Gov’t Bldg, 1781Greensville County Circle, Emporia, VA on April 12, 2017 at 6:00pmINFORMATION BRIEFING: Same date and location from 5:30pm to 6:00pm (just prior to hearing)PERMIT NAME: Significant amendment to a Prevention of Significant Deterioration Permit issued byDEQ, under the authority of the Air Pollution Control BoardAPPLICANT NAME AND REGISTRATION NUMBER: Virginia Electric and Power Company, #52525FACILITY NAME AND ADDRESS: Greensville County Power Station, 2500 Rogers Rd., Emporia, VAPROJECT DESCRIPTION: Virginia Electric and Power Company has applied for a permit amendment tomodify the Greensville County Power Station. The facility will be classified as a major source of airpollution and will be located at 2500 Rogers Road, just west of Emporia, Virginia. This amendment willbe to update the rated capacities of the ancillary equipment to be built at the facility. Facility-wideemissions are decreasing. The revised maximum annual emissions of air pollutants from the facility areexpected to be: 188.4 tons of PM10, 187.9 tons of PM2.5, 878.5 tons of CO, 369.0 tons of NOx, 56.5 tonsof SO2, 646.8 tons of VOC, 29.8 tons of H2SO4, 5,782,968 tons of CO2e, 0.18 tons of acrolein, 6.5 tons offormaldehyde, 1.2 lbs of beryllium, 106.6 lbs of cadmium, 135.2 lbs of chromium, 48.6 lbs of lead, 25.2lbs of mercury, and 204 lbs of nickel. Modeling has shown that the proposed power station does notcause or significantly contribute to a predicted violation of any applicable NAAQS, Class I or Class II PSDincrement.HOW TO COMMENT AND/OR REQUEST BOARD CONSIDERATION: DEQ accepts comments andrequests for Board consideration by hand-delivery, e-mail, fax or postal mail. All comments and requestsmust be in writing and be received by DEQ during the comment period. Submittals must include thenames, mailing addresses and telephone numbers of the commenter/requester and of all personsrepresented by the commenter/requester. Change Order No. I to the contract documents for the installation of Well #5 project for the town of Ivor located in Southampton County have been reviewed by this office. The original contract documents were approved on August 30, 2016.

Change Order No. I reflects the negotiations with the bidder to lower the cost of the project. Some of the changes to the project scope include reducing the diameter of the well casing and screens, reducing the length of the screens and gravel pack, and reducing the depth of the well pump intake.

The Change Order is technically adequate and is approved by this Office, in accordance with Commonwealth of Virginia Waterworks Regulations, § 12 V AC 5-590-240. A copy of this document is on file in the Southeast Virginia Field Office.

This approval does not suspend, minimize, or otherwise alter the waterworks obligation to comply with federal, state, or local laws and regulations or permits.

RESOLUTION OF SUPPORT FOR DISPOSAL OF BUSINESS SOLID WASTE IN AN

ENVIRONMENTALLY AND ENERGY EFFICIENT MANNER

WHEREAS the disposal of solid waste in Hampton Roads is a critical issue for local governments and businesses, and

WHEREAS those organ izations must know their costs for disposal in planning budgets for the coming fiscal year, and

WHEREAS a growing number of companies or other organizations practice "zero landfilling" for their waste, and

WHEREAS waste to energy, which dramatically reduces dependence on landfilling, has been an integral part of the regional solid waste disposal system for decades in Hampton Roads, and

WHEREAS that process is essential to the operation of the Norfolk Naval Shipyard, one of the area's largest employers with nearly 10,000 workers, by providing heat for its buildings and dry­docks and a backup renewable energy source for the facility, and

WHEREAS the company that currently owns and operates the waste to energy plants in Portsmouth is a significant local taxpayer, supporter of environmental groups including the Elizabeth River Project, a major employer and economic driver in the region, and

WHEREAS the Southeastern Public Service Authority is now deciding which vendor will be granted the contract to transport and process nearly 400,000 tons of commercial waste annually beginning in 2018, and

WHEREAS the current company is the only one under consideration that will process the waste for a beneficial purpose (steam and electricity) and not dispose of it directly into a landfill,

THEREFORE BE IT RESOLVED that the Hampton Roads Chamber strongly urges the Southeastern Public Service Authority to select a vendor that will continue our region's reliance on waste to energy, which has served our community, the environment and the United States Navy well and can continue to do so for decades to come.

CenturyLink, and (ii) the transfer of minority control of CenturyLink's certificated Virginia

operating subsidiaries, Centel Virginia, United Southeast, and CLC (collectively, "CenturyLink

OpCos"), to Level 3's shareholders. ("Proposed Transfers").3

According to the Petition, an Agreement and Plan of Merger was entered into on

October 31, 2016, through which Level 3 will be merged into a wholly owned subsidiary of

CenturyLink.4 The Petitioners state that as a result of the merger, CenturyLink will acquire

indirect control over Level 3 and each of its subsidiaries, including the Level 3 OpCos.5 The

Level 3 OpCos and CenturyLink OpCos are authorized to provide telecommunications services

in the Commonwealth of Virginia pursuant to certificates of public convenience and necessity

issued by the Commission.6 The Petitioners further assert that upon the closing of the

transaction, CenturyLink shareholders will own approximately 51% and Level 3 shareholders

will own approximately 49% of the combined company.7

In support of the Proposed Transfers, the Petitioners assert that the standard of review

provided in Code § 56-88.1 is met as the Petitioners currently possess the financial, managerial,

and technical resources to render local exchange telecommunications services as evidenced by

their current certifications and provision of these services and will retain such resources p

following the completion of the Proposed Transfers.8 The Petitioners further represent that the jj^

Proposed Transfers will not negatively affect existing consumer services or contractual

obligations and that the Level 3 OpCos and CenturyLink OpCos will continue to offer services

as they do presently and subject to the same rules, regulations, and applicable tariffs or price

lists.9

NOW THE COMMISSION, upon consideration of the Petition and applicable statutes,

finds that this matter should be docketed; that the Petitioners should give notice of the Petition to

the public; that interested persons should have an opportunity to comment and request a hearing

on the Petition; and that the Commission's Staff ("Staff) should be directed to investigate the

Petition and file a report containing the Staffs findings and recommendations ("StaffReport").

Further, a Hearing Examiner should be appointed to rule on all discovery matters that arise

during the course of this proceeding.

Under Code § 56-88.1, the Commission must approve or disapprove this Petition no later

than 60 days from the filing date, unless the review period is extended by the Commission up to

an additional 120 days. We find that our review period should be extended an additional 60

days. We expect to rule on the Petition expeditiously but find that additional time is necessary to

review the transaction, to provide public notice, and to afford interested persons an opportunity

to file comments or request a hearing.

Accordingly, IT IS ORDERED THAT:

(5) On or before February 28, 2017, the Petitioners shall serve a copy of this Order for

Notice and Comment on the chairman of the board of supervisors and the county attorney of any

county and upon the mayor or manager (or equivalent official) and city or town attorney of every

city and town in the Petitioners' service territory in the Commonwealth of Virginia. Service shall

be made by either personal delivery or first class mail to the customary place of business or

residence of the person served.

(6) The Petitioners shall respond promptly to requests for copies of the Petition and shall

provide one copy free of charge. A copy of the Petition may be obtained by submitting a written

(9) On or before March 17, 2017, any person or entity may request that the Commission

convene a hearing on the Petition by filing a request for hearing. If not filed electronically, an

original and fifteen (15) copies of the request for hearing shall be filed with the Clerk of the

Commission at the address set forth in Ordering Paragraph (7). A copy of the request for hearing

also shall be served upon counsel for the Petitioners at the addresses set forth in Ordering

Paragraph (6) and sent via electronic mail or facsimile transmission at the email addresses or fax

numbers set forth in the Petition. Requests for hearing shall refer to Case No. PUR-2017-00007

and shall include: (i) a precise statement of the filing party's interest in the proceeding; (ii) a

statement of the specific action sought to the extent then known; (iii) a statement of the factual

and legal basis for such action; and (iv) a precise statement why a hearing should be conducted

in this matter. Any request for hearing shall state with specificity why the issues raised in the

request for hearing cannot be adequately addressed without a hearing. All such filings shall refer

(10) On or before March 17, 2017, any person or entity may participate as a respondent in ^

© this proceeding by filing a notice of participation in accordance with 5 VAC 5-20-140 and 5 VAC lba

5-20-150 of the Rules of Practice. If not filed electronically, an original and fifteen (15) copies of

the notice of participation shall be filed with the Clerk of the Commission at the address set forth

in Ordering Paragraph (7). The respondent shall serve a copy of the notice of participation on

counsel to the Petitioners at the addresses set forth in Ordering Paragraph (6). Pursuant to 5 VAC

5-20-80 B of the Rules of Practice, any notice of participation shall set forth: (i) a precise

statement of the interest of the respondent; (ii) a statement of the specific action sought to the

extent then known; and (iii) the factual and legal basis for the action. Any organization,

corporation, or government body participating as a respondent shall be represented by counsel as

required by 5 VAC 5-20-30 of the Rules of Practice. All filings shall refer to Case No. PUR-

2017-00007.

(11) Within five (5) business days of receipt of a notice of participation as a respondent,

the Petitioners shall serve upon each respondent a copy of this Order for Notice and Comment, a

copy of the Petition, and all materials filed by the Petitioners with the Commission in this

proceeding, unless these materials have already been provided to the respondent.

(12) On or before March 24, 2017, the Petitioners may file with the Clerk of the

Commission a response to any requests for hearing filed in this proceeding. If not filed

electronically, an original and fifteen (15) copies of any response shall be filed with the Clerk of

the Commission at the address set forth in Ordering Paragraph (7). A copy of the response shall

(13) The Staff shall investigate the Petition. On or before April 14, 2017, the Staff shall

file with the Clerk of the Commission an original and fifteen (15) copies of a Staff Report

containing its findings and recommendations.

(14) On or before April 28, 2017, the Petitioners may file with the Clerk of the

Commission any response to the Staff Report and comments filed in this proceeding. If not filed

electronically, an original and fifteen (15) copies of any response shall be filed with the Clerk of

the Commission at the address set forth in Ordering Paragraph (7). A copy of the response shall

be served on any respondent who filed a notice of participation and the Staffs counsel.

(15) The Petitioners shall respond to interrogatories and requests for production of

documents within five (5) calendar days after receipt of the same. In addition to the service

requirements of 5 VAC 5-20-260 of the Rules of Practice, on the day that copies are filed with

the Clerk of the Commission, a copy of the interrogatory or request for production shall be

served electronically, or by facsimile, on the party to whom the interrogatory or request for

production is directed or the assigned Staffs attorney, if the interrogatory or request for

production is directed to the Staff. Except as so modified, discovery shall be in accordance with

Part IV of the Commission's Rules of Practice, 5 VAC 5-20-240 et seq.

COMES NOW the Respondent, Culpeper County, Virginia, through its Board of

Supervisors, and by counsel, pursuant to Title 56 of the Code of Virginia (1950), as amended,

and the State Corporation Commission (SCC) Rules of Practice at 5 VAC 5-20-80-B, which

states as follows:

1. The Board of Supervisors of Culpeper County is the local governing body of one of the

2. The Board of Supervisors of Culpeper County does wish to participate in the ^

P proceedings to be able to voice its position with regard to any concerns identified in the process

and with the proposed transfer of control;

3. The Board does share that local impacts of concern to the Board of Supervisors of

Culpeper County may include, but are not limited to, the continuous provision of reasonable

prices and reliable service, as well as insuring existing consumer services or contractual

obligations are not negatively affected, and that the petitioners will continue to offer services as

they do presently and subject to the same rules, regulations, and applicable tariffs or price lists.

4. The Board of Supervisors of Culpeper County, moreover, does urge the SCC, before

approval, if any, to specifically determine that the proposed transfer of control is reasonable and

in fact in the public interest; and

5. Please note the contact information for the Office of the County Attorney found

below, and the contact information for the County Administrator of Culpeper County, which is
