We're taking strong responsive measures todefend them. That includes new extended work-sharing, to help employers avoidlayoffs, and increased capacity for job and skills training programs for any workerswho need them." - Patty Hajdu, Minister of Employment, Workforce Developmentand Labour.

Canada welcomes OPCW actions to counter impunityfor use of chemical weapons, offers $7.5mOTTAWA - Chrystia Freeland, Minister of Foreign Affairs, today issued the following statement:"Any use of chemical weapons is an abhorrent breach of international law and Canada stronglysuppor ts efforts to ensure that perpetrators of such crimes are held to account."Canada welcomes today's decision by the special Conference of States Par ties of the ChemicalWeapons Convention to task the Organisation for the Prohibition of Chemical Weapons (OPCW)Technical Secretariat with identifying those who use chemical weapons in Syria. These findingswill be repor ted to the United Nations Secretary General and will ensure that the perpetrators ofattacks using chemical weapons in Syria will not be able to hide behind anonymity. The decisionalso authorizes the OPCW Director-General to help attribute responsibility for chemical attackson the territory of member states."The Conference of States Par ties recognized the results of the OPCW-UN Joint InvestigativeMechanism's last repor t, which attributed the use of the sarin nerve agent in Khan Shaykhun toSyrian government forces. This is an impor tant step towards holding the Assad regime account-able for its horrific attacks against the people of Syria. This follows the disappointing actions byRussia to block the renewal of the OPCW-UN Joint Investigative Mechanism and to shield themurderous Assad regime from accountability for its actions."Canada will continue to suppor t the international rules-based order in the face of these actions.Canada has consistently demonstrated its suppor t for the OPCW, not only with words but withconcrete actions. I am pleased to announce today a contribution of $7.5 million over three yearsto help build the OPCW's new Centre for Chemistry and Technology."

TheChief Minister underlined the need for a Master Plan forconservation of water and suggested including waterconservation in school curriculums to create awarenessamong children about the impor tance of saving groundwater. US PLAN TO END IRANIAN OIL EXPORTS 'A FANTASY': ROUHANIGENEVA, (AFP) A plan by the United States to cut Iran's oilproduction to zero is a "fantasy," Iranian President HassanRouhani said during his European tour to rally suppor t for the2015 nuclear deal. Washington has said it wants to pressureIran to change its behaviour by taking away all revenueTehran generates from crude sales, par t of the confrontationalapproach adopted by President Donald Trump, who pulled outof the historic nuclear pact in May."These are exaggerated statements that can never be imple-mented," Rouhani told repor ters in Bern, after holding talks

with Swiss authorities on a range of issues, including thenuclear deal. "Such a scenario would mean the US wasimposing its imperialist policy in flagrant violation of interna-tional law," he said. "This is really a baseless fantasy," headded, condemning an "unjust" scenario where all oil produc-ers are allowed to expor t crude except Iran.Washington has said it is confident the world has enoughspare oil capacity to replace Iranian crude, and Tr ump hassaid that he has persuaded Saudi Arabia to balance themarket by boosting its own production. The international

community still overwhelmingly backs the nuclear deal whichopened new oppor tunities to deepen economic relations withIran. But many believe nations will have to sever ties once Washing-ton reimposes sanctions, to avoid losing access to US marketsand financing. Rouhani and Swiss President Alain Berset bothunderscored the impor tance of the nuclear deal, known as theJoint Comprehensive Plan of Action, substantial par ts of whichwere negotiated in Switzerland. The deal was signed in Vienna, where Rouhani will hold fur ther talks tomor row.

Trump has repeat-edly questioned the value of the alliance and claimed that its members weretaking advantage of the US. CNN quoted a source as saying that the letterswere "very tough." The President has previously referred to NATO as "obso-lete" although he later reversed that position. The Times repor t said thatmany of the letters to the various leaders included similar language, butTrump's letter to German Chancellor Angela Merkel was particularly critical."As we discussed during your visit in April, there is growing frustration inthe US that some allies have not stepped up as promised," the letter toMerkel read, according to the Times, which cited a source who hadseen it and sent excepts. "Continued German underspending on de-fence undermines the security of the alliance and provides validationfor other allies that also do not plan to meet their military spendingcommitments, because others see you as a role model."
