REPORT SUMMARY

The purpose of this report is to recommend to Council the adoption of the Buffalo and Kittys Creek as well as Parramatta River- Ryde subcatchments’ Flood Studies, and Floodplain Risk Management Studies and Plans. The Studies and Plans are according to the NSW government guidelines. They have been overseen by Council’s Floodplain Management Committee (FMC) which is comprised of community representatives, Councillors and staff from the City of Ryde, a representative from the NSW Office of Environment and Heritage (OEH) and the State Emergency Service (SES). At its meeting of 4 March 2015, Council’s FMC resolved to recommend to Council the adoption of the Buffalo and Kittys Creek Flood Study and Floodplain Risk Management Study & Plan. In an additional meeting on 22 March 2015, Council’s FMC committee resolved to recommend to Council the adoption of the Parramatta River- Ryde subcatchments’ Flood Study and Floodplain Risk Management Study and Plan.

Adoption of the recommended Studies and Plans has the benefit of eligibility to seek grant funding from the NSW Office of Environment and Heritage for costs associated with the implementation of the Plans. The more detailed flood mapping will contribute to development certainty within the catchments. Where flood control notations on Section 149 certificates would be placed as a result of the Flood Studies, consultation will be undertaken with the property owners prior to the amendments. A further report will be provided to Council at a later date to outline the details of the consultations with the property owners.

RECOMMENDATION: (a) That Council adopts the Buffalo and Kittys Creek Flood Study and Floodplain

Risk Management Study and Plan as the basis for managing development and guiding flood mitigation works in the catchments.

(b) That Council adopts the Parramatta River- Ryde subcatchment Flood Study and

Floodplain Risk Management Study and Plan as the basis for managing development and guiding flood mitigation works in the catchments.

Background In response to the NSW Government’s requirement to reduce the impact of flooding and flood liability on individual owners and occupiers of flood prone properties, the City of Ryde Council has carried out Flood Studies, Floodplain Risk Management Studies and Plans in its Local Government Area, in Kittys Creek and Buffalo Creek catchments and Parramatta River- Ryde subcatchment. The Parramatta River- Ryde subcatchment includes Archer Creek, Denistone, Charity Creek, River and Gladesville catchments. The Floodplain Risk Management process for the catchments is in accordance with the procedure outlined in the NSW Government’s Floodplain Development Manual, gazetted in April 2005. The Floodplain Risk Management process involves the following four sequential stages: 1. Preparation of a Flood Study

To determine the nature and extent of the flooding problem and gather data to define peak water levels, velocities and discharges for floods of varying severity. 2. Preparation of a Floodplain Risk Management Study This aims at identifying, assessing and comparing various risk management options, while quantifying and prioritising them appropriately into an overall plan. 3. Development of a Floodplain Risk Management Plan

This establishes appropriate planning controls and other management measures recommended to reduce the impacts of flooding for existing and future development. 4. Implementation of the Plan This entails:

The identification of funding needs and preparation of an implementation plan.

The construction of infrastructure or implementation of flood mitigation measures to reduce flood damage and protect existing properties identified in the Plan.

The inclusion of flood related planning controls within local environmental plans.

Ensures that development control plans are compatible with the flood hazard reduction strategies.

The use of the Plan to identify and assess the viability of potential development areas.

The Floodplain Management Study and Plan (the Plan) are linked integrally and are carried out simultaneously. The Plan will subsequently need to be adopted and implemented by Council. Discussion As a preliminary measure in the Floodplain Risk Management process, an advisory committee chaired by the City of Ryde was formed to assist in overseeing the development of the study and implementation of a management plan. The committee is comprised of community representatives, Councilors and staff from the City of Ryde, and representatives from the NSW Office of Environment and Heritage and the State Emergency Services (SES). The studies involved the following activities:

The collection of flood related data

A Community Newsletter/Questionnaire introducing the study objectives and seeking information on historic flood patterns was forwarded to residents in the floodplain, details of which have been outlined in the following pages.

Preparation of models

Natural surface of the catchment and its underground stormwater drainage system, including the main arms of the creeks and their overland flow paths were modelled. The models extended from the headwaters of the catchments to Lane Cove River for Buffalo and Kittys Creek catchments and Parramatta River in the case of Parramatta River- Ryde subcatchment.

Presentation of study results

Study results were presented in the report as water surface profiles, diagrams

showing indicative extents of inundation and flood hazard classification based

on depth and velocity of overland flows.

Sensitivity studies

A number of runs were carried out to test the sensitivity of the hydraulic model results to variations in model parameters such as hydraulic roughness and likely increases in rainfall intensities resulting from future climate change.

The Floodplain Risk Management Study aimed to identify, assess and compare various risk management options and consider opportunities for environmental enhancement as part of mitigation works.

A list of possible floodplain risk management measures which could be applied in the study area were initially developed for consideration. As part of this process a number of measures were identified as not being worthy of further consideration. The feasible options for consideration were also presented in the report for implementation in the future. Moreover, the hazard categories for the catchments were quantitatively determined. Flood damages assessment was undertaken for existing development within the catchments. The economic consequences of floods are discussed in the report and flood damages to the properties in the floodplain are assessed. Consultation

Community consultation has been an important component of this project. Community consultation on the draft Flood Studies, Floodplain Risk Management Studies and Plans for all the catchments has now been completed. The key elements of the consultation process have been as follows: Buffalo and Kittys Creek Catchment The Flood Study and Floodplain Risk Management Study and Plan were commissioned to GHD on 14 March 2012 after an extensive tendering process. Following commissioning GHD, the Floodplain Management Committee meeting was held for the Buffalo and Kittys Creek Catchments. The committee consisted of representatives from:

The public consultation process included media releases, newsletters, survey questionnaires and the following stages:

Reports to Council in February 2012 and March 2013.

Public exhibition of the Flood Study and Floodplain Risk Management Study and Plan during September and October 2014, including public displays, drop in sessions and workshops.

Parramatta River- Ryde subcatchment

The Flood Study and Floodplain Risk Management Study and Plan were commissioned to Jacobs (previously known as SKM) on 27 April 2011 after an extensive tendering process. The Floodplain Management Committee meeting was held for the catchment. The committee consisted of representatives from:

Letters and questionnaires to all the residents in the catchment on 25 October 2011 advising them of the start of the project and requesting their feedback.

Floodplain Management Committee meeting on 8 May 2013 and 22 April 2015.

Newsletters to the residents on 12 November 2014 updating them on the

progress of the project and informing them of the Public Exhibition and two

drop in sessions. The draft Study and Plan were publicly exhibited in the

Public Exhibition period between 12 November 2014 and 12 December 2014.

The Public Exhibition of the draft report was also advertised on the City of

Ryde Website and in the Northern District Times on 12 November 2014.

Copies of the final Flood Studies and Floodplain Risk Management Studies and Plans are CIRCULATED UNDER SEPARATE COVER. Consultation concerning Section 149 Certificates

It is important to note that flood control notations on Section 149 certificates are already in place for those parcels identified as being subject to flooding as a result of previous modellings and studies in the entire LGA. The amendments to Section 149 certificate notations as a result of Buffalo, Kittys Creek and Parramatta River Ryde Subcatchments’ Flood Studies may result in the removal of Section 149 certificate notations from some of those parcels that already have the notation as a result of previous modellings. It may also result in the addition of flood control notations on Section 149 certificates for some parcels that do not already have them. In cases where the flood modelling shows that flood control

notations on Section 149 certificates will need to be placed on the parcels to indicate that they will be subject to flood related development controls, consultation will be undertaken with the property owners. Additionally, where the flood control notations on Section 149 certificates are removed from some parcels the property owners will be notified. The notations on Section 149 certificates also enables Council to reduce the impact of flooding and flood liability on individual owners and occupiers of flood prone properties by applying appropriate development controls. Future Capital Works Once the Studies and Plans are adopted, Council will develop a program for implementing the recommended mitigation works, prioritise the works proven feasible and proceed with including them in the Capital Works program following the approval of the grant by the OEH. Financial Impact Minimal impact to the Delivery Plan in adopting the recommendation as no work is recommended at this stage. Conclusion

Following the preparation of the Flood Study and Floodplain Risk Management Study and Plan for Buffalo and Kittys Creek catchments and Parramatta River- Ryde subcatchment an extensive community consultation process was conducted by Council. The reports were developed in accordance with the NSW Government Flood Prone Land Policy and were overseen by the Floodplain Management Committee. The Flood Studies and Floodplain Risk Management Studies and Plans represent a best practice approach in managing the development in flood prone areas. This report seeks Council’s adoption of the Flood Studies, Floodplain Management Studies & Plans for Buffalo and Kittys Creek catchments as well as Parramatta River- Ryde subcatchment. The formal adoption of the Flood Studies and Floodplain Risk Management Studies and Plans will enable Council to proceed to the next stage in the Floodplain Risk Management process which is to implements the Plan. The next stage in Council’s Floodplain Management program is for properties identified as being at risk of flooding to be noted on Section 149 Certificates. This enables Council to reduce the impact of flooding and flood liability on individual owners and occupiers of flood prone properties by applying appropriate Development Controls depending on the level of risk for individual properties.

3 GLEN STREET MURAL PANEL PROJECT

Report prepared by: Community Project Officer File No.: GRP/09/4/14 - BP15/597

REPORT SUMMARY This report seeks approval to install 10 painted 4 x 2 metre panels inside the Glen Street carpark in Eastwood. These works are in line with other safety measures introduced in Eastwood. The panels will activate the carpark and provide patrons with a way finding solution throughout the site. It will also address graffiti issues within the carpark and will align with the proposed lighting and CCTV improvements scheduled for Glen Street carpark; adding to the perception of safety. The panels will be painted by youth attending Our Space Community Hub under the instruction of an artist facilitator and installed at the car park in September 2015. This project is recommended to be funded from the Local Neighbourhood Events project 2014/15 operational budget.

RECOMMENDATION:

That Council approve the Mural Panel Project to be installed at Glen Street carpark, Eastwood.

History The Glen Street carpark has a major impact on Eastwood. Visually poor, it nevertheless plays a vital role in providing convenient parking in the town centre. The carpark is particularly important for the shops adjoining Progress Avenue.

In early 2014, a number of community concerns were raised following an assault incident that occurred in close proximity to Glen Street carpark, Eastwood. In response, Council staff undertook a safety audit in consultation with the local Police to assess the situation. As a result, CCTV and lighting improvements have been approved for the Glen Street carpark and will be implemented after June 2015 with funding from the Federal Government’s ‘Safer Streets Program’. Council has already commenced an ongoing program of safety improvements in the area, including maintenance works to street lighting, pruning of trees and improved signage. Discussion Council’s Safety Committee, in consultation with the business and community sector, wish to create and foster a viable safe business precinct for the area. Funding from the Federal Government’s ‘Safer Streets Program’ will enable an upgrade to lighting in selected locations in Eastwood town centre and Glen Street carpark. The use of public domain elements and artwork add to the perception of improved community safety. Currently, Glen Street carpark is subject to frequent graffiti attacks, bill posters and poor visibility, particularly around pillars and shadowy areas within the ground floor of the carpark. Recommendations from Council’s Community Safety Working Group and Ryde Local Area Police include better way finding throughout the car park; improvements to the perception of safety, which this project seeks to address using artwork to provide directional and pleasing visual indicators to lead patrons to and from their cars. This report seeks approval to install 10 painted 4 x 2 metre panels inside the Glen Street carpark in Eastwood. The selected artist facilitator for this project will work with inexperienced artists and graffiti offenders in producing the proposed public artworks for the panels.

The panel project is a cost effective way to enhance the vitality of the carpark and to engage local youth to reduce graffiti vandalism in the immediate and surrounding area. The mural panels can remain in place and can be replaced easily when the artwork is in need of updating or repair. The risks of installing the panels are minimal and the artwork will be undertaken offsite at Our Space Youth Hub. The hoarding boards have the capacity to be reused for future art/ mural projects, ongoing community cultural development events and projects. Images of the final artwork of the 10 panels will be presented to Council via the Councillor Information Bulletin for feedback prior to temporary installation. The production of public art murals is an approach used by a number of Councils to assist in reducing the levels of illegal graffiti vandalism and has been found to reduce illegal graffiti and vandalism in the surrounding area and improve people’s perceptions of safety. It is known that graffiti offenders usually do not target such artwork. Financial Implications

Should Council resolve to undertake this project, it will result in a financial impact of $5,000 and recommended to be funded from the existing 2014/15 Local Neighbourhood Events project operational budget. The project will include the following costs:

Artist fees and materials $3,870.00

Installation fees $ 800.00

Total $4,670.00

Context The installation of the mural panels will meet the concerns of the safety committee and provide opportunities for local youth to engage in community enhancement through the arts in the Eastwood precinct. The project will also provide:

A sense of community ownership in the creation of the Mural panels by participants involved.

A sense of location through art work is a contributing factor that increases confidence and the feeling of ‘being in control’ experienced by car park patrons, which can be achieved by addressing issues such as orientation, legibility of signage and comfortable/inviting spaces.

The proposed mural installation date is September 2015, after the completion of eight workshops and is in line with the lighting and CCTV camera upgrade of the carpark.

Consultation with relevant external bodies

City of Ryde Community Safety Working Group and Ryde Local Area Police. Consultation around concept of design for mural panels will incorporate concepts to target appropriate way finding markers; art that is suitable for the public realm; uplifting and light hearted art to brighten dark spaces. Local youth attending Our Space Youth Hub and graffiti offenders will be referred via the Young Offenders Program to this project if requested. Options An alternative option for way finding would be the use of conventional directional signage throughout the carpark. This would not engage community participation and the cost may prove significantly higher.

4 HERRING ROAD URBAN ACTIVATION PRECINCT

_ REPORT SUMMARY The State Government as part of their Priority Precincts Program (new title for Urban Activation Precinct) are offering funding of $5 million for each of the Priority Precincts. The funding is for local projects such as footpaths, cycle ways, landscaping, street furniture, parks and playgrounds. These funds are available for the Herring Road Precinct. The Department is seeking Council’s suggestions on how this money could be spent in the Precinct. The options for the expenditure of the funds in this Precinct are listed as follows:

1) Road Infrastructure 2) Flood/Stormwater Mitigation Works 3) Open space 4) Social

It is considered that the funds would be best spent in embellishing the parkland along the Shrimptons Creek Corridor – being Elouera Reserve, Wilga Reserve, Quandong Reserve and the parkland adjoining the Creek. The embellishment program would be guided by and undertaken in accordance with the Elouera Reserve concept plan and Shrimptons Creek Parklands Plan of Management. The use of the funds on this local project will address a current need and assist in supporting the needs of the future population. Council is to note that the $5million is inadequate to deliver the infrastructure required to meet the development outcomes and future residential population proposed for this area. If Council supports the allocation of the funds to this local project, the Department of Planning and Environment will be advised accordingly.

RECOMMENDATION: (a) That Council endorsed the allocation of the $5million (available under the

Priority Precincts Program) to the embellishment and upgrade of the parkland along the Shrimptons Creek Corridor – being Elouera Reserve, Wilga Reserve, Quandong Reserve and the parkland adjoining the Creek.

Background The NSW Government Urban Activation Precinct (UAP) Program was announced in June 2012. The program aims to assist the NSW Government deliver its housing targets, while supporting Councils to address the increased demand for local infrastructure. The State Government has identified eight Urban Activation Precincts (UAPs) across Sydney; two within City of Ryde at North Ryde Station and Herring Road. Council nominated the Herring Road Precinct to be considered as a UAP at its meeting of 14 August 2012. This nomination was predicated on the co-ordinated delivery of Infrastructure to assist Council in responding to significant growth in the Macquarie Park Corridor. In particular, the necessity for a new grade separated bus interchange on Herring Road between Macquarie University and the Macquarie Shopping Centre is considered to be a key component in any master plan guiding future growth. The proposed rezoning and associated planning controls for the Herring Road UAP are based on the principles of a Transport Orientated Development (TOD) and focuses on integrating land use and transport. TODs promote the creation of a network of well-designed, walkable neighbourhoods that provide access to the jobs, education facilities, healthcare facilities and cultural and recreation destinations. The Herring Road UAP Proposal proposes a significant increase in density and heights in the Precinct, which are well above those proposed by Council through its Amendment 1 planning controls for the Macquarie Park Corridor The Herring Road UAP Proposal was publicly exhibited in Jul/ August 2014. Council’s submission raises several concerns regarding the Herring Road UAP Proposal, including:

The Herring Road UAP Planning controls are not consistent with those proposed in Amendment 1 - two sets of controls will operate within Macquarie Park with different intents;

Concern for the current residents of the Ivanhoe Public Housing Estate – clarity as to the quantum of social housing to be retained on site, and the opportunity for current residents to remain in-situ;

Excessive scale and density – the heights and FSRs proposed are significantly higher than those that currently operate or proposed in Amendment 1;

Net Loss of open space – no additional open space is provided to support the predicted increase in population;

Lack of certainty and details of the infrastructure to be delivered – while Amendment 1 has a mechanism to fund the delivery of infrastructure, the Herring Road UAP has no such mechanism this may place a significant burden on Council to deliver and manage the required facilities;

Lack of planning for a Transport Interchange on Herring Road, which is considered by Council to be a prerequisite for further densification – the current Bus Interchange has reached capacity; a short and long term strategy to upgrade the Transport Interchange is required;

The Herring Road UAP Proposal considers the precinct in isolation – the UAP needs to be considered holistically, as part of the broader Macquarie Park Corridor.

Based on these concerns, Council has not supported the Proposal in its current form. A decision on the approval of the planning framework of the Precinct is not known. Discussion - State Government funding for Priority Precincts

In selecting an option or item to expend the $5 million the Council staff have used the following criteria:

The potential of the works to be undertaken as part of the development process – eg conditions of consent and/or a planning agreement.

Intersection works such as major intersection upgrade on classified road delivered by the State Government.

A complete project/outcome delivered with the funds.

The delivery of the project meets an established need. Based on these criteria – it is considered that the funds would be best spent in embellishing the parkland along the Shrimptons Creek corridor – being Elouera Reserve (completion of the park upgrade), Wilga Reserve, Quandong Reserve and the parkland adjoining the Creek. The embellishment program would be guided by and undertaken in accordance with the Elouera Reserve concept plan and Shrimptons Creek Parklands Plan of Management. While the funding from the State Government will assist in the provisions of local infrastructures in the Precinct, it is inadequate to deliver the infrastructures required for the over 11,000 new residents. This will leave a substantial funding shortfall as Council seeks to provide the physical and social infrastructure. It is anticipated the current and future infrastructure will cost many millions of dollars. The exhibited UAP Master Plan fails to adequately address the timing, priority and mechanism for the delivery of this infrastructure (transport interchange, intersection upgrades, public and community facilities, schools, public domain treatments, and open space); these needs will be left for Council to deliver. It is clear that Section 94 alone will be inadequate to provide for this level of infrastructure and its ongoing maintenance. Consultation The Open Space unit have indicated their support for the expenditure of the funds in the Shrimptons Creek Corridor. Conclusion and next steps It is suggested that the allocation of $5million available for the Herring Road Priority Precinct be used to embellishing the parkland along the Shrimptons Creek Corridor – being Elouera Reserve (completion of the park upgrade), Wilga Reserve, Quandong Reserve and the parkland adjoining the Creek. 5 WEST RYDE URBAN VILLAGE - EXPENDITURE OF FUNDS UNDER DEED OF AGREEMENT WITH COLES

REPORT SUMMARY

Council successfully concluded negotiations with Coles Group Property Developments Pty Ltd in April 2015 regarding a Deed of Agreement to provide, amongst other things, assurances in the form of bank guarantees directly attributable to the West Ryde Drainage and Roadworks. In summary, the Deed of Agreement provides for the following:

(a) the timely delivery of stormwater drainage infrastructure and associated road works within Anthony Road and Reserve Street, West Ryde;

(b) $58,248.30 (including GST) cost recovery for the relocation of a utility pole at the corner of Chatham Road and Betts Street, West Ryde; and

(c) $939.08 (including GST) payment of an outstanding water bill for the West

Ryde Village Square. The relevant bank guarantees for item (a) stormwater drainage infrastructure, have been provided to Council and are in safe keeping. The cheques for items (b) cost recovery for the relocation of a utility pole and item (c) the payment of an outstanding water bill have been deposited into the appropriate Council account. This report seeks approval to expend the funds for items (b) and (c) for the purposes set out in the Deed of Agreement between Council and Coles Group Property Developments Pty Ltd.

RECOMMENDATION:

(a) That Council:

(i) allocate the amount of $58,248.30 from contributions for the purpose for the relocation of a utility pole at the corner of Chatham Road and Betts Street, West Ryde; and

(ii) allocate the amount of $939.08 from contributions for the purpose of payment of an outstanding water bill for the West Ryde Village Square; and

(iii) consolidate these amounts into the next Quarterly Review. (b) The General Manager be authorised to expend funds for any works that may

arise associated with the Deed of Agreement.

There are no financial implications as Coles will fully fund the relocation of the utilities pole with acceptance of the $59,187.

Conclusion That due to the successful negotiation of a Deed of Agreement with Coles Group Property Developments Pty Ltd regarding the West Ryde drainage and road works, which guarantees these works for Council, this agreement also ensures that the outstanding amounts also be paid to relocate the telegraph pole and pay an outstanding Sydney Water bill. These amounts can now be realised and consolidated into Council’s next Quarterly Review.
