9 Transitional provisions consequent on making of Standard Instrument (Local Environmental Plans) Amendment Order 2011(1) The amendments made by the Standard Instrument (Local

Environmental Plans) Amendment Order 2011 (the amendingOrder) to the standard instrument prescribed by this Order do nothave effect in relation to any local environmental plan that was inforce immediately before the commencement of the amendingOrder until 4 months after that commencement.

(2) In any instrument or in any map adopted by an instrument, areference to Zone RU4 Rural Small Holdings is taken to includea reference to Zone RU4 Primary Production Small Lots.

(3) For the purposes of subclause (2), instrument means a localenvironmental plan made under section 33A of the Act or anyother environmental planning instrument that adopts or refers tothe land use zones under the standard instrument prescribed bythis Order.

(4) This clause does not limit the operation of clause 8.

(3) The size of any lot resulting from a subdivision of land to whichthis clause applies (other than any lot comprising associationproperty within the meaning of the Community LandDevelopment Act 1989) is not to be less than the minimum sizeshown on the Lot Size Map in relation to that land.Direction. 5.9AA Trees or vegetation not prescribed by development control plan [compulsory](1) This clause applies to any tree or other vegetation that is not of a

species or kind prescribed for the purposes of clause 5.9 by adevelopment control plan made by the Council.

(2) The ringbarking, cutting down, topping, lopping, removal,injuring or destruction of any tree or other vegetation to whichthis clause applies is permitted without development consent.

[52] Clause 5.10 Heritage conservationOmit the clause. Insert instead:

5.10 Heritage conservation [compulsory]Note. Heritage items (if any) are listed and described in Schedule 5. TheHeritage Map may also show the location of a heritage item. Heritageconservation areas (if any) must be shown on the Heritage Map as wellas being described in Schedule 5.The location and nature of Aboriginal objects and Aboriginal places ofheritage significance may be described in Schedule 5 and shown on thesheet of the Heritage Map marked “Aboriginal Heritage Map”.

(1) Objectives

The objectives of this clause are as follows:(a) to conserve the environmental heritage of [Name of local

government area or other relevant name],(b) to conserve the heritage significance of heritage items and

heritage conservation areas, including associated fabric,settings and views,

(c) to conserve archaeological sites,(d) to conserve Aboriginal objects and Aboriginal places of

heritage significance.

(2) Requirement for consent

Development consent is required for any of the following:(a) demolishing or moving any of the following or altering the

exterior of any of the following (including, in the case of abuilding, making changes to its detail, fabric, finish orappearance):(i) a heritage item,

(ii) an Aboriginal object,(iii) a building, work, relic or tree within a heritage

conservation area,(b) altering a heritage item that is a building by making

structural changes to its interior or by making changes toanything inside the item that is specified in Schedule 5 inrelation to the item,

(c) disturbing or excavating an archaeological site whileknowing, or having reasonable cause to suspect, that thedisturbance or excavation will or is likely to result in a relicbeing discovered, exposed, moved, damaged or destroyed,

(d) disturbing or excavating an Aboriginal place of heritagesignificance,

(e) erecting a building on land:(i) on which a heritage item is located or that is within

a heritage conservation area, or(ii) on which an Aboriginal object is located or that is

within an Aboriginal place of heritage significance,(f) subdividing land:

(i) on which a heritage item is located or that is withina heritage conservation area, or

(ii) on which an Aboriginal object is located or that iswithin an Aboriginal place of heritage significance.

(3) When consent not required

However, development consent under this clause is not requiredif:(a) the applicant has notified the consent authority of the

proposed development and the consent authority hasadvised the applicant in writing before any work is carriedout that it is satisfied that the proposed development:(i) is of a minor nature or is for the maintenance of the

heritage item, Aboriginal object, Aboriginal placeof heritage significance or archaeological site or a

(ii) would not adversely affect the heritage significanceof the heritage item, Aboriginal object, Aboriginalplace, archaeological site or heritage conservationarea, or

(b) the development is in a cemetery or burial ground and theproposed development:(i) is the creation of a new grave or monument, or

excavation or disturbance of land for the purpose ofconserving or repairing monuments or gravemarkers, and

(ii) would not cause disturbance to human remains,relics, Aboriginal objects in the form of gravegoods, or to an Aboriginal place of heritagesignificance, or

(c) the development is limited to the removal of a tree or othervegetation that the Council is satisfied is a risk to humanlife or property, or

(d) the development is exempt development.(4) Effect of proposed development on heritage significance

The consent authority must, before granting consent under thisclause in respect of a heritage item or heritage conservation area,consider the effect of the proposed development on the heritagesignificance of the item or area concerned. This subclause appliesregardless of whether a heritage management document isprepared under subclause (5) or a heritage conservationmanagement plan is submitted under subclause (6).

(5) Heritage assessment

The consent authority may, before granting consent to anydevelopment:(a) on land on which a heritage item is located, or(b) on land that is within a heritage conservation area, or(c) on land that is within the vicinity of land referred to in

paragraph (a) or (b),require a heritage management document to be prepared thatassesses the extent to which the carrying out of the proposeddevelopment would affect the heritage significance of theheritage item or heritage conservation area concerned.

(6) Heritage conservation management plans

The consent authority may require, after considering the heritagesignificance of a heritage item and the extent of change proposedto it, the submission of a heritage conservation management planbefore granting consent under this clause.

(7) Archaeological sites

The consent authority must, before granting consent under thisclause to the carrying out of development on an archaeologicalsite (other than land listed on the State Heritage Register or towhich an interim heritage order under the Heritage Act 1977applies):(a) notify the Heritage Council of its intention to grant

consent, and(b) take into consideration any response received from the

Heritage Council within 28 days after the notice is sent.(8) Aboriginal places of heritage significance

The consent authority must, before granting consent under thisclause to the carrying out of development in an Aboriginal placeof heritage significance:(a) consider the effect of the proposed development on the

heritage significance of the place and any Aboriginalobject known or reasonably likely to be located at the placeby means of an adequate investigation and assessment(which may involve consideration of a heritage impactstatement), and

(b) notify the local Aboriginal communities, in writing or insuch other manner as may be appropriate, about theapplication and take into consideration any responsereceived within 28 days after the notice is sent.

(9) Demolition of nominated State heritage items

The consent authority must, before granting consent under thisclause for the demolition of a nominated State heritage item:(a) notify the Heritage Council about the application, and(b) take into consideration any response received from the

Heritage Council within 28 days after the notice is sent.(10) Conservation incentives

The consent authority may grant consent to development for anypurpose of a building that is a heritage item or of the land onwhich such a building is erected, or for any purpose on an

Aboriginal place of heritage significance, even thoughdevelopment for that purpose would otherwise not be allowed bythis Plan, if the consent authority is satisfied that:(a) the conservation of the heritage item or Aboriginal place of

heritage significance is facilitated by the granting ofconsent, and

(b) the proposed development is in accordance with a heritagemanagement document that has been approved by theconsent authority, and

(c) the consent to the proposed development would requirethat all necessary conservation work identified in theheritage management document is carried out, and

(d) the proposed development would not adversely affect theheritage significance of the heritage item, including itssetting, or the heritage significance of the Aboriginal placeof heritage significance, and

(e) the proposed development would not have any significantadverse effect on the amenity of the surrounding area.

(3) The consent authority must not grant consent under this Plan tocarry out development for the purposes of an eco-tourist facilityunless the consent authority is satisfied that:(a) there is a demonstrated connection between the

development and the ecological, environmental andcultural values of the site or area, and

(b) the development will be located, constructed, managedand maintained so as to minimise any impact on, and toconserve, the natural environment, and

(c) the development will enhance an appreciation of theenvironmental and cultural values of the site or area, and

(d) the development will promote positive environmentaloutcomes and any impact on watercourses, soil quality,heritage and indigenous flora and fauna will be minimal,and

(e) the site will be maintained (or regenerated wherenecessary) to ensure the continued protection of naturalresources and enhancement of the natural environment,and

(f) waste generation during construction and operation will beavoided and that any waste will be appropriately removed,and

(g) the development will be located to avoid visibility aboveridgelines and against escarpments and from watercoursesand that any visual intrusion will be minimised through thechoice of design, colours materials and landscaping withlocal indigenous flora, and

(h) any infrastructure services to the site will be providedwithout significant modification to the environment, and

(i) any power and water to the site will, where possible, beprovided through the use of passive heating and cooling,renewable energy sources and water efficient design, and

(j) the development will not adversely affect the agriculturalproductivity of adjoining land, and

(k) the following matters are addressed or provided for in amanagement strategy for minimising any impact on thenatural environment:(i) measures to remove any threat of serious or

irreversible environmental damage,(ii) the maintenance (or regeneration where necessary)

of habitats,

emergency services organisation means any of the following:(a) Ambulance Service of New South Wales,(b) Fire and Rescue NSW,(c) NSW Rural Fire Service,(d) NSW Police Force,(e) State Emergency Service,(f) New South Wales Volunteer Rescue Association

Incorporated,(g) New South Wales Mines Rescue Brigade established

under the Coal Industry Act 2001,(h) an accredited rescue unit within the meaning of the State

Emergency and Rescue Management Act 1989.environmental protection works means works associated withthe rehabilitation of land towards its natural state or any work toprotect land from environmental degradation, and includes bushregeneration works, wetland protection works, erosion protectionworks, dune restoration works and the like, but does not includecoastal protection works.extensive agriculture means any of the following:(a) the production of crops or fodder (including irrigated

heritage management document means:(a) a heritage conservation management plan, or(b) a heritage impact statement, or(c) any other document that provides guidelines for the

ongoing management and conservation of a heritage item,Aboriginal object, Aboriginal place of heritagesignificance or heritage conservation area.

high technology industry means a building or placepredominantly used to carry out an industrial activity thatinvolves any of the following:(a) electronic or micro-electronic systems, goods or

components,(b) information technology (such as computer software or

hardware),(c) instrumentation or instruments of a scientific, industrial,

technological, medical or similar nature,(d) biological, pharmaceutical, medical or paramedical

systems, goods or components,(e) film, television or multi-media technologies, including any

post production systems, goods or components,(f) telecommunications systems, goods or components,(g) sustainable energy technologies,(h) any other goods, systems or components intended for use

in a science or technology related field,but does not include a building or place used to carry out anindustrial activity that presents a hazard or potential hazard to theneighbourhood or that, because of the scale and nature of theprocesses involved, interferes with the amenity of theneighbourhood.Note.
