Miami, FL, and WZTA(FM), Miami Beach, from Guy Gannett Publishing Co. to Paxson Broadcasting of Miami, LP. Also granted was the applicants' request for a waiver of the FCC's one -to -a- market rule. Lowell Paxson owns 100% of the voting stock of Paxson Enterprises, Inc., general partner of Paxson Broadcasting of Miami. Mr.
Paxson also has an interest in HSN Broadcasting of Hollywood, Florida, Inc., the licensee of WYHS(TV) in Hollywood, FL. Since the grade A contour of the television station encompasses Miami and Miami Beach, a grant of the assignment applications would result in Paxson owning attributable interests in a television station and radio stations in the same market. The waiver of the one -to -a- market rule was granted under the "Top 25 Markets /30 Voices" test.
The Commission reversed and remanded a Review Board decision denying the
application of Evansville Skywave, Inc. (ESI) for a new station at 107.5 MHz in
Evansville, IN. The Board disqualified ESI for misrepresenting facts concerning the validity of its organization as a two- tiered corporation. It found that ESI's two -tiered structure was a sham designed to exploit artificially the FCC's
comparative licensing process. ESI is the sole remaining applicant for the new
station, and is organized as a two- tiered stock corporation with voting and non- voting stock. The Board found that ESI's single voting stockholder did not
exercise control over the applicant, but that its non -voting stockholder, Skywave Communications Corp. and its president, Lee Perkinson represented the driving force behind the applicant. Thus the application was found to be a sham and the
Board deemed ESI to unqualified as a licensee. The Commission found that the
Board had not used an appropriate legal analysis in making its determination, and
that the record did not reflect that ESI knowingly misrepresented or concealed material information. Because the Board's disqualification of ESI could not be
sustained, the Commission remanded the proceeding to the Board to consider exceptions relating the financial certification and deposition testimony issues
that the Board previously considered moot.

In other actions, the Commission: affirmed with modifications the Review Board decision granting the application of Orion Communications, Ltd. for a new station at 96.5 MHz in Biltmore Forest, NC; affirmed with modifications its Memorandum Opinion and Order upholding the grant of Efrain Archilla -Diez' application for a
new station in Maguabo, Puerto Rico; denied the application of J. McCarthy Miller for a new station at 95.3 MHz in Gulf Breeze, FL; and notified Agape Broadcasting Foundation, Inc., licensee of noncommercial station KNON in Dallas, TX, of an apparent liability for a forfeiture of $5,000 for violating the Communications Act, which prohibits noncommercial stations from broadcasting advertisements.
In yet another FCC friendly reminder to Mass Media Bureau Filers: Rules implementing section 5301 of the Anti -Drug Abuse Act are now in effect. The Commission granted a news exemption from Section 315 of the Communications Act to WWRC in Washington, DC for an eight -hour program block (which aired February 27) in which Democratic and Republican presidential candidates were featured as part of "on- the -spot coverage of a bona fide news event." The Commission gave a
similar exemption to King Broadcasting, Inc., for coverage of the 1988 presidential campaign, which involved back -to -back candidate appearances and questioning by news personnel; with ne apparent opportunity for licensee favoritism in the format.
In response to petitions requesting reconsideration of the FCC's Report and Order on the technical assignment criteria for AM broadcast service, the NAB issued comments that generally supported the principles adopted by the Commission. The NAB said it defends the FCC's plan for licensing facilities on the expanded band, which will rely on the migration of existing AM broadcasters to provide the expansion service, and will reduce existing band interference levels through the termination cf existing band operations. The NAB said the Commission should amend and /or clarify its rules so that stations forced to change their facilities would not have to meet the 10% interference reduction requirement; and that such a
requirement be "revised to afford a greater degree of equity and fairness to broadcasters who might choose to make modest changes." The NAB continues to advocate the restriction of travel and information services facilities to only two discrete AM frequencies, rather than allowing the services to have free rein over the AM band.
CANADA THIS WEEK
The CRTC announced that it would consider granting flexibility to operators of radio stations in border markets or in small markets with respect to certain of their programming commitments. The following guidelines have been established to assess border market stations for programming flexibility: 1) Substantial tuning to U.S. stations in the market. A share of 20% tuning or more to U.S. stations would constitute "substantial tuning," according to the CRTC. 2) Unprofitability of the market. The CRTC will measure profitability according to the average profit before interest and taxes (PBIT) of all commercial stations in the market over the preceding 5 years.
The CRTC may grant flexibility with respect to the level of hits and the maximum repeat factor to the licensees of FM stations in border markets that meet the guidelines. It may also allow licensees to decrease their music list size, change their vocal -to- instrumental ratio or increase the allowable amount of commercial content. The CRTC, however, will not likely grant flexibility with respect to
station formats or requirements for French - language vocal music. Reductions in
spoken word programming will generally be granted in those cases where applicants can demonstrate that it is essential to the station's competitive position in
relation to U.S. stations. Flexibility regarding Canadian content will not
generally be accorded except for the licensees of AM and FM stations in border markets where exceptional circumstances are present, as in the case of the Windsor market and others that are greatly affected by the presence of U.S. signals. In
such markets, the CRTC will expect applicants proposing a reduction in spoken word programming and /or Canadian content to demonstrate how they will continue to provide identifiably Canadian programming services.
The CRTC's flexibility guidelines for small market stations are: 1) population of
less than 100,000 in the market, based on Canadian census data, and 2)
unprofitability of the market, determined by the average PBIT of all commercial stations in the market over the preceding 5 years. The CRTC may also take into account such factors as the location of the community in relation to others and the amount of out of town tuning on the market's financial situation. The CRTC

will consider flexibility for certain programming aspects of small market stations as described above for border stations, including music list size, the level of hits, maximum repeat factor, etc. The CRTC also will not likely be prepared to accord flexibility with respect to Canadian content and spoken word to FM licensees operating in small markets.
In the application process, the onus will be on the border or small market licensee to demonstrate to the CRTC why exceptions to normal programming requirements are warranted for each its proposals. Applicants in such markets will also be expected to demonstrate the following: 1) how each of the proposed changes will help the competitive situation of the station; 2) how the station will continue to serve the particular needs and interests of the community; 3)
that the proposed changes will not cause undue harm to local AM stations and AM and FM station sin neighboring communities; and 4) in the case of border market station licensees that are proposing reductions to Canadian content and /or spoken word, that the station will remain an identifiably Canadian service.
The CRTC will adopt a more flexible approach in regard to communities that have only one receivable FM station. Such first service stations will be given flexibility because concerns about divel:sity of service within the market and the impact of such flexibility on AM stations are not present in these cases. The CRTC may grant the same flexibility to first service FM stations as it does to AM stations with respect to music use indicators, format and advertising content levels. The CRTC's primary consideration for first radio service stations will be maintenance of the best possible service to the community. However, the CRTC, will not likely grant flexibility to such stations with respect to Canadian content, spoken word and French -language vocal music.

The World Administrative Radio Conference (WARC) allocated space in the 1500 MHz band (L Band) for satellite and terrestrial digital audio broadcasting service worldwide. For the U.S. only, the WARC allocated space in the 2300 MHz (S band) for satellite and terrestrial DAB service. The NAB, which has been advocating development of in -band terrestrial DAB, reacted negatively to the WARC's decision, saying, "The WARC decision to allocate space in the 1500 MHz band for terrestrial and satellite DAB pcves the way for a worldwide DAB satellite service. We see the decision as a threat to our system of local over -the -air terrestrial broadcasting." The NAB added that it expected that Canada, Mexico, and U.S. receiver manufacturers would likely put pressure on the U.S. government to adjust to the world -wide DAB assignment by moving U.S. military telemetry operations from their current location in the L band to the 2300 MHz S band. The NAB urged proponents of terrestrial in -band DAB to develop such systems quickly.
The Supreme Court decided not to review a lower court decision rejecting a 24 -hour ban on indecent broadcasting which is favored by Jesse Helms and the Bush administration. Because of the Court's decision not to make the review, broadcasters can continue to air indecent, but not obscene, material from 10:00 p.m. to 6:00 a.m. The NAB supported the Court's decision because of potential First Amendment violations, and added, "Now it's up to the Commission to adopt new procedures to determine when such material is permitted to be broadcast."
The Commission affirmed its decision to renew the licenses of Ogden Broadcasting's WGSN(AM) /WNMB -FM, in North Myrtle Beach, SC, for a short term with an imposition of a forfeiture of $10,000 for a violation of the EEO rules. Ogden, the South Carolina State Conference of Branches of the NAACP, and the National Black Media Coalition (NBMC) sought reconsideration of the Commission's decision. In its
petition, Ogden asked the Commission to eliminate or substantially reduce the forfeiture and grant its stations a full -term license renewal. The NAACP and the NBMC requested that the Commission hold a hearing concerning the licensee's renewal application and then deny them. The Commission declined, saying that reconsideration of its decisions are appropriate where the petitioner shows either a material error or omission or raises additional facts not known or not existing until after the petitioner's last opportunity to present such matters. In
applying its standard, the Commission decided that reconsideration in this case was not appropriate.
The Commission issued Show Cause and Hearing Designation Orders against ten AM stations to determine whether their licenses should be revoked. The following stations have been off the air without authority for extended periods of time: WAGF, Dothan, AL; WKIJ, Parrish AL; KBRS, Springdale, AR; KOKY, Jacksonville, AR;
WAPR, Avon Park, FL; WFRK, Coleman, FL; WDAT, Amory, MS; WPSC, Pageland, SC; WORI,
Oak Ridge, TN; KMHT, Marshall, TX. It should be noted KMHT recently returned to
the air under a new owner.
The FCC terminated the renewal of noncommercial station WGHS at 88.5 MHz in Glen Ellyn, IL. The station, owned by the Glenbard West High School district, has been off the air for two years.

CANADA THIS WEEK
Under the new Broadcasting Act, the CRTC is examining the possibility of granting exemptions from licensing requirements to persons who carry on broadcasting undertakings of certain classes, in addition to those already exempted under old legislation. Specifically, the CRTC is looking at low -power broadcast undertakings and temporary networks. The CRTC has broadened the exemption to include such broadcasts because of their limited audience reach, limited duration of operation, and because licensing such undertakings would not materially contribute to the achievement of the objectives of the Broadcasting Act. The CRTC may revoke exemptions previously granted, should it be deemed necessary or appropriate, and may prcpose additional exemptions in the future.
Low -power radio undertakings are those operating at 50 watts ERP or less on FM, or 100 watts transmitter power on AM. Such low -power stations are not protected -- meaning they have to move if a regular station has been granted an application to
broadcast on the same frequency. The only protection the low -power stations now have is against interference from any future low -power stations that may be
established in their vicinity. Except for community, native, and student stations, the impact of low -power stations in the Canadian broadcasting system is
limited, due to the narrow target audience of such stations. Therefore, the CRTC feels such stations lend themselves to ccdnsideration for exempt:.on from licensing and regulation, and said it will begin considering only those types of low -power stations that present the clearest and least controversial grounds for exemptions.
A low -power station must meet the following proposed criteria to qualify for exemption. The undertaking must be one that: 1) the CRTC would not be prohibited from licensing pursuant to any Direction to the Commission by the Governor -in Council; 2) operates at a power of 50 watts ERP or less for FM, and less than 100
watts transmitter power for AM; 3) does not broadcast any programming that contravenes the Radio Regulations, 1986; 4) except insofar as it rebroadcasts the programming of an undertaking licensed by the CRTC, does not broadcast programming that is religious or political in nature; 5) has been issued a broadcasting certificate by the Department of Communications, unless the Department does not
require one.
Other undertakings eligible for the proposed exemptions would be those providing Temporary Resource Development Distribution (TRDD), Special Events Programming, and Low -Power Announcement Services. The TRDD undertakings include stations serving work camps that operate only during the term of a specific construction, logging or similar project. Such temporary broadcasts operate in remote areas,
and distribute the programming of another licensed station. Special Events Programming Undertakings are generally established for a specific period to
provide coverage of recognized sports, cultural, or touristic events. They are on air only for the period of the event, although the event may occur annually. Low Power Announcement Services include those who entire message is commercial and is
intended as a sales aid, and those used to provide tourist information at heritage sites. Because the commercial nature of such services does not pose a threat to
conventional broadcasters, the CRTC proposes to exempt the announcement services from licensing requirements. All three classes of undertakings described above must meet specific criteria outlined by the CRTC in Public Notice 1992 -5.
Under the category of temporary networks, the CRTC, is considering license exemption for such networks whose operation is of very short duration and those that distribute programming that is noncommercial in nature or provides coverage of a nonprofit event. Events considered for the exemption could also include
those of a commercial, for profit nature, and could include commercial message,
but would have to being and conclude within a 24 -hour period. An example of such
an event is the Live Aid concert. The CRTC will also consider exemption for the
broadcast of special events that take place in Canada, including the Montreal International Jazz Festival, or the Alberta Summer Games. In addition, exemptions are proposed for temporary networks broadcasting information on such unforeseen events as environmental disasters or other public emergencies. As in the case of
the low -pcwer stations, the CRTC has specific criteria for exemption of temporary networks. The CRTC invites public comment on its proposed exemptions, and requests that submissions be received on or before March 27, 1992.
Along with its proposed exemptions for low -power and temporary stations, the CRTC
has decided to grant license exemptions to those who broadcast meetings of the
House of Commons and provincial or territorial legislatures, because such
undertakings are in the public interest and would contain no editorial comment.
The criteria for granting such an exemption are: no fee can be charged for the
service; the programming service contains no advertising material; any programming

description of the processes of the House of Commons or legislature involved or an agenda of upcoming activities, without any comment or analysis of the proceedings themselves; coverage of the proceedings should be gavel to gavel, except in the case of repeat broadcasts of question periods or selective coverage of committee meetings, if approved by the appropriate Speaker; control over the programming provided by the undertaking is retained by the appropriate Speaker.
ELSEWHERE
Last week's Country Radio Seminar in Nashville had a record 1705 attendees, an increase of 40% over last year's attendance. The large turnout reflected the growth and increased popularity of the format. The seminar featured several meetings, roundtables, and exhibits, as well as entertainment by new and established country artists. Three sessions addressed local marketing agreements. Others concerned programming formatics, record charts in trade publications, ratings, production techniques, station promotions, and managing in a bad economy. Members of panel discussions included station program directors, consultants, record company personnel and recording artists. Overall, the seminar was a
success. The only significant problem occurred when over 250 attendees were shut out u country superstar Garth Brooks' Super Faces Show. Based on low attendance at previous years' concerts, the CRS decided to move the show to smaller venue at
Opryland. Because their assumption backfired, the CRS is offering refunds to attendees who request them.
In Satellite Music Network's LMA session, radio broker Gary Stevens discussed the advantages of leasing agreements, calling the LMA almost a "no -lose" situation. Stevens said, "I believe the LMA will continue because it's cost efficient." He predicted that "five or six base operators will be controlling 80 percent of the market." He advised those interested in LMAs to bring lenders in early and choose their LMA partner carefully.
Missing from this year's CRS was any kind of hot topic. Country stations seemed happy just to be where they are. Also missing was talk of how country radio might capitalize on it's success and grow even further. Not missing were the record company parties, as each tried to out -do the other. Country broadcasters proved they could work all day and party all night.
The best country liner heard at the show: "Now the first of a billion songs in a
row, from the station that don't count so good."
The Radio Advertising Bureau released its January 1992 revenue figures, indicating a stabilization of national and local revenues at -0.1% compared with revenues from January 1991. Local revenues increased by 0.7 %, while national decreased by 3.3 %. Network revenue for January 1992 was down by 6.7% over last year. The greatest regional increase in local revenue was found in-the Southwest, with +8.3% over January 1991 figures. The Midwest had the greatest regional increase in
national revenue, with +2.5 %. RAB president Gary Fries said, "We're beginning to
see cig -s which in '-icste that t_hP r.ecession's effects on radio, which prevailed during much of 1991, are coming to an end."
As mentioned in last week's M Street, WWRC in Washington, DC, got the go -ahead to
broadcast an eight -hour program block on February 27 featuring Democratic and Republican presidential candidates. According to the Washington Post, none of the
candidates took the talk station up on its offer. Several said they could not
participate because of time constraints, while President Bush's campaign expressed interest, but said they could only offer a campaign spokesman. WWRC program Director Tyler Cox said, "Not only could we not get them to commit, but then they wanted to send a spokesman!"
Maryland's attorney general last year ruled that broadcast of out -of -state lottery ads was illegal, under an unusual interpretation of an 1860 anti -lottery law.
While no station has been threatened with prosecution under the ruling, last week
a group of broadcasters, including Bethesda station WGMS(FM) and the
Maryland /District of Columbia /Delaware Broadcasters Association are suing the
state, arguing that the new interpretation of the law has had a chilling effect on
the selling of spots for out -of -state lotteries. The group charged the state with
restraint of trade and violation of broadcasters' First Amendment rights. They further alleged that the state of Maryland has chosen its interpretation in an
effort to limit exposure from competing lotteries in the District of Columbia and Virginia.

WASHINGTON THIS WEEK
Last week, the FCC announced a major revision of its national and local radio ownership rules, including a policy addressing local marketing agreements. Under the new national ownership limits, one licensee could own up to 30 AM and 30 FM stations nationwide, which is an increase over the 12 AM and 12 FM limits. The FCC's local ownership limits are determined on an incremental basis. In markets with fewer than 15 stations, one licensee could own up to three stations, with no
more than two FMs, provided that the owned stations comprise less than 50 percent of the market. AM and FM combos would be allowed in any event.
Larger market ownership limits are as follows: 1) In markets with 15 to 29
stations, a single licensee could own a combination of 2 AM and 2 FM stations, not
exceed 25% combined audience share; 2) In markets with 30 to 39 stations, a single licensee could own a combination of 3 AM and 2 FM stations, not to exceed 25%
combined audience share; 3) In markets with 40 or more stations, a single licensee could own a combination of 3 AM and 3 FM stations, not to exceed 25% combined audience share.
Under the FCC's LMA or "time brokerage" policy, a station that brokers time on
another station serving in the same market "will be considered to have an
attributable ownership interest" in the brokered station for the purpose of the FCC's multiple ownership rules. Therefore, stations in LMAs will not be permitted to lease another local station that they could not own under the new local
ownership rules. The FCC also prohibited licensees from simulcasting more than 25% of their programming on another station in the same service (AM or FM) under LMAs in which the stations serve substantially the same area. Also, stations involved in LMAs will be required to keep their LMA written agreements in their public files and file copies of the agreements with their FCC ownership reports. The ownership revisions are scheduled to take effect August 1, 1992, but will
likely face a challenge from Congress and others who might file a petition for
reconsideration.
Commissioner Andrew Barrett, who abstained from voting on the revision, said he
would have preferred a "more modest relaxation of the rules phased in over a
period of years with a subsequent thorough market study of the implications of
such actions." Barrett said the Commission's plan was a "quick -fix program" that
would benefit such interests as station brokers and "a few large group owners with
deep pockets." He added that those likely to be hurt by the revision would include small market group owners, stand -alone licenses, small market station licensees, new entrants, and the public.
The NAB's Eddie Fritts issued a memo speculating that the new rules would likely
be modified or overturned because of "a sense of outrage" among members of
Congress about the FCC's actions and the procedure used in arriving at the ruling,
as well as concerns about minority station owners. Fritts said Congress probably would have favored national ownership of 25 AMs and 25 FMs, with 30 in each
service for licensees with minority investors. He also said that Congress would
have allowed ownership of 2 AMs and 2 FMs in most markets, with additional oversight of LMAs. Fritts further speculated that as a result of the FCC's
revision, Congress might advocate "considerably lower ownership caps." Fritts advised broadcasters to consider possible action by Congress before developing any
business plan based on the Commission's revision of the rules.

Some of the major questions raised by the revised ownership limits are: How will the FCC determine the 25% combined audience share? Will the FCC use Arbitron markets? If Arbitron's markets are used, what about stations that are not in a rated market? As M Street reported last September, over half the stations in the U.S. are in markets that are not rated. The new rules would appear to allow for a great deal of market manipulation to achieve the ownership desired. The answers to many questions will not be available until the complete text of the decision is made available by the FCC, which could take several weeks.
The Commission has started a proceeding to seek ways to reduce the burden of government regulation on investment in the broadcast industry. The Commission has invited comment on the following subject areas: 1) Whether, and if so, under what conditions the Commission should amend its rules to allow former licensees and third parties to hold security and reversionary interest in broadcast licenses; 2)
Whether the Commission should alter its ownership attribution rules by a) raising the basic attribution benchmark from 5 to 10 percent; b) increasing the attribution benchmark for passive investors from 10 to 20 percent; and c)
broadening the class of investors eligible for passive status to include Small Business and Minority Enterprise Small Business Investment Companies; 3) Whether there are other Commission actions which might make financing more readily available to the broadcast industry. The Commission also asked whether it should change its attribution rules to exempt certain widely held limited partnerships from attribution where individual interest represents an insignificant percentage of total partnership equity.
The FCC has established a Small Business Advisory Committee, which will provide expert advice and recommendations on small business issues, include minority and female participation issues. The Commission has also released a report on its "Communications and Minority Enterprise in the 1990s" conference. Evergreen Media's WLUP(AM) continues to get the FCC's attention. The Loop was issued a notice from the Commission that the station "may have violated Section 1464 by airing indecent programming during hours when there is a reasonable risk that children may have been in the audience." The broadcasts in question took place last year on the Steve and Garry Show and the Kevin Matthews Show, in which the announcers made repeated specific references to sexual organs. If Evergreen does not respond to the notice, the Commission said it might subject the licensee to "serious sanctions." The Loop is already involved in a civil suit filed by the Commission for nonpayment of a $6,000 fine for two previous violations of the Communications Act.
In other actions, the Commission: denied appeal of dismissal of Beth Knight's application for a new station at 93.7 MHz at Sebastopol, CA; denied reconsideration of a $2,000 forfeiture order filed by EZ Communications, Inc., licensee of KYKY -FM in St. Louis, MO; affirmed its decision to renew the licenses of Ogden Broadcasting of South Carolina, Inc., licensee of WGSN(AM) and WNBM -FM in North Myrtle Beach, SC, for a short -term, and imposition of a forfeiture of $10,000 for violation of the EEO rules; notified Corpus Christi Media Partners, LP, licensee of KRYS -FM in Corpus Christi, TX, of an apparent liability for a
forfeiture for $6,250 for willfully and repeatedly violating the anti -lottery broadcast provisions of the United States Code and the Commission's rules; denied the complaint by Chicago water commissioner candidate Thomas Kelly, alleging violations by WBBM -FM, Chicago, of the equal opportunity provision of the Communications Act.
The Emergency Broadcast System will hold its fourth regional workshop in Kansas City, MO. As in previous workshops, attendees will include federal, state and local officials and business and industry leaders from the broadcast and cable industries. Arbitron issued a cover notice, a page 5B notice, and a computer tape flag to
KWKH -FM in Shreveport, LA, for ratings bias in the station's recent "campaign for
higher ratings." KWKH's began its "campaign" last December, when the station's afternoon DJ made references to the "campaign" approximately three to four times each day. The DJ announced over the air that he would be leaving the station because of poor ratings and was conducting on -air interviews for his replacement. In ensuing broadcasts the station aired listener comments such as, "Hi, you're listening to KWKH with (person's name) and we don't want (DJ's name) to leave, so
let's get those ratings going sky high, to keep (DJ) with us, the best. KWKH 94.5." Arbitron said that such activity may differentially sensitize the station's listeners about participating in its surveys or about reporting listening to KWKH in their diaries. The ratings service said it took the action to alert its subscribers to activities which have been conducted in the market.
The Chancellor Broadcasting Network is offering "Coast to Coast AM with Art Bell" via satellite from Las Vegas. The two -way talk program airs from 1:00 a.m. to
6:00 a.m. Pacific Time, Tuesday through Saturday. The network has assembled an
impressive affiliate line -up for a new network. Included in the list are KOB,

Terry Robinson resigned last week as Co- Chairman and CEO of Unistar Communications Group. Robinson was the founder of the Transtar Radio Networks which merged with
United Stations Radio Networks to form Unistar in 1989. Unistar said Robinson resigned "to pursue other interests."
The NAB has recently published European Media Markets: Commercial i Public Media
in 15 Countries by media analyst Kenneth Donow, which covers privatization and
growth of radio, television, cable and satellite markets in Europe. The book also
reports on the proliferation of pirate broadcasters, who are given credit for
helping the expansion of private broadcasting in Europe. For more information

Star Communications of Boston has signed an agreement with the National Hockey
League to be the exclusive radio broadcaster of the Stanley Cup Final Playoffs.
The best -of -seven series is scheduled to start in late May. The broadcasts are
offered by Star on a barter basis, with first refusal rights belonging to regular
local NHL stations. The following stations have already signed up for the games:
KMOX, St. Louis; WEEI, Boston; WBBM, Chicago; and WMAL, Washington, DC. For more

Continental Electronics has signed an exclusive agreement with Register Data
Systems to distribute RDS's digital products worldwide. RDS manufactures and
markets traffic, logging, and billing systems for broadcasters, as well as a hard

Westwood One is launching a new country hits program the week of March 30 called
Country Countdown USA, hosted by Radio & Records Nashville editor Lon Helton. The

Shadow Traffic Network is offering Shadow Broadcast Services, featuring news,
sports and weather, tailored to local stations' specific formats. The new service

will be called Express Broadcast Services, because that market's "Shadow" traffic

Chris Parry, the head of the Fiction Records label is set to launch the United Kingdom's first legal alternative music station next month. For a 28 -day trial period beginning April 13, XFM will broadcast its programming on 101.2 MHz in the North London, England area. The station will be sponsored by the rock publication NME, and will carry 70% music and 30% speech during its 24 -hour broadcast day.
Parry, who noted the effect of alternative rock stations on record sales in the U.S., said, "I have seen what these stations can do and know how beneficial it can be, and I find it strange that this area of music is currently so poorly serviced in the UK."

In a letter to Representative John Dingell, FCC Chairman Alfred Sikes addressed the congressman's and others' concerns about the Commission's relaxation of ownership rules. Sikes said the FCC based its decision to change the rules on a number of studies. In particular the FCC examined radio's position in the media marketplace compared with such competition as broadcast and cable television, newspapers and magazines. He noted that radio accounts for only 11% of mass media advertising, and that under a worst case scenario in which every group owner acquired the maximum number of stations allowed, there would still be 166 radio stations competing in the national media marketplace. Other "worst case" analysis by the FCC found that in 96.2% of the markets, there would be at least four separate radio owners; in 84.2 %, there would be at least five separate owners; in 65.8 %, there would be at least six separate owners; and in 26.2% of the rated markets, there would be at least nine separate owners. Sikes said the full text of the revised rules will be released on or before April 12.
The FCC has started a re- examination of its 1965 Policy Statement on comparative broadcast hearings. According to the Commission, the criteria used to select among competing applicants have not been changed since the the policy was enacted. Two primary objectives of the comparative licensing process were defined in the policy statement -- maximum diffusion of control and best practicable service to the public. The following criteria are currently used for comparing competing applicants: diversification of control of mass media communications; integration of ownership into management; proposed program service; past broadcast record; efficient use oÎ the ELequel1Ly, d,,%1 auxiliary ps.)we E úirZe t
In its re- examination, the Commission will consider whether it should retain, eliminate, or modify four of the criteria -- integration, proposed program service and past broadcast record and auxiliary power. In addition, the Commission proposed the addition of two comparative factors -- a service continuity preference and a finder's preference. Under the former, credit would be awarded to applicants that could commit to the ownership of a station for at least three years. A finder's preference would be awarded to applicants who successfully request new broadcasting allotments through rulemaking. The Commission is also considering the use of a point system which it said might be a more objective way to evaluate applicants. The point system under consideration includes the following: 1) defining the weight of each preference in terms of an absolute number of "points," rather than in terms of relative adjectival preference and demerits; 2) precisely defining the circumstances under which points are awarded under each criterion; and, 3) providing a "tie- breaker" procedure for resolving cases in which no applicant receives a dispositive preference under the comparative criteria. The Commission added that it would not change the proportionate weight presently given to the minority ownership factor. The proposed criteria changes would be applied to all applicants not in hearing as of the effective date of action in the proceeding.
In comments regarding the re- examination of the comparative hearing policy, Commissioner Ervin Duggan supported the proposed service continuity preference but voiced concern about the possible elimination of the program service criterion. Duggan said, "Although I can appreciate the litigation and enforcement difficulties that may persist if we continue to use this factor, I believe that the public interest is served by encouraging applicants to embrace an explicit commitment to news, public affairs, minority and foreign language programming, and other types of public service programming." Duggan said he would carefully review comments regarding program service to determine better ways to implement and enforce the factor in comparative hearings.
According to the Washington Post, a House committee is investigating the FCC's refusal to move from its downtown location on M Street to new quarters under construction in Southwest Washington, D.C. The Commission had been seeking a new location for several years, but changed its mind on the move after the General Services Administration selected the Southwest site. Last month, the GSA canceled lease negotiations before an agreement was signed. While FCC officials said the move was canceled because the building would not be large enough and would take too long to build, an attorney for Republic Properties Corp., the developer of the Southwest site, speculated that "apparently the FCC Chairman [Alfred Sikes] doesn't want to move beyond walking distance of Duke Zeibert's," the downtown restaurant oft -touted by talker Larry King. District delegate and committee member Eleanor Holmes Norton argued that the GSA's decision to give in to the Commission's "frivolous demands" would cause the loss of construction jobs for District. In a letter responding to the Post article, the FCC's Managing Director Andy Fishel said the Commission's decision was not frivolous, but based on such

requirements as a guaranteed occupancy date in order to set up computers, enough space for all FCC employees, and a handicap accessible building. Fishel also argued that the FCC's decision not to move will save at least $1 million a year.
The FCC consented to assign the license for KEZU, Spearfish, SD, from United Radio Group, Inc., to Duhamel Broadcasting Enterprises. Duhamel, which holds licenses for KOTA(AM) and KOTA -TV in Rapid City, was granted a waiver of the one -to -a- market rule under the Commissions case -by -case standard.
In other action, the FCC granted the renewal application of Bennett Gilbert Gaines, Interlocutory Receiver for Magic 680, Inc., denied the application of
Mount Vernon Broadcasting for a new AM station at 680 KHz in Baltimore, MD, and granted the application for assignment of license from Bennett Gilbert Gaines to
WCBM Maryland, Inc.

Robert Sillerman announced the formation CF Media, which is a combination of
Norman Feuer's Force II, Inc. and Steven Hicks' Capstar Communications. Under the
$100 million merger, CF will acquire KODA, Houston, TX, and KJQY, San Diego, CA,
from Command Communications, and will buy KKCW in Portland, OR, through a
transaction in progress begun by Force II. Capstar already owns WSIX, Nashville,
WJDS and WMSI in Jackson, MS, and WSSL -AM /rM in Greenville, SC. AccoLàing to
Inside Radio, prior to the merger, Sillerman was involved in the financing of
Force II, Capstar and Command. Sillerman is president and CEO of CF Media, with
Hicks and Feuer serving as senior executive vice presidents.
The K -Love Radio Network recently added KRVC, Medford, OR, to its list of full -
time affiliates. The noncommercial contemporary Christian network can be also
heard on the following stations: KLVR, Santa Rosa, CA; KLVM, Monterey, CA; KRDG,
Redding, CA; and KDBX, Portland, OR. K -Love began in 1982 at the former KCLB (now
KLVR) in Santa Rosa. The network is listener- supported and has a format of adult
contemporary Christian music with 60- second teaching commentaries. For more

The NAB held runoff elections for seats on its Radio Board. And the winners are:
John Quinn, WJDM, Elizabeth, NJ, in District 2; T. David Luther, WBTM /WAKG,
Danville, VA, Ln District 4; Raymond Saadi, KHOM /KTIB, Houma, LA, in District 8;
and J.D. Freemen, KMLE, Phoenix, AZ, in District 22.
The Radio Advertising Bureau announced its appointees to the RAB's Sales Advisory
Committee and the RAB Steering Committee for the 1993 Managing Sale Conference.
Chris McMurray of KDMX, Dallas, TX, is Chairman of the '92 RAB Sales Advisory
Committee, and Jim Champlin cf Beck Ross Communications is Chairman of the 1993
MSC Steering Committee.
The NAB has scheduled some "nuts- and -bolts" research sessions for its annual
convention April 12 -16 in Las Vegas. Among the sessions will be "Marketing Your
Station to Advertisers," which will give ideas on selling advertisers on
"innovative programming reaching key audiences "; "Establishing Your Research
Department," which will cover the various aspects of adding a research staff to a
station, including the costs and benefits; and "Doing Effective Research --
International Experiences," which will explore how research is conducted at radio
and television stations world -wide. In addition, the convention will have a
special reception for broadcast research directors from 6:00 to 7 :00 p.m. on April

Controversial Canadian talker Bruce Allen will be syndicating his "Sound -Off" show
coast -to -coast across Canada over the Seltech Broadcast System, starting April 5.

WASHINGTON THIS WEEK
The FCC will end its freeze on filing applications for new AM construction permits and modifications of existing facilities at midnight on April 19, 1992. In
addition, amendments to the AM technical rules will become effective on April 19.
The Commission will release a new application form in early May, and has issued interim supplement forms that should be filed with the current version of forms 301, 302, and 340. The supplements include questions pertaining to migration to
the expanded AM band (1605 -1705 kHz) and the installation of stereo generating equipment. However, requests for migration to the expanded band will not be accepted at this time, and the FCC will announce a filing window at a later date. The FCC issued orders to the following licensees of silent AM stations to show cause why their licenses should not be revoked: Dothan Broadcasting Co., Inc., for WAGF, Dothan, AL, silent since May 1991; Brown Communications, for WKIJ, Parrish, AL, silent since January 1991; Richard L. The Commission denied R. J. Winter, Inc. review of the dismissal of its
application by the Mass Media Bureau for a new station on 101.3 MHz in Essex, NY.
The FCC affirmed the Bureau's dismissal of Winter's application as inadvertently accepted for tender because Winter certified it was financially unqualified in its
application as originally filed. In its request for review, Winter argued that
the wording in the FCC's Form 301 Revision Order was unclear regarding negative financial certifications. Winter contended that the Revision Order statement that applications would be returned either as "unacceptable or non -tenderable" referred ambiguously to two different FM application processing standards. The Commission rejected Winter's argument, saying that the statement meant that all broadcast operations that failed to contain the requisite affirmative financial certification were henceforth regarded as not substantially complete and returned to the applicant.
The Commission granted assignment of license for KEZV (FM), Spearfish, SD, from
United Radio Group to Duhamel Broadcasting Enterprises with a waiver of the
one -to -a- market rule, under the Commission's case -by -case standard. Duhamel owns
two other stations in the Rapid City, SD, market -- KOTA(AM) and KOTA -TV, as well
as satellite stations KHSD -TV and KSGW -TV. FCC Commissioner Andrew Barrett issued a dissenting statement on the assignment, voicing concern about one -to -a- market waivers in general, and their effect on diversity and competition within markets.
Barrett said, "Given the combination of commercial voices, radio and TV,
controlled by Duhamel subsequent to this waiver, I find that there are serious diversity concerns relative to the number of separately owned commercial voices remaining in the market." He said there was potential for confusion in
determining the number of voices, because Arbitron does not define a television metro market for Rapid City. In the absence of such data, the FCC considers
three -county radio market statistics, which can include noncommercial stations.
Barrett suggested that such data should be used conservatively, based on surveys for commercial stations.
In other actions, the Commission denied the applications for review of Oxnard Broadcasting, Inc., Borchard FM Broadcasting Co., Inc., and IST Broadcasting, Inc., seeking reinstatement of their applications for a new FM station at 102.9
MHz in Oxnard, CA. The Mass Media Bureau dismissed all three applications under
the Commission's "hard look" policy. All three applicants had violated antenna
height and power provisions of the Mexican -U.S. agreement on border area stations,
and the applications were dismissed. The Commission concurred with the Bureau and
upheld the dismissal.

Arbitron has issued bilingual ratings distortion posters to Hispanic broadcasters, informing them of Arbitron's Special Station Activities guidelines. The poster, which is Spanish on one side and English on the other, is being distributed to help prevent ratings distortion. Arbitron defines ratings distortion as "any activity, or activities, conducted by a station or its personnel which could result in manipulated, altered or inflated audience estimates," accomplished through such practices as direct diarykeeper solicitation or station promotional activities that might influence diarykeepers to inflate, falsify, or misrepresent their listening or viewing.
Ratings service, Willhight Research, Inc., recently completed a survey of Alaska for the Alaska Public Radio Network. After conducting over 4,100 telephone interviews from December to February, Classic rocker KBFX in Anchorage emerged as
Alaska's number one station, with an 8.1 share for audiences 12 +. Willhight will be adding two survey areas this spring: Medford /Ashland, OR, and San Luis Obispo /Atascadero, CA. Sweeps for the areas will begin April 16 and end June 10,
with reports to be shipped to clients by July 1.
Willhight's president Jim Willhight is scheduled to speak at next month's NAB convention, at the "Local Radio Audience Measurement Town Meeting." The meeting will take place Sunday, April 12, fiom 3:00 to 4:15 p.m. Join ü,g Jim on the panel will be Gerry Boehme from Katz Radio, and a yet -to -be named representative from Arbitron.
The National Supervisory Network (NSN) and Gardiner Broadcast Partners, Ltd. have activated the United States' first MUSICAM based digital VSAT radio network system. The system will be used by Gardiner's Rocky Mountain Radio Network, for
broadcast to its stations throughout Colorado. NSN is callinc its new system VISION, for VSAT Intelligent Satellite Integrated Operations Networks, and is
offering the service to station groups who want to link their broadcast operations with a centralized facility, "without losing the local flavor found at
