industriousness is a willingness to go beyond what is asked of you. it’s not just showing up and going through the motion, it is inspired, arduous work. The hours of a physician are long, the work laborious, but the care of patients demands an individual who is willing to go the extra mile. Diligence is what is required to develop the skills needed

to take care of patients. Learning procedural skills is important, but so also are the cognitive skills that help you listen, assimilate information, and develop a care plan. it takes initiative to read more about your patients, to study their problems and provide the best care for them. You cannot begin to do the work of a physician if you don’t

have initiative. initiative is the energy and desire to put ideas into action. it is this inner drive that makes physicians independent learners and helps them to make informed decisions and take action. This is why medicine is a practice, you have to continually obtain new knowledge, hone your skills, and apply those skills to the care of patients. This work ethic keeps one beside the woman in labor; available to the family when a loved one is dying of cancer; or responsive to the worried mother on the phone about her child with a fever.

The Academy has been very industrious this legislative session. At this writing our prior Authorization Bill appears to be headed to the governor’s desk to be signed into law. There appears to be a budgetary amendment that will expand the intent of the law from the Commercial payers to include Medicaid plans as well. With the help of members, and their willingness to reach out to their legislators we appear to have addressed the patient safety concern for providers who are approved to perform CDL exams. it will now be important for many of us to consider becoming credentialed to perform these exams to meet the demand for drivers seeking these exams.

On February 11th, the Academy cosponsored with MSV a White Coats On-Call Day for Family physicians at the Capitol. The day provided an opportunity for physicians to learn about Advocacy, meet with Legislators, attend Committee Meetings and interact with our legislative liaisons.

The administrative team continues to develop the job search feature for the website. This site will allow applicants to search for positions available in different regions of the Commonwealth and improve the retention rate of graduating residents to remain in Virginia.

The Health of the public committee is working with the VDH initiative that seeks to address the issues of healthcare disparity and the need for all citizens of

the Commonwealth to have equal opportunity to be healthy. This might include programs such as the Million Hearts Collaborative.

The recent Winter Meeting at Wintergreen was once again an overall success both in the quality of CME provided, and the opportunity for members to interact and learn from one another. The Academy looks forward to the Annual Meeting to be held in Williamsburg this July/August.

The initiatives of the Academy are driven by you the members and your input as always is welcomed and requested. Autonomy. It’s a word we attorneys often use to describe our law practice. There are very few insurance companies that can tell us what we’ll be paid for what we do. We largely regulate ourselves. That’s not so with physicians. Either the federal or state government tells you how or what you can or what you can’t do at every turn. The government tells you how you can invest your money and, worse yet, how you can’t invest it. It restricts how you can advertise your practice, whether you can prescribe medicines for your spouse, and what you’ll be paid for what you do. There’s even a place where every person on earth can go to check up on you. Believe it or not, CMS now has created two mobile apps designed to help physicians keep track of the give-aways they receive from drug companies. Part of ObamaCare, these apps let doctors electronically tabulate, and report to the feds, every pen, mug, and consulting fee they receive from drug manufacturers, right on their I-phone. And, yes, this data is available to the public on a searchable web site. The AMA and many state medical societies supported this so-called “Sunshine Act” to bolster patient confidence in their member-physicians. What’s being missed, however, is that all this regulation (no matter which governmental entity it comes from) represents a steadily increasing change in how government views the medical profession. And physicians have let it happen to them. They have permitted federal limitations and state reporting requirements to impose a profound and troubling snapshot of the medical profession.

One of the fundamental tenets of professional autonomy and responsibility is self-regulation. Like law, medicine used to afford privileges merely because of its commitment to impartial public service. No one would argue today, however, that medical societies still provide an adequate measure of regulatory supervision over physicians. Let’s tell it like it is – medical societies exist today largely to lobby for more money or additional time for physicians to earn it. Their lobbyists are reactive. They play defense. Neither Washington nor Richmond has demonstrated an abundance of faith in physicians. Government sees a need to regulate and legislate nearly every aspect of a physician’s medical practice. If there was a problem with drug manufacturers and their gifts to physicians, there already was a law to punish that conduct, and it’s called an anti-kickback statute. The Feds have an anti-kickback statute, and so does Virginia. The medical profession is ailing, and the “Sunshine Act” demonstrates both the symptom and the disease. It’s the natural result of the failure of the medical profession to effectively self-regulate. At least, now there’s an app for that.

The VAFp achieved significant success in the 2015 Virginia general Assembly Session! An intense 45-day session closed on Saturday, 28 February and the VAFp secured its major offensive and defensive priorities.

PrescriPtion Drug Prior AuthorizAtion reform

After an intense lobbying effort, lengthy negotiations with the Virginia Association of Health plans, America’s Health insurance plans, Express Scripts, and Anthem - BCBS, the prescription drug prior authorization reform legislation has been enacted by the general Assembly. The twin bills, House Bill 1942 (Habeeb) and Senate Bill 1262 (newman) passed both chambers of the general Assembly and are on their way to governor McAuliffe’s desk for approval.

These bills will force significant reforms to Virginia’s prior authorization laws requiring carriers to accept electronic submission of prior authorization requests and mandating a response time limit of two business days and 24 hours on routine and urgent prior authorization requests respectively. patients transferring carriers will enjoy at least 30 days of grandfathered prior authorization approvals and all relevant prior authorization information, including formularies, procedures, and forms, must now be centrally located on a carrier’s website.

Additionally, the VAFp is charged with convening stakeholder meetings with Virginia health plans in order to identify evidence-based prior authorization standards for the ten most commonly prescribed chronic disease, mental health, and generic medications. These conversations will allow VAFp representatives to sit down and meaningfully discuss clinical criteria with health plan medical directors and formulary directors. The general Assembly’s Health insurance reform Commission and its respective Commerce & Labor Committees will review the report generated from these meetings.

Finally, VAFp secured an amendment in the general Assembly’s budget committee conference report to extend the provisions of HB1942/SB1262 to the Virginia Medicaid managed care plans. The amendment was filed by Delegate Chris peace. These provisions align the Medicaid managed care plans with the reforms to the commercial carriers.

chiroPrActor scoPe of PrActice threAt

Family physicians faced a significant scope of practice threat this session in Senate Bill 1244. SB1244 would have expanded the scope of chiropractic in Virginia allowing chiropractors to perform Department of Transportation physicals for commercial driver’s license applicants. SB1244 had the support of the Virginia Chiropractic Association and the Virginia Trucking Association.

Thanks to member e-mails and phone

calls to key legislators, as well as testimony in the House Health subcommittee, this legislation was defeated. While we were successful, it is likely that this and other scope of practice issues will return.

It’s an exciting time for Family Medicine! The AAFP Foundation has launched its new Education Signature Program, Family Medicine Leads.

What is it? The purpose of Family Medicine Leads is to ensure the future of the Family Medicine specialty by supporting efforts to fill the workforce pipeline with the quantity and quality

of family physicians needed to improve the health of all people.

How? With a year round program that builds upon the National Conference of Family Medicine Residents and Students experience by:

• Increasing the number of scholarships to National Conference from 200 to 250. Scholarships focus on rising second- and third-year students to influence their commitment to the specialty.

• Delivering a competitive leadership development program, Family Medicine Leads Emerging Leader Institute. FAMILY MEDICINE CARES USA MAKING A DIFFERENCE IN YOUR STATE

Since the program’s inception in 2011, Family Medicine Cares, USA (FMC USA), the AAFP Foundation’s Humanitarian Signature Program, has helped free clinics across the United States

to provide more than an estimated 3.5 million dollars in services as a result of approximately 18,000 patient visits. The FMC USA program gives up to $25,000 for the start-up efforts of new free health clinics and up to $10,000 for existing health clinics that provide services at no charge to patients nationwide. This year, FMC USA was pleased to award $10,000 to CrossOver Healthcare Ministry. CrossOver has been serving the low-income, uninsured residents of the greater Richmond area for over 30 years. With two full-service locations, CrossOver is the largest free clinic in Virginia and provides healthcare services to more than 7,000 patients. CrossOver utilized the FMC USA funds to benefit patients from more than 20 cities and counties in Central Virginia by purchasing much needed clinical

equipment (e.g. a physician scale, blood pressure cuff and standing machines, diagnostic system, electrocardiogram machine, and blood draw chairs) and diabetes testing supplies. For CrossOver, “New standardize and effective equipment gives the patient’s overall experience a quality one. Also, the look and feel of our offices and the equipment we use gives the patient the dignity and respect they deserve.”

In addition to providing grants the FMC USA program also offers opportunities for family physicians, residents, and medical students to volunteer at the free clinics in their area. In the past year, CrossOver has seen an unprecedented increase in the need for health care services, because many of their patients have lost their jobs and no longer have health insurance. The necessity for additional volunteers is great. Stone Mountain Health Services (SMHS), a network of community health centers in Southwestern Virginia, and Russell County Medical Center (RCMC), located in Lebanon, Virginia, are currently seeking a Full Time Family Medicine or Internal Medicine Physician to work in a future o�ce planned for Lebanon, Virginia. The mission of SMHS is to provide quality primary health care that is accessible, a�ordable, and community-based to the people of Southwestern Virginia.

RCMC will provide an Income Guarantee, Sign-On Bonus, Relocation Assistance, Residency Stipend and Educational Loan Reimbursement to quali�ed candidate. SMHS base salaries are negotiated and competitive. Bonus incentives are paid based on productivity and quality. Bene�ts include 17 vacation days, one week CME, 11 days sick, and 8 paid holidays per year. Malpractice coverage for the provider is provided at no cost to the physician. SMHS provides a $25,000 life insurance policy, free of charge, through United Health Care to Medical Providers.
