Gervais School District #1 School Board Regular Session Meeting Minutes

Thursday, June 19, 2014 REGULAR SESSION Director LaFollette called the School Board of Gervais School District #1, Marion County into Regular Session at 5:32 p.m. in the Gervais School District Conference Center on Thursday, June 19, 2014. Board Members present included: Brent LaFollette, Maria Caballero, Molly McCargar, Jose Ayala, and Steve Rush. 1.0 CALL TO ORDER

1.1 Pledge of Allegiance Director LaFollette called the School Board Meeting to order with the Pledge of Allegiance at 5:32 p.m.

BUDGET HEARING 1.2 Modification to 2014-2015 Budget

Ms. Wolfer recommended that the 2014-2015 Budget be adopted, with modifications, by increasing the beginning fund balance by $190,000.00 and adjust appropriation levels as shown on Agenda Item 06-14-1.0.1.

1.3 Discussion of 2014-2015 Budget

Mr. Hensel asked the audience for any comments regarding the 2014-2015 Budget. Ms. Colon commented that hiring an athletic secretary was not necessary for the high school. She feels that the District has too many administrators when enrollment numbers are going down. Director LaFollette closed the Budget Hearing closed at 5:36 p.m., and resumed the Regular Session.

4.6 Approve 2014-2015 Milk Products RFP Award:

Gervais School District #1 Board of Directors approves the Gervais School District, along with Woodburn and North Marion School Districts, award the 2014-2015 Milk Products RFP to Medosweet Farms. This roll over would extend the bid 2013 award to a second year of the five (5) year optional period.

4.7 Approve 2014-2015 Student Accident Insurance: Gervais School District #1 Board of Directors approves Myers-Stevens and Toohey and Co., Inc., as the Student Accident and Health Insurance Company for the 2014-2015 School Year, as shown on agenda item 6-14-4.12.

5.0 REPORTS

Student Council There was no one present to report.

Administrators Reports SAT Information

Ms. Paton (Associate Principal 6-12 School) reported that 11 students took the SAT test this year. The scores were below state average. She shared that transportation has been a problem for students to go elsewhere to take the test. She hopes to offer the SAT test at Gervais High School by late winter next year.

Diploma Graduation Requirements Ms. Paton shared that she and Mr. Solem decided to make Government a year-long course in order to help prepare students for citizenship responsibilities. By adding a semester it will allow teachers to add curriculum about the law and how it impacts citizens, more civics-related curriculum, and some economics components. This will add a .5 credit to Social Studies and decrease electives by .5 credits.

Grading Changes for the 2014-15 school year 70% of Gervais High School wide grading will be summative 30% of Gervais High School wide grading will be formative 70% and above will be passing 60% and below will be failing No D’s will be given Ms. Paton expressed that 70% of student’s grade will be based on testing and students will be able to prove that they learn the subject and/or concept. Some teachers are already implementing this in their classroom. She commented that nationwide things are headed that way. She reported that 122 students at Gervais High School earned a D in this past semester.

Ms. Paton said now students will not have a choice, but to meet proficiency standards if they want to pass a class.

Community Eligibility Provision Ms. Columbus (Food Services Director) shared that since the District is considered a high risk community with 86% on a pre-qualified program (migrant & food assistance), the District qualifies for the community eligibility provision of the National School Lunch Program. This program means free meals for all students. Community Eligibility Provision will run for four years. The Board thanked Ms. Columbus for her hard work learning and qualifying the district for the Community Eligibility program.

Financial Report Ms. Wolfer (Business Manager) didn’t have anything else to add to her written report.

Superintendent Report Safety Committee Report

Mr. Hensel stated that Safety Committee is an employee based committee. As more shooting are happening in schools, the district has been ahead of the game in terms of teachers looking at this differently. The other aspect of this committee has been working on a reunification plan for students in case an intruder came in to the schools. Gervais Police are working with the District on this plan. In addition, Woodburn police will be doing training during the summer at the high school. Director McCargar asked if there’s a plan in place to pick up students from schools not directly affected by an intruder situation. Mr. Hensel replied that when the middle school exercise facility is completed, that could possibly be a place for reunification for parents to pick up their students. He also stated that a reunification location for students and staff unaffected by an intruder situation at another building cannot always be known ahead of time.

Memorandum of Understanding (MOU)-Licensed Personal Days Mr. Hensel stated that although the negotiations teams wanted to address the business personal leave issue in the contract it was not resolved before negotiations were concluded. A MOU has been developed that would allow License staff that accumulates personal leave to get compensated for the personal leave not used.

Consolidation of the District Update Mr. Hensel showed a presentation regarding the savings in different areas of the budget impacted by the Consolidation. Mr. Hensel clarified that numbers on savings might not be as accurate because of other factors still pending. His presentation provided information on the following areas: Savings

• Not replacing retirees • Reduction of staff • Sale of buildings

Pending savings

• Custodial will see savings next year • Energy savings

Ongoing Expenses

• Loan payment Problems encountered during the 2013-14 school year

• No gym for Middle Schools students • Middle School class sizes to small • Furniture was too big for Middle School rooms • Disagreements with play space from community members at Elementary School

Mr. Hensel said that although some things were not accomplished the consolidation was a success.

Director LaFollette stated that even though the consolidation brought a lot of debt to the District, it will be relieved by the sale of the other building.

6.0 BOARD FOCUS

Daycare Ms. Valentine-Garcia (Samuel Brown Principal) shared that daycare will be placed in one of the modular classrooms at Samuel Brown Academy depending on student enrollment. Daycare has six customers from staff and community and might have three more enrolling. Teen Parents from Samuel Brown Academy have five infants

that will be coming too, possibly nine. Total numbers for daycare could be nine to sixteen. She stated that she talked to Willamette Education Service District regarding a mini grant available and hopes to start a preschool program. Director Caballero asked if preschool age and infants will be in the same room next year. Ms. Valentine-Garcia replied that staff found the need of separating the age groups this year; infants need time to nap and preschool age need more of a classroom setting to move around. Director Caballero asked if there's a possibility that daycare will be certified for next year. Ms. Valentine-Garcia replied that a location needs to be found first before getting certified. She does see a need to focus on a pre-school program. She is looking into partnering with other agencies. Currently she is looking at agencies that work with common core standards to prepare student for kindergarten. She shared that right now ninety student’s ages 3-5 years are enrolled in summer school. She also has 35 students from North Marion that are attending summer school in Gervais district. Ms. Schultz expressed that she was not aware that the district had a daycare. Ms. Valentine-Garcia responded that daycare is open 7:00 a.m. to 5:00pm and runs from August to June. Fees are $500 a month and operates the same calendar that teachers do. Daycare services are open to staff, teen parents and community. Ms. Colon (Parent & Instructional Assistant) noted that she sees a great benefit to get certified and that she knows that there’s funding available to start this type of program. She expressed it has been a great benefit for the district to have a daycare. Ms. Colon suggested having the daycare at the district office building. She feels that it would be a great place to have daycare because it already has the rooms to separate age groups and a kitchen.

7.0 PUBLIC FORUM

7.1 Public Participation in Board Meetings (Gervais School District Policy BDDH-AR)

Mr. Hensel discussed the following points: Approval of human sexuality policy and conditional distribution of condoms as part of the curriculum; Media Coverage regarding the subject; Teen pregnancy is a family matter; School employees deal face to face with a lot of family matters; and The Board always does its best when making decisions for the district.

Director LaFollette reminded the group that when statements are made everyone has to remember that we are all here for the students’ success. Ms. Cacka (community member) expressed that she is an alumni and a past teen parent and feels that condoms are not the solution to solve the teen parent pregnancy problem. She feels that it’s something deeper within the person. She shared that she currently has a seventh grader and is thinking of possibly enrolling him in the sports program, but now will be thinking twice about enrolling him because of this policy change. Mr. Hensel commented that it’s a very important a concern to not view teen pregnancy as a “problem”. Ms. Orton (community member) expressed that she is a graduate that lives in the district. She has three young children. She said that she has three concerns; one she agrees with Ms. Cacka that it has to do with something deep inside a person, second students might be hurting inside and might need mental health help and thirdly parents must be part of this decision making process. She feels that parents’ authority was taken away. She doesn’t understand how students are not allowed to be given a cough drop without parent permission and now will not need parent permission to get a condom.

Mr. Saafeld expressed that he is a graduate from Gervais. He shared that he read about the program “cuidate”. He said that he has some concerns about the program. This program has been designate for the Latino groups. This program teaches safer sex and models the idea of using condoms. He feels that family values are not to have safer sex.

Ms. Weaver expressed that she currently has a sophomore in school. She expressed that she is here to let the district know that it’s a big mistake to approve the distribution of condoms. She sees a lack of integrity there. She shared that she has seen a lot of public displays of affection (PDA) among high school students during lunches and school sponsor activities. She asked if the PDA policy is currently being enforced by staff. She feels that it’s real distraction to the students’ education. Ms. Beyer (graduate) shared that she has been very supportive with the schools, but feels concern about the condoms being distributed. This serious matter needs to be communicated to the families. Condoms loose effectiveness if being distributed in a non-sterilized facility.

Dr. Raska shared that he is not from Gervais, but this matter was brought to his attention to come in to speak. He feels that there should be an education piece added regarding human sexuality and not the distribution of condoms. Parents must receive prior notifications before deciding on matters like this in order to be in compliance with Oregon statutes.

Mr. Belleque expressed that he had four boys that attended Gervais Schools and appreciates the diversity in this community, but respectfully asks for the retraction of this policy.

Mr. Gregory expressed that he had a student that attended Gervais schools. He feels that we are all here first for the students. The District needs to find alternatives solutions to this concern and do research first.

Mr. Hensel said that two board members attended training and also received studies from OHSU nurses and based on that information, the Board made a final decision on May 15, 2014.

Ms. Miller expressed that she had all of her children graduate from Gervais. She expressed that she has volunteered for 12 years in a teen parent crisis center and has been exposed to challenges that girls go through when becoming pregnant. She feels that by dispensing condoms it would create more problems. She also feels that this needs to be addressed with boys having sex with younger girls. Have parents be completely involved in these decisions. Many parents and people that live in the district find the condoms distribution against their beliefs.

Ms. Miller expressed that she and her children grew up in this committee and her grandchildren are attending the district. She asked the Board to respectfully reconsider this policy. This policy decision takes away parent’s authority.

Ms. Saalfeld said that her children attended Gervais School District and are highly involved in the community. She is asking the Board to reconsidered revising this plan. She feels very concerned about rape happing among older boys with younger girls.

Ms. Belleque shared that she works at Sacred Heart Private School and Church and works with many families in the community. The first time she heard about this was two weeks ago on the radio and was shocked. She feels that more communication should have been given to families. She does feel that there’s no easy answer, but feels condoms will not be a good fix. She expressed that everyone needs to work together to find a solution to this concern.

Mr. Belleque expressed that this topic was discussed at last month’s Night of Columbus meeting at Sacred Heart Parish. He feels that the district must look at other options for a solution to this concern and would like to help.

Mr. Counts expressed that he had children graduate from Gervais and has served on the School Board. He said that he heard about this in the newspaper and feels disappointed. He would like to look at different solutions for the students. He said that Mt. Angel has a program called “virtual life”. Virtual Life teaches students how to respect their bodies.

Ms. Counts stated that she had six of her children graduate from the district. She feels that condoms are not the solution. Research has showed that it has not helped. She feels that the only thing that works is promoting abstinence.

Ms. Dewald stated that she has been a substitute for Gervais School District. She shared a couple thoughts for the district to consider. One point was that she feels that is not right for staff to take the parents authority and for the district to look into programs that are non-religions that promote abstinence.

Ms. Colon stated that she has four daughters herself in the district and feels good about the policy. She shared that lot of work was put in to pass this policy. She also expressed ultimately it is the parents responsibility to teach their students about these kinds of things at home. Ms. Shultz stated that she is not on either side, but feels that there’s a need for mental health help for the students. She shared that she worked at a family planning facility and saw middle school age girls coming in their facility and shared all the things that they did. A lot of the things that the girls shared might be something that parents are not aware of.

Ms. Shaffer stated that she’s graduated from Gervais. She said that she doesn’t agree with distribution of condoms. She feels that students need to be taught how to respect their bodies. She would like to be part of the solution. She’s a nurse it knows about sexually transmitted diseases. Director LaFollette thanked the guest for coming in to share their concerns.

There was a motion by Director McCargar and seconded by Director Caballero for the Gervais School District Board of Directors to approve the revisions to policy BBB and policy GBEDA as shown in action item 06-14-8.1. Motion passed 5-0.

8.2 2014-2015 Designation of Confidential Employees Motion: There was a motion by Director Caballero and seconded by Director McCargar for the Gervais School District Board

of Directors to approve to designate, Lydia Iliyn and Sandra Segura as Confidential Employees for the 2014-2015 school year. Motion passed 5-0.

8.3 Negotiated Changes to the 2012-2015 Classified Collective Bargaining Agreement for the 2014-2015 School Year Discussion: Mr. Hensel said insurance was increased by $30 a month. Ms. Wolfer stated that although each contract has different wage scales, the result is that both groups will get the

same financial increases. Motion: There was a motion by Director Caballero and seconded by Director Ayala for the Gervais School District Board of

Directors to approve the 2014-2015 classified contract with changes as represented in summary 06-14-8.3.2. Financial changes are $1230/month district contribution toward health insurance and a 3.4% increase on the base

8.4 2014-2015 Licensed Collective Bargaining Agreement Discussion: Director Rush stated that if you work for a private sector you don’t get raises every year. Things will have to be

done differently next year for negotiations. He shared that is hard to see a good teacher go just because they were the last hire.

Director McCargar shared a letter from a parent about keeping a teacher. Director McCargar stated that she agrees with Director Rush, but also understand the employee’s side. Director LaFollette shared that it’s hard to approve employee’s raises when he sees a need for a counselor in the

district. Director Rush stated that things have to be done differently next year. Director McCargar said that when something is approved the Board really needs to think things through. Motion:

There was a motion by Director Caballero and seconded by Director Ayala for the Gervais School District Board of Directors to approve the 2014-2015 licensed contract revisions with article changes as represented in summary 06-14-8.4.2 Financial changes are $1230/mo. district contribution toward health insurance and a 1% increase on the base of the 2013-2014 salary schedule, as outlined in salary schedule. Motion passed 4-1 (Director Rush abstained).

8.5 Licensed Administrators, Classified Manager, and Confidential Employee 2014-2015 Financial Information Discussion: Motion: There was a motion by Director McCargar and seconded by Director Ayala for the Gervais School District Board of

Directors to: • Approve an increase in the Licensed Administrator, Classified Manager, and Confidential Employee salaries of

3.4%. The Insurance CAP will increase to $1230 per month. • Approves salary for Mike Solem of $107, 000 year and $1230 per month for insurance. (Stipend terminated

and salary will be frozen until 2017-2018 school year). The Insurance CAP will increase to $1230 per month. • Approves an increase for Michele Paton of $5,000 salary plus an increase of 3.4% and $1230 per month for

insurance. Motion passed 5-0.

LEVYING AD VALOREM TAXES AND CATEGORIZATION OF LEVY BE IT RESOLVED, that the Board of Directors of Gervais School District #1 hereby imposes the taxes provided for in the adopted budget in the amount or at a rate of $4.6427 per $1000 of assessed value for operations; and that these taxes are hereby imposed and categorized for the tax year 2014-2015 upon the assessed value of all taxable property within the district as follows:

Debt Service Levy -0- 8.8 Textbook Adoption Discussion: Ms. O’Connell expressed that she would like to get approval from the Board to spend $40,000.00 for textbooks

adoption for next year. She mention that the district has not adopted textbooks recently which is a State requirement. She will come back to the Board with a proposal after some research is done sometime during the summer for approval.

Director LaFollette expressed that he has a problem approving this amount because what if more money is

needed. Ms. Wolfer stated that she wants to get approval first to start the research and will come back with more

information at a future meeting. Motion: There was a motion by Director Rush and seconded by Director McCargar for the Gervais School District Board of

Directors to approve spending the textbook adoption budget as outlined in the plan presented by Ms. O’Connell. Motion passed 5-0.

8.9 Renewal of Commercial Real Estate Agent Contract

Discussion: Mr. Hensel recommends that the District renew the Commercial Real Estate contract with Hancock Realty. He said that it’s a free service to us and feels that the district has been properly represented. Director LaFollette asked if they could come to a Board meeting to talk to them about their services. Motion: There was a motion by Director Rush and seconded by Director McCargar for the Gervais School District Board of Directors to approve a twelve month contract with Hancock Realty for the sale of school property. Motion passed 5-0.

Director Caballero expressed that it was good to see a big crowd tonight. She expressed that it’s very important for everyone to come to Board Meeting and get involved.

Mr. Kaup suggested sending more information regarding the program that will be implemented regarding distribution of condoms to teach parents.

Gervais School District Board Guidelines 2014 – 2015

1. Discussion

Discussion is allowed before and after a motion is made. The Chair, with assistance from the members, will keep the discussion focused on the matter at hand.

2. Public Forum

Public comments and questions will be limited to 5 minutes, per individual. If an individual needs more than 5 minutes, they will be asked to submit their comments and/or questions in writing. The main purpose is for public input in relation to school issues. This time will not be used for debates. Questions will be answered by administration or the Board, if information is readily available. If not, the answer will be sent by email, mail, or over the phone. Patrons speaking in public forum will not be allowed to address the audience, and must address comments to the board. Board Members will respond to audience comments after seeking permission from the Board Chair. Personnel issues shall not be discussed in public forum.

3. Action Items

The Superintendent will make recommendations with supporting data and financial impacts on items the Superintendent supports or doesn’t support. Other items may have available background information, but no recommendation.

4. Meeting Length

All business will be conducted within four hours. A majority vote is required to extend the meeting time.

5. Financial Updates

The Superintendent and the Deputy Clerk will keep the board informed in financial areas, including overspending.

6. Reading of Action Items

Board policies and other action items requiring adequate time for public input will be presented for discussion one month prior to action being taken.

The Gervais School District Board Advisory Memo

Date: July 1, 2014 To: All Board Members From: Food Service Subject: 2014-2015 Food Products and Non-Food Supplies Requirements RFP Award

Recommendation: Award of the 2014-2015 the Food Products and Non-Food Supplies Requirements RFP to SYSCO Portland. Two bids were received for the Oregon Child Nutrition Coalition (OCNC) Food Products and Non-Food Supplies Requirements RFP on June 18, 2012. Our school district is a member of this coalition. The bid totals were: Food Services of America - $9,139,827.95 + $90,410 = adjusted $9,230,237.90 SYSCO Portland - $8,141,914.86 + $91,950 = adjusted $8,233,864.80 Adjustment numbers are calculated based on weighted quality indicators identified in the bid such as fees for delivery of commodity processed products, fees for delivery of produce and fees for purchase of items not listed on the bid but stocked by the distributor. The RFP results were reviewed and approved by the OCNC Board members on June 20, 2012. This bid meets the State and Federal purchasing requirements for food, non-food supplies, chemicals, produce, milk, and bread. Copies of the RFP and the response from SYSCO are posted on OCNC’s web site at www.ocnc.org. The RFP included four possible extensions. Based on the January and July Consumer Price Indexes, Pacific Cities and US City Average for the City of Portland Oregon for the previous year the OCNC Board and Sysco agreed on a 1.25% increase on the fixed fees which is half of the current COLA amount. Legal authority for acceptance of this bid lies with the individual school district’s governing boards. Approval motion: I recommend the District award the 2014-2015 Food Products and Non-Food Supplies Requirements RFP to SYSCO Portland.

   FINANCIAL REPORTS 

The June financial reports are included in the July Board Agenda Packet.  I will include two sets of financial reports in the August Board packet representing the 2013‐14 and 2014‐15 fiscal years.  I will provide both sets of reports until I am able to roll the ending fund balances forward from the prior year into the new fiscal year.  Typically balances are rolled after the final field visit from auditors.  The auditors will be onsite September 3‐5 to do the final field work on the 13/14 audit.     SUPPLEMENTAL BUDGET 

ParTech, the contractor building the Gervais Middle School Exercise Facility, was unable to complete the project by the deadline of June 19, 2014.  I did not anticipate that payments would be needed for this project in the new fiscal year.  As a result, I will ask the School Board to adopt a supplemental budget for fund 400 appropriating levels that allow for payments after 7/1/14 at the August 21, 2014 Board meeting.  It is necessary to wait for a meeting after the regular July meeting due to meeting posting requirements under budget law.  The contractor may request that payment be made sooner than 8/22/14.  If this is the case, a special meeting of the School Board may need to be arranged.   UPCOMING ITEMS FOR CONSIDERATION IN AUGUST

Public Participation in Board Meetings 1. A visitor may be recognized by the chairperson by rising, identifying himself/herself with his/her full name and address, and

stating his/her purpose for appearing. 2. A group of visitors with a common purpose should designate a spokesperson for the group. 3. Discussion or presentation concerning a published agenda item is limited to the public forum section of the agenda, unless

otherwise authorized by the chairperson. 4. A visitor may introduce a topic not on the published agenda. However, the Board, at its discretion, may require that a

proposal, inquiry, or request be submitted in writing, and reserves the right to refer the matter to the administration for action or for study and to report at a subsequent meeting. The Board shall make a decision at the meeting where information is presented only if the issue is considered an emergency by the Board.

5. At the discretion of the Board chairperson, when meetings are large or controversial, anyone wishing to speak before the

Board, either as an individual or as a member of a group, on any agenda item or other topic, may do so by providing information to the board secretary on a sign-in sheet prior to the meeting. This will help the chairperson provide adequate time for each agenda item.

6. Statements by members of the public should be brief and concise. The chairperson may, at his/her discretion, establish a

time limit on discussion or oral presentation by a visitor on any topic. 7. Speakers may offer objective criticism of school operations and programs but the Board will not hear complaints concerning

specific school personnel. The chairperson will direct the visitor to the appropriate means for Board consideration and disposition of legitimate complaints involving individuals.

8. These procedures will be published on the back of every Board meeting information pamphlet.

DEFINING “A MEMBER OF HOUSEHOLD”

Summary

House Bill (HB) 2079 from the 2013 Legislative session modified Oregon Revised Statutes(ORS) 244.020 and ORS 244.175, which impacted the definition of “relative” and addressed“a member of household” language. We received further clarification concerning thedefinition of “a member of household” from the Oregon Government Ethics Commission(OGEC) and are releasing the Commission’s recommended edits. BUS DRIVER EXAMINATION AND TRAINING

Summary

Under new requirements from the Federal Motor Carrier Safety Administration (FMCSA),all physical examinations of school bus drivers must be administered by a certified medicalexaminer who is listed in the FMCSA’s National Registry of Certified Medical Examiners. To remain in compliance with the commercial driver license regulations, the OregonDepartment of Education is requiring all physical exams administered on or after theimplementation date of May 21, 2014, be done by a certified medical examiner.

GRADING AND REPORTING

Summary

House Bill (HB) 4150 passed in the 2014 Legislature made changes to HB 2220 passed inthe 2011 Legislature, affecting how school districts report a student’s progress; how parentsare informed of their student’s progress; and what can be included in a student’s grades.

In addition, an annual report created by HB 2220 is no longer required but districts maycontinue to report.

Further, it added that proficiency teaching and learning, and proficiency grading andreporting are not required of districts, but districts may choose to continue current systems ormay implement systems. In doing so, the districts must consult an advisory committee.

The changes recommended herein are made as a result of HB 4150 (a rewrite of ORS329.485), if changes result from a rewrite of OAR 581-022-1670, OSBA will again makeappropriate updates.

ANIMALS IN FACILITIES

Summary

The Department of Justice revised rules about service animals and what can be asked of aperson when it is not obvious what service the animal provides. The questions that can beasked are: 1) Is the dog a service animal required because of a disability? and 2) What workor task has the dog been trained to perform?

The Americans with Disabilities Act definition of “service animal” was also added as afootnote.

PERSONAL ELECTRONIC DEVICES AND SOCIAL MEDIA,TEXTBOOKS AND INSTRUCTIONAL MATERIALS

Summary

House Bill (HB) 2426 passed during the 2013 Session creates new provisions and amendsOregon Revised Statutes (ORS) 337.120 and ORS 343.223. It is intended to encourageschool boards and districts to have thoughtful conversations about how technology is utilizedin schools and how to make better educational use of all the computers, iPads and electronicdevices that students are already bringing to school. HB 2426 requires school district boardsto adopt policies regarding student use of personal electronic devices (computers, iPads, et.al.). The bill also requires districts that implement curriculum which integrates or includestechnology, to grant access to these materials free of charge.

There has been some confusion on the matter of what “granting access” to technology usedas part of the curriculum means. After consulting with the Oregon Department of Education,we have determined that “granting access” includes any of the following:

1. Allowing students to download programs, applications or materials onto their ownpersonal devices free of charge;

2. Purchasing programs, applications or materials for students to download to their ownpersonal devices; or

3. Providing a school-owned device that includes or provides access to the programs,applications or materials used in the curriculum.

Some have interpreted “granting access” to these materials as a requirement for the school topurchase for download to a personal device of each student’s choosing. However, the law hasa broader definition of “granting access” which can be met by providing the public charterschool-owned technology directly to the student; the law contains no mandate to purchasematerials for any student-owned personal electronic device.

In addition, the new provisions require annual professional development for staff whosupport students with a print disability** (defined in ORS 337.511(5)), and, when adopting alist of textbooks and other instructional materials, consideration of the availability of thetextbooks and other instructional materials through online resources for students with printdisabilities. The policy may allow students to use personal devices for academic activities orindependent communications (via the electronic device), but districts retain the control of theuse of these devices including prohibiting personal phone calls or use of social media.

The new law requires an appeal process when a student is denied the use of a personalelectronic device.

Policies to fulfill these provisions should be adopted and implemented for the 2014-2015school year.

In addition, similar revisions have been made to the highly recommended sample policy forstaff, GCAB - Personal Electronic Devices and Social Media – Staff.

The district should review the three versions to see which one closely matches the onealready adopted, then revise or amend policy JFCEB so that it represents the district’s chosenpractice and adopt. These revised statutes require the district to adopt policy, therefore thissample policy is now designated as “required,” and the administrative regulation is stilloptional. Administrative regulation, LBE-AR - Public Charter Schools, was updated toreflect that public charter schools are also required to comply with this revised statute.

The district should review the three versions of policy IIA to see which one closely matchesthe one already adopted, then add the recommended revisions and readopt.

If the board’s policy manual includes highly recommended policy GCAB - PersonalElectronic Devices and Social Media – Staff consider the recommended revisions andreadopt.

Oregon Revised Statute (ORS) 343.223 was amended by House Bill 2426 (Section 3) in the2013 Legislative session to add that “...(2) School districts shall ensure that schooladministrators and school personnel whose duties may require them to assist a student with aprint disability, ...receive annual professional development related to using online resourcesthat enable students with print disabilities to receive instructional materials free of charge.”

Section 4 of HB 2426 requires districts to ensure these staff members receive training byOctober 1, 2014.

None of this language is required to be in policy; this was provided as an informational item.

SECLUSION ROOMS

Summary

At its January 2014 meeting the State Board of Education amended and clarified thestandards for “seclusion rooms.” The Board added requirements for reporting data on“seclusion rooms” which will be included in the annual report to the Superintendent ofPublic Instruction about the use of physical restraints and seclusion in the district.

1. When a district contracts with a transportation provider, the district does not need toadopt policy. The transportation provider needs to perform the required, appropriate drugtesting.

2. When a district provides student transportation, and a driver is required to carry a CDLlicense, the district must adopt drug testing policies and perform the required,appropriate drug testing.

In the case when the district contracts with a transportation provider, the district shouldconfirm via contract language that the transportation provider has appropriate drug testingpolicies and procedures for transportation personnel. The district should also, in its contract,include “indemnity” language requiring the transportation provider to defend the district onthis issue. The district may want to review this with their legal counsel.

As a result of the discussion, OSBA has redesignated Board policy GBEDA - Drug Testing –Transportation Personnel and its administration regulation, both as “conditionally required.”If there are questions related to this, please call OSBA policy services.
