Dear Colleagues:

i hope the first few months of this new year have been happy, healthy, and successful for you. As i write this, today is “cross-over” day in the general Assembly, when house bills go to the senate and vice versa. So i wanted to take this opportunity to thank Hunter Jamerson and Dr. Jesus Lizarzaburu, as well as the Legislative Committee, the board, and Mary Lindsay White for all the advocacy work they’ve done on our behalf at the legislature. There were numerous bills around nurse practitioner scope of practice and the

prescription Monitoring program (pMp), as well as bills as diverse as an associate physician bill, a bill (again) to allow chiropractors to do transportation physicals, and numerous bills about death certificates. i’m pleased to say that at the time of this writing, and to the credit of Hunter and the folks above, most of these bills have either been killed, merged, and/or amended to the benefit of our patients and to our members. By the time you read this, we’ll know the outcome of these legislative efforts, but at this time, for most of them, i am very optimistic. So, again, thank you to Hunter, to the Legislative Committee, and to all of you who met with, phoned, or emailed your representatives.

i would also like to thank all of you who took a day off from your practice and served as “Doc of the Day” at the legislature. That is an important opportunity for us.

regarding the pMp, the VAFp Board, at our last meeting in Wintergreen, voted to expand the scope of our efforts to improve the appropriate prescribing of opiates in the Commonwealth. We all agree that there is a significant problem with opioid dependence and overdoses in our state, so we wanted to continue to take a proactive approach to this problem. To that end, the board committed to continuing and perhaps increasing the educational sessions around opioid abuse/dependency, appropriate prescribing, and pain management at our professional meetings. in addition, as in the past, we will include pain Management in the Maintenance of Certification

(SAM) sessions offered by the VAFp and run by Drs. greenawald and Elward. We will also include more links to pain management educational resources on the VAFp web site, to make it a clearinghouse of those types of resources. And as was done in this legislative session, we will advocate for the use of the pMp, but in a way and in a frequency that makes the most clinical sense without overly burdening our members. To that end, we will also advocate for attainable integration of the pMp into the clinical workflow within the EMr, and seek to share experience and best practices to that end.

For example, in my medical group, we have figured out a way to pull the pMp with a click of a button from within the patient’s chart. We are also working on doing the same thing through a call over the internet to the vendor that maintains Virginia’s pMp, which is the preferred approach. i would be glad to share our experience in doing this with anyone interested and hope to post some information about it on the VAFp web site.

As always, i am very appreciative of the amazing care you give to your patients, the citizens of Virginia. Thank you for all you do. Keep fighting the good fight!

Physician Assistants are essential members of the team-based

approach to patient care, and Physician-PA teams add versatility to any clinical setting. Trained in the Medical Model, PAs practice in all medical settings and specialties. They are bridging the gap created by a growing provider shortage and Physician-PA teams are improving access to care.

I N A N E M P L O Y M E N T A G R E E M E N T An employment agreement is the single most important document you will sign during your working life. Yet, many physicians sign their employment agreement and file it with other papers that they never will look at again – that is, until a problem arises. That may be too late. Many employed physician complaints often can be traced to their acceptance of onerous provisions in their employment contract. Physicians tend to focus on the salary and perks they are offered and ignore the meat and potatoes of the contract itself. Below are a few pitfalls that can be dangerous and costly as you consider a proposed employment agreement. 1. You may have to give back some income, even

if you’re not at fault. More and more, hospitals are inserting provisions that make the physician financially responsible if government or third-party payer auditors identify overpayments.

2. You could have too much call. Most contracts

leave it to the employer to decide call arrangements.

3. Productivity compensation arrangements

often are problematic. Hospitals now insist on productivity based compensation arrangements because they don’t want a repeat of what happened in the 1990s.

4. You may lose control over where you practice.

If you are employed by a large health system, you may be assigned to multiple locations across a wide geographic area. The more you have to drive from office to office, the more difficult it will be to satisfy your productivity target.

5. You may be barred from doing outside work.

Most contracts now prohibit physician employees from taking outside jobs to supplement your income.

6. You may be fired for no reason at all. Most agreements contain a “without cause” termination provision, meaning that your employer can fire you at any time, and for any reason (or no reason at all), with a reasonable amount of notice.

7. You likely won’t be able to practice in the

area when you leave. Your employment agreement likely contains a noncompetition provision that will define the amount of time and the geographic area in which the prohibition will apply.

8. You may be left unprotected against

malpractice lawsuits. If you are insured with “claims-made” coverage during your practice, which covers claims filed while you are employed, you will need tail coverage when you leave.

Especially if you do it while you’re being recruited by a group, it’s not impossible to cure some (if not all) of these issues before you sign an employment agreement. It is important, however, to request only reasonable revisions to an agreement and do it courteously and professionally.

Hunter Jamerson, JD, VAFp Legislative ConsultantLegislative UpdateLegisLative UPdate

On March 7th the general Assembly entered its last full week of the legislative session. All legislative action must be completed before the general Assembly adjourns Sine Die on March 12th.

During this session, the Virginia Academy of Family physicians worked diligently with stakeholders and legislators on a variety of issues. Below are three bills that highlight the work of the Virginia Academy of Family physicians this session:

SCOPE OF PRACTICESB 369 directs the State Department

of Health to establish a pilot program that would allow physicians to serve, via telemedicine, as patient care team physicians for nurse practitioners in medically underserved areas. The bill directs the State Department of Health to consult with relevant stakeholders in establishing the program. SB 369 passed in the Senate on February 12th and is scheduled to pass the House this week with a substitute. The

substitute includes a provision that this pilot program will expire on July 1, 2018.

DIRECT PRIMARY CAREHB 685 provides that the

Commonwealth’s insurance laws do not apply to direct primary care agreements. The measure further provides that (i) a direct primary care practice is not subject to the jurisdiction of the State Corporation Commission (SCC) and is not required to obtain a certificate of authority or license to market, sell, or offer to sell a direct primary care agreement; (ii) entering into a direct primary care agreement shall not be considered to be engaging in the business of insurance; and (iii) a direct primary care agreement is not a contract of insurance and is not subject to regulation by the SCC. HB 685 passed the House without much debate and then proceeded to catch fire in the Senate. After a long Senate floor battle, HB 685 reported out of the Senate 23 to 17.

OPIOID ABUSE/PRESCRIPTION MONITORING PROGRAM:

SB 513 requires a prescriber to obtain information from the prescription Monitoring program at the time of initiating a new course of treatment that includes the prescribing of opioids anticipated to last more than 14 consecutive days. The bill also allows a prescriber to delegate the duty to request information from the prescription Monitoring program to another licensed, registered, or certified health care provider who is employed at the same facility under the direct supervision of the prescriber or dispenser. Further, the bill creates exemptions from the requirement that a prescriber check the prescription Monitoring program in certain cases. The provisions of the bill expire on July 1, 2019. SB 513 passed the House and Senate and was approved by the governor on March 1, 2016. The provisions of this bill will become effective on July 1, 2016.

Congratulations to John O. Marsh, MD recipient of the 2015 Family physician of the Year Award. Dr. Marsh was not able to be present at the 2015 VAFp Annual Meeting therefore the Academy formally recognized Dr. Marsh during the 2016 Winter Family Medicine Weekend held January 29- 31 at Wintergreen resort. The award was presented to Karl Clebak and Dr. Clebak will personally present the award to Dr. Marsh.

Dr. Marsh’s award states, “In recognition of your tireless efforts to provide care for those in your community and those travelling through your community that would otherwise be without. You are truly an American hero not only for what you do for patients today but for your prior service in the U.S. Army to the soldiers that fought for U.S. freedom. The Virginia Academy of Family physicians (VAFp) Foundation is delighted to announce one new medical student scholarship and one new resident scholarship in 2016 for assistance with education loan repayment. Many medical students and family medicine residents in Virginia have expressed an interest in staying in Virginia after their graduation to complete a family medicine residency or to practice in a medically underserved area. Over the past two years the VAFp Foundation has received donations to support this effort to keep our own.

This year the Foundation will offer one graduating Virginia medical student a $1,000 scholarship. The successful candidate will meet the following criteria:

1) graduating Virginia medical student in good academic standing.

2) Entering a Virginia family medicine residency program. A letter from the program director is required.

3) Will have completed the pgY-1 year successfully and be entering into the pgY-2 year at that program. A letter from the program director is required in order to receive the scholarship

check for loan repayment at that time.

4) Must submit a 250-500 word letter explaining why they want to practice family medicine in Virginia as a resident and as a family physician.

in addition, we are offering one $1,500 scholarship for a graduating pgY-3 Virginia family medicine resident who wishes to practice in an underserved area of Virginia. The requirements for this scholarship are as follows:

1) graduating as a pgY-3 Virginia family medicine resident.

2) Have an up-to-date Virginia medical license.

3) practicing family medicine in an underserved medical area after graduation as designated by United States Human resource Service Administration (HrSA) and/or Virginia Department of Health. A letter verifying this is required.

4) Must submit a 250-500-word letter explaining why they want to practice in an underserved area of Virginia.

5) practicing at the underserved site for one year. Documentation is necessary to receive the scholarship check for loan repayment after one year of practice in an underserved area.

The Virginia Academy of Family physicians held its first group part iV program, at Wintergreen resort on Thursday, January 28, 2016. The focus of the program was generating high-yield clinical questions and using an EMr and/or other electronic search engines to get information quickly and efficiently to support patient care.

The attendees were a dynamic group of practicing family physicians who learned new approaches for accessing clinical guidelines, patient-oriented evidence and strategic search strategies as well as shared their own “pearls and perils.” They completed the bulk of the part iV requirement

during the 3.5 hour session and are in the process of completing the final chart reviews for certification.

The session rated 4.8 out of 5 for content and applicability to practice. We appreciate the attendees’ active participation and contributions which made this initiative successful. The VAFp is proud to provide high quality and relevant CME and MOC activities which directly relate to family medicine.

Thanks to the Medical Society of Virginia Foundation for collaborating with us in this effort – their role as a special ABMS portfolio Sponsor allowed us to provide part iV credit

for this program and their dynamic track record of practice-oriented MOC initiatives continues to serve all Virginia physicians.

The group part iV program will be presented again this summer and fall which will allow busy family physicians to more easily achieve their MOC requirements and do so in a way that directly relates to their patient care and their practice needs! A “precepting Medical Students” workshop was held at the 2016 VAFp Winter Family Medicine at Wintergreen resort on Friday, January 29th. The session was attended by 8 participants, including current family medicine residents and student preceptors with over 10 years of experience. The workshop was sponsored by

your VAFp Student, resident and Faculty Committee. Lisa rollins, phD, Associate professor and Director of Scholarship, from the University of Virginia School of Medicine, lead the session, which included large group and small group instruction. The topic was Best practices for student teaching. The Best practices were broken down into the following areas: pre-immediately post Arrival Best practices, Engaging Students Best practices, Maintaining Efficiency Best practices, and Threshold Concepts.

communications campaign to advocate for the values of family medicine, demonstrate the benefits of primary care, and drive patient activation. Led by Family Medicine for America’s Health, Health is primary uses advertising, news media outreach, online communications, partnerships and stakeholder outreach to transform perceptions and behavior around health and health care in America and foster awareness and action to support the essential role of primary care.

Family medicine wants to ensure that America is a place where Health is primary.
