SUBSEA PRODUCTION SYSTEMS TO BE USED?• Subsea Production Systems are typical wells located on the sea floor, in

shallow or deep water. • They are generally termed as Floating production systems, where the

petroleum/gas is extracted at the seabed and the same can be tied back to an already existing production platform or an onshore facility.

REPSOL SAYS ITS SAFE• A Repsol spokesperson stated to Portugal Newswatch: “One basic difference between gas and oil is that gas evaporates and oil needs

containment on water surfaces. In the event of a well failure, gas spills are easier to control than oil spills, as the gas is not retained in the seawater.

No water pollution is generated and the hydrocarbon bubbles into the atmosphere until well control is achieved. In the Algarve, as no hazardous gas is expected, a gas pollution case is an extremely improbable situation.”

• Safe = protected from or not exposed to danger or risk; not likely to be harmed or lost. Protected from harm/danger, shielded, sheltered, guarded, defended, secure, safe and sound, out of harm's way, all right. Not likely to cause or lead to harm or injury; not involving danger or risk.

• Somehow, I cant relate above explanation for "safe" with the drilling industry, can you?

Portugal "está cego" em relação à exploração dos recursos de gás no Algarve diz o Presidente da Partex LUSA - Agência de Notícias de Portugal, S.A. 29 Set, 2010

• O presidente da petrolífera Partex Oil and Gas considerou que Portugal "está cego" em relação aos recursos de gás natural na Bacia do Algarve, que poderiam representar uma poupança anual na fatura energética de mil milhões de euros.

• "Há uma correlação muito forte da Bacia do Algarve com a Bacia de Cádis, em Espanha.

84 Million Euros Investment• Quoting Negócios Online of 10 September 2012, in which Repsol Europe

Director Max Torres stated that Repsol would be investing 84 Million Dollars during the exploration phase in the Algarve concessions.

• At face value, this figure appears to be substantive, but what Mr. Torres failed to state is how much of that investment would benefit the Portuguese economy, the timeline of this investment, how many jobs would be created in the Algarve or what would be the economic benefit for the local communities here.

• In addition, government representatives talk of figures that range from 30 Million to 120 Million Euros. Now, which amount is true? Sounds like the right hand not knowing what the left is doing … or is it pure disinformation?

Trindade, afirmou hoje que "há sinais significativos" de que Portugal irá explorar gás natural, mas alertou que "não é expectável que a energia baixe num país que encontre energia no seu território".

• Artur Trindade acredita que Portugal esteja muito perto de começar a explorar gás natural no 'offshore' do Algarve, o que não significa muito para os consumidores já que o secretário de Estado da Energia deixa desde já o aviso que a exploração não terá reflexos nos bolsos dos consumidores daquela fonte de energia.

PARTEX REPLY TO ASMAA IN A MEETING IN LISBON• Luis Guerreiro, Director of Exploration and New Projects for Partex on friday the 27

September 2013, told ASMAA representatives in Lisbon during the launch of the Gulbenkian Foundation Oceans Initiative "Valuing Oceans for Tomorrow" that the consortium which is led by the Spanish company Repsol, seeks to bring the gas ashore to an as yet unspecified location and to pump the unrefined gas to a refinery where the gas will be cleaned and depressurized for sale, with the final product being linked to a gas distribution grid.

• He further informed us that the exploration and completion (operational / extraction) process to be followed would be the same as the process used by Repsol in its Poseidon fields in Spain.

REPSOL WILL CONDUCT AN ESIA8 Jan 2014 – Algarve News Watch (Len Port) • A Repsol spokesman stated that an “Environmental and safety studies are

being conducted to guarantee a clean and safe drilling operation,”. • “Repsol does environmental and safety studies prior to any operation, taking

into account the social, economic and environmental issues and following legislation and the highest international standards in the industry. The company takes into consideration such studies in the planning of the operations and works closely with national and local authorities.”

• We await this report with interest. Especially due to the fact that legally its not a pre-requirement under Portuguese law, which was substantiated by the minister in 2012. But with the latest developments in the EU and the publication of the latest EU directive for oil and gas sector in the EU we can fully understand why Repsol is now stating that they will be conducting a ESIA.

SAFETY• On 10 June 2013 the EU adopted a Directive on safety of offshore oil and gas operations.

The new rules (initially proposed to take the form of a regulation) will make sure that the highest safety standards will be followed at every oil and gas platform across Europe.

• It will also ensure that we react effectively and promptly should an accident nevertheless occur. This would help minimise the possible damage to the environment and the livelihoods of coastal communities.

OIL LICENSING• EU countries have to follow strict rules when issuing licenses for searching for, drilling for

and producing oil: the Hydrocarbons Licensing Directive (94/22/EC) ensures a competitive, non-discriminatory and transparent European market and improves the security of supply.

• Directive 94/22/EC of 30 May 1994 on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons

• National governments can determine the geographical areas for prospecting, exploring for and producing hydrocarbons.

• However, they have to follow a specific procedure when granting licences: an invitation for applications has to be published in the Official Journal of the EU at least 90 days before the closing date for applications. This notice should specify information such as the geographical area, the type of authorisation and selection criteria for applicants. All interested companies can submit applications.

• In their annual reports, EU countries have to inform the European Commission (EC), amongst others, on the geographical areas opened and the licences issued to companies.

LIABILITY FOR ENVIRONMENTAL DAMAGE• The Directive requires Member States to ensure that licensees are financially liable for

the prevention and remediation of environmental damage, as defined under the Environmental Liability Directive (ELD), caused by offshore oil and gas activities carried out by, or on behalf of, the licensee or the operator.

• This means that a licensee that is not the operator is still liable under the ELD.

• The Directive contains an amendment to the ELD under which the ELD provisions dealing with water damage now also apply to the marine waters of Member States. Consequently, liability under the ELD has been extended.

• The Directive does not contain any provisions on civil liability on the part of licensees for loss or damage suffered by third parties. However, in 2012 the European Commission ordered a study into issues relating to such liability, so this topic may very well be covered by EU legislation in the near future.

TRANSPARENCY AND INFORMATION SHARING• Under the Directive, Member States must ensure that operators (or

owners) provide the relevant competent authority with the information described in Annex IX to the Directive.

• This includes information relating to any unintended release of oil or gas, any failure of a safety and environmental critical element, any fatal accident, any evacuation of personnel, helicopter accidents, etc. Member States are also required to make such information publicly available.

• When reporting the requisite information, operators and owners must do so using a common data reporting format, to be drawn up by the Commission. Member States must submit annual reports to the Commission on offshore safety and environmental impact based on the information provided by operators.

WHY IS IT A GAMBLE THAT PORTUGAL DOES NOT NEED TO TAKE?

1. The Government gave the green light to the Repsol and Partex in 2012 without any public consultation, any disclosures or even without the necessary EIA’s having been done.
