REGULATORY RESOL TION 2017 - j_

RULES REGARDING SOLAR E ERGY COLLECTIO DEVICES

WHEREAS, the lots in the ully tation subdivision are subject to those restrictive covenants of record set forth in the Amendment and Restatement of Sully Station Declaration of Covenants, Conditions and Restrictions ( 'Declaration"), of record in the land records of Fairfax County at Deed Book 6507, Page 0087, et seq., and related Supplemental Declarations; and,

WHEREAS, Article VI, Section l(c) of the Declaration states in pertinent part that no improvements alterations, modifications or "other work whjch in any way alters the exterior of any Lot ... or the improvements located thereon" shall be undertaken or installed without the prior written appro al of the Architectural Review Board ("ARB')· and,

WHEREAS Article VI, Section l(d) of the Declaration authorizes the Board of Trustees to adopt general rules relating to the use of property with.in the SuJly Station subdivision; and

WHEREAS Va. Code 67-701 (Covenant regarding solar power) states in pertinent part that although a homeowners association cannot prohibit the installation by a lot owner of solar energy collection devices on his lot unless such installation is expressly prohibited by the declaration to the lot is subject, a community association may establish "reasonable restrictions concerning the size, place and manner of placement of such solar energy collection devices on property designated and intended for individual ownership and use'· and,

WHEREAS, by th.is Resolution the Board of Trustees appro es and adopts reasonable regulations governing the installation and maintenance of solar energy collection devices in accordance with aforementioned Virginia statute, which regulations are intended to protect the aesthetic appearance of the Association's lots and thereby preserve property values within the ully tation subdivision· and,

WHEREAS, each lot owner shall be go erned by, and shall comply with, all of the terms of the Declaration and Rules and Regulations, including the design regulations as amended from time to time; and

NOW, THEREFORE, the Board of Trustees adopts the following rules governing the installation and maintenance of solar energy collection devices, which regulations shall be deemed duly adopted and approved regulations of the Association and enforceable as such pursuant to Virginia Code § 55-513A.

I. APPLICATION FOR APPROVAL

A. In accordance with Article VI ection I (c) (Condition for Architectural Control) of the Declaration, prior to the instaJ lation of any solar energy collection device (' solar device ') on a lot/dwelling, the lot owner must submit a written application to the Association for approval of their proposed device and the installation thereof. All applications must include a drawing indicating the exact purpo e, type and size of the device and exact location of de ired in tallation.

II. INSTALLATIO RULES

A. Size and Color

1. Total panel size must be limited to within current residential net metering code regulations.

2. Solar panels framing and piping must match/blend with the roof color or be a dark color.

3. All wiring and control device must be concealed. Exposed piping shall not exceed 3 .

4. Owners should ensur that there is minimal vi ual impact to adjacent properties and public view in order to preserve the design scheme and aesthetic appearance of the Sult tation community.

R Panel Location

1. Roof-mounted panels must be parallel with the roof edge. 2. Roof-mounted panels must be installed on the back side of

the roof (i.e., the portion of the roof not visible from the front curb of the lot).

3. Roof-mounted panels cannot extend pa t the roof line. 4. Roof-mounted panels mu t be near the rooftop. Panels should

be mounted so that the total distance from the roof top to the top of the panel shall not exceed 6" .

S. Ground mount systems are not allowed.

C. In tallation

1. Solar devices must be properly installed and secured so they do not jeopardize the safety of any passersby and comply with all applicable Virginia building codes and manufacturer's instructions.

2. Owners are required to exercise their best efforts to instal l the solar panels in such a way and location where the panels will work with the least adverse impact upon the lot' aesthetic appearance and in the least obtrusi e manner possible.

3. The Association reserves the right to requir owners to camouflage any portion of the solar panel so that it matches or is reasonably compatible with the color of the structure to which it is attached. If such a requirement would void the warranty from the manufacturer, the owner must submit a copy of the warranty to the Association in order to be released of the requirement.

D. Maintenance

I . Owners who install or maintain solar energy devices are responsible for all costs associated with:

a. Placing (or replacing) repairing maintaining, and moving or removing the solar panels; or,

b. Repairing damage to any property caused by the owner's failure to properly install maintain or use the solar panels·

c. Reimbursing the Association for costs incurred to repair damage to common area or facilities caused by the owner's failure to properly install maintain or use the solar panels.

2. Owners who install solar energy devices shall have the following ongoing maintenance/repair responsibilities:

a. Owners shall ha e a continuing duty to prevent their solar panels from falling into disrepair or becoming a safety hazard. Owners shall be responsible for the solar panel maintenance repair and replacement and the correction of any safety hazard.

b. If a solar panel becomes detached the owner must remove or repair :uch detachment within 72 hours of the detachment.

c. Owners shall be responsible for the repainting or replacement of the solar panels if the appearance of the exterior surface of their solar panels deteriorate or are damaged in any way.

d. In the event that the solar panels are permanently removed, the owner must restore the roof e.,..18,m to its original condition.

UL SEVERABILITY

If a court of law rules any provision herein to be invalid the remainder of these rules hall remain in full force and effect.
