4628 ENVIRONMENTAL PROTECTION AGENCY [40 CFR Part 410 ] TEXTILE INDUSTRY POINT SOURCE CATEGORY Proposed Effluent Limitation Guidelines Notice is hereby given that effluent limitations guidelines for existing sources and standards of performance and pre- treatment standards for new sources set forth in tentative form below are pro- posed by the Environmental Protection Agency ("EPA") for the textile manu- facturing category of point sources pur- suant to sections 301, 304 (b) and (c), 306(b) and 307(c) of the Federal Water Pollution Control Act, as amended (33 U.S.C. 1251, 1311, 1314' (b) and (c), 1316(b) and 1317(c); 86 Stat. 816 et seq.; Pub. L. 92-500) (the "Act"). (a) Legal authority-(1) Existing point sources. Section 301(b) of the Act requires the achievement by not later than July 1, 1977, of effluent limitations for point sources, other than publicly owned treatment works, which require the application of thb best practicable control technology currently available as defined by the Administrator pursuant to section 304(b) of the Act. Section 301(b) also requires the achievement by not later than July 1, 1983, of effluent limita- tions for point sources, other than pub- licly owned treatment works, which re- quire the application of best available technology economically achievable which will result in reasonable further progress toward the national goal of eliminating the discharge of all pollut- ants, as determined in accordance with regulations issued by the Administrator pursuant to section 304(b) to the Act. Section 304(b) of the Act requires the Administrator to publish regulations providing guidelines, for effluent limita- tions setting forth the degree of effluent reduction attainable through the appli- cation of the best practicable control technology currently available and the degree of effluent reduction attainable through the application of the best con- trol measures and practices achievable including treatment techniques, process and procedure innovations, operating methods and other alternatives. The regulations proposed herein set forth effluent limitations guidelines, pursuant to section 304(b) of the Act, for the tex- tile manufacturing category. (2) New sources. Section 306 of the Act requires the achievement by. new sources of a Federal standard of per- formance providing for the control of the discharge of pollutants which reflects the greatest degree of effluent reduction which the Administrator determines to be achievable through application of the best available demonstrated control tech- nology, processes, operating methods, or other alternatives, including, where practicable, a standard permitting no discharge of pollutants. Section 306(b) (1) (B) of the Act re- quires the Administrator to propose regulations establishing Federal stand- ards of performance for categories of PROPOSED RULES new sources included in a list published pursuant to section 306(b) (1) (A) of the Act. The Administrator published in the FEDERAL REGISTER of January 16, 1973 (38 FR 1624), a list of 27 source catego- ries, including the textile manufacturing category. The regulations - proposed herein Set forth the standards of per- formance applicable to new sources for the textile manufacturing category. Section 307(c) of the Act requires the Administrator to promulgate pretreat- ment standards for new sources at the same time that standards of perform- ance for new sources are promulgated pursuant to section 306. Sections 410.15, 410.25, 410.35, 410.45, 410.55, 410.65, and 410.75, proposed below provide pretreat-: ment standards for new sources within the textile manufacturing industry cate- gory. Section 304(c) of the Act requires the Administrator to issue to the States and appropriate water pollution control agencies information on the prdcesses, procedures or operating methods which reiult in the elimination or reduction of the discharge of pollutants to implement standards of performance under section 306 of the Act. The Development Docu- ment referred to below provides, pursu- ant to section 304(c) of the Act, infor- mation on such processes, procedures or operating methods. (b) Summary and basis of proposed effluent limitations guidelines for exist- ing sources and standards of perform- ance and pretreatment standards for new sources. (1) General methodology. The efflu- ent limitations guidelines and standards of performance proposed herein were developed in the following manner. The point source category was first studied for the purpose of determining whether separate limitations and standards are appropriate for different segments within the category. This analysis included a determination of whether differences in raw material used, product produced manufacturing process employed, age, size, waste water constituents and other factors require development of separate limitations and standards for different segments of the point source category. The raw waste characteristics for each such segment were then identified. This included an analysis of (1) the source, flow and volume of water used in the process employed and the sources of waste and waste waters in the operation; and (2) the constituents of all waste water. The constituents of the waste waters which should be subject to efflu- ent linitations guidelines and standards of performance were identified. The control and treatment technolo- ies existing within each segment were identified. This included an identifica- tion of each distinct control and treat- ment technology, including both in-plant and end-of-process technologies, which are existent or capable of being designed for each segment. It also included an identification of, in terms of the amount of constituents and the chemical, physi- cal, and biological characteristics of pollutants, the effluent level resulting from the application of each of the tech- nologies. The problems, limitations and reliability of each treatment and control technology were also Identified, In addi- tion, the non-water quality environmen- tal impact, such as the effects of the application of such technologies upon other pollution problems, including air, solid waste, noise and radiation, was identified. The energy requirements of each control and treatment technology were determined as well as the cost of the application of such technologies. The information, as outlined above, was then evaluated In order to determine what levels of technology constitute the '"best practicable control technology cur- rently available," "best available tech- nology economically achievable" and the "best available demonstrated control technology, processes, operating meth- ods, or other alternatives." In Identifying such technologies, various factors were considered. These included the total cost of application of technology in relation to the effluent reduction benefits to be achieved from such application, the ago of equipment and facilities involved, the process employed, the engineering as- pects of the application of various types of control techniques, process changes, non-water quality environmental impact (including energy requirements) and other factors. The data upon which the above analy- sis was performed included EPA permit applications, EPA sampling and inspec- tions, consultant reports, and industry submissions. The pretreatment standards proposed herein are Intended to be complementary to the pretreatment standards proposed for existing sources under Part 128 of 40 CFR. The basis for such standards is set forth in the FEDERAL REOISTER of July 19, 1973, 38 FR 19236. The provisions of Part 128 are equally applicable to sources which would constitute "new sources," under section 306 If they were to dis- charge pollutants directly to navigable waters, except for § 128.133. That section provides a pretreatment standard for "incompatible pollutants" which requires application of the "best practicable con- trol technology currently available," sub- ject to an adjustment for amounts of pollutants removed by the publicly owned treatment Works. Since the pretreat- ment standards proposed herein apply to new sources, §§ 410.15, 410.25, 410.35, 410.45, 410.55, 410.65, and 410.75 below amend § 128.133 to require application of the standard of performance for new sources rather than the "best practica- ble" standard applicable to existing sources under sections 301 and 304(b) of the Act. (2) Summary of conclusions with re- spect to the textile manufacturing indus- try category of point sources. (I) Categorization. limitations guidelines for existing sourcesand standards of performance and pre-treatment standards for new sources setforth in tentative form below are pro-posed by the Environmental ProtectionAgency ("EPA") for the textile manu-facturing category of point sources pur-suant to sections 301, 304 (b) and (c),306(b) and 307(c) of the Federal WaterPollution Control Act, as amended (33U.S.C. 1251, 1311, 1314' (b) and (c),1316(b) and 1317(c); 86 Stat. 816 et seq.;Pub. (a) Legal authority-(1) Existingpoint sources. Section 301(b)also requires the achievement by notlater than July 1, 1983, of effluent limita-tions for point sources, other than pub-licly owned treatment works, which re-quire the application of best availabletechnology economically achievablewhich will result in reasonable furtherprogress toward the national goal ofeliminating the discharge of all pollut-ants, as determined in accordance withregulations issued by the Administratorpursuant to section 304(b) to the Act.

Section 304(b) of the Act requires theAdministrator to publish regulationsproviding guidelines, for effluent limita-tions setting forth the degree of effluentreduction attainable through the appli-cation of the best practicable controltechnology currently available and thedegree of effluent reduction attainablethrough the application of the best con-trol measures and practices achievableincluding treatment techniques, processand procedure innovations, operatingmethods and other alternatives. Theregulations proposed herein set fortheffluent limitations guidelines, pursuantto section 304(b) of the Act, for the tex-tile manufacturing category.

(2) New sources. Section 306 of theAct requires the achievement by. newsources of a Federal standard of per-formance providing for the control of thedischarge of pollutants which reflectsthe greatest degree of effluent reductionwhich the Administrator determines tobe achievable through application of thebest available demonstrated control tech-nology, processes, operating methods, orother alternatives, including, wherepracticable, a standard permitting nodischarge of pollutants.

Section 306(b) (1) (B) of the Act re-quires the Administrator to proposeregulations establishing Federal stand-ards of performance for categories of

new sources included in a list publishedpursuant to section 306(b) (1) (A) of theAct. The Administrator published in theFEDERAL REGISTER of January 16, 1973(38 FR 1624), a list of 27 source catego-ries, including the textile manufacturingcategory. The regulations -proposedherein Set forth the standards of per-formance applicable to new sources forthe textile manufacturing category.

Section 307(c) of the Act requires theAdministrator to promulgate pretreat-ment standards for new sources at thesame time that standards of perform-ance for new sources are promulgatedpursuant to section 306. Sections 410.15,410.25, 410.35, 410.45, 410.55, 410.65, and410.75, proposed below provide pretreat-:ment standards for new sources withinthe textile manufacturing industry cate-gory.

(1) General methodology. The efflu-ent limitations guidelines and standardsof performance proposed herein weredeveloped in the following manner. Thepoint source category was first studiedfor the purpose of determining whetherseparate limitations and standards areappropriate for different segments withinthe category. This analysis included adetermination of whether differences inraw material used, product producedmanufacturing process employed, age,size, waste water constituents and otherfactors require development of separatelimitations and standards for differentsegments of the point source category.The raw waste characteristics for eachsuch segment were then identified. Thisincluded an analysis of (1) the source,flow and volume of water used in theprocess employed and the sources ofwaste and waste waters in the operation;and (2) the constituents of all wastewater. The constituents of the wastewaters which should be subject to efflu-ent linitations guidelines and standardsof performance were identified.

The control and treatment technolo-ies existing within each segment were

velopment Document for the textilemanufacturing category. -

The textile manufacturing industryhas been divided into seven subcate-gories for the purpose of establishingeffluent limitations guidelines and stand-ards of performance. An exception with-in the subcategorization was also re-quired because of unequal economic im-pacts caused by diseconomies of scale.The seven subcategories are comprised ofa number of mill types which have beendetermined to have sufficiently dissim-ilar plant processes and waste character-istics to group them separately as sub-categories.

(1) Subpart A-Wool Scouring Sub-category. Wool-scouring and topmakingis the term used to describe the initialwashing and cleaning of wool. This proc-ess generates a wide variety of organicand inorganic products in the waste ef-fluents such as suint, dirt, and greasealong with oils, such as lanolin.

(2) Subpart B-Wool Finishing Sub-category. Wool finishing involves therinsing, bleaching, dyeing and finishingof wooL Specialized dyes peculiar to thisfiber often result in the presence ofchrominum in thewaste effluent. In addi-tion, phenols occur from dyeing poly-ester blends. The remaining wastes aresimilar to those in knit fabric finishing.

(3) Subpart C-Greige Subcategory.Greige mill processes include. the spin-ning and texturizing of yarns which re-quire a lubricating oil, similar to min-eral oiL-In addition, the yarns are oftencoated with a sizing material to give theyarn both lubrication and strength. This

- subcategory has mostly drY processes andvery small industrial water usage.

(4) Subpart D-Woven Fabric Finish-ing-Subeategory. Woven fabric finishingand integrated woven, fabric fisingmay involve many of the following oPer-ations: Sizing applications, desizing,bleaching, mercerizing, washing, dyeing,and rinsing, followed by the applicationof finishes such as soil repellants andanti-statics.

(5) Subpart E-_ nit Fabric FinishingSubcategory. Knit fabric finishing in-volves the same processes that take placein woven fabric finishing and integratedwoven fabric finishing without the slzlng/desizing and little or -no mercerizingoperations.- (6) Subpart F-Carpet Subcategory.

Carpet mills often include similar proc-esses of the knit finishing subcategorywith the addition of the latex backing tothe carpets creating a special effluentproblem.

(7)" SubPart G--Stock and Yarn Dye-ing and Finishing Subcategory. Stock andyarn dyeing and finishing involves manyof the following: Mercerizing, bleaching,dyeing, and rinsing of stock and/or yarns.This operation differs from woven fabricfinishing because there is no sizing anddesizing operation.

(ii) 'Waste characteristics: The knowntignificant pollutant characteristics ofwaste waters resulting from the textilemanufacturing industry include: bio-chemical oxygen demand (BOD5), chem-ical oxygen demand (COD), total sus-

pended nonfilterable solids (TSS), oilsand grease, pH and fecal coliforms.

Ammonia and nitrate nitrogen, phe-nols, phosphates, dissolved solids, color,alkalinity, temperature, sulfides, chro-mium, and heavy metals are other wastewater pollutants that are considered tobe of lesser importance because availabledata has indicated these pollutants aronormally removed when BODS or TSSare removed or they occur in insignif1cantquantities.

Three constituents of the waste waterfrom plants within the textile industryhave been found which would interferewith, pass through, or otherwise be In-compatible with a well designed andoperated publicly owned activated sludgeor trickling filter waste water treatmentplant. Waste water constituents includegrease from wool scouring operations,latex from carpet mills and heavy metalssuch as chromium used in dyes. Adequatecontrol methods can and should be usedto keep significant quantites of these ma-terials out of the waste water. Dye sub-stitutes are available for many dyes con-taining heavy metals.

(liI) Treatment and control tcch-nology. In-plant procedures -to controlpollution include strict management con-trol over housekeeping and water usepractices and minimization of the intakeof water by reuse and recirculation ofwaste waters.

"End of process" waste water treat-ment processes include preliminaryscreening, primary sedimentation, bio-logical treatment and advanced treat-ment such as multi-media filtration oractivated carbon.

Waste water treatment and controltechnologies have been studied for eachsubeategory of the industry to determinewhat is: (a) The best practicable controltechnology currently available; (b) thebest available technology economicallyachievable; and (c) the best demon-strated control technology, processes,operating methods or other alternatives.

Best practicable control technologycurrently available for the wool scouringand finishing subcategories, grelge millsubcategory, woven and knit fabric fin-ishing subcategories, carpet subcategoryand stock and yarn dyeing and finishingsubcategory includes preliminary screen-Ing, biological treatment and chlorina-tion. Best practicable technology also in-cludes primary sedimentation of proceswaste water for grease removal at woolscouring plants (subcategory 1) and acidcoagulation for latex removal at carpetmills (subeategory 6).

The specified level of technology Ispricticable because it Is being practicedby textile mills representing a wide rangeof plant sizes and types. Eighteen ex-emplary biological treatment systemshave been utilized to develop the effluentlimitations. These systems treat textilewaste waters from lit fabric finishing,dyeing and finishing of broadvovencotton and cotton-synthetic blends, car-pet manufacturing, and stock and yarndyeing and finishing. The effluent limita-tions established for each of these sub-categories have been developed by aver-

aging the effluent discharges from exem-plary biological systems treating the ap-propriate subcategory waste water. Theaverage BOD5 removal efficiency of thesesystems Is greater than 95 percent; thisefficiency has been utilized to developlimitations In subcategories without ex-emplary treatment operations. In thesesubcategories there are treatment sys-tems that have demonstrated that highlevels of effluent reduction for BOD5 andTSS are attainable. Most of these sys-tems should be capable of meeting theselimitations with some modification inoperation or perhaps the presence of akmowledgeable operator. In general, onlyminor plant design changes along withcooperation from management and plantpersonnel will be required.

Best available control technology eco-nomically achievable for the seven textilesubcategorles includes the bes practi-cable control technolo-y currently avail-able along with advanced treatment suchas multimedlafiltration or activated car-bon adsorption. In some plants wherelarge quantities of dispersed dyes or ma-teris with poor adsorptive capacitiesare discharged, both activated carbonadsorption and multimedia filtrationmaybeneeded.

The specified level of technology isachievable. Biological treatment is prac-ticed throughout the textile industry andactivated carbon adsorption is practicedin at least four textile mills. The use ofactivated carbon to treat textile wasteswas pioneered at a Pennsylvania carpetmill and at least one synthetic knit goodsplant (Mill HH) is installing activatedcarbon. Multi-media filtration has beenu.ed effectively in various EPA applica-tions including Lebanon, Ohio, andWashington, D.C. Filtration is also usedas pretreatment before carbon adsorp-tion at a Virginia textile milL

Treatment required to achieve the bestavailable demonstrated control technol-ogy, procses, operating methods orother alternatives for new sources Is thesame as for best available control tech-nology economically achievable.

(iv) Economic impact analysis. A sig-nifilcant portion of the industry has al-ready instituted some of the waste man-agement alternatives, particularly bio-logical treatment systems. A few haveInstalled advanced systems, particularlyactivated carbon adsorption.

The capital investment costs of meet-Ing the best Practicable level of effluentreduction through the use of biologicalsystems such as extended aeration aree:timated to range from $10,200 to $336,-000 for model p lnts within the seventextile subcategories. 7he annual treat-ment costs range from $3,900 to $88,000.

The capital investment costs of meet-ing the best available level of effluent re-duction by the uze of advanced treat-ment systems range from $10,000 to$140,000 for multi-media filtration u.nitsand range from $385,000 to $1,050,000 foractivated carbon adsorption systems. Theannual costs for multi-media filtration atmodel plants within the seven textilesubcategories range from $3,000 to $41,-300; the annual costs for activated car-

bon adsorption range from $113,100 to$404,800.

The estimated increases in final prod-uct costs for the best practicable controltechnology currently available (biologi-cal treatment) are economically feasiblefor small and large plants in all seventextile subcategories. The estimated finalproduci cost increases range from 0.1 to0.8 cents per kilogram of product forvarious subcategories. The average in-crease is less than 0.4 cents per kilogram.

The best available level of effluentreduction for the seven textile subcate-gories includes biological treatmentalong with advanced treatment such asmultimedia filtration or activated carbonadsorption.

The estimated increases in final prod-uct costs for multimedia filtration aresignificantly less than costs for biologicaltreatment. These costs are not excessiveand should be economically achievablefor all plant sizes in each subcategory.The maximum cost for any industrymodel plant is less than 0.4 cents perkilogram of product.

The price increases attributable toactivated carbon adsorption appear tocreate an unequal economic impact. Var-iations in unit costs for small industryplants as compared with medium sizedplants are reflected in an average priceincrease for a small plant of 4.2 centsper kilogram of product as comparedwith an average price increase for me-dium sized plants of 2.3 cents per kilo-gram. The diseconomy of scale with theassociated unequal economic impact re-sulted in the establishment of differenteffluent limitations for small plants thanfor medium or large sized plants in sixsubcategories. Because of raw wastecharacteristics, carbon adsorption is notneeded by greige mills. Thus, best avail-able technology economically achievableis multi-media filtration for small textilemills in six subcategories and all greigemills and activated carbon adsorptionfor the remainder of the seven textilesubcategories. Small mills in six sub-categories are defined by final productcapacity as follows: Wool scouring plantswith capacity less than 6,500 kg/day;

'wool finishing mills with capacity lessthan 900 kg/day; woven fabric finishingmills with capacity less than 1000 kg!day; knit fabric finishing mills with ca-pacity less. than 3,450 kg/day; carpetmills with capacity less than 3,450kg/day; and stock and yarn dyeing andfinishing mills with capacity less than3,100 kg/day.

The additional price increases for thebest available technology economicallyachievable are estimated to range from0.05 to 0.4 cents per kilogram of productprocessed byjmodel small plants in sixsubcategories and all greige mills. Forlarger plants in the six subcategories theprice increases range from 0.4 cents perkilogram to a high of 2.0 cents per kilo-gram. The overall costs of best practi-cable and best available technology areestimated to range between 0.3 and 1.1cents per kilogram (0.6 and 2.5 cents perpound) produced by small plants and

between 0.5 and 2.5 cents per kilogram(1.0 and 5.4 cents per pound) of productfrom larger plants.

Non-water quality impacts of the pol-lution control systems were analyzed and,found to be of little consequence. Energyrequirements of the industry are rela-tively low: Power required to operate themore refined mechanically aerated blo-logical systems will increase consumptionby considerably less than 10 Percent.Solid wastes from treatment sludges andsome odor from treatment systems areencountered, but no substantial impactcan be identified.

It should be noted that a precise studyof. economic impact is difficult due tonumerous other economic forces at workwithin an industry, and because of thegreat variability experienced from plant-to-plant in such factors as pollution con-trol costs, profitability, and return oninvestment. In an economic study suchas this, it is difficult to deal with thesefactors on an individual plant basis.

It is not expected that any significant.economic impact would result from im-posing the best practicable effluentlimitations on all segments of this cate-gory by 1977.

Also, it is not expected that any sig-nificant economic impact would resultfrom imposing the best available effluentlimitations on industry segments by 1983.Because of this conclusion, we judge thatthe proposed guidelines for 1977, 1983and new sources are economicallyachievable.

The report entitled "Development Doc-ument for Proposed Effluent LimitationsGuidelines and New Source PerformanceStandards for the Textile Industry PointSource Category" details the analysis un-dertaken in support of the regulationsbeing proposed herein and is available forinspection in the EPA Information Cen-ter, Room 227, West Tower, WatersideMall, Washington, D.C., at all EPA re-gional offices, and at State water pollu-tion control offices. A supplementaryanalyss prepared for EPA of the pos-sible economic effects of the proposedregulations is also available for inspec-tion at these locations. Copies of both ofthese documents are being sent to per-sons or institutibns affected by the pro-posed regulations, or who have placedthemselves on a mailing list for thispurpose (see EPA's7 Advance Notice ofPublic Review Procedures, 38 FR 21202,August 6, 1973). (c) Environmental explanation. OnJune 14, 1973, the Agency published pro-cedures designed to insure that, whencertain major -standards, regulations,and guidelines are proposed, an explana-tion of their basis, purpose and environ-mental' effects 'is made available to thepublic. (38 FR 15653) The proceduresare applicable to major standards, reg-ulations and guidelines which are pro-

posed on or hfter December 31, 1973 andwhich prescribe national standards ofenvironmental quality or require nationalemission, effluent or performance stand-ards and limitations.

The Agency determined to implementthese procedures In order to insure thatthe public was apprised of the environ-mental effects of Its major standardssetting actions and was provided withdetailed background information to as-sist it in commenting on the merits ofa proposed action. In brief, the proce-dures call for the Agency to make publicthe information available to it delineat-ing the major nonenvIronmental factorsaffecting the decision, and to explain theviable options available to it and thereasons for the option selected.

The procedures contemplate publica-tion of this information in the 1EDERALREGIsTER, where this is practicable. Theyprovide, however that where, because ofthe length of these materials, such pub-lication is Impracticable, the materialmay be made available in an alternateformat.

The report entitled "Development Doc-ument for Proposed Effluent LimitationsGuidelines and New Source PerformanceStandards for the Textile Industry PointSource Category" contains Informationavailable to the Agency concerning themajor environmental effects of the reg-,ulation proposed below, including:

(1) The pollutants presently dis-charged into the Nation's waterways bymanufacturers of textiles and the degrceof pollution reduction obtainable fromimplementation of the proposed guide-lines and standards (see particularlySections IV, V, VI, IX, X, and XI)I

(2) The anticipated effects of the pro-posed regulation on other aspects of theenvironment including air, subsurfacewaters, solid waste disposal and land use,and noise (see particularly Section VIII);and

(3) Options available to the Agency Indeveloping the proposed regulatory sys-tem and the reasons for Its selecting theparticular levels of effluent reductionwhich are proposed (see particularly Se-tions VI, VII, and VIII).

The supplementary report entitled"Economic Analysis of Proposed EffluentGuidelines TEXTILES INDUSTRY" con-tains an estimate of the cost of pollu-tion control requilrements and an analy-sis of the possible effects of the proposedregulations on prices, production levels,employment, communities In which tex-tile manufacturing plants are located,and international trade. In addition, theabove described Development Documentdescribes, In Section VIII, the cost andenergy consumption implications of theproposed regulations.

The two reports described above in theaggregate exceed 200 pages in length andcontain a substantial number of charts,diagrams, and tables. It is clearly im-practicable to publish the material con-tained In these documents In the F EDEAT.REGISTER. To the extent possible, signifi-cant aspects of the material have beenpresented in summary form In foregoing

The comnents were highly variable,ranging from full approval to rejection.It must be clearly understood that thetreatment technologies used to de-velop the effluent limitations are alterna-tive systems that have operated satis-factorily.

The primary Issues raised in the de-velopment of the proposed effluent limi-tations guidelines and standards of per-formance and the treatment of theseissues herein are as follows:

(1) Some comments were to the effectthat the best available effluent limita-tions were too stringent. As outlined inthe Development Document, the bestavailable control technology economi-cally achievable is the best practicablecontrol technology plus multimedia fil-tration or activated carbon adsorption.Thle cost effectiveness of multiple-effectevaporation and incineration was evalu-ated and these, technologies were deter-mined to be less desirable than filtrationor adsorption. Accordingly, best avail-able effluent limitations have been de-veloped based on filtration or carbontreatment.

(2) A number of commentors took theposition that the cost and energy re-quirements of the best available effluentlimitations were excessive. As mentionedabove, the cost effectiveness of evapora-tion and incineration were determinedto be less desirable than filtration or ad-sorption. Furthermore, economic analy-ses indicate that the disecononles ofscale resulting from activated carbon ad-sorption would create a more severe eco-nomic Impact on many small textile millsthan on the rest of the industry. Thus,exceptions have been made within sixsubcategories that provide for differentlimitations for small mills.

(3) Both the technical and economicstudies have had to make important de-cisions on very limited information. Ef-fluent limitations for wool subcategoriesare supported by only a limited database. The more severe economic Impactsfor small mills are based on very limitedinformation. Interested persons are In-vited to submit comments on any aspectof the proposed guidelines, particularlyas they effect the small textile millwhether the discharge is to surfacewaters or a municipal treatment system.Information on alternative treatmenttechnologies to meet the guidelines andthe associated costs are specifically re-quested. The number, size, and locationsof plants affected by the guidelines havebeen estimated by EPA. Any externalestimates by industry are invited. Onthe basis of the .information available,EPA will further evaluate segmentationon the basis of size in the final regulation.

Interested persons may participate inthis rulemaking by submitting writtencomments to the EPA InformationCenter, Environmental ProtectionAgency, Washington, D.C. 20460, Atten-tion: Mr. Philip B. Wisman. Commentson all aspects of the proposed regulations

are solicited. In the event comments areIn the nature of criticisms as to theadequacy of data which is available, orwhich may be relied upon by the Agency,comments should Identify and, If pos-sible, provide any additional data whichmay be available and should indicatewhy such data Is essential to the develop-ment of the regulations. In the eventcomments address the approach takenby the Agency in establishing an effluentlimitation guideline or standard of per-formance, EPA solicits suggestions as towhat alternative approach should betaken and why and how this alternativebetter satisfies the detailed requirementsof sections 301, 304(b), 306, and 307 ofthe Act.

Subpart G-Stock and Yam Dyeing andFlnlshlng Subcategory

§ 410.70 Applicability; description ofstock and yarn dyeing and finishingsubcategory.

The provisions of this subpart are ap-plicable to dischaes resulting from thefollowing types of textile mil: Stockand yarn dyeing and finishing which mayInclude any or all of the following unitoperations and processes; cleaning,scouring, bleaching, mercerizing, dyeingand Special finishing.§ 410.71 Specialized definitions.

For the purposes of this subpart:(a) The term "product" shall mean

the final material produced or processedby the mill;

(b) The term "fecal coliform" shall bemeasured by the procedure presented in"Standard Methods for the Examinationof Water and Wastewater", 13th Edition,1971.

(c) The following -abbreviations shallhave the followingmeanings: (1) "k'"shall mean kilograms(s); (2) 1kkg"shall mean 1,000 kilograms; (3) "lb"shall mean pound(s); (4) "ml" ,;allmean milliliter; (5) "TSS" shall meantotal suspended nonfilterable solids; (6)"BODS" stall mean five day biochemi-cal oxygen demand; (7) "COD" shallmean the chemical oxygen demand.

The pretreatment standards undersection 307(c) of the Act, for a sourcewithin the stock and yarn dyeing andfinishing subcategory which Is an indus-trial user of a publicly owned treatmentworks (and which would be a new sourcesubject to section 306 of the Act, if Itwere to discharge pollutants to navigablewaters), shall be the standard set forthin Part 128 of this chapter, except thatfor the purposes of this section, § 128.133of this chapter, shall be amended to readas follows:

In addition to the prohibitions set forth in§ 128.131 of this chapter, the pretreatmentstandpxd for incompailble pollutants intro-duced Into a publicly owned treatment worksby a major contributing industry shall bethe standard of performance for new sourcesspecified In § 410.74: Provided, That, If thepublicly owned treatment works which re-ceives the pollutants is conimitted, in itsNPDES permit, to remove a specified percent-age of any in'compatible pollutant, the pro-treatment standard applicable to users ofsuch treatment works shall be correspond-ingly reduced for that pollutant.
