3. Department of Engineering & Operations, Operations Division, Report No. 2015-20, Subject: Port Colborne Distribution System Annual Inspection Report

Committee of the Whole recommends:

That, having again been awarded a rating and ranking of 1 00% compliant by the Ministry of the Environment and Climate Change for the City's water system, Council hereby receives report 2015-20, Port Colborne Distribution System Annual Inspection Report for information and that City staff be commended for its continuing efforts to maintain the highest standards for safe, clean drinking water in the City of Port Colborne.

4. Department of Engineering & Operations, Engineering Division, Report No. 2015-23, Subject: Ministry of Transportation (MTO) Off­Peak Deliveries Pilot

Committee of the Whole recommends:

That the Council of the City of Port Colborne support and endorse the participation in the MTO Off-Peak Deliveries Program and, further;

That the local business community be solicited for input on the program;

That the Ministry of Transportation be advised of Port Colborne's participation;

5. Department of Planning & Development, Report No. 2015-24, Subject: Recommendation Report for a Zoning By-Law Amendment (File No. D14-12-14) 3986 Yager Road

Committee of the Whole recommends:

1. That Council of the City of Port Colborne approve the Zoning By-law Amendment, attached hereto as Appendix A, rezoning the land from "A (Agricultural) to "A-382 (Agricultural Purposes Only)", "NFR (Non-Farm Residence)" and "EP (Environmental Protection)".

2. That the City Clerk is hereby authorized and directed to proceed with the giving of the notice of passing of the By-law, in accordance with the Planning Act.

3. That pursuant to the provisions of Section 34(17) of the Planning Act, no further notice of public meeting be required.

8. Department of Planning & Development, Report No. 2015-26, Subject: Proposed Amendment to Designating By-law for Julia Yager Community Centre, located at 2703 Chippawa Road

Committee of the Whole recommends:

That Council of the City of Port Colborne approve the Amendment to the Designating By-law attached hereto as Appendix C, adding the original tin/copper ceiling and crown molding in the second floor classroom to the description of heritage attributes on the reasons for designation of the Julia Yager Community Centre, municipally known as 2703 Chippawa Road.

9. Department of Community & Corporate Services, Clerk's Division, Report No. 2015-27, Subject: Appointments to Boards and Committees, Senior Citizen Advisory Council and Transit Advisory Committee

Committee of the Whole recommends:

Senior Citizen Advisory Council: That Judy Wade and Susan Brown be appointed to the Senior Citizen Advisory Council for a term ending December 31,2017.

Transit Advisory Committee: That Melissa Bigford be appointed to the Transit Advisory Committee for a term ending December 31, 2018; and

That the composition of the Port Colborne Transit Advisory Committee be temporarily amended to allow for one medical health representative, one business representative, one representative of persons with disabilities, two seniors representatives, and two at­large citizen representatives, two Council representatives, one Weiland Transit representative, one Port Cares representative and no education representative, for a total of eleven members; and

10. Department of Community & Corporate Services, Community Services Division, Report No. 2015-29, Community Room Naming Rights Agreement for the Vale Health & Well ness Centre

Committee of the Whole recommends:

That Council of the City of Port Colborne authorize the City Clerk and Mayor to execute the attached naming right agreement for the Community Room at the Vale Health & Wellness Centre.

12. Region of Niagara Re Water & Wastewater: 2015 Budget, Rate Setting and Requisition Report (CSD Report 90-2014)

13. Region of Niagara Re Waste Management: 2015 Budget and Requisition Report (CSD Report 91 -2014 Revised)

Committee of the Whole recommends:

That the correspondence received from the Region of Niagara Re Waster Management: 2015 Budget and Requisition Report (CSD Report 91-2014 Revised), be received for information.

Outside Resolutions - Requests for Endorsement

14. Canadian Union of Postal Workers Re Request for Support to Save Canada Post

Committee of the Whole recommends:

That the correspondence from the Canadian Union of Postal Workers Re Request for Support to Save Canada Post be received and supported;

That the Canadian Union of Postal Workers be advised of the resolution previously passed by Port Colborne in support of the request for Canada Post to reconsider the elimination of Home to Home Postal Delivery; and

That the Council of The Corporation of the City of Port Colborne resolves as follows:

WHEREAS Canada Post and the Conservatives are taking an axe to long-treasured postal services - killing good jobs, eliminating door-to-door delivery, drastically increasing postage rates and closing , downsizing and reducing hours at post offices;

WHEREAS Canada Post did not properly consult on these changes. effectively eliminating any opportunity for input from the people who will be most affected;

WHEREAS closing and downsizing post offices, reducing post office hours, and eliminating door-to-door delivery will reduce service and eliminate thousands of jobs in communities throughout our country;

WHEREAS Canada Post offers a public service that needs to be protected;

BE IT RESOLVED THAT the City of Port Col borne write a letter to the Minister responsible for Canada Post that calls on the government to reverse the changes to services announced by Canada Post, and to look instead for ways to increase service and revenues in areas such as postal banking;

BE IT FURTHER RESOLVED THAT the City of Port Colborne ask the Federation of Canadian Municipalities to request that the federal government consult with the public about what kind of postal service they need before allowing Canada Post to make such major changes to public postal service.

16. Town of Pelham Re the City of Port Colborne's Resolution regarding Property Tax Relief for Seniors

Committee of the Whole recommends:

That the resolution from the Town of Pelham receiving the City of Port Colborne's Resolution regarding Property Tax Relief for Seniors, be received for information.

7. PRESENTATIONS

(a) Recognition of Annette Molenaar on her retirement from the City of Port Colborne

Mayor Maloney presented Annette Molenaar, Administrative Assistant to the Director of Community and Corporate Services, with a plaque and framed photo in recognition of her retirement from the City of Port Colborne.

(b) Port Colborne Hydro Inc., grant cheque presentations to successful applicants

On behalf of the Port Colborne Hydro Board, Councillor Bodner, Councillor Kenny, and Mayor Maloney presented cheques to the successful hydro grant applicants. The recipients were as follows:

8. DELEGATIONS

(a) Chris Stout Re request to appeal an Open Burning By-law Offence received in September 2014

Chris Stout was in attendance and advised that he received an open burning by-law offence in September following three Open Burning By-law warning notices. Mr. Stout requested Council reduce the amount of the applicable fine. Mr. Stout advised that the fine totals over $500, including interest.

That applicable interest charges on the fine for an Open Burning By­law Offence, received by Chris Stout in September 2014, be waived.

CARRIED.

9. MAYOR'S REPORT

Mayor Maloney advised that he met with Alastair Davis, Chief Executive Officer, Habitat for Humanity, who informed that a home in Port Colborne has been donated to Habitat for Humanity, which will be renovated and provided to a family in need. The Mayor advised that Habitat for Humanity is in search of a building lot, and that they expressed interest in being informed of whether there are any properties which are surplus to the City's needs.

Mayor Maloney informed that he met with Terry Suess, Chief Executive Officer, YMCA of Niagara, and informed that the YMCA will be attending a future Council meeting to make a presentation regarding their operations at the Vale Health & Wellness Centre.

Mayor Maloney advised that recently attended to the 2015 Partners Breakfast at the Business Education Council.

Mayor Maloney informed that the Flavours Advisory Committee held a meeting regarding the upcoming Flavours of Niagara Festival. The Manager of Community Services advised that a report to Council is forthcoming.

10. REGIONAL COUNCILLOR'S REPORT

Nil.

11. COUNCILLOR'S ITEMS/NEW BUSINESS

(a) Bus Stop at Grocery Store (Mayne) Councillor Mayne advised that abandoned shopping carts have been observed in various locations throughout the City and enquired whether the bus route could be altered to include a stop at the local grocery store. Councillor Doucet advised that this matter is currently under review by the Transit Advisory Committee.

(b) Parking on City Streets During Snow Removal (Desmarais) Councillor Desmarais advised that she received a red parking tag from the City's By-law Enforcement Division because her vehicle was parked on the street during snow removal. Councillor Desmarais informed that there are areas in the City without driveways and the only option is for residents to park on the street. Councillor Desmarais suggested the use of "even and odd" snow ploughing, where residents can park on one side of the street on an even day of the week, and the alternate side on an odd day. The Director of Engineering and Operations recommended that those without a driveway monitor snow removal activity in their area and temporarily move their vehicle to the other side of the road until the snow has been removed. The

Director informed that residents have responded well and a decrease in red tagging has been observed this year. Councillor Desmarais suggested the establishment of a task force to review snow removal issues with stakeholders at the end of the season.

(c) Depositing Snow onto Roadway- Offence (Doucet) Councillor Doucet reminded the public that depositing snow cleared from their property onto the roadway is prohibited and is an offense in contravention of the Highway Traffic Act.

Councillor Kenny enquired whether there is a restriction on the height that of snow that is piled on private property. The Director of Planning and Development advised that there is no restriction under the City's by-laws.

(d) 211 Ontario Helpline (Bodner) Councillor Bodner informed that members of the public can call211 Ontario Helpline in order to obtain information and assistance regard ing a variety of social services available in the community.

(e) Downtown Snow Removal (Elliott) Councillor Elliott recommended removing snow from the downtown area as the large amount of snow is causing mobility challenges for seniors and persons with disabilities. The Director of Engineering and Operations advised that downtown snow removal operations will commence on February 10, 2015 and will take approximately ten to twelve days to complete. The Director advised that updates concerning progress will be posted on the City's website. The Director informed that the City hires additional staff on a temporary basis during winter control operations and has a winter control contract for snow removal in Ward Four and for equipment rental, when required.

(f) Downtown Business lm provement Area Annual General Meeting (Elliott) Councillor Elliott advised of that the Downtown Business Improvement Area will hold its Annual General Meeting on February 11 , 2015 at City Hall beginning at 6:30 p.m.

(g) Sportsfest (Elliott) Councillor Elliott advised that Sportsfest begins on February 13, 2015. The Manager of Community Services advised that Sportsfest will run from Friday to Sunday, and programming details are available on the City's website.

(h) Dewitt Carter Public School Parking (Doucet) Councillor Doucet advised that a time limited parking zone will be implemented in front of Dewitt Carter Public School to allow parents fifteen minutes to deliver and pick-up their children from school.

Staff Responses to Previous Councillors' Enquiries:

(a) Snow Removal Around Fire Hydrants and Vents Leading from Homes (Cartwright) The Fire Chief advised that the Fire and Emergency Services Department is in the process of clearing fire hydrants of snow. The Fire Chief advised that residents can contact the Fire and Emergency Services Department to obtain assistance in clearing snow from fire hydrants or, if physically capable, may do so themselves. The Fire Chief reminded the public to clear snow away from vents leading from their homes in order to prevent a fire or carbon monoxide poisoning.

15. City of Thorold Re City of Port Colborne's Resolution regarding Property Tax Relief for Seniors

The Chief Administrative Officer advised that staff would report back regarding the authority for upper tier municipalities to pass by-laws to provide property tax relief to low income seniors and disabled residents.
