August meeting meal will be sponsored by Custom pool remodeling's Ken Lewis , he will also be giving a short presentation on various services they offer. Dave Kohtz from Aqua pool service will be giving a presentation on Pentair Suntouch controller and other Pentair products. So bring your questions and comments to the meeting so we can all learn a few new tricks. New Classified section for members to post new or used parts, trucks, tools, route for sale. This is free for Santa Clara IPSSA members. If you want to place an ad please email it to sparkle- [email protected] and put classified in the subject. Protecting Yourself Before the Lawsuit Service techs often ask how they can protect themselves before their customer makes a claim. Although it is difficult to defend a tech for damages he actually created, the following methods can provide a real ammunition for damages caused by another: (1) Keep a log including your weekly readings for sanitizer, pH, total alkalinity and calcium hardness. Your log will provide a valuable defense for claims that improper water chemistry resulted in plaster and equipment damage, as well as for claims that an inadequate level of sanitizer caused an illness; (2) Make a sketch of every new pool you take on account. The drawing should include areas of the pool displaying existing etching or stained plaster, delamination and/or calcification. This drawing should be dated and signed by your customer. You will be glad to have this drawing if your customer later decides to blame you for the damage. (3) Have a written service agreement with each customer outlining the frequency of service and what you will be providing. Items outside of routine maintenance, such as filter cleaning and heater maintenance should be listed as excluded services. (4) Never fill water without leaving your truck keys on the hose bib. Water claims often exceed $10,000, and in some cases are over $100,000. You won't have an overfill claim if you follow this rule. Your likelihood of success in a dispute will be far increased by following these few simple techniques. Can Residential Pool Owners Be Held Responsible For Failing To Comply With VGB, And Are Ser-vice Techs At Risk If They Don’t Warn? The requirement to bring pools and spas into compliance with the Virginia Graeme Baker Pool and

Spa Safety Act became effective more than a year ago. As we know, VGB mandates that all public pools and spas be equipped with unblockable suction outlets and/or secondary safety devices. However, little attention has been paid to the potential liability of residential pool or spa owners and the pool service technician’s duty, if any, to address the issue of residential anti-entrapment safety upgrades. The key question here is could a residential pool owner be held liable for failing to outfit his pool with anti-entrapment systems should tragedy strike? Is a pool service technician potentially liable as well for not informing his customer of the increased safety provided by the new technology?

Surprisingly, the answer to both questions is yes.

Commonly accepted legal principles say that a landowner will be liable for injury caused by his failure to exercise ordinary care. For example, the parents of a child entrapped in a non-compliant residential pool would argue that the pool owner didn’t exercise ordinary care because the entrapment was foreseeable and would have been prevented had the pool been upgraded with readily available anti-entrapment products. The pool service technician would likely be sued as well for failing to advise the homeowner of the availability of VGB-compliant equipment. The best approach for the service technician is to provide his residential customers written notification of the availability of VGB-compliant covers and SVRS products, and the safety benefits each offers. Doing so should satisfy the pool technician’s duty to warn and, at minimum, provide an i m p o r t a n t e l e m e n t t o h i s l e g a l d e f e n s e . Ultimately, society has an interest in preventing entrapments.
